margin:1.0in 47.85pt 53.85pt 52.5pt;} div.Section1 {page:Section1;} /* List Definitions */ ol {margin-bottom:0in;} ul {margin-bottom:0in;} საქართველოს მთავრობის დადგენილება №380 2010 წლის 10 დეკემბე რი ქ. თბილისი  შპს ,,საგზაო ტექნიკის“ სახსრებით საქონლისა და მომსახურების შესყიდვების სპეციალური წესის დამტკიცების შესახებ     მუხლი 1🔗 ,,სახელმწიფო შესყიდვების შესახებ“ საქართველოს კანონის მე-3 მუხლის პირველი პუნქტის ,,ა.თ“ ქვეპუნქტის საფუძველზე დამტკიცდეს თანდართული შპს ,,საგზაო ტექნიკის“ სახსრებით საქონლისა და მომსახურების შესყიდვების სპეციალური წესი.     მუხლი 2🔗 დადგენილება ამოქმედდეს გამოქვეყნებისთანავე და ძალაშია 201 2 წლის 1 დეკემბრ ის ჩათვლით. პრემიერ-მინისტრი ნ. გილაური შპს ,,საგზაო ტექნიკის“ სახსრებით საქონლისა და მომსახურების შესყიდვების სპეციალური წესი     მუხლი 1🔗. ზოგადი დებულებები 1 . შპს ,,საგზაო ტექნიკის “ სახსრებით საქონლისა და მომსახურების შესყიდვების სპეციალური წესი (შემდგომში – წესი ) შემუშავებულია ,,სახელმწიფო შესყიდვების შესახებ“ საქართველოს კანონის მე -3 მუხლის პირველი პუნქტის ,,ა .თ “ ქვეპუნქტის შესაბამისად და ადგენს შპს ,,საგზაო ტექნიკის “ სახსრებით საქონლისა და მომსახურების შესყიდვების სპეციალურ წესს . ამ წესის მიზანია განსახორციელებელი მომსახურებისა და საქონლის შესყიდვების პროცედურების გამარტივება , კომპანიის მიზნების შეუფერხებლად განხორციელების უზრუნველყოფა . 2 . შპს ,,საგზაო ტექნიკის “ მიერ განსახორციელებელ სხვა დანარჩენ შესყიდვაზე ვრცელდება საქართველოს კანონი ,,სახელმწიფო შესყიდვების შესახებ “ და სახელმწიფო შესყიდვების სააგენტოს თავმჯდომარის 2006 წლის 3 იანვრის №1 ბრძანება ,,სახელმწიფო შესყიდვების განხორციელების წესის შესახებ “ დებულების დამტკიცების შესახებ “. 3 . შესყიდვის განხორციელებისას შეიძლება გამოყენებულ იქნეს მსოფლიო ბანკის , გაერთიანებული ერების ორგანიზაციის , ევროპის რეკონსტრუქციისა და განვითარების ბანკის , აზიის განვითარების ბანკის , სხვა დონორი (დამფინანსებელი ) ორგანიზაციებისა და ქვეყნების მიერ განსაზღვრული შესყიდვის პროცედურები , თუ შესყიდვის განხორციელებასთან დაკავშირებული სამართალურთიერთობის მონაწილე რომელიმე ზემოაღნიშნული სუბიექტია . იმ შემთხვევაში , თუ სუბიექტები არ არიან შესყიდვის განხორციელებასთან დაკავშირებული სამართალურთიერთობის მონაწილენი , მათი , აგრეთვე სხვა სუბიექტების შესყიდვის პროცედურები შესაძლებელია გამოყენებულ იქნეს მხოლოდ საქართველოს მთავრობის განკარგულების საფუძველზე . 4 . საქონლისა და მომსახურების შესყიდვების შესახებ გადაწყვეტილება მიიღება ამ წესის შესაბამისად .     მუხლი 2🔗. ტერმინთა განმარტება ამ წესში გამოყენებულ ტერმინებს აქვს შემდეგი მნიშვნელობა : ა ) შესყიდვა – შპს ,,საგზაო ტექნიკის “ მიერ ამ წესის №1 დანართით განსაზღვრული საქონლისა და მომსახურების შესყიდვა ; ბ ) შემსყიდველი ორგანიზაცია – შპს ,,საგზაო ტექნიკა “; გ ) შესყიდვის ობიექტი – შესასყიდი საქონელი ან /და მომსახურება ; დ ) შესყიდვის ერთგვაროვანი ობიექტი – იდენტური , ასევე არაიდენტური , მაგრამ მსგავსი კომპონენტების , ტექნიკური მაჩვენებლების (მახასიათებლის ) ან /და ფუნქციების მქონე შესყიდვის ობიექტები ; ე ) საქონელი – ნებისმიერი სახისა და აღწერილობის ქონება (გარდა უძრავი ქონებისა ) როგორც მყარ , ისე თხევად ან აირად მდგომარეობაში , აგრეთვე საქონლის მიწოდების თანმდევი მომსახურება , თუ ამ მომსახურების ღირებულება არ აღემატება