text-decoration:line-through; color:red;} /* Page Definitions */ @page Section1 {size:595.35pt 842.0pt; margin:85.05pt 46.35pt 27.0pt 70.9pt;} div.Section1 {page:Section1;} /* List Definitions */ ol {margin-bottom:0in;} ul {margin-bottom:0in;} საქართველოს მთავრობის დადგენილება №23 2010 წლის 27 იანვარი  ქ. თბილისი რეგულარული საერთაშორისო საჰაერო მიმოსვლის განსახორციელებლად საქართველოში რეგისტრირებული ავიაგადამზიდველისათვის რეგულარული საერთაშორისო საჰაერო გადამზიდველის სტატუსის მინიჭების (დანიშვნის), დანიშნულ ავიაგადამზიდველებზე ფრენის სიხშირეების განაწილებისა და უცხო სახელმწიფოს მიერ დანიშნული ავიაგადამზიდველის აღიარების წესის შესახებ     მუხლი 1🔗. საქართველოს საჰაერო კოდექსის 52-ე მუხლის პირველი ნაწილის შესაბამისად დამტკიცდეს რეგულარული საერთაშორისო საჰაერო მიმოსვლის განსახორციელებლად საქართველოში რეგისტრირებული ავიაგადამზიდველისათვის რეგულარული საერთაშორისო საჰაერო გადამზიდველის სტატუსის მინიჭების (დანიშვნის), დანიშნულ ავიაგადამზიდველებზე ფრენის სიხშირეების განაწილებისა და უცხო სახელმწიფოს მიერ დანიშნული ავიაგადამზიდველის აღიარების თანდართული წესი.     მუხლი 2🔗. დადგენილება ამოქმედდეს 2010 წლის 25 იანვრიდან. პრემიერ-მინისტრი ნ. გილაური რეგულარული საერთაშორისო საჰაერო მიმოსვლის განსახორციელებლად საქართველოში რეგისტრირებული ავიაგადამზიდველისათვის რეგულარული საერთაშორისო საჰაერო გადამზიდველის სტატუსის მინიჭების (დანიშვნის), დანიშნულ ავიაგადამზიდველებზე ფრენის სიხშირეების განაწილებისა და უცხო სახელმწიფოს მიერ დანიშნული ავიაგადამზიდველის აღიარების წესი თავი I ზოგადი დებულებები     მუხლი 1🔗. წესის მოქმედების სფერო და მიზანი 1. რეგულარული საერთაშორისო საჰაერო მიმოსვლის განსახორციელებლად საქართველოში რეგისტრირებული ავიაგადამზიდველისათვის რეგულარული საერთაშორისო საჰაერო გადამზიდველის სტატუსის მინიჭების (დანიშვნის), დანიშნულ ავიაგადამზიდველებზე ფრენის სიხშირეების განაწილებისა და უცხო სახელმწიფოს მიერ დანიშნული ავიაგადამზიდველის აღიარების წესი (შემდგომში – წესი) არეგულირებს საქართველოდან რეგულარული საერთაშორისო საჰაერო მიმოსვლის (გადაყვანა-გადაზიდვის) განსახორციე-ლებლად საქართველოში რეგისტრირებული ავიაგადამზიდველის დანიშვნასთან, დანიშნულ ავიაგადამზიდვე-ლებზე ფრენის სიხშირეების განაწილებასა და საქართველოში რეგულარული საერთაშორისო საჰაერო მიმოსვლის განსახორციელებლად უცხო სახელმწიფოს მიერ დანიშნული ავიაგადამზიდველის აღიარებასთან დაკავშირებულ სამართლებრივ ურთიერთობებს, განსაზღვრავს დანიშვნის, ფრენის სიხშირეების განაწილებისა და აღიარების განმახორციელებელ ორგანოს და მის კომპეტენციას, დანიშნული ან აღიარებული ავიაგადამ-ზიდველის უფლებამოსილებას. 2. მწესის მიზანია საქართველოდან/საქართველოში რეგულარული საერთაშორისო საჰაერო მიმოსვლის განხორციელებასთან დაკავშირებული საკითხების სამართლებრივი მოწესრიგება.     