margin:1.0in 1.25in 1.0in 1.25in;} div.Section1 {page:Section1;} /* List Definitions */ ol {margin-bottom:0in;} ul {margin-bottom:0in;} საქართველოს პრეზიდენტის  ბრძანებულება №404 2008 წლის 15 აგვისტო  ქ. თბილისი იძულებით გადაადგილებული პირის – დევნილის დროებითი საბუთის გაცემის წესის დამტკიცების შესახებ „ნორმატიული აქტების შესახებ“ საქართველოს კანონის მე-18 მუხლის მე-2 პუნქტის შესაბამისად: 1. დამტკიცდეს იძულებით გადაადგილებული პირის – დევნილის დროებითი საბუთის გაცემის თანდართული წესი. 2. ეს ბრძანებულება ამოქმედდეს გამოქვეყნებისთანავე. მ. სააკაშვილი იძულებით გადაადგილებული პირის – დევნილის დროებითი საბუთის გაცემის წესი     მუხლი 1🔗. წესის მოქმედების სფერო 1. ეს წესი განსაზღვრავს იძულებით გადაადგილებული პირის – დევნილისათვის (შემდეგში – დევნილი) დევნილის დროებითი საბუთის გაცემის წესსა და პირობებს. 2. ამ ბრძანებულების მიზნებისათვის: ა) იძულებით გადაადგილებული პირი – დევნილი არის საქართველოს ის მოქალაქე, რომელსაც უკვე მიღებული აქვს საქართველოს მოქალაქის პირადობის მოწმობა და რომელიც 2008 წლის 6 აგვისტოდან საქართველოზე რუსეთის ფედერაციის შეიარაღებული თავდასხმის შედეგად, იძულებული გახდა დაეტოვებინა თავისი მუდმივი საცხოვრებელი ადგილი და გადაადგილებულიყო საქართველოს ტერიტორიის ფარგლებში იმ მიზეზით, რომ საფრთხე შეექმნა მისი ან მასთან მცხოვრები ოჯახის წევრების სიცოცხლეს, ჯანმრთელობას, სხვა უფლებებსა და თავისუფლებებს; ბ) დევნილის დროებითი საბუთი არის ამ პუნქტის „ა“ ქვეპუნქტით გათვალისწინებულ პირებზე გაცემული დოკუმენტი, რომელიც იძლევა პირის (დევნილის) იდენტიფიკაციის საშუალებას. 3. დევნილის დროებითი საბუთი არ გაიცემა ამ მუხლის მე-2 პუნქტით გათვალისწინებულ იმ პირებზე, რომლებსაც თან აქვთ საქართველოს მოქალაქის პირადობის მოწმობა ან/და პირადობის დამადასტურებელი სხვა დოკუმენტი. 4. ეს ბრძანებულება არ აწესრიგებს “იძულებით გადაადგილებულ პირთა –დევნილთა შესახებ“ საქართველოს კანონით გათვალისწინებულ დევნილთა რეგისტრაციისა და დევნილის მოწმობის გაცემის საკითხებს, რაც ხორციელდება (რეგულირდება) აღნიშნული საკანონმდებლო აქტით დადგენილი წესით.      მუხლი 2🔗. დევნილის დროებითი საბუთის გაცემის წესი 1. დევნილის დროებითი საბუთის გაცემის თაობაზე ინფორმაციის გამოქვეყნება უნდა მოხდეს მასობრივი ინფორმაციის საშუალებებით. 2. დევნილის დროებითი საბუთის გაცემას უზრუნველყოფს საქართველოს იუსტიციის სამინისტრო საჯარო სამართლის იურიდიული პირის – სამოქალაქო რეესტრის სააგენტოს (შემდეგში – სააგენტო) ტერიტორიული სამსახურების მეშვეობით. 3. დევნილის დროებითი საბუთის გაცემის პროცესის ორგანიზებასა და კოორდინაციას ახორციელებს სააგენტო. 4. დევნილის დროებითი საბუთის გაცემის პროცესში სააგენტოს ტერიტორიული სამსახური დევნილის იდენტიფიკაციას ახორციელებს ფოტოგრაფირების, გასაუბრებისა და დევნილის იდენტიფიცირებისათვის საჭირო, სააგენტოსათვის ხელმისაწვდომი სხვა საშუალებებით. 5. დევნილის დროებითი საბუთის მიღების უფლება აქვს უშუალოდ დევნილს, ხოლო ქმედუუნარო ან შეზღუდულ ქმედუნარიანი პირის შემთხვევაში – მის კანონიერ წარმომადგენელს. დაუშვებელია სხვა პირზე დევნილის დროებითი საბუთის გაცემა. დევნილი, ხოლო ქმედუუნარო ან შეზღუდულ ქმედუნარიანი პირის შემთხვევაში – მისი კანონიერი წარმომადგენელი, ხელს აწერს დევნილის დროებით საბუთს და დევნილის დროებითი საბუთის გაცემის ჟურნალში ხელმოწერით ადასტურებს საბუთის მიღებას. 6. დევნილის დროებითი საბუთის გაცემისათვის უფლებამოსილი სააგენტოს ტერიტორიული სამსახურების ჩამონათვალს განსაზღვრავს სააგენტოს თავმჯდომარე. 7. თუ დევნილმა ობიექტური მიზეზით (ხანდაზმულობა, მძიმე ავადმყოფობა და სხვ.) ვერ შეძლო სააგენტოს შესაბამის ტერიტორიულ ორგანოში გამოცხადება, სააგენტოს უფლებამოსილი პირი ვალდებულია, დევნილის მოთხოვნით, დევნილის სამყოფელ ადგილზე მისვლით უზრუნველყოს დევნილის დროებითი საბუთის გაცემა.     მუხლი 3🔗. დევნილის დროებითი საბუთის ფორმა დევნილის დროებითი საბუთის ფორმას ამტკიცებს საქართველოს იუსტიციის მინისტრი.       მუხლი 4🔗. დევნილის დროებითი საბუთის მოქმედების ვადა 1. დევნილის დროებითი საბუთის გაცემის ფაქტობრივი საფუძვლების აღმოფხვრის შემთხვევაში, ამ ბრძანებულების შესაბამისად გაცემული დევნილის დროებითი საბუთის მოქმედების შეწყვეტის შესახებ გადაწყვეტილებას იღებს საქართველოს იუსტიციის მინისტრი. 2. ამ ბრძანებულების ძალადაკარგულად გამოცხადება იწვევს მის საფუძველზე გაცემული დევნილის დროებითი საბუთის მოქმედების შეწყვეტას, თუ შესაბამისი ბრძანებულებით სხვა რამ არ იქნება გათვალისწინებული.