საქონლის ღირებულებას ; ვ ) მომსახურება – შესყიდვის ნებისმიერი ობიექტი , საქონლისა და სამუშაოს გარდა . ამასთან , ამ წესის მიზნებისათვის ტერმინი – მომსახურება მოიცავს იჯარას , ქირავნობასა და ლიზინგს ; ზ ) პრეტენდენტი – შესყიდვის მონაწილე პირი , რომელიც წარადგენს პირობათა გამოკითხვის წინადადებას ; თ ) მიმწოდებელი – პირი , რომელმაც შპს ,,საგზაო ტექნიკასთან “ დადო ხელშეკრულება შესყიდვის შესახებ ; ი ) გადაუდებელი აუცილებლობა – ვითარება , რომელიც რეალურ საფრთხეს უქმნის შემსყიდველი ორგანიზაციის ფუნქციონირებას და რომელიც არ შეიძლებოდა ყოფილიყო წინასწარ განსაზღვრული ან /და რომლის დადგომა არ არის გამოწვეული შემსყიდველი ორგანიზაციის ქმედებით ან რომელმაც შეიძლება მნიშვნელოვანი ზიანი მიაყენოს შემსყიდველი ორგანიზაციის ქონებას ; კ ) პირობათა გამოკითხვა – გამარტივებული საშუალება საქონლისა და მომსახურების შესყიდვისათვის ; ლ ) კომისია – შპს ,,საგზაო ტექნიკის “ დირექტორის მიერ ამ წესის მე -7 მუხლის შესაბამისად შექმნილი კომისია .     მუხლი 3🔗. შპს ,,საგზაო ტექნიკის“ უფლება-მოვალეობები 1 . შპს ,,საგზაო ტექნიკა “ უფლებამოსილია : ა ) ამ წესის შესაბამისად მოახდინოს პრეტენდენტთა შერჩევა ; ბ ) ამ წესის დაცვით შეარჩიოს მიმწოდებელი ; გ ) ხელშეკრულების დადებამდე ნებისმიერ დროს შეაჩეროს ან შეწყვიტოს შესყიდვის პროცედურა , თუ აღნიშნული შესყიდვა შპს ,,საგზაო ტექნიკისათვის “ წამგებიანი აღმოჩნდება ; დ ) განახორციელოს მიმწოდებლის მიერ ხელშეკრულების პირობების შესრულების კონტროლი და ზედამხედველობა ; ე ) შეაჩეროს ან შეწყვიტოს ხელშეკრულების მოქმედება საქართველოს კანონმდებლობით გათვალისწინებული შემთხვევების არსებობისას . 2 . შპს ,,საგზაო ტექნიკა “ ვალდებულია განახორციელოს შესყიდვის პროცედურები მის მიერ შესყიდვებისათვის გამოყოფილი თანხის ფარგლებში , ამ წესით დადგენილი პირობების დაცვით .     მუხლი 4🔗. ინტერესთა კონფლიქტის თავიდან აცილების პირობები და წესები 1 . ინტერესთა კონფლიქტის არსებობის შემთხვევაში შესყიდვის განხორციელებასთან დაკავშირებული პირი (შპს ,,საგზაო ტექნიკის “ თანამშრომელი , კონსულტანტი , ექსპერტი და სხვ .) ვალდებულია წერილობითი უარი განაცხადოს შესყიდვის განხორციელებასთან დაკავშირებული საქმიანობის შესახებ . 2 . დაუშვებელია , რომ შპს ,,საგზაო ტექნიკამ “ შესყიდვის მომზადება , განხორციელება ან /და მასზე ზედამხედველობა დააკისროს პირს ან კონსულტანტად (ექსპერტად ) მოიწვიოს პირი , თუ იგი : ა ) ფიზიკური პირია და არის შესყიდვის მონაწილე რომელიმე იურიდიული პირის ხელმძღვანელის , თანამშრომლის ან უშუალო მონაწილის ახლო ნათესავი ; ბ ) ბოლო 3 წლის განმავლობაში მუშაობდა შპს ,,საგზაო ტექნიკაში “; გ ) პირადი ან საქმიანი ინტერესით დაკავშირებულია ან ასეთი კავშირის დასამყარებლად მოლაპარაკებას აწარმოებს შესყიდვის მონაწილე იურიდიულ ან ფიზიკურ პირთან . 3 . დაუშვებელია , შესყიდვაში მონაწილეობა მიიღონ იურიდიულმა და ფიზიკურმა პირებმა , რომლებიც მონაწილეობდნენ შესყიდვის მოსამზადებელ სამუშაოებში . 4 . ამ მუხლის მე -2 და მე -3 პუნქტების მოთხოვნები ვრცელდება აგრეთვე : ა ) ხელშეკრულების შესრულების კონტროლის განმახორციელებელი პირების მიმართ ; ბ ) ერთ პირთან მოლაპარაკების საშუალებით შესყიდვის განხორციელების შესახებ მოლაპარაკების მონაწილე პირების მიმართ .     მუხლი 5🔗. შესყიდვების დაგეგმვა 1 . შპს ,,საგზაო ტექნიკა “ შესყიდვებს ახორციელებს წინასწარ განსაზღვრული წლიური გეგმის შესაბამისად , რომელსაც ამტკიცებს შპს ,,საგზაო ტექნიკის “ დირექტორი . 