margin:42.55pt 52.05pt 21.3pt 56.7pt;} div.Section1 {page:Section1;} /* List Definitions */ ol {margin-bottom:0in;} ul {margin-bottom:0in;} ყაზბეგის მუნიციპალიტეტის საკრებულოს დ ა დ გ ე ნ ი ლ ე ბ ა № 54 2011 წლის 29 დეკემბერი დ.სტეფანწმინდა ყაზბეგის მუნიციპალიტეტის ტერიტორიაზე I კლასის შენობა-ნაგე­ბო­ბა­თა განთავსება/მშენებლობის შესახებ  „ადგილობრივი თვითმმართველობის შესახებ“ საქართველოს ორგანული კანონის 22-ე მუხლის პირველი პუნქტის „ჟ“ ქვეპუნქტის, ,, ნორმატიული აქტების შესახებ“ საქართველოს კანონის 25-ე მუხლისა და „მშენებლობის ნებართვის გაცემის წესისა და სანებართვო პირობების შესახებ“ საქართველოს მთავრობის 2009 წლის 24 მარტის №57 დადგენილების 65-ე და 66-ე მუხლების შესაბამისად, ყაზბეგის მუნიციპალიტეტის საკრებულო ა დ გ ე ნ ს :     მუხლი 1🔗 1. ყაზბეგის მუნიციპალიტეტის ტერიტორიაზე „მშენებლობის ნებართვის გაცემის წესისა და სანებართვო პირობების შესახებ“ საქართველოს მთავრობის 2009 წლის 24 მარტის №57 დადგენილების (შემდგომში – საქართველოს მთავრობის დადგენილების) 65-ე მუხლის პირველი პუნქტით გათვალისწინებული I კლასს დაქვემდებარებულ შენობა-ნაგე­ბო­ბა­თა განთავსება/მშენებლობა მშენებლობის ნებართვის გარეშე და საქართველოს მთავრობის დადგენილების 66-ე მუხლით გათვალის­წინე­ბუ­ლი პროცედურის დაცვით შესაძლებელია ყაზბეგის მუნიციპალიტეტის მთელ ტერიტორიაზე, გარდა ამ დადგენილების მე-2 მუხლით განსაზღვრული ტერიტორიისა. 2. თუ შენობა-ნაგე­ბო­ბა­თა განთავსება/მშენებლობა ან დემონტაჟი ხორციელდება ამ დადგენილების მე-2 მუხლით გათვალისწინებული ტერიტორიის ფარგლებს გარეთ, დამატებითი დოკუმენტაციის სახით სავალდებულოა (გარდა გადაუდებლობის შემთხვევაში შენობა-ნაგებობის დროებითი გამაგრებისა) ყაზბეგის მუნიციპალიტეტის გამგეობაში წარმოდგენილ იქნეს: ა) შენობა-ნაგებობის ფასადის მდებარეობის ამსახველი ადგილის ტოპოგრაფიული რუკა ფასადის მდებარეობის ადგილის ჩვენებით; ბ) შენობა-ნაგებობის ესკიზური ნახაზი.     მუხლი 2🔗 1. ყაზბეგის მუნიციპალიტეტის ტერიტორიაზე I კლასს დაქვემდებარებულ შენობა-ნაგე­ბო­ბა­თა განთავსებისთვის/მშენებლობისთვის მშენებლობის ნებართვის აღება სავალდებულოა (გარდა გადაუდებლობის შემთხვევაში შენობა-ნაგებობის დროებითი გამაგრების სამუშაოებისა), თუ ასაშენებელი/დემონტაჟისთვის განკუთვნილი შენობა-ნაგებობა მდებარეობს: ა) ყაზბეგის მუნიციპალიტეტის საკრებულოს ამ დადგენილების №1 დანართით გათვალისწინებულ ზონაში; ბ) ყაზბეგის მუნიციპალიტეტის ტერიტორიაზე გამავალი „საერთაშორისო და შიდასახელმწიფოებრივი მნიშვნელობის საავტომობილო გზების ნუსხის დამტკიცების შესახებ“ საქართველოს პრეზიდენტის 2011 წლის 27 მაისის №287 ბრძანებულებით განსაზღვრული საქართველოს საერთაშორისო და შიდასახელმწიფო მნიშვნელობის, ყაზბეგის მუნიციპალიტეტის ტერიტორიაზე გამავალი ,,ადგილობრივი მნიშვნელობის საავტომობილო გზების ნუსხის დამტკიცების შესახებ“ ყაზბეგის მუნიციპალიტეტის საკრებულოს 2011 წლის 29 დეკემბრის № 52 დადგენილებით გათვალისწინებული ადგილობრივი მნიშვნელობის გზის ღერძულა ხაზის ორივე მხარეს მიმდებარე 50-მეტრიან ზოლში; გ) ყაზბეგის მუნიციპალიტეტის ტერიტორიაზე არსებულ კულტურული მემკვიდრეობის დაცვის ზონებში (გარდა იმ შემთხვევისა, როდესაც ამ ზონებში შენობა-ნაგებობის მშენებლობა/მონტაჟი აკრძალულია ან შეზღუდულია „კულტურული მემკვიდრეობის შესახებ“ საქართველოს კანონით), სასაზღვრო ზოლში ან/ადა სასაზღვრო ზონებში, დაცულ ტერიტორიებზე, რეკრიაციულ ტერიტორიებსა და საქართველოს კანონმდებლობით განსაზღვრულ სხვა ტერიტორიებზე. 2. ამ მუხლის პირველი პუნქტის „ა“ და „ბ“ ქვეპუნქტებით გათვალისწინებულ ტერიტორიაზე ანტრესოლის, კიბის, ვიტრინის, კარის, ფანჯრის და სხვა ღიობების მოწყობა/დემონტაჟის შემთხვევაში, თუ ანტრესოლი, კიბე, ვიტრინა, კარი, ფანჯარა და სხვა ღიობები არ უკავშირდება შენობის ფასადის ცვლილებას, მათი მოწყობა/დემონტაჟი ხორციელდება შესაბამისი ნებართვის აღების გარეშე, საქართველოს მთავრობის დადგენილების 65-ე მუხლის პირველი პუნქტის „ყ“ ქვეპუნქტით გათვალისწინებული ვალდებულებისა და 66-ე მუხლით გათვალის­წი­ნე­ბუ­ლი პროცედურის დაცვით.     მუხლი 3🔗 ძალადაკარგულად გამოცხადდეს ყაზბეგის მუნიციპალიტეტის საკრებულოს 2011 წლის 12 ნოემბრის №31 დადგენილება ,,ყაზბეგის მუნიციპალიტეტის ტერიტორიაზე I კლასს დაქვემდებარებულ შენობა-ნაგე­ბო­ბა­თა სახეობებისა (რომელთა განთავსება/მშენებლობა მშენებლობის ნებართვის გარეშე იქნება შესაძლებელი) და პირობების განსაზღვრის შესახებ“.     მუხლი 4🔗 დადგენილების მოქმედება და პირობები ვრცელდება ყაზბეგის მუნიციპალიტეტის მთელ  ტერიტორიაზე, გუდაურის სარეკრიაციო ტერიტორიის გარდა.     მუხლი 5🔗 დადგენილება ძალაშია გამოქვეყნებისთანავე.  საკრებულოს თავმჯდომარე   გ.მალანია                                                                                                                            დანართი №1
