color:teal;} span.msoDel {mso-style-name:""; text-decoration:line-through; color:red;} /* Page Definitions */ @page Section1 {size:8.5in 11.0in; margin:1.0in 45.0pt 1.0in 1.25in;} div.Section1 {page:Section1;} /* List Definitions */ ol {margin-bottom:0in;} ul {margin-bottom:0in;} საქართველოს მთავრობის  დადგენილება №111 2010 წლის 24 აპრილი ქ. თბილისი საჯარო სამათლის იურიდიული პირის – სახელმწიფო შიდა კონტროლის ეროვნული ცენტრის წესდების დამტკიცების თაობაზე     მუხლი 1🔗. „სახელმწიფო შიდა აუდიტისა და ინსპექტირების შესახებ“ საქართველოს კანონის 30-ე მუხლის მე-3 პუნქტისა და „საჯარო სამართლის იურიდიული პირის – სახელმწიფო შიდა კონტროლის ეროვნული ცენტრის შექმნის შესახებ“ საქართველოს პრეზიდენტის 2010 წლის 7 აპრილის №215 ბრძანებულების მე-2 პუნქტის საფუძველზე, დამტკიცდეს საჯარო სამართლის იური­დიული პირის – სახელმწიფო შიდა კონტროლის ეროვნული ცენ­ტრის თანდართული წესდება.  მუხლი 2🔗.  დადგენილება ამოქმედდეს 2010 წლის 1 მაისიდან. პრემიერ-მინისტრი    ნ. გილაური საჯარო სამართლის იურიდიული პირის – სახელმწიფო შიდა კონტროლის ეროვნული ცენტრის წ ე ს დ ე ბ ა     მუხლი 1🔗. ზოგადი დებულებანი 1. საჯარო სამართლის იურიდიული პირი – სახელმწიფო ში­და კონტროლის ეროვნული ცენტრი (შემდგომში – ცენტრი) არის საჯარო სამართლის იურიდიული პირი, რომელიც შექმნი­ლია „სა­ხელმწიფო შიდა აუდიტისა და ინსპექტირების შესახებ“ საქარ­თველოს კანონის საფუძველზე და „საჯარო სამართლის იური­დიული პირის შესახებ“ საქართველოს კანონის შესაბამისად. 2. ცენტრი ახორციელებს „სახელმწიფო შიდა აუდიტისა და ინსპექტირების შესახებ“ საქართველოს კანონის მე-4 მუხლით გათვალისწინებული დაწესებულებების (შემდგომში – დაწესებუ­ლე­ბე­ბი) შიდა აუდიტის სუბიექტების და ფინანსური მართვისა და კონტროლის განმახორციელებელი სტრუქტურული ერთეულების საქმიანობის კოორდინაციასა და მონიტორინგს, უზრუნველყოფს და­წესებულებებში ფინანსური მარ­თ­ვი­სა და კონტროლის ჰარ­მო­ნიზაციას. 3. ცენტრი თავის საქმიანობას წარმართავს საქართველოს კონსტიტუციის, საერთაშორისო ხელშეკრულებებისა და შეთანხ­მებების, „საჯარო სამართლის იურიდიული პირის შესახებ“ სა­ქარ­თველოს კანონის, „სახელმწიფო შიდა აუდიტისა და ინსპექ­ტი­რების შესახებ“ საქართველოს კანონის, ამ წესდებისა და სხვა მოქმედი სამართლებრივი აქტების შესაბამისად. 4. ცენტრის სახელმწიფო კონტროლის განმახორციელებელი ორგანო არის საქართველოს ფინანსთა სამინისტრო (შემდგომში – სა­მინისტრო). 5. ცენტრს აქვს დამოუკიდებელი ბალანსი, ანგარიშები (მათ შორის, სავალუტო) სხვადასხვა საბანკო დაწესებულებებში, სიმ­ბო­ლიკა, მრგვალი ბეჭედი საქართველოს სახელმწიფო გერბის გამო­სახულებით და ცენტრის დასახელებით, სხვა ბეჭდები, შტამ­პები და საჯარო სამართლის იურიდიული პირის სხვა რეკ­ვი­ზი­ტები. 6. ცენტრი საკუთარი სახელით იძენს უფლებებსა და მოვა­ლე­ობებს, დებს გარიგებებს, თავისი სახელით გამოდის მესამე პი­რებ­თან ურთიერთობებში, ასევე სასამართლოში მოსარჩელედ ან/­და­ მოპასუხედ. 7. ცენტრის სრული სახელწოდებაა – „საჯარო სამართლის იუ­რი­დიული პირი – სახელმწიფო შიდა კონტროლის ეროვნული ცენტრი“ (ცენტრი უფლებამოსილია, გამოიყენოს შემოკ­ლე­ბული და­სახე­ლება „სახელმწიფო შიდა კონტროლის ეროვ­ნული ცენტ­რი“). 8. ცენტრის იურიდიული მისამართია: ქ. თბილისი, ვ. გორგას­ლის ქ. №16.     