2 . შემსყიდველი ორგანიზაციის გადაწყვეტილებით , ერთი საბიუჯეტო (საფინანსო ) წლის განმავლობაში შესყიდვის ერთგვაროვანი ობიექტების შესყიდვა შესაძლებელია განხორციელდეს ეტაპობრივად .     მუხლი 6🔗. შესყიდვის საშუალებები 1 . შესყიდვა ხორციელდება პირობათა გამოკითხვის საშუალებით , თუ ამ მუხლით სხვა რამ არ არის გათვალისწინებული . 2 . შესყიდვა შეიძლება განხორციელდეს ერთ პირთან მოლაპარაკების საშუალებით , თუ : ა ) შესასყიდი საქონლის ან მომსახურების სავარაუდო ღირებულება არ აღემატება 250 000 ლარს ; ბ) კომისიამ მიიღო აღნიშნული გადაწყვეტილება; გ) საქონლის მიწოდება ან მომსახურების გაწევა მხოლოდ ერთი პირის ექსკლუზიური უფლებაა; დ) მიმწოდებლისაგან შესყიდული ობიექტის ხარისხის გაუარესების თავიდან აცილების ან/და მისი შემდგომი ექსპლუატაციის უზრუნველყოფის მიზნით აუცილებელია შესყიდვა იმავე მიმწოდებლისაგან, გარდა იმ შემთხვევებისა, როდესაც განსახორციელებელი შესყიდვის ობიექტის სავარაუდო ღირებულება აღემატება თავდაპირველი მიწოდების ღირებულებას; ე) ხორციელდება შესყიდული საქონლის ახალი, იმავე ან გაუმჯობესებული პარამეტრების მქონე საქონლით ჩანაცვლება. 3. პირობათა გამოკითხვის პროცედურებს ახორციელებს კომისია. 4. შემსყიდველი ორგანიზაციის გადაწყვეტილებით, შესაძლებელია ამ წესის №1 დანართით განსაზღვრული საქონლისა და მომსახურების შესყიდვა ელექტრონული ტენდერისა და გამარტივებული ელექტრონული ტენდერის საშუალებით, ,,სახელმწიფო შესყიდვების შესახებ “ საქართველოს კანონის შესაბამისად.     მუხლი 7🔗. კომისიის შექმნისა და საქმიანობის წესი 1. პირობათა გამოკითხვას ატარებს კომისია, რომელსაც ბრძანებით ქმნის შპს ,,საგზაო ტექნიკის “ დირექტორი არანაკლებ 3 წევრის შემადგენლობით. 2. კომისიის წევრებად ინიშნებიან შპს ,,საგზაო ტექნიკის“ თანამშრომლები. 3. კომისიას თავმჯდომარეობს შპს ,,საგზაო ტექნიკის“ ხელმძღვანელობაზე უფლებამოსილების მქონე პირი ან მის მიერ დანიშნული პირი. 4. კომისიის გადაწყვეტილების საფუძველზე კომისიაში ექსპერტებად და კონსულტანტებად შეიძლება მოწვეულ იქნენ შესაბამისი დარგის სპეციალისტები. 5. კომისია გადაწყვეტილებებს იღებს კომისიის წევრთა სიითი შემადგენლობის უმრავლესობით. კომისიის წევრს, რომელიც არ ეთანხმება კომისიის გადაწყვეტილებას, უფლება აქვს, წერილობით წარადგინოს თავისი აზრი, რომელიც უნდა დაერთოს კომისიის გადაწყვეტილებას. ხმათა თანაბრად განაწილების შემთხვევაში გადამწყვეტია კომისიის თავმჯდომარის ხმა. 6. კომისიის სხდომის შესახებ დგება ოქმი, რომელსაც ხელს აწერენ სხდომაზე დამსწრე კომისიის წევრები და კომისიის თავმჯდომარე.     მუხლი 8🔗. განცხადება პირობათა გამოკითხვის ჩატარების შესახებ 1. პირობათა გამოკითხვის ჩატარებისას კომისია შპს ,,საგზაო ტექნიკის“ სახელით პირობათა გამოკითხვის დოკუმენტაციას (შემდგომში – დოკუმენტაცია) უგზავნის მის მიერ შერჩეულ არანაკლებ სამ პირს. თუ ვერ მოხერხდა სამი პირის შერჩევა, ასეთ შემთხვევაში პირობათა გამოკითხვის შესახებ განცხადებას აქვეყნებს გაზეთ ,,24 საათში “ და/ან სხვა მასობრივი ინფორმაციის საშუალებებში. 2. პირობათა გამოკითხვის ჩატარების შესახებ განცხადებაში მითითებულ უნდა იყოს: ა ) შპს ,,საგზაო ტექნიკის “ რეკვიზიტები ; ბ ) შესასყიდი საქონლისა და მომსახურების სახეობა , რაოდენობა , ხარისხი და სავარაუდო ღირებულება . იმ შემთხვევაში , თუ შესყიდვის ობიექტის (ნავთობპროდუქცია და სხვა მსგავსი საქონელი ) ღირებულება თავისი სპეციფიკის გამო დამოკიდებულია საერთაშორისო სასაქონლო ბირჟაზე არსებულ ცვალებად ფასებზე , შესაძლებელია , შესყიდვის ობიექტის სავარაუდო ღირებულების დადგენისას შპს ,,საგზაო ტექნიკამ “ გაითვალისწინოს შემსყიდველის მიერ განსაზღვრული მომენტისათვის კონკრეტულ საერთაშორისო სასაქონლო ბირჟაზე არსებული მაჩვენებელი . ასეთ შემთხვევაში შესყიდვის ობიექტის სავარაუდო ღირებულების დასადგენად გამოიყენება კანონქვემდებარე ნორმატიული აქტით გათვალისწინებული წესი , მიწოდების ადგილი და ფორმა , შესრულების ადგილი , აგრეთვე სხვა მონაცემები , რომელთა მითითებას შპს ,,საგზაო ტექნიკა “ საჭიროდ მიიჩნევს შესყიდვის ობიექტის აღწერის მიზნით ; გ ) შესასყიდი საქონლის მიწოდებისა და მომსახურების გაწევის სასურველი ან სავალდებულო ვადები ; დ ) პირობათა გამოკითხვის შესახებ წინადადებების წარდგენის ვადა , ადგილი და ენა ; ე ) საკვალიფიკაციო მონაცემების დამადასტურებელი დოკუმენტები , ასეთის მოთხოვნის შემთხვევაში ; ვ ) დოკუმენტაციის გატანის წესი , ვადა და ადგილი . 3 . პირობათა გამოკითხვის ჩატარების შესახებ განცხადებას ამტკიცებს კომისია . 4 . კომისიას უფლება აქვს , შეცვალოს პირობათა გამოკითხვის ჩატარების შესახებ განცხადებაში მითითებული ინფორმაცია. ეს ცვლილებები უნდა გამოქვეყნდეს იმავე საინფორმაციო საშუალებებში, რომლებშიც გამოქვეყნდა განცხადება პირობათა გამოკითხვის ჩატარების შესახებ, ასევე მიეწოდოთ ინფორმაცია წერილობითი სახით იმ პრეტენდენტებს, რომელთაც დაეგზავნათ ან რომლებმაც გაიტანეს დოკუმენტაცია. 5. პირობათა გამოკითხვის ჩატარების შესახებ განცხადებაში შეტანილი ცვლილებები უნდა გამოქვეყნდეს გონივრულ ვადებში, შესყიდვის ობიექტის სპეციფიკიდან გამომდინარე.     მუხლი 9🔗. საკვალიფიკაციო მონაცემები შესყიდვის მონაწილეობის მსურველთათვის საკვალიფიკაციო მონაცემების შესახებ მოთხოვნებს ყოველ კონკრეტულ შემთხვევაში განსაზღვრავს კომისია.     მუხლი 10🔗. პირობათა გამოკითხვის დოკუმენტაცია 1. კომისია დოკუმენტაციას ამტკიცებს პირობათა გამოკითხვის ჩატარების შესახებ განცხადების გაგზავნამდე ან მის გამოქვეყნებამდე. 2. დოკუმენტაცია უნდა შეიცავდეს: ა) განაცხადს პირობათა გამოკითხვის პროცედურაში მონაწილეობისათვის; ბ) ინფორმაციას ტექნიკური შესაბამისობის შესახებ (შესყიდვის ობიექტის დასახელება, შესყიდვის ობიექტის აღწერილობა); გ) ინფორმაციას ფასებისა და მიწოდების გრაფიკის შესახებ; დ) პირობათა გამოკითხვის წინადადებას; ე) შეფასების კრიტერიუმებს.     მუხლი 11🔗. პრეტენდენტთა პირობათა გამოკითხვის წინადადების წარდგენისა და განხილვის წესი 1 . პირობათა გამოკითხვის წინადადების (შემდგომში – წინადადება ) წარდგენა შესაძლებელია დახურული კონვერტით . შეთავაზებული წინადადებების შერჩევა ხდება პრეტენდენტთა თანდასწრებით . 2 . პრეტენდენტებს უფლება აქვთ , კონვერტების გახსნამდე ნებისმიერ დროს წერილობით გამოითხოვონ ან შეცვალონ წინადადება . 3 . შესული წინადადებების შერჩევა ხდება იმავე დღეს , წინადადების მიღების დამთავრებისთანავე , ხოლო გამარჯვებული გამოვლინდება შერჩევის დასრულებიდან 2 დღის ვადაში . 4 . კომისია პრეტენდენტის დისკვალიფიკაციას ახდენს იმ შემთხვევაში , თუ : ა ) პრეტენდენტის მიერ არ არის წარდგენილი ყველა საჭირო დოკუმენტი (თანმხლები დოკუმენტების ჩათვლით ) ან /და ინფორმაცია , საჭიროების შემთხვევაში – ნიმუში ; ბ ) შესყიდვის პროცედურების დროს ადგილი ექნება პრეტენდენტის არაკეთილსინდისიერ ქმედებას ; გ ) შესყიდვის პროცედურების მონაწილე პირის მიერ წარდგენილი მონაცემები ან /და მათი დამადასტურებელი დოკუმენტები ყალბი აღმოჩნდება . 5 . შემსყიდველი იტოვებს უფლებას , წარდგენილ დოკუმენტაციაში რაიმე სახის ეჭვის გამოვლენის შემთხვევაში მოსთხოვოს პრეტენდენტს აღნიშნული დოკუმენტის ხელახალი წარდგენა . 6 . წინადადების შერჩევის დროს უნდა შემოწმდეს , არის თუ არა მასში დაშვებული მექანიკური შეცდომები . შეცდომების გამოვლენის შემთხვევაში კომისიამ ამ წინადადების წარმდგენ პრეტენდენტს უნდა შესთავაზოს შეცდომის გამოსწორება . 7 . კომისია ვალდებულია ზეპირ ვაჭრობაზე მოიწვიოს ის პრეტენდენტები , რომლებიც შერჩევის პროცედურების დასრულების შემდეგ დაიშვებიან შეფასებაზე . ამასთან , ზეპირი ვაჭრობის დროს დასაშვებია მხოლოდ წინადადებით წარდგენილი ფასის შეცვლა . 8 . წინადადებები შეფასდება დოკუმენტაციაში მითითებული კრიტერიუმებისა და ამ კრიტერიუმების პრიორიტეტულობის გათვალისწინებით . 9 . წინადადების შეფასებისას შეიძლება გამოყენებულ იქნეს შემდეგი კრიტერიუმები : ა ) წინადადების ღირებულება ; ბ ) საქონლის მიწოდებისა და მომსახურების გაწევის ვადები ; გ ) საქონლისა და მომსახურების ხარისხობრივი პარამეტრები და ფუნქციონალური მახასიათებლები ; დ ) ანგარიშსწორების ფორმები და პირობები . 10 . შეფასებისას გამოყენებულ თითოეულ კრიტერიუმს უნდა გააჩნდეს ციფრობრივად გამოსახული ხვედრითი წონა ჯამურ შეფასებაში (პრიორიტეტულობის მაჩვენებელი), რომელიც უნდა გამოიხატოს კოეფიციენტის სახით, ამასთან, ყველა კრიტერიუმის პრიორიტეტულობის კოეფიციენტების ჯამი უნდა უდრიდეს ერთ მთელს. მათ შორის ფასთა გამოკითხვის კოეფიციენტი გათვალისწინებული იქნება არანაკლებ 0.4-ით. 11. კომისიის თითოეული წევრი წერილობითი ფორმით აფასებს ყოველი პრეტენდენტის წინადადებას ცალ-ცალკე, ყოველი კრიტერიუმის მიხედვით, ათქულიანი სისტემით. თითოეული კრიტერიუმის მიხედვით პრეტენდენტისათვის მინიჭებული ქულა მრავლდება ამ კრიტერიუმის პრიორიტეტულობის კოეფიციენტზე, ხოლო მიღებული ნამრავლის დაჯამებით გამოითვლება თითოეული პრეტენდენტის წინადადების ჯამური შეფასება. კომისიის წევრის ერთ-ერთი პრეტენდენტისათვის მინიჭებული ყველაზე მაღალი ჯამური შეფასება ჩაითვლება ამ პრეტენდენტისათვის მიცემულ ერთ ხმად. 12. პრეტენდენტი გამარჯვებულად ჩაითვლება, თუ მას კომისიის წევრთა სიითი შემადგენლობის უმრავლესობის დასკვნით მიენიჭება უპირატესობა. ხმათა თანაბრად განაწილების შემთხვევაში გადამწყვეტია კომისიის თავმჯდომარის დასკვნა. 13. კომისიის გადაწყვეტილება პირობათა გამოკითხვის პროცედურაში გამარჯვებული პრეტენდენტის შესახებ ფორმდება კომისიის სხდომის ოქმით, რომელსაც თან ერთვის კომისიის წევრთა დასკვნები. ოქმში აგრეთვე მოკლედ უნდა იყოს აღწერილი პრეტენდენტების მიერ წარდგენილი წინადადებები.     მუხლი 12🔗. პირობათა გამოკითხვისას ზეპირი ვაჭრობის ჩატარების წესი და პირობები 1 . ზეპირი ვაჭრობა გაიმართება შემსყიდველი ორგანიზაციის მიერ დოკუმენტაციაში მითითებულ ადგილზე . 2 . შემსყიდველი ორგანიზაცია ვალდებულია შერჩევის პროცედურის დასრულებისთანავე დაადგინოს დოკუმენტაციაში მითითებულ დღეს ზეპირი ვაჭრობის დაწყების კონკრეტული დრო და ამის შესახებ დაუყოვნებლივ წერილობით აცნობოს შეფასებაზე დაშვებულ პრეტენდენტებს . 3 . კომისია ვალდებულია ზეპირ ვაჭრობაზე მოიწვიოს ის პრეტენდენტები , რომლებიც შერჩევის პროცედურების დასრულების შემდეგ დაიშვებიან შეფასებაზე . 4 . ზეპირ ვაჭრობაზე გამოუცხადებლობა ან /და ზეპირ ვაჭრობაში მონაწილეობაზე უარი არ გამოიწვევს პრეტენდენტის დისკვალიფიკაციას . 