მუხლი 2🔗. ტერმინები და განმარტებები ამ წესში გამოყენებული ტერმინების მნიშვნელობებია: ა) ავიაგადამზიდველის დანიშვნა – საჰაერო მიმოსვლის შესახებ საქართველოსა და შესაბამის უცხო სახელმწიფოს შორის დადებული საერთაშორისო ხელშეკრულების (შემდგომში – საერთაშორისო ხელშეკრულება) ან ამ წესის მე-3 მუხლის პირველი პუნქტის „ბ.ბ“ ქვეპუნქტით დადგენილი პირობებისა და ამ წესის შესაბამისად, კონკრეტულ საერთაშორისო საჰაერო ხაზზე საქართველოს რეგიონული განვითარებისა და ინფრასტრუქტურის სამინისტროს (შემდგომში – სამინისტრო) სახელმწიფო საქვეუწყებო დაწესებულების – ერთიანი სატრანსპორტო ადმინისტრაციის (შემდგომში – ადმინისტრაცია) მიერ, საქართველოს ავიაგადამზიდველისათვის რეგულარული საერთაშორისო საჰაერო გადამზიდველის სტატუსის მინიჭება და აღნიშნულის თაობაზე საქართველოს საგარეო საქმეთა სამინისტროს მეშვეობით საერთაშორისო ხელშეკრულებით გათვალისწინებული პირობებით ამ შესაბამისი უცხო სახელმწიფოს წერილობით ინფორმირება; ბ) შესაბამისი უცხო სახელმწიფო – სახელმწიფო, რომელთანაც საქართველოს დადებული აქვს საერთაშორისო ხელშეკრულება, რომელიც ითვალისწინებს საქართველოსა და ამ სახელმწიფოს სამოქალაქო აეროპორტებს შორის რეგულარული საერთაშორისო საჰაერო გადაყვანა-გადაზიდვის განხორციელების წესსა და პირობებს; გ) ავიაგადამზიდველის აღიარება – ადმინისტრაციის მიერ ამ წესით დადგენილი მოთხოვნების შესაბამისად უცხო ქვეყნის ავიაგადამზიდველის სტატუსის აღიარება; დ) დანიშვნის თარიღი – ადმინისტრაციის მიერ, დანიშვნასთან დაკავშირებით შესაბამისი უცხო სახელმწიფოს საავიაციო ხელისუფლებისათვის გაგზავნილ წერილში მითითებული თარიღი; ე) დანიშვნის მაძიებელი – საქართველოს ავიაგადამზიდველი, რომელსაც ადმინისტრაციაში წარდგენილი აქვს განცხადება რეგულარული საერთაშორისო საჰაერო გადამზიდველის სტატუსის მიღების თაობაზე; ვ) სიხშირის მაძიებელი – საქართველოს ავიაგადამზიდველი, რომელსაც ამ წესის შესაბამისად მინიჭებული აქვს რეგულარული საერთაშორისო საჰაერო გადამზიდველის სტატუსი და ადმინისტრაციაში წარდგენილი აქვს განცხადება ფრენის სიხშირის მიღების შესახებ; ზ) აღიარების მაძიებელი – უცხო ქვეყნის ავიაგადამზიდველი, რომელსაც ადმინისტრაციაში წარდგენილი აქვს განცხადება აღიარებასთან დაკავშირებით; თ) შეზღუდვა – თ.ა) საერთაშორისო ხელშეკრულების შესაბამისად დადგენილი პირობა ფრენის სიხშირ(ეებ)ისა და/ან დანიშნული ავიაგადამზიდველ(ებ)ის კონკრეტული რაოდენობის თაობაზე; თ.ბ) საერთაშორისო ხელშეკრულებით განსაზღვრული პირობების შესაბამისად საქართველოსა და შესაბამისი უცხო სახელმწიფოს საავიაციო ხელისუფლებებს შორის გაფორმებული ხელშეკრულება ფრენის სიხშირეების კონკრეტული რაოდენობის შესახებ; ი) მოთხოვნა – ი.ა) დანიშნულ ავიაგადამზიდველთა რაოდენობის შესახებ – დანიშვნის პირველი მაძიებლის მიერ ადმინისტრაციაში წარდგენილი განცხადებიდან ადმინისტრაციის მიერ რეგულარული საერთაშორისო საჰაერო გადამზიდველის სტატუსის მინიჭების თაობაზე გადაწყვეტილების მიღებამდე პერიოდში დანიშვნის მაძიებელთა რაოდენობა; ი.