მუხლი 2🔗. ცენტრის მიზნები, ფუნქციები და საქმიანობის ძი­რი­თა­დი მიმართულებები 1. ცენტრის მიზნებია: ა) თავისი კომპეტენციის ფარგლებში, სახელმწიფო ფინან­სური მართვის, კონტროლისა და შიდა აუდიტის დარგობრივი კა­ნონმდებლობის სრულყოფა, მათი „სახელმწიფო შიდა აუდიტისა და ინსპექტირების შესახებ“ საქართველოს კანონთან და საერთა­შორისო სტანდარტებთან შესაბამისობაში მოყვანა; ბ) თავისი კომპეტენციის ფარგლებში, სახელმწიფო შიდა კონტროლისა და შიდა აუდიტის უწყებათაშორისი ჰარმონი­ზებუ­ლი სისტემის შექმნა და მისი მუდმივი განვითარების ხელშეწყობა; გ) შიდა აუდიტის, ფინანსური მართვისა და კონტროლის უწყვეტი გაუმჯობესებისა და საერთაშორისო სტანდარტებთან შე­სა­­ბამისობაში მოყვანის ხელშეწყობა მეთოდოლოგიების, ტრე­ნინ­­გების შემუშავებისა და განხორციელების გზით; დ) დაწესებულებებში შიდა აუდიტის სუბიექტების უწყვეტად ფუნქციონირების ხელშეწყობა, მათი საქმიანობის ხარისხის კონ­ტრო­ლი და კოორდინაცია; ე) შიდა აუდიტორთა პროფესიული უნარების ამაღლება; ვ) სახელმწიფო ფინანსური მართვის, კონტროლისა და შიდა აუ­დიტის სფეროში ქვეყნის საერთაშორისო ინტეგრაციის ხელშეწ­ყობა. 2. ცენტრი მოქმედი კანონმდებლობის შესაბამისად: ა) ახორციელებს შიდა აუდიტის სუბიექტებსა და ცალკეულ დაწესებულებებში ფინანსური მართვისა და კონტროლის განმა­ხორ­ციელებელი ერთეულების მუშაობის კოორდინირებას; ბ) სახელმწიფო შიდა აუდიტის, ფინანსური მართვისა და კონტროლის სფეროში შეიმუშავებს საერთაშორისო სტანდარ­ტების შესაბამის მეთოდოლოგიებს, სტანდარტებს, ინსტრუქ­ციებს, აუდიტორთა ეთიკის კოდექსს, აუდიტორთა პრაქტიკულ სა­ხელ­მძღვანელოებსა და მეთოდურ მითითებებს; გ) აწესებს შიდა აუდიტის, ფინანსური მართვისა და კონტ­როლის მინიმალურ სტანდარტებს შიდა აუდიტის განყოფი­ლებე­ბის კადრებით დაკომპლექტების, დამოუკიდებლობისა და კონფი­დენ­ციალურობის დაცვის, ინტერესთა კონფლიქტის თავიდან აცი­ლების, შიდა აუდიტის ჩატარებისა და ანგარიშების მომზა­დების ჩათვლით; დ) რეგულარულად გადასინჯავს შიდა აუდიტის მეთოდო­ლოგიასა და სტანდარტებს, უზრუნველყოფს მათ შესაბამისობას არსებულ კანონმდებლობასა და საერთაშორისო სტანდარტებთან ფინანსური მართვისა და კონტროლის, შიდა აუდიტის სფეროში მოქმედ საერთაშორისო ორგანიზაციებთან და საქართველოს კონ­ტ­როლის პალატასთან აქტიური თანამშრომლობის გზით; ე) ახორციელებს შიდა აუდიტის სუბიექტების საქმიანობის ანალიზსა და მუდმივ მონიტორინგს მისი მოქმედ კანონმდებლო­ბასთან, სახელმწიფო სტრატეგიულ და სამოქმედო გეგმებთან, სა­ერ­თაშორისო სტანდარტებთან, აუდიტის მეთოდოლოგიასა და სა­ხელმწიფო მიზნებთან შესაბამისობის უზრუნველყოფის მიზნით და შეიმუშავებს სათანადო ღონისძიებებს გამოვლენილი ნაკლოვა­ნებების გამოსასწორებლად/აღმოსაფხვრელად; ვ) საქართველოს ფინანსთა მინისტრთან (შემდგომში – მინისტრი) შეთანხმებით, შიდა აუდიტის სუბიექტების მონაწილე­ობით, უზრუნველყოფს სახელმწი­ფოში შიდა აუდიტის სამოქმედო გეგმის შემუშავებას/განახლებას და საქართველოს მთავრობისა­თ­ვის დასამტკიცებლად წარდგენას, ახორციელებს სამოქმედო გეგ­მის შესრულების მონიტორინგს; ზ) შიდა აუდიტის სუბიექტებთან კოორდინირებულად უზრუნ­ველყოფს სახელმწიფო სექტორის შიდა აუდიტის სუბიექტთა სტრა­ტე­გიული და ყოველწლიური გეგმების შემუშავებას/განახლე­ბას; თ) მინისტრთან შეთანხმებით წე­ლიწადში ერთხელ ან მოთ­ხოვნისამებრ, მოამზადებს და წა­რუდ­გენს საქართველოს მთავ­რო­ბას ანგარიშს სახელმწიფო ში­და კონ­ტროლისა და შიდა აუ­დიტის ფუნქციონირების შესახებ; ი) რეგულარულად შეისწავლის შიდა აუდიტის სუბიექტთა და­მოუკიდებლობის საკითხს და აცნობებს საქართველოს მთავრო­ბას, თუ არ არის უზრუნველყოფილი შიდა აუდიტის სუბიექტთა დამოუკიდებლობის ან/და მუშაობის ხარისხი; კ) მოამზადებს, განახორციელებს და უზრუნველყოფს შიდა აუდიტორთა, ასევე სახელმწიფო შიდა კონტროლისა და შიდა აუ­დიტის შესაბამისი დაწესებულების სხვა თანამშრომელთა რე­გუ­­ლარულ პროფესიულ განვითარებასა და ტრენინგს; ლ) უზრუნველყოფს სახელმწიფო შიდა ფინანსური კონ­ტრო­ლისა და შიდა აუდიტის სფეროში მოქმედი საერთაშორისო და სხვა სახელმწიფოების შიდა აუდიტის ორგანოებსა და ინსტი­ტუტებთან თანამშრომლობას, მოცემულ სფეროში საერთაშორისო ურთიერთობების დამყარებასა და კოორდინაციას; მ) ხელს უწყობს დაწესებულებებში შიდა აუდიტის სუბიექტების კომუნიკაციას; ნ) გასცემს რეკომენდაციებს დაწესებულებებში არსებული შიდა აუდიტის სუბიექტებისათვის შიდა აუდიტის, ფინანსური მარ­თვისა და კონტროლის სფეროში არსებული ცალკეული პრობლე­მატური საკითხების გადასაწყვეტად; ო) მონაწილეობს სახელმწიფო შიდა კონტროლისა და შიდა აუდიტის დარგობრივი კანონმდებლობის მუდმივი დახვეწის პრო­ცესში მისი საერთაშორისო სტანდარტებთან შესაბამისობის უზ­რუნ­ველყოფის მიზნით; პ) შეიმუშავებს და ინახავს შიდა აუდიტის სუბიექტების მო­ნა­ცემთა ბაზას; ჟ) შეიმუშავებს პრაქტიკულ სახელმძღვანელოებსა და მითი­თე­ბებს შიდა აუდიტის სუბიექტების დებულებების ჩამოყალიბე­ბისა და შემდგომი სრულყოფის მიზნით; რ) შეიმუშავებს და მინისტრს და­სამტკიცებლად წარუდგენს ინსტრუქციას ფინანსური მართვისა და კონტროლის სისტემის ჩამოყალიბების წესებისა და პროცედუ­რების შესახებ; ს) „სახელმწიფო შიდა აუდიტისა და ინსპექტირების შესახებ“ საქართველოს კანონის მოთხოვნების შესაბამისად, გამოსცემს მე­თოდურ მითითებებს ფინანსური მართვისა და კონტროლის კომ­­პო­ნენტების გათვალისწინებით; ტ) ახორციელებს „სახელმწიფო შიდა აუდიტისა და ინსპექ­ტი­რების შესახებ“ საქართველოს კანონის 29-ე მუხლის მე-2 პუნქ­ტის შესაბამისად შიდა აუდიტის სუბიექტების მიერ წარდგენილი წლი­ური ანგარიშის შედეგების შეჯამებას შიდა აუდიტის სუ­ბი­ექტების შემოწმების გზით, მათ საქმიანობაში არსებული ნაკლო­ვა­ნებების ანალიზს და მინისტრთან შე­თანხ­მებით საქართველოს მთავრობი­სათვის სათანადო ანგარი­შის წარდგენას; უ) „სახელმწიფო შიდა აუდიტისა და ინსპექტირების შესახებ“ საქართველოს კანონის 32-ე მუხლის მე-6 პუნქტის მოთხოვნათა შესაბამისად, ითანხმებს შიდა აუდიტის განხორციელების საკითხს იმ საჯარო სამართლის იურიდიულ პი­რებ­ში, სადაც არ შექმნილა საკუთარი შიდა აუდიტის სუბიექტები; ფ) ახორციელებს კანონმდებლობით მისთვის მინიჭებულ სხვა უფლებამოსილებებს.     მუხლი 3🔗. ცენტრის მართვა 1. ცენტრს მართავს ცენტრის უფროსი (შემდგომში – უფ­როსი), რომელსაც თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფლებს მინისტრი. 2. უფროსი მინიჭებულ უფლებამოსილებათა ფარგლებში მოქ­მედებს დამოუკიდებლად და პერსონალურად აგებს პასუხს ცენტ­რის საქმიანობის კანონმდებლობის მოთხოვნათა შესაბამისად წარ­­მარ­თვისათვის, ცენტრის საკუთრებაში არსებული ქონების დაც­­­ვისა და ფულადი სახსრების მიზნობრივი ხარჯვისათვის. 3. უფროსი: ა) ახორციელებს ცენტრის მართვას და წარმოადგენს ცენტრს მესამე პირებთან ურთიერთობაში; ბ) პასუხისმგებელია საქართველოს კონსტიტუციისა და სხვა სამართლებრივი აქტების შესრულებისათვის; გ) კომპეტენციის ფარგლებში გამოსცემს ინდივიდუალურ ადმინისტრაციულ-სამართლებრივ აქტებს; დ) ახორციელებს ცენტრის საერთო ხელმძღვანელობასა და აგვარებს მისი მმართველობის სფეროს მიკუთვნებულ საკით­ხებს; ე) თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფ­ლებს ცენტრის სტრუქტურული ქვედანაყოფების ხელმძღვანე­ლებ­სა და საშტატო ნუსხით გათვალისწინებულ სხვა თანამშ­რომ­ლებს, განსაზღვრავს მათი თანამდებობრივი სარგოს ოდენო­ბას; ვ) წყვეტს ცალკეული დაწესებულების შიდა აუდიტის სუბი­ექტის მიერ შემუშავებული დასკვნის, ანგარიშის ან/და მოხსენე­ბის ოფიციალურ ბეჭდვით ორგანოში გამოქვეყნების საკითხს; ზ) ანაწილებს მოვალეობებს ცენტრის თანამშრომლებს შო­რის, აძლევს მათ სათანადო მითითებებსა და დავალებებს, აკონტ­როლებს ცენტრის თანამშრომელთა მიერ სამსახურებრივი მოვა­ლეობების შესრულებას; თ) მინისტრს ყოველწლიურად დასა­მტკიცებლად წარუდგენს ანგარიშს ცენტრის მიერ გაწეული საქ­მიანობის შესახებ; ი) მინისტრთან შეთანხმებით წე­ლიწადში ერთხელ ან მოთ­ხოვნისამებრ, მოამზადებს და წარუდ­გენს საქართველოს მთავ­რობას ანგარიშს სახელმწიფო შიდა კონ­ტროლისა და შიდა აუდი­ტის ფუნქციონირების შესახებ; კ) მინისტრთან შეთანხმებით საქარ­თველოს მთავრობას წა­რუდგენს ინფორმაციას ცენტრის მიზნების მიღწევისა და მისი ფუნქციების შესრულების პროცესში განხორ­ციელებული პროექ­ტების, წინადადებებისა და დასკვნების შესა­ხებ; ლ) აცნობებს საქართველოს მთავრობას, თუ არ არის უზ­რუნ­­ველყოფილი შიდა აუდიტის სუბიექტთა დამოუკიდებლობის ან/და მუშაობის ხარისხი; მ) საქართველოს სახელმწიფო ბიუჯეტის შესაბამისად, სამი­ნისტროს წარუდგენს ცენტრის ხარჯთაღრიცხვას და ახორ­ციე­ლებს მისი შესრულების კონტროლს; ნ) სამინისტროსთან შეთანხმებით ამტკიცებს ცენტრის საშ­ტატო განრიგს, ხელფასის ფონდსა და ცენტრის შინაგანაწესს; ო) უფლებამოსილია, მოახდინოს მისთვის კანონმდებლობით მინიჭებული ცალკეული უფლებამოსილებების, მათ შორის, ფინან­სური საქმიანობის განხორციელების, დოკუმენტაციაზე ხელმოწე­რისა და წარმომადგენლობის, თანამშრომლის მივლინებაში ან/და შვებულებაში გაშვების უფლებამოსილების დელეგირება; პ) უფლებამოსილია, ცენტრის მიზნებიდან გამომდინარე, კონ­კ­რეტული სამუშაოს შესასრულებლად, შრომითი ხელშეკრუ­ლე­­ბის საფუძველზე აიყვანოს ცენტრის საშტატო განრიგით გა­უთ­ვალის­წი­ნებელი თანამშრომლები; ჟ) უფლებამოსილია, თანამშრომელთა მიმართ გამოიყენოს წა­­ხა­ლისებისა და დისციპლინური პასუხისმგებლობის ზომები; რ) ახორციელებს კანონმდებლობით მისთვის მინიჭებულ სხვა უფ­ლე­ბა­მოსი­ლებებს. 4. უფროსს ჰყავს მოადგილე, რომელსაც თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფლებს მინისტრი. მოადგი­ლის ფუნქციებს განსაზღვრავს უფროსი. 5. უფროსის არყოფნის შემთხვევაში მის უფლება-მოვა­ლეო­ბებს ასრულებს მისი მოადგილე. 6. უფროსს ჰყავს მრჩეველი, რომელსაც თანამდებობაზე ნიშ­ნავს და თანამდებობიდან ათავისუფლებს უფროსი. 7. ცენტრის სტრუქტურულ ქვედანაყოფს ხელმძღვანელობს სტრუქ­ტურული ქვედანაყოფის უფროსი, რომელსაც თანამდებო­ბაზე ნიშნავს და თანამდებობიდან ათავისუფლებს უფროსი. 8. სტრუქტურული ქვედანაყოფის უფროსი ანგარიშვალ­დებუ­ლია უფროსის ან უფროსის მოადგილის წინაშე. 