Article 21¹⁸. Procedure for the consideration of a case and issuance of an order for placement of a person in an inpatient facility for the purpose of involuntary psychiatric care🔗

1. A judge shall consider a case for placement of a person in an inpatient facility for the purpose of involuntary psychiatric care and render a judgment within 24 hours from the submission of the relevant application.

2. A judge shall consider a case for placement of a person in an inpatient facility for the purpose of involuntary psychiatric care alone, at a closed court hearing. Only persons involved in the treatment process of the patient/convicted person, as well as persons whose participation is necessary to ensure the conduct of administrative proceedings, shall have the right to attend the court hearing. The following shall participate in the consideration of the said case: respectively, a representative of the administration of the psychiatric institution or of the penitentiary institution, at least one member of the relevant commission of psychiatrist doctors, the patient/convicted person and his/her lawyer. If the patient/convicted person does not have the opportunity to retain a lawyer, the court shall be obliged to appoint a lawyer for him/her at the expense of the State. The legal representative of the patient/convicted person shall also participate in the consideration of the case, and in his/her absence – a relative (in this case, the term "patient's relative" means a person from the circle of persons defined by subparagraph "h" of Article 4 of the Law of Georgia "On Mental Health"). In a special case, when it is impossible to bring the patient/convicted person to court due to his/her illness or another objective reason, the judge, for the purpose of considering the case for placement of a person in an inpatient facility for the purpose of involuntary psychiatric care, shall hold an off-site court hearing in the inpatient facility where the patient/convicted person is located, or, by a court judgment, the patient/convicted person may participate in the consideration of the case remotely, using technical means.

3. After opening the court hearing, the judge shall announce what application is being considered, name the participants in the court proceedings, and determine whether there are any challenges. Accordingly, the representative of the administration of the psychiatric institution or of the penitentiary institution shall substantiate the application submitted by him/her, after which he/she shall answer the questions of the judge, the patient/convicted person, his/her lawyer, legal representative and/or relative. The failure of the legal representative or relative of the patient/convicted person to appear at the court hearing shall not be a ground for postponing the consideration of the application.

4. A judge is entitled to summon and question the members of the commission of physician-psychiatrists, on the basis of whose opinion the administration of the psychiatric institution or the penitentiary institution applied to the court, as well as another person whose testimony (information) substantiates the application. The patient/convicted person, his/her lawyer, legal representative and/or relative has the right to request the questioning of other persons as well, whose testimonies may be of essential importance for the case. The patient/convicted person, his/her lawyer, legal representative and/or relative also has the right to give explanations to the court and to formulate opposing opinions.

5. Minutes shall be drawn up at the court hearing. After verifying the substantiation of the application and assessing the grounds defined by the first paragraph of Article 18 of the Law of Georgia “On Mental Health”, the judge shall issue a reasoned order on the placement of the patient in an inpatient facility for the purpose of providing involuntary psychiatric assistance until the criteria for involuntary treatment are exhausted, but for not more than 6 months.

6. If the grounds established by law for the placement of a person in an inpatient facility for the purpose of involuntary psychiatric assistance do not exist, the judge shall issue a resolution refusing the placement of the person in an inpatient facility for the purpose of involuntary psychiatric assistance. In this case, a person placed in an inpatient facility for the purpose of involuntary psychiatric assistance shall be immediately discharged from the inpatient facility.

7. The judge's order on the placement of a person in an inpatient facility for the purpose of involuntary psychiatric assistance shall specify:

a) the date and place of issuance of the order;

b) the surname of the judge;

c) the psychiatric institution whose administration submitted the relevant application to the court, or the penitentiary institution that applied to the court;

d) the parties participating in the court proceedings;

e) the disposition on the placement of the person in an inpatient facility for the purpose of involuntary psychiatric assistance, with the relevant substantiation, and the identity of the person to be placed in the inpatient facility (if the person's identity is not established because there is no document, fact or data confirming his/her identification, then the judge's order shall state – “unidentified patient No. ......” and a conditional number shall be assigned to him/her according to the registration number of the administrative case examined);

f) the term of validity of the order on the placement of the person in an inpatient facility for the purpose of providing involuntary psychiatric assistance, which shall not exceed 6 months. As a rule, the order shall state that it is valid until the criteria for the patient's involuntary treatment are exhausted, which is determined by the relevant commission of physician-psychiatrists on the basis of an opinion;

g) the psychiatric institution (its head) that must execute the order;

h) the judge's signature and the court's seal.

8. The judge's resolution refusing the placement of a person in an inpatient facility for the purpose of involuntary psychiatric assistance shall specify:

a) the date and place of issuance of the resolution;

b) the surname of the judge;

c) a psychiatric institution whose administration has submitted the relevant application to the court, or a penitentiary institution that has applied to the court;

d) the parties participating in the court proceedings;

e) the order on refusal to place a person in an inpatient facility for the purpose of involuntary psychiatric assistance, with the relevant reasoning, and the identity of the person who was to be placed in the inpatient facility (if the identity of the person has not been established, because there is no document, fact or data confirming his/her identification, then the judge's ruling shall state – "unidentified patient No. ......" and, according to the registration number of the administrative case considered, he/she shall be assigned a conditional number);

f) the psychiatric institution (its head) which must execute the ruling;

g) the judge's signature and the court seal.

9. The judge's order (ruling) shall be drawn up in three copies, one of which shall be sent to the psychiatric institution submitting the application, the second – to the patient, his/her legal representative or relative, and the third shall remain with the court.

10. The administration of the psychiatric institution shall have the right, during the consideration of the application to the court, before the judge retires to the deliberation room, to withdraw its application.

The said term shall not apply to a patient who is serving a sentence in the relevant medical (treatment) institution. The term of placement in the inpatient facility shall be counted from the placement of the person in the inpatient facility.

2. Depending on the patient's mental condition and where the grounds provided for by the first paragraph of Article 18 of the Law of Georgia "On Mental Health" exist, on the basis of a reasoned application of the administration of the psychiatric institution, the extension of the term referred to in the first paragraph of this Article by not more than 6 months shall be permissible. In the event of the exhaustion of each term so extended, the administration of the psychiatric institution shall be entitled to again apply to the court with a request for extension of the term, if the criteria for the patient's involuntary treatment have not been exhausted. The application of the administration of the psychiatric institution on the extension of the term of placement of a person in an inpatient facility for the purpose of providing involuntary psychiatric assistance shall be considered in accordance with the procedure established by Article 21¹⁸ of this Code, within 72 hours from the submission of the relevant application of the administration of the psychiatric institution.

Article 21⁵⁴. Procedure for hearing a case of involuntary isolation of a patient and issuing an order🔗

1. The judge hears the case of involuntary isolation of the patient and adopts a judgment within 48 hours from the submission of the relevant application to him.

2. The judge hears the case of involuntary isolation of the patient individually at a closed court hearing. Only those persons whose participation is necessary to ensure administrative proceedings have the right to attend the court hearing. The patient's participation in the hearing of the case is necessary if this does not create a threat to the health of other persons. In the hearing of the case, in addition to the patient, representatives of the relevant local public health unit and the relevant medical service provider, the patient's lawyer, and also, if any, the patient's other legal representative must participate. If the patient does not have the opportunity to retain a lawyer, at the patient's request the court is obliged to appoint a lawyer for him at the state's expense. When hearing the case of a minor patient, the interests of the minor patient are represented by his parent or other legal representative. In a special case, when it is impossible to bring the patient to court due to his illness or another objective reason, the judge, for the purpose of hearing the case of involuntary isolation of the patient, holds an off-site court hearing at the medical service provider institution in which the patient is located.

3. After opening the court hearing, the judge announces which application is being considered, names the participants in the court proceedings, and determines whether there are recusals. The representative of the relevant local public health unit substantiates the application submitted by him, after which he answers questions from the judge, the patient, his lawyer and/or other legal representative. The non-appearance of the patient's legal representative at the court hearing is not a ground for postponing the consideration of the application.

4. The judge is entitled to question the representative of the medical service provider who applied to the local public health unit with a motion for the application of involuntary isolation to the patient. The patient, his lawyer and/or other legal representative is also entitled to request the questioning of other persons whose testimony may be of substantial importance in connection with the case. The patient, his lawyer and/or other legal representative is also entitled to give explanations to the court and to formulate opposing opinions.

5. A record is drawn up at the court hearing. After checking the substantiation of the application and assessing the circumstances provided for by paragraphs 2 and 3 of Article 14 of the Law of Georgia "On Tuberculosis Control", the judge issues a reasoned order on the involuntary isolation of the patient and his placement in the medical service provider institution until the basis for involuntary isolation is exhausted, but for not more than 6 months.

6. If the grounds established by law for the involuntary isolation of a patient do not exist, the judge shall issue a ruling refusing the involuntary isolation of the patient. In such a case, if the patient is already in a medical service provider institution, he or she shall be discharged immediately.

7. The judge's order on the involuntary isolation of a patient shall specify:

a) the date and place of issuance of the order;

b) the judge's surname;

c) the local public health unit that submitted the application to the court;

d) the parties participating in the court proceedings;

e) the decision on the involuntary isolation of the patient with the relevant reasoning, as well as the identity of the person to be placed in the medical service provider institution;

f) the term of validity of the order, which shall not exceed 6 months. The judge's order shall, as a rule, specify that it remains in force until the ground for the involuntary isolation of the patient is exhausted, which shall be determined by the relevant local public health unit on the basis of the application of the medical service provider / the medical commission provided for by paragraph 12 of Article 15 of the Law of Georgia on Tuberculosis Control;

g) the medical service provider institution that must execute the judge's order;

h) the judge's signature and the court seal.

8. The judge's ruling refusing the involuntary isolation of a patient shall specify:

a) the date and place of issuance of the ruling;

b) the judge's surname;

c) the local public health unit that submitted the application to the court;

d) the parties participating in the court proceedings;

e) the identity of the patient;

f) the medical service provider institution that must execute the judge's ruling;

g) the judge's signature and the court seal.