5 . ზეპირი ვაჭრობის გამართვის დროს კომისია წარუდგენს ზეპირი ვაჭრობის მონაწილე პრეტენდენტებს მათ მიერ წინადადებ ებით წარდგენილ ფასებს ან /და ერთეულის ფასებს (მათი არსებობის შემთხვევაში ) (შემდგომში – ფასი ). აღნიშნული ინფორმაციის მიღების შემდეგ თითოეულ მონაწილე პრეტენდენტს უფლება აქვს , სამჯერ მოახდინოს წინადადების ფასის ცვლა კლებადობის პრინციპის დაცვით . 6 . ზეპირი ვაჭრობის მონაწილე პრეტენდენტების მიერ წინადადების ფასის ცვლა ხორციელდება რიგითობით . წინადადების ფასის ცვლას იწყებს შეფასებაზე დაშვებული უმაღლესი წინადადების ფასის მქონე და რიგითობის პრინციპით აგრძელებს ყოველი წინაზე უფრო დაბალი ფასის წარმდგენი . 7 . ზეპირი ვაჭრობა დასრულებულად ითვლება ყოველი მონაწილის მიერ თავისი ფასის სამჯერ შეცვლის ან /და საბოლოო ფასის დაფიქსირების მომენტში . ზეპირი ვაჭრობის პროცედურა უნდა დასრულდეს მისი ჩატარების დღეს . 8 . ზეპირი ვაჭრობის მსვლელობა , მათ შორის , თითოეული მონაწილე პრეტენდენტის წინადადების ფასი და ყოველ ჯერზე შეცვლილი დაფიქსირებული ფასი, უნდა აისახოს შესაბამის ოქმში, რომელსაც ხელს აწერენ კომისიის ყველა წევრი და მონაწილე პრეტენდენტები. ზეპირი ვაჭრობის მონაწილე პრეტენდენტების მიერ ოქმის ხელმოწერაზე უარის თქმა მიიჩნევა, როგორც უარი მის მიერ ზეპირ ვაჭრობაზე დაფიქსირებულ ყველა შეცვლილ ფასზე და ძალაში დარჩება მისი წინადადების პირვანდელი ფასი. 9. ზეპირ ვაჭრობაზე საბოლოო ფასების დაფიქსირების შემდეგ შეფასება ხორციელდება ამ წესის შესაბამისად.     მუხლი 13🔗. გამარჯვებულ პრეტენდენტთან ხელშეკრულების დადება 1. ამ წესის შესაბამისად გამარჯვებული პრეტენდენტის წინადადებით განსაზღვრული პირობების საფუძველზე გამარჯვებულ პრეტენდენტსა და შპს ,,საგზაო ტექნიკას“ შორის იდება ხელშეკრულება. 2. გამარჯვებული პრეტენდენტის დისკვალიფიკაციის ან მის მიერ ხელშეკრულების დადებაზე უარის თქმის შემთხვევაში კომისია მიმართავს პირობათა გამოკითხვის პროცედურის მონაწილე დანარჩენ პრეტენდენტებს წინადადებათა ხელახალ განხილვაში მონაწილეობის თაობაზე. თუ არც ერთმა პრეტენდენტმა არ გამოთქვა თანხმობა წინადადებათა ხელახალ განხილვაში მონაწილეობის მიღებაზე, ტარდება ახალი პირობათა გამოკითხვა. თუ წინადადებათა ხელახალ განხილვაში მონაწილეობაზე თანხმობა გამოთქვა ერთმა ან რამდენიმე პრეტენდენტმა, ხდება მათი წინადადებების ხელახალი განხილვა.     მუხლი 14🔗. ჩაშლილი პირობათა გამოკითხვა 1. პირობათა გამოკითხვა ითვლება ჩაშლილად, თუ: ა) დადგენილ ვადებში არ იქნა წარდგენილი არც ერთი პირის საკვალიფიკაციო მონაცემები და/ან წინადადება; ბ) არც ერთი პირის მიერ წარდგენილი საკვალიფიკაციო მონაცემები ან/და წინადადება არ შეესაბამებოდა შპს ,,საგზაო ტექნიკის “ მოთხოვნებს; გ) წარდგენილი წინადადების ფასებიდან არც ერთი არ შეესაბამება შპს ,,საგზაო ტექნიკის“ ფინანსურ შესაძლებლობებს. 2. ამ მუხლის პირველი პუნქტით გათვალისწინებულ შემთხვევებში, ამავე წესის მე-15 მუხლის თანახმად, ცხადდება ხელახალი პირობათა გამოკითხვა.     მუხლი 15🔗. ხელახალი პირობათა გამოკითხვა 1. პირობათა გამოკითხვის ჩაშლილად გამოცხადების შემდეგ კომისიას შეაქვს საჭირო ცვლილებები ახალ დოკუმენტაციაში და ატარებს ხელახალ პირობათა გამოკითხვას. 2. ამ მუხლის პირველი პუნქტით გათვალისწინებულ შემთხვევაში შპს ,,საგზაო ტექნიკის“ დირექტორს უფლება აქვს, შეცვალოს კომისიის შემადგენლობა.     მუხლი 16🔗. შესყიდვის შესახებ ხელშეკრულების პირობები და მათი გადასინჯვის წესი 1. შესყიდვის შესახებ ხელშეკრულება იდება მხოლოდ წერილობითი ფორმით, გარდა ამ მუხლის მე-5 და მე-6 პუნქტებით გათვალისწინებული შემთხვევებისა. 2. შესყიდვის შესახებ ხელშეკრულების შესრულების უზრუნველყოფის მიზნით, კომისიის გადაწყვეტილებით, შეიძლება გამოყენებულ იქნეს ხელშეკრულების შესრულების გარანტირების მექანიზმი. 3. ხელშეკრულების შესრულების გარანტირების მექანიზმის მოთხოვნა სავალდებულოა, თუ: ა) ხელშეკრულებით გათვალისწინებულია წინასწარი ანგარიშსწორება (ავანსი); ბ) ხელშეკრულების საერთო ღირებულება საქონლის ან მომსახურების შესყიდვის შემთხვევაში აღემატება 200 000 ლარს. 4. შესყიდვის შესახებ ხელშეკრულებაში შეტანილ უნდა იქნეს შემდეგი აუცილებელი პირობები: ა) ხელშეკრულების მხარეების ზუსტი დასახელება და რეკვიზიტები; ბ) ხელშეკრულების ობიექტის დასახელება, ტექნიკური პარამეტრები, ძირითადი მახასიათებლები და საიდენტიფიკაციო მონაცემები, რაოდენობა, ერთეულის და მთლიანი ღირებულება; გ) ხელშეკრულების ჯამური ღირებულება (ფასდათმობების, გადასახადების, ტრანსპორტირების, დაზღვევისა და სხვა ფაქტორების გათვალისწინებით); დ) შესასყიდი საქონლისა და მომსახურების ხარისხი, საჭიროების შემთხვევაში – არსებულ სტანდარტებთან შესაბამისობა; ე) საქონლის მიწოდების, მომსახურების გაწევის ეტაპობრივი ვადები და ადგილი; ვ) საქონლის, მომსახურების მიღება-ჩაბარების წესი; ზ) ანგარიშსწორების ფორმა, გრაფიკი და ადგილი; თ) ხელშეკრულების შესრულების გარანტია (ამ მექანიზმის გამოყენების შემთხვევაში); ი) მხარეთა უფლება-მოვალეობანი; კ) მხარეთა პასუხისმგებლობა ხელშეკრულების პირობების დარღვევისათვის; ლ) ფორსმაჟორული სიტუაციები; მ) ხელშეკრულების პირობების, მათ შორის, ფასების გადასინჯვის შესაძლებლობა; ნ) ხელშეკრულების მოქმედების ვადა; ო) დავების გადაწყვეტის წესი; პ) ხელშეკრულების შესრულების ინსპექტირების პირობები. 5. შესყიდვის განხორციელება დასაშვებია წერილობითი ხელშეკრულების გარეშე ერთ პირთან მოლაპარაკების საშუალებით, თუ შესყიდვის ობიექტებია: ა) კომუნალური მომსახურება (ელექტროენერგია, ბუნებრივი აირი, წყალი, დასუფთავება და სხვ.); ბ) ფიქსირებული სატელეფონო ქსელის მომსახურება; გ) მივლინების დროს წარმომადგენლობითი მიზნებისათვის განსახორციელებელი მომსახურება; დ) საქონელი ან მომსახურება, რომლის შესყიდვაც განხორციელდება დირექტორის გადაწყვეტილებით, თუ საქონლის ან მომსახურების შესყიდვა დასტურდება საბაჟო დეკლარაციით, ზედდებულით ან/და თანხის გადახდის დამადასტურებელი დოკუმენტით (საბანკო გადარიცხვა, ნაღდი ანგარიშსწორების დამადასტურებელი დოკუმენტი ან მიღება-ჩაბარების აქტი). 6. შესყიდვის განხორციელება დასაშვებია წერილობითი ხელშეკრულების გარეშე ერთ პირთან მოლაპარაკების საშუალებით აგრეთვე საქართველოს ნორმატიული აქტით დადგენილი გადასახდელების გადახდის გზით განხორციელებული სახელმწიფო შესყიდვისას. 7. მიმწოდებელთან დადებული ხელშეკრულების პირობების გადასინჯვის წესი განისაზღვრება საქართველოს კანონმდებლობით.     მუხლი 17🔗. ანგარიშის წარდგენა 1. შპს ,,საგზაო ტექნიკა“ განხორციელებული საქონლისა და მომსახურების შესყიდვის შესახებ ანგარიშს ყოველწლიურად წარუდგენს სსიპ – სახელმწიფო შესყიდვების სააგენტოს არა უგვიანეს მომდევნო წლის 20 თებერვლისა. 2. ანგარიში წარდგენილ უნდა იქნეს ამ წესის №2 დანართის შესაბამისად.     მუხლი 18🔗. ცვლილებებისა და დამატებების შეტანის წესი ამ წესში ცვლილებებისა და დამატებების შეტანა ხდება საქართველოს მთავრობის დადგენილებით. დანართი №1 შპს ,,საგზაო ტექნიკის“ საქმიანობის სპეციფიკასთან დაკავშირებული საქონლისა და მომსახურების ჩამონათვალი საქონლის დასახელება საოფისე და კომპიუტერული მანქანები, აქსესუარები, მოწყობილობები და მარაგი, პროგრამების პაკეტის ჩათვლით საკანცელარიო საქონელი საოფისე ავეჯი ავეჯი ელ. გამათბობლები მაცივრები ტელევიზორები ფოტოაპარატები ტელეფონის აპარატები (მათ შორის, უკაბელო ტელეფონის აპარატები) კონდიციონერები ჟურნალ-გაზეთები და სპეცლიტერატურა ორგანიზაციის ბეჭდები, ბლანკები და ქვითრები სასაქონლო ზედდებულები საგზურის ფურცლები სავიზიტო ბარათები სპეცტანსაცმელი და აღჭურვილობა სამეურნეო საქონელი სამუშაო იარაღები და ხელსაწყოები სხვადასხვა მასალის მილები ფურცლოვანი ლითონი გასაჩარხი მასალა (მრგვალი რკინა) სხვადასხვა მასალის სხმულები ლაბორატორიული აღჭურვილობა ქიმიური ხსნარები და რეაქტივები დაზგა-დანადგარები ავტომანქანები სპეც. სამშენებლო ტექნიკა რეციკლირების მანქანის საჭრისები, საჭრისის ბუდეები, საჭრისის ბუდის ძირები და საჭრისის ბუდეების სამაგრები გრეიდერის სათადარიგო ნაწილები ,,ვირტგენ ინტერნაციონალის“ ჯგუფში შემავალი სპეც. ტექნიკის სათადარიგო ნაწილები ,,კატერპილარის“ ჯგუფში შემავალი სპეც. ტექნიკის სათადარიგო ნაწილები ავტომანქანებისა და სამშენებლო ტექნიკის სათადარიგო ნაწილები ქვის სამსხვრევი საამქროს მალცვეთადი ნაწილები ქვის სამსხვრევი საამქროს სათადარიგო ნაწილები ქვის სამსხვრევის ელ. ნაწილები და აგრეგატები სამსხვრევის ყბები ქვის სამსხვრევის ბადეები ტრანსპორტიორის ლენტები ბეტონის ქარხნის მალცვეთადი ნაწილები ბეტონის ქარხნის სათადარიგო ნაწილები ბეტონის ქარხნის ელ. ნაწილები და აგრეგატები ღორღი და სხვადასხვა ფრაქციის ქვიშა-ღორღოვანი მასალები ბიტუმი, ბიტუმის ემულსია ასფალტბეტონი ცემენტი სამშენებლო მასალები ელ. გენერატორები სპეც. ზეთები და საცხებ-საპოხი მასალები დიზელის საწვავი ბენზინი საგზაო ნიშნები, ბოძკინტები, თვალამრიდები არმირებული გრუნტის ელემენტები სხვადასხვა ჭურჭელი-რეზერვუარი ჟანგბადი, ჟანგბადის ბალონები თხევადი გაზი მომსახურება კომპიუტერული მომსახურება პროგრამული უზრუნველყოფა საინფორმაციო და სარეკლამო მომსახურება ნებართვებისა და სპეცფორმების აღება რუკების ბეჭდვა საფოსტო მომსახურება წარმომადგენლობითი ხარჯები საპროექტო მომსახურება ,,ვირტგენ ინტერნაციონალის“ ჯგუფში შემავალი სპეც. ტექნიკის რემონტი ,,კატერპილარის“ ჯგუფში შემავალი სპეც. ტექნიკის რემონტი ქვის სამსხვრევი საამქროს რემონტი ბეტონის ქარხნის კვანძების რემონტი ავტომანქანებისა და სამშენებლო ტექნიკის ტექნიკური მომსახურება ავტომანქანებისა და სამშენებლო ტექნიკის რემონტი მძიმე გაბარიტული და არაგაბარიტული ტვირთების ტრანსპორტირება ავტომანქანებისა და სპეცტექნიკის ტექდათვალიერება დაზგა-დანადგარებისა და ელ. გენერატორების რემონტი სანოტარო მომსახურება თარგმნა იურიდიული მომსახურება სადაზღვევო მომსახურება აუდიტური, საკონსულტაციო მომსახურება პერსონალის გადამზადება, ტრენინგ-სემინარები ექსპერტიზის მომსახურება ლაბორატორიული მომსახურება დაცვა დასუფთავება სატრანსპორტო მომსახურება სპეც. ტექნიკით მომსახურება ავტომანქანებისა და სპეც. ტექნიკის იჯარა დანართი №2 № შესყიდვის საშუალება ( ერთ პირთან მოლაპარაკება, პირობათა გამოკითხვა) შესყიდვის ერთგვაროვან ობიექტთა ჯგუფის დასახელება მიმწოდე- ბელი მხარის დასახელება შესყიდვის შედეგად დადებული ხელშეკრუ-ლების მოქმედების ვადა შესყიდვის საერთო ღირებულება შესყიდვისათვის ფაქტობრივად გადახდილი თანხა
