b) ensuring and protecting the safety of the human living and cultural environment;
c) protection of state and public interests.
3. An activity or action that is not directly related to public risk shall be exempted from regulation by the State or shall be regulated only partially.
4. A licence or permit issued by a foreign country may be recognised by an international treaty or law and be granted the same legal status as a licence or permit issued on the basis of Georgian legislation.
Article 3. Definition of terms🔗
The terms used in this Law have the following meaning:
a) licence – the right to carry out a specified activity granted to a person by an administrative body on the basis of an administrative act, upon fulfilment of the conditions established by law:

The licence holder is entitled to divide the usage licence and/or to transfer it in whole or in part to another person, including by inheritance;
a.b) activity licence – a type of licence by which a person is granted the right to carry out the activity defined by this Law. l) one-stop-shop principle – a rule of administrative proceedings where the issuer of a licence or permit itself ensures confirmation of additional licensing or permit conditions by another administrative body. Confirmation of additional licensing or permit conditions shall be connected with the administrative proceedings for the issuance of the licence or permit. Obtaining factual circumstances confirming these conditions must directly serve the purpose of obtaining the licence or permit;
m) departmental licensing register – a systematic set of data on the issuance of licences, amendments thereto and their revocation;
n) departmental permit register – a systematic set of data on the issuance of permits, amendments thereto and their revocation;

q) licence fee – a one-time mandatory payment to the central budget of Georgia, which the licence applicant pays in the amount established by law, for granting the applicant the right to carry out the licensed activity specified by law. A licence holder who receives a licence within 6 months before the start of the reporting period shall not be obliged to submit a report to the licensor.
4. If the submitted reporting does not clearly declare or does not indicate at all the fact of compliance with licence conditions, the licensor shall be entitled to apply to the licence holder and request information confirming the fulfilment of compliance with licence conditions within a reasonable time.
5. Failure by the licence holder to comply with the request specified in paragraph 4 of this Article shall be grounds for imposing liability established by legislation.
6. The licensor shall exercise control over the fulfilment of licence conditions only by inspecting licence conditions. Article 22. Liability for violation of licensing conditions. Revocation of a licence🔗
1. Failure by a licence holder to fulfil the licensing conditions established by law shall result in the fining of the licence holder in accordance with the procedure established by legislation. The amount of the fine shall be determined by law. The licensor shall determine a reasonable time limit for the fulfilment of the licensing conditions and shall establish the conditions that must be observed for the pursuit of the specific activity.
2. Notwithstanding the imposition of liability, failure by the licence holder to fulfil the licensing conditions within the established time limit shall result in the tripling of the imposed fine. When a fine is imposed on the licence holder, a time limit and the relevant conditions for the fulfilment of the licensing conditions shall be determined.
3. After the expiry of the established time limit from the imposition of the tripled fine, if the licensing conditions are not fulfilled by the licence holder, the imposed fine shall be tripled.
4. If, notwithstanding the imposition of the liability provided for by paragraphs 1, 2 and 3 of this Article, the fulfilment of the licensing conditions has not been ensured by the licence holder, the licensor shall adopt a decision on the revocation of the licence.
4¹. If it is evident that the fining of the licence holder for failure to fulfil the conditions of a licence for use and/or the requirements established for the use of a specific object does not produce an effect, the licensor shall be entitled to revoke the licence under the simplified administrative procedure.
5. In the decision on the revocation of the licence, the licensor shall substantiate the necessity of applying this form of liability.
6. Revocation of a licence means declaring the decision on the issuance of the licence invalid in accordance with the General Administrative Code of Georgia.
7. In addition to that provided for by Article 61 of the General Administrative Code of Georgia, the grounds for declaring the decision on the issuance of a licence invalid shall be:
a) the request of the licence holder;
b) the death (liquidation) of the holder of an activity licence, being declared dead in accordance with the established procedure, being recognised as missing, or being recognised as a recipient of support, unless otherwise determined by a court judgment;
c) failure to fulfil the licensing conditions established by law;
d) a court judgment of conviction that has entered into legal force on deprivation of the right to pursue the activity.
7¹. The licensor shall be entitled, in accordance with the procedure established by this Law, to revoke a licence related to the use of natural resources that has been attached, pledged or otherwise encumbered, if there are grounds for revocation of the licence. In the event of revocation of the licence, the corresponding attachment, pledge or other encumbrance shall also be extinguished.
8. The licensor shall adopt a decision on the revocation of the licence in accordance with the procedure established by this Law for the issuance of a licence. The licensor shall be obliged to immediately notify the licence holder of the commencement of administrative proceedings on the revocation of the licence.
9. In the presence of the ground provided for by subparagraph „d“ of paragraph 7 of this Article, as well as in a case of urgency, when a delay in taking a decision may cause substantial harm to public or private interests, the licence issuer shall, within 3 days, take a reasoned decision on the revocation of the licence and shall immediately notify the licence holder of the revocation of the licence.
9¹. The failure by the holder of a licence for use provided for by paragraphs 1, 2, 4, 5 and 9 of Article 7 of this Law to pay the regulation fee in accordance with the established procedure shall result in the fining of the licence holder. At the same time, notwithstanding the imposition of the fine, if the licence holder fails to pay the regulation fee within 30 calendar days from the expiry of the established time limit for the payment of the regulation fee, the licence issuer is entitled to revoke the licence under the simplified administrative proceedings procedure.
10. The licence certificate shall be returned to the licence issuer within 3 days from the entry into force of the decision on the revocation of the licence.
11. Liability in the form of revocation of a licence shall be applied only after the fining of the licence holder fails to ensure compliance with the licence conditions and the licence issuer substantiates that the revocation of the licence will not cause more harm than the validity of the licence.
12. If the revocation of the licence may cause more harm than the continuation of the validity of the licence, or it is substantially impossible to suspend its validity, the licence issuer shall take a reasoned decision on granting the licence holder the right to continue the licensed activity in compliance with the conditions established by the issuer. In such a case, the licence holder shall, within a reasonable time limit established by the licence issuer, ensure compliance with additional licence conditions.
13. If, in the case provided for by paragraph 12 of this Article, compliance with the licence conditions is not ensured by the licence holder, the licence issuer is entitled, notwithstanding the imposition of liability on the licence holder, to take a decision on ensuring compliance with the licence conditions itself or through third parties, in the name and at the expense of the licence holder.
14. In the case of the types of licences provided for by law, when compliance with the licence conditions is impossible in the manner provided for by paragraph 13 of this Article, on the basis of an application of the licence issuer, the court shall take a decision on the appointment of a special manager for the pursuit of the licensed activity and for compliance with the licence conditions. If the delay may cause harm, the licence issuer shall, by a reasoned decision, appoint a special manager and shall immediately submit it to the court for a decision.
15. The rule established by paragraphs 12, 13 and 14 of this article may be applied notwithstanding the imposition of a fine on the licence holder, if the licence issuer knows in advance that the imposition of a fine on the licence holder will not ensure compliance with the licence conditions. The licence issuer shall be obliged to substantiate the said decision.
16. The special manager is entitled, at the expense of the licence holder, for the purpose of ensuring the fulfilment of the licence conditions as far as possible in the shortest possible time, to carry out all measures related to the licensed activity. Unless another time limit is established by law, the court approves the monthly report of the activity carried out by the special manager.
17. The special manager is appointed for a specified term, taking into account the licence conditions to be fulfilled. If the licence conditions have not been fulfilled within the established term, the court is entitled to extend the said term.
18. The licence holder shall be obliged, upon the request of the special manager, to immediately provide the special manager with any information or material means related to the licensed activity. Failure by the licence holder to fulfil the said obligation or obstruction of the special manager shall entail the liability of the licence holder in accordance with the procedure established by legislation.
19. In the event of ensuring the fulfilment of the licence conditions by the special manager or by the licence holder himself/herself, the court shall adopt a judgment on the cancellation of the special management.
20. All actions aimed at ensuring the fulfilment of the licence conditions, including the remuneration of the special manager, shall be carried out at the expense of the licence holder.
21. The issues of the powers, activity and remuneration of the special manager, taking into account the specifics of the licensed activity, may be additionally regulated by a normative act of the licence issuer or its superior (controlling) administrative body.
22. If the licence holder has a general licence and fails to satisfy the licence conditions regulating any narrow special activity from among activities of a similar type, it is entitled to carry out the other remaining activities provided for by the general licence. Non-fulfilment of the licence conditions regulating the narrow activity cannot be a ground for prohibiting the carrying out of other activities provided for by the general licence.
23. The carrying out by the holder of a general licence of any narrow special activity from among activities of a similar type in violation of the licence conditions regulating it shall entail liability in accordance with the procedure established by this article.
24. Control over the fulfilment by the holder of a usage licence of the licence conditions and the requirements established for the use of a specific object, and liability for their violation, shall be determined in accordance with the procedure established by Articles 21 and 22 of this Law.