9. The judge's order/ruling shall be drawn up in four copies, of which one copy shall be sent to the local public health unit submitting the application, the second — to the medical service provider that applied to the local public health unit with a petition for the application of involuntary isolation to the patient, the third — to the patient (or his or her lawyer/other legal representative), and the fourth copy shall remain with the court.

10. The relevant local public health unit is entitled, during the court's consideration of its application, before the judge retires to the deliberation room, to withdraw the application.

11. The judge shall terminate the proceedings of the case of involuntary isolation of a patient in the case provided for by paragraph 11 of Article 15 of the Law of Georgia on Tuberculosis Control.

2. Depending on the patient's state of health, in the presence of the circumstance provided for by paragraph 16 of Article 15 of the Law of Georgia "On Tuberculosis Control", on the basis of a reasoned application of the local public health unit for extension of the term of the patient's involuntary isolation, extension of the term provided for by paragraph 1 of this Article shall be permissible for not more than 2 months. The court shall consider the application of the local public health unit in accordance with the procedure established by Article 21⁵⁴ of this Code, within 72 hours of its submission.

3. A patient may apply to the court with a motion for termination of involuntary isolation in respect of him/her if he/she considers that, while in involuntary isolation, the requirements established in respect of him/her by the Law of Georgia "On Tuberculosis Control" or other legal acts of Georgia are being violated, or the ground for involuntary isolation no longer exists. The court shall decide the issue of termination of involuntary isolation in respect of the patient within 72 hours of receipt of the motion. When making this decision, the court, along with other circumstances, shall take into account the issue of resumption of the patient's intake of anti-tuberculosis medicines under conditions of involuntary isolation. If the court makes a decision on termination of involuntary isolation in respect of the patient, the patient shall continue anti-tuberculosis treatment under the supervision of the medical service provider institution. The patient's application on termination of the judge's order on involuntary isolation of the patient before its term shall be considered in accordance with the procedure established by Article 21⁵⁴ of this Code.

4. A decision on the patient's discharge from the medical service provider institution shall be immediately communicated to the magistrate judge and/or the relevant district (city) court.

Unless otherwise provided by law, the court may, upon the filing of a claim, on the motion of a party, suspend the operation of a normative administrative-legal act if there is a reasonable doubt as to the lawfulness of that act or if its urgent enforcement would cause substantial damage to a person or would make it impossible to protect the person's lawful right and interest.

2. In the presence of a newly discovered circumstance, the court is entitled, on the basis of a party's motion, to amend or revoke a ruling on the suspension of the operation of a normative administrative-legal act.

3. A private complaint may be filed against a court ruling.

Article 32. Court judgment in connection with a claim concerning the declaration of an administrative-legal act as void or the declaration of its invalidity🔗

1. If an administrative-legal act or part thereof contradicts the law and it directly and immediately (individually) harms the claimant's lawful right or interest, or unlawfully restricts his right, the court, in connection with the claim referred to in Article 22 of this Code, shall deliver a judgment on the declaration of the administrative-legal act as void.

2. If an individual administrative-legal act was enforced before the delivery of the court judgment, the court, upon the party's motion, shall indicate in the judgment the procedure for the reversal of enforcement.

3. In the case of declaring an individual administrative-legal act void before the delivery of the court judgment, the court is entitled, where the party has a lawful interest and upon his request, to declare this individual administrative-legal act void.

4. If the court considers that the individual administrative-legal act was issued without the examination and assessment of circumstances essential to the case, it is entitled, without deciding the disputed issue, to declare the individual administrative-legal act void and to instruct the administrative body, after the examination and assessment of these circumstances, to issue a new one. The court adopts this judgment if there is an urgent lawful interest of the party for declaring the individual administrative-legal act void.

4¹. In the case of declaring void an administrative-legal act issued by the National Bank of Georgia within the scope of the exercise of resolution powers on the basis of the Organic Law of Georgia "On the National Bank of Georgia", the restoration of the situation existing prior to the declaration of the said act as void shall be inadmissible if such restoration may pose a threat to the stable functioning of the financial sector. In the said case, the court may impose on the National Bank of Georgia only compensation for actually incurred damage.

5. A court judgment on the declaration of a normative administrative-legal act as void has binding force. If the declaration of a normative administrative-legal act as void poses a significant threat to state or public security or causes a significant increase in state or municipal expenditures, or if the declaration of a legal act of the National Bank of Georgia, including an individual administrative-legal act issued in the process of resolution of a commercial bank, as void may pose a threat to the stable functioning of the financial sector and/or the lawful rights or interests of depositors of a commercial bank or microbank, the court is entitled, instead of declaring the legal act provided for by this paragraph void, to declare it invalid.

6. The operative part of a court judgment shall be published in the same manner in which the normative act was published. Publication shall be carried out at the expense of the administrative body that issued the normative act.

At the request of a party, the court shall set the time limit for the issuance of the administrative-legal act.