9. სტრუქტურული ქვედანაყოფის უფროსი თავისი კომპეტენ­ციის ფარგლებში: ა) ხელმძღვანელობს და წარმართავს სტრუქტურული ქვედა­ნაყოფის საქმიანობას; ბ) წარმოადგენს სტრუქტურულ ქვედანაყოფს მასზე დაკის­რებული უფლება-მოვალეობების განხორ-ციელებისას; გ) წარუდგენს წინადადებებს უფროსს ან უფროსის მოად­გილეს ცალკეული საკითხების მოწესრიგებისა და გადაწყვეტის მიზნით; დ) წარუდგენს უფროსს წინადადებებს სტრუქტურული ქვე­დანაყოფის თანამშრომელთა წახალისებისა და მათთვის დის­ციპ­ლინური პასუხისმგებლობის დაკისრების შესახებ; ე) ასრულებს უფროსის და/ან უფროსის მოადგილის ცალკე­ულ მითითებებსა და დავალებებს; ვ) ახორციელებს კანონმდებლობით განსაზღვრულ სხვა ფუნ­ქ­­ციებს.     მუხლი 4🔗. ცენტრის სტრუქტურა ცენტრის სტრუქტურული ქვედანაყოფებია: ა) შიდა აუდიტის სუბიექტების კოორდინაციის, ზედამხედვე­ლობისა და მეთოდოლოგიის სამსახური; ბ) ფინანსური მართვისა და კონტროლის მონიტორინგის სამ­სახური; გ) საერთაშორისო ურთიერთობის, სასწავლო პროგრამებისა და სტრატეგიული დაგეგმვის სამსახური; დ) ადმინისტრაციული სამსახური.     მუხლი 5🔗. ცენტრის სტრუქტურული ქვედანაყოფების ფუნქ­ცი­ე­ბი და ამოცანები 1. შიდა აუდიტის სუბიექტების კოორდინაციის, ზედამხედვე­ლო­ბისა და მეთოდოლოგიის სამსახური: ა) ახორციელებს შიდა აუდიტის სუბიექტების მუშაობის კო­ორ­დინირებას; ბ) სახელმწიფო შიდა აუდიტის სფეროში შეიმუშავებს საერ­თაშორისო სტანდარტებთან შესაბამის მეთოდოლოგიებს, სტან­დარ­ტებს, ინსტრუქციებს, აუდიტორთა ეთიკის კოდექსს, აუდი­ტორთა პრაქტიკულ სახელმძღვანელოებსა და მეთოდურ მითითე­ბებს; გ) ახორციელებს შიდა აუდიტის სფეროში საერთაშორისო სტანდარტების მონიტორინგს და უზრუნველყოფს შიდა აუდიტის სუბიექტების დროულ ინფორმირებას ცვლილებების შესახებ; დ) უზრუნველყოფს სახელმწიფო შიდა აუდიტისა და შიდა კონტროლის საკითხების თაობაზე საქართველოს კონტროლის პა­ლატასთან თანამშრომლობას; ე) აწესებს შიდა აუდიტის სტანდარტებს შიდა აუდიტის განყოფილებების კადრებით დაკომპლექტების, დამოუკიდებლობისა და კონფიდენციალურობის დაცვის, ინტერესთა კონფლიქტის თა­ვიდან აცილების, შიდა აუდიტის ჩატარებისა და ანგარიშების მომ­ზადების ჩათვლით; ვ) რეგულარულად გადასინჯავს შიდა აუდიტის მეთოდო­ლოგიასა და სტანდარტებს; უზრუნველყოფს მათ შესაბამისობას არსებულ კანონმდებლობასა და საერთაშორისო სტანდარ­ტებ­თან ფინანსური მართვისა და კონტროლის, შიდა აუდიტის სფე­როში მოქმედ საერთაშორისო ორგანიზაციებთან და საქართვე­ლოს კონ­ტროლის პალატასთან აქტიური თანამშრომლობის გზით; ზ) ახორციელებს შიდა აუდიტის სუბიექტების საქმიანობის ანალიზსა და მუდმივ მონიტორინგს მისი მოქმედ კანონმდებ­ლობასთან, სახელმწიფო სტრატეგიულ და სამოქმედო გეგმებთან, საერთაშორისო სტანდარტებთან, აუდიტის მეთოდოლოგიასა და სახელმწიფო მიზნებთან შესაბამისობის უზრუნველყოფის მიზნით და შეიმუშავებს სათანადო ღონისძიებებს გამოვლენილ ნაკლოვა­ნებათა გამოსასწორებლად/აღმოსაფხვრელად; თ) რეგულარულად შეისწავლის შიდა აუდიტის სუბიექტების დამოუკიდებლობის საკითხს და თუ შიდა აუდიტის სუბიექტების დამოუკიდებლობის ან/და მუ­შაობის ხარისხი არ არის უზრუნ­ველ­ყოფილი, ცენტრი აღნიშნულის თაობაზე აცნობებს საქართველოს მთავრო­ბას; ი) ხელს უწყობს დაწესებულებებში შიდა აუდიტის სუბი­ექტების კომუნიკაციას; კ) გასცემს რეკომენდაციებს დაწესებულებებში არსებული შიდა აუდიტის სუბიექტებისათვის შიდა აუდიტის სფეროში არსე­ბუ­ლ ცალკეულ პრობლემატურ საკითხთა გადასაწყვეტად; ლ) მონაწილეობს სახელმწიფო შიდა კონტროლისა და შიდა აუდიტის დარგობრივი კანონმდებლობის მუდმივი დახვეწის პრო­ცესში მისი საერ­თაშორისო სტანდარტებთან შესაბამისობის უზ­რუნ­ველყოფის მიზნით. 2. ფინანსური მართვისა და კონტროლის მონიტორინგის სამ­სა­ხური: ა) აწესებს ფინანსური მართვისა და კონტროლის მინიმალურ სტანდარტებს ფინანსური მართვისა და კონტროლის განმახორ­ციე­ლებელი განყოფილებების კადრებით დაკომპლექტების, დამოუ­კი­დებ­ლობისა და კონფიდენციალურობის დაცვის, ინტერესთა კონ­ფლიქტის თავიდან აცილების, შიდა აუდიტის ჩატარებისა და ან­გა­რი­შების მომზადების ჩათვლით; ბ) რეგულარულად გადასინჯავს ფინანსური მართვისა და კონტროლის მეთოდოლოგიასა და სტანდარტებს; უზრუნველყოფს მათ შესაბამისობას არსებულ კანონმდებლობასა და საერთა­შორისო სტანდარტებთან ფინანსური მართვისა და კონტროლის სფეროში მოქმედ საერთაშორისო ორგანიზაციებთან და საქარ­თველოს კონტროლის პალატასთან აქტიური თანამშრომლობის გზით; გ) ახორციელებს ცენტრის შიდა წესების მუდმივ მონიტო­რინგს ფინანსური მართვისა და კონტროლის სფეროში; დ) ახორციელებს ცალკეულ დაწესებულებებში ფინანსური მართვისა და კონტროლის განმახორციელებელი ერთეულების მუ­შაობის კოორდინირებას; ე) სახელმწიფო ფინანსური მართვისა და კონტროლის სფე­როში შეიმუშავებს საერთაშორისო სტანდარტებთან შესაბამის მე­თო­დოლოგიებს, სტანდარტებს, ინსტრუქციებს, აუდიტორთა ეთი­კის კოდექსს, აუდიტორთა პრაქტიკულ სახელმძღვანელოებსა და მეთოდურ მითითებებს; ვ) ახორციელებს ფინანსური მართვისა და კონტროლის გან­მახორციელებელი ერთეულების საქმიანობის ანალიზსა და მუდ­მივ მონიტორინგს მისი მოქმედ კანონმდებლობასთან, სახელმწიფო სტრატეგიულ და სამოქმედო გეგმებთან, საერთაშორისო სტანდარ­ტებთან, აუდიტის მეთოდოლოგიასა და სახელმწიფო მიზნებთან შესაბამისობის უზრუნველყოფის მიზნით და შეიმუშავებს სათანა­დო ღონისძიებებს გამოვლენილ ნაკლოვანებათა გამოსასწორებ­ლად/აღმოსაფხვრელად; ზ) გასცემს რეკომენდაციებს დაწესებულებებში არსებული შიდა აუდიტის სუბიექტებისათვის ფინანსური მართვისა და კონ­ტროლის სფეროში არსებული ცალკეული პრობლემატური საკით­ხების გადასაწყვეტად; თ) შეიმუშავებს და მინისტრს დასა­მტკიცებლად წარუდგენს ინსტრუქციას ფინანსური მართვისა და კონტროლის სისტემის ჩამოყალიბების წესებისა და პროცედუ­რების შესახებ; ი) „სახელმწიფო შიდა აუდიტისა და ინსპექტირების შესახებ“ საქართველოს კანონის მოთხოვნების შესაბამისად შეიმუშავებს მე­თოდურ მითითებებს ფინანსური მართვისა და კონტროლის კომ­პონენტების გათვალისწინებით. 3. საერთაშორისო ურთიერთობის, სასწავლო პროგრამებისა და სტრატეგიული დაგეგმვის სამსახური: ა) ახორციელებს დისკუსიების, თემატური სემინარებისა და კონფერენციების ორგანიზებას დაინტერესებული პირების, ორგა­ნი­ზა­ციებისა და დაწესებულებებისათვის; ბ) ახორციელებს შიდა აუდიტის სფეროში პრეზენტაციების, სემინარების, ტრენინგებისა და შიდა აუდიტორთა პროფესიული ცნობიერების ამაღლებისაკენ მიმართული სემინარების მომზადე­ბასა და ჩატარებას; გ) მინისტრთან შეთანხმებით, შიდა აუდიტის სუბიექტების მონაწილეობით, უზრუნველყოფს სახელმწი­ფოში შიდა აუდიტის სამოქმედო გეგმის შემუშავებას/განახლებას და საქართველოს მთავ­რობისათვის დასამტკიცებლად წარდგენას; განახორციელებს სამოქმედო გეგმის შესრულების მონიტორინგს; დ) შიდა აუდიტის სუბიექტებთან კოორდინირებულად უზრუნ­ველყოფს სახელმწიფო სექტორის შიდა აუდიტის სუბიექტების სტრა­ტეგიული და ყოველწლიური გეგმების შემუშავებას/განახლე­ბას; ე) მინისტრთან შეთანხმებით, წე­ლიწადში ერთხელ ან მოთ­ხოვნისამებრ, ამზადებს ანგარიშს სახელმწიფო შიდა კონ­ტრო­ლი­სა და შიდა აუდიტის ფუნქციონირების შესახებ, რომელსაც ცენ­ტრი წარუდ­გენს საქართველოს მთავრობას; ვ) მოამზადებს, განახორციელებს და უზრუნველყოფს შიდა აუდიტორთა, ასევე სახელმწიფო შიდა კონტროლისა და შიდა აუდიტის შესაბამისი დაწესებულების სხვა თანამშრომელთა რე­გუ­ლარულ პროფესიულ განვითარებასა და ტრენინგს; ზ) უზრუნველყოფს სახელმწიფო შიდა ფინანსური კონტრო­ლისა და შიდა აუდიტის სფეროში მოქმედი საერთაშორისო და სხვა სახელმწიფოების შიდა აუდიტის ორგანოებსა და ინსტიტუ­ტებთან თანამშრომლობას, მოცემულ სფეროში საერთაშორისო ურ­თი­ერთობების დამყარებასა და კოორდინაციას; თ) შეიმუშავებს და ინახავს შიდა აუდიტის სუბიექტების მონაცემთა ბაზას; ი) შეიმუშავებს პრაქტიკულ სახელმძღვანელოებსა და მითი­თებებს შიდა აუდიტის სუბიექტების დებულებების ჩამოყალი­ბებისა და შემდგომი სრულყოფის მიზნით; კ) ახორციელებს „სახელმწიფო შიდა აუდიტისა და ინსპექ­ტირების შესახებ“ საქართველოს კანონის 29-ე მუხლის მე-2 პუნქ­ტის შესაბამისად შიდა აუდიტის სუბიექტების მიერ წარდგენილი წლიური ანგარიშის შედეგების შეჯამებას შიდა აუდიტის სუ­ბიექ­ტების შემოწმების გზით, მათ საქმიანობაში არსებული ნაკ­ლო­­ვანებების ანალიზს და ამზადებს ანგარიშს, რომელსაც ცენტ­რი მინისტრთან შე­თანხმებით წარუდ­გენს საქართველოს მთავრო­ბას; ლ) „სახელმწიფო შიდა აუდიტისა და ინსპექტირების შესა­ხებ“ საქართველოს კანონის 32-ე მუხლის მე-6 პუნქტის მოთ­ხოვ­ნათა შესაბამისად ითანხმებს შიდა აუდიტის განხორ­ციე­ლე­ბის საკ­ითხს იმ საჯარო სამართლის იურიდიულ პი­რებ­ში, სა­დაც არ შექმ­ნი­ლა საკუთარი შიდა აუდიტის სუბიექტები. 4. ადმინისტრაციული სამსახური: ა) ახორციელებს შემოსავლებისა და ხარჯების დაგეგმვასა და წლიური ხარჯთაღრიცხვის მომზადებას; ბ) ახორციელებს ფინანსური ანგარიშების მომზადებას, ბუ­ღალ­ტრული აღრიცხვის წარმოებას მოქმედი კანონმდებლობის შე­სა­­ბამისად, კომერციული საქმიანობიდან მიღებული შემოსავ­ლების, საბიუჯეტო და არასაბიუჯეტო სახსრების ოპერაციების აღრიცხ­ვასა და კონტროლს; გ) უზრუნველყოფს ცენტრის პერსონალის მართვისა და საქ­მისწარმოების ორგანიზაციას, მატერიალურ-ტექნიკურ უზრუნველ­ყო­ფას, ცენტრის ფუნქციონირებისათვის საჭირო შესყიდვების და­გეგმვასა და განხორციელებას; დ) ახორციელებს ცენტრის მიმდინარე საქმიანობის სამარ­თლებ­რივ უზრუნველყოფას; ე) უზრუნველყოფს შესაბამისი მინდობილობის საფუძველზე ცენტრის წარმომადგენლობას საქართველოს სასამართლოებში; ვ) კომპეტენციის ფარგლებში ახორციელებს შესაბამისი სა­მარ­თლებრივი აქტების პროექტების მომზადებას; ზ) ახორციელებს სახელმწიფო საიდუმლოებას მიკუთვნე­ბუ­ლი კორესპონდენციის საქმისწარმოებას; თ) წარმართავს საარქივო საქმიანობას; ი) უზრუნველყოფს ცენტრის საზოგადოებასთან ურთიერ­თო­ბას;  კ) უზრუნველყოფს ცენტრში მიმდინარე პროცესებთან და­კავშირებული ოფიციალური შეტყობინებების, განცხადებებისა და სხვა საინფორმაციო მასალების მომზადებასა და საჭიროების შემ­თხვევაში, საინფორმაციო საშუალებებისათვის მიწოდებას; ლ) უზრუნველყოფს საჯარო ინფორმაციის ხელმისაწვდო­მო­ბას; მ) უზრუნველყოფს მოქალაქეთა მიღების კოორდინაციას; ნ) ასრულებს ცენტრის უფროსის სხვა დავალებებს.     მუხლი 6🔗. ცენტრის ქონება და დაფინანსების წყარო 1. ცენტრი თავისი საქმიანობისა და დაკისრებული ფუნქ­ციე­ბის განსახორციელებლად ფლობს ქონებას, რომელიც ფორ­მირ­დება: ა) სამინისტროს წინადადებით, საქართველოს ეკონომიკური განვითარების სამინისტროს მიერ უსასყიდლო უზუფრუქტისა და თხოვების ფორმით გადაცემული ქონებისაგან; ბ) საქართველოს კანონმდებლობის შესაბამისად მიღებული სხვა ქონებისაგან. 2. ცენტრის დაფინანსების წყაროებია: ა) შესაბამისი ბიუჯეტიდან გამოყოფილი მიზნობრივი სახს­რები; ბ) სახელმწიფო შეკვეთის შესრულების შედეგად მიღებული შემო­სავ­ლები; გ) მიზნობრივი კრედიტები და გრანტები; დ) ხელშეკრულების საფუძველზე შესრულებული სამუშაოსა და მომსახურების გაწევით მიღებული შემოსავლები; ე) დამხმარე სამეწარმეო საქმიანობიდან მიღებული შემოსავ­ლები; ვ) საქართველოს კანონმდებლობით ნებადართული სხვა შე­მო­სავლები. 3. ცენტრის მიერ მიღებული ამ მუხლის მე-2 პუნქტით გათვალისწინებული სახსრები და შემოსავლები მთლიანად ხმარ­დება ცენტრის მიზნებისა და ფუნქციების განხორციელებას.     მუხლი 7🔗. ცენტრის საქმიანობის აღრიცხვა და საბუღალტრო ანგარიშგება 1. ცენტრი ახორციელებს საფინანსო-ეკონომიკური საქმიანო­ბის აღრიცხვასა და ანგარიშგებას საქართველოს მოქმედი კანონ­მდებლობის შესაბამისად. 2. ცენტრის პირველი საფინანსო წელი იწყება, საქართველოს კანონმდებლობის შესაბამისად, მისი უფლებაუნარიანობის წარმო­შობის მომენტიდან და მთავრდება იმავე კალენდარული წლის 31 დეკემბერს. შემდეგი საფინანსო წლები ემთხვევა კალენდარულს. 3. ყოველწლიურად ან მოთხოვნისთანავე ცენტრი მინისტრს წარუდგენს ფინანსურ ანგარიშს. 4. ცენტრის წლიურ ბალანსს ამოწმებს სამინისტროს მიერ დანიშნული დამოუკიდებელი აუდიტორი, რომლის სათანადო ხარ­ჯებს აანაზღაურებს ცენტრი.     მუხლი 8🔗. ცენტრის საქმიანობის სახელმწიფო კონტროლი 1. ცენტრი ექვემდებარება სახელმწიფო კონტროლს, რაც გუ­ლისხმობს მის მიერ განხორციელებული საქმიანობის კანონიე­რების, მიზანშეწონილობის, ეფექტიანობისა და საფინანსო-ეკონო­მი­კური საქმიანობის ზედამხედველობას. 2. ცენტრის საქმიანობის სახელმწიფო კონტროლს ახორციე­ლებს სამინისტრო. 3. ცენტრი ვალდებულია, კონტროლის განსახორციელებლად მინისტრს მოთხოვნისთანავე წარუდგინოს შესაბამისი ინფორმაცია და მასალები. 4. მინისტრი უფლებამოსილია, შეაჩეროს ან გააუქმოს უფრო­სის (ცენტრის) არამართლზომიერი გადაწყვეტილება. 5. ცენტრს სამინისტროს თანხმობით შეუძლია განახორ­ციე­ლოს: ა) უძრავი ქონების შეძენა, გასხვისება და დატვირთვა; ბ) სესხის აღება; გ) თავდებობა; დ) საშტატო განრიგისა და ხელფასის ფონდის განსაზღვრა; ე) ცენტრის თანამშრომელთა მატერიალური წახალისები­სათ­ვის გამოსაყოფი სახსრების, აგრეთვე ცენტრის მიერ შესაძენი საწ­ვა­ვისა და გასაწევი საკომუნიკაციო ხარჯების ლიმიტების გან­საზღვრა; ვ) სხვა გადაწყვეტილებები ცენტრის ქონებასთან დაკავში­რებით, თუ ისინი სცილდება ჩვეულებრივი საქმიანობის ფარგ­ლებს.     მუხლი 9🔗. ცენტრის რეორგანიზაცია და ლიკვიდაცია ცენტრის რეორგანიზაცია და ლიკვიდაცია ხორციელდება სა­ქარ­თველოს მოქმედი კანონმდებლობით დადგენილი წესით.     მუხლი 10🔗. წესდებაში ცვლილებებისა და დამატებების შეტა­ნის წესი ცენტრის წესდების ან მისი ნაწილის ძალადაკარგულად გა­მოც­ხადება, მასში ცვლილებებისა და დამატებების შეტანა ხორ­ციელდება საქართველოს მთავრობის დადგენილების საფუძველზე.