ბ) ფრენის სიხშირეთა რაოდენობის შესახებ – სიხშირის პირველი მაძიებლის მიერ ადმინისტრაციაში წარდგენილი განცხადებიდან, ადმინისტრაციის მიერ ფრენის სიხშირეების განაწილების თაობაზე გადაწყვეტილების მიღებამდე პერიოდში სიხშირის მაძიებელთა მიერ მოთხოვნილი ფრენის სიხშირეთა ჯამური რაოდენობა; კ) ფრენის სიხშირე – კვირაში რეგულარული საჰაერო მიმოსვლების რაოდენობა; ლ) დანიშნული ავიაგადამზიდველი – საქართველოს ავიაგადამზიდველი, რომელსაც საერთაშორისო ხელშეკრულებით დადგენილი პირობებისა და ამ წესის შესაბამისად კონკრეტულ საერთაშორისო საჰაერო ხაზზე მინიჭებული აქვს რეგულარული საერთაშორისო საჰაერო გადამზიდველის სტატუსი; მ) უცხო ქვეყნის ავიაგადამზიდველი – შესაბამის უცხო სახელმწიფოში რეგისტრირებული ავიაგადამზიდველი, რომელსაც საერთაშორისო ხელშეკრულებით დადგენილი პირობების შესაბამისად კონკრეტულ საერთაშორისო საჰაერო ხაზზე მინიჭებული აქვს რეგულარული საერთაშორისო საჰაერო გადამზიდველის სტატუსი; ნ) ავიაგადამზიდველი – საჰაერო გადამყვან-გადამზიდველი; ო) საქართველოს ავიაგადამზიდველი – საქართველოში რეგისტრირებული ავიაგადამზიდველი;  პ) რეგულარული საჰაერო მიმოსვლა (გადაყვანა-გადაზიდვა) – მრავალჯერადი კომერციული სა-ჰაერო გადაყვანა-გადაზიდვა, რომელიც სრულდება გამოცხადებული განრიგის შესაბამისად, და რომლით სარგებლობის უფლებაც აქვს ნებისმიერ მომხმარებელს;  ჟ) რეისის ჩაშლა – დანიშნული ავიაგადამზიდველის მიერ ადმინისტრაციის მიერ დამტკიცებული ფრენის განრიგით გათვალისწინებული რეისის შეუსრულებლობა განრიგით გათვალისწინებული დროიდან 12 საათის განმავლობაში.     მუხლი 3🔗. ზოგადი დებულებები 1. საქართველოდან/საქართველოში რეგულარული საერთაშორისო საჰაერო მიმოსვლა ხორციელდება: ა) საერთაშორისო ხელშეკრულებით დადგენილი პირობების შესაბამისად; ბ) საერთაშორისო ხელშეკრულების არარსებობის შემთხვევაში, „საერთაშორისო სამოქალაქო ავიაციის შესახებ“ ჩიკაგოს 1944 წლის კონვენციის მე-6 მუხლის („რეგულარული საჰაერო მიმოსვლა“) შესაბამისად: ბ.ა) უცხო სახელმწიფოში რეგისტრირებული ავიაგადამზიდველის მიერ საქართველოში ფრენების განხორციელებისას – სამინისტროს მიერ დადგენილი პირობ(ებ)ით; ბ.ბ) საქართველოში რეგისტრირებული ავიაგადამზიდველის მიერ უცხო სახელმწიფოში ფრენების განხორციელებისას – ამ უცხო სახელმწიფოს კომპეტენტური ორგანოს მიერ დადგენილი პირობებით. 2. საქართველოდან უცხო სახელმწიფოში რეგულარული საერთაშორისო საჰაერო მიმოსვლის განხორციელების უფლება კონკრეტულ საერთაშორისო საჰაერო ხაზზე აქვს მხოლოდ: ა) ამ წესის შესაბამისად დანიშნულ საქართველოს ავიაგადამზიდველს; ბ) საერთაშორისო ხელშეკრულებაში რეგულარული საერთაშორისო საჰაერო მიმოსვლის (გადაყვანა-გადაზიდვის) განსახორციელებლად რეგულარული საერთაშორისო საჰაერო გადამზიდველის სტატუსის მინიჭების (დანიშვნის) მოთხოვნის არარსებობისას კი – საქართველოს ავიაგადამზიდველს, რომელიც აკმაყოფილებს ამ წესის მე-3 მუხლის მე-10 პუნქტის „ბ“ ქვეპუნქტით გათვალისწინებულ მოთხოვნებს. 3. უცხო სახელმწიფოდან საქართველოში რეგულარული საერთაშორისო საჰაერო მიმოსვლის განხორციელების უფლება კონკრეტულ საერთაშორისო საჰაერო ხაზზე აქვს მხოლოდ უცხო ქვეყნის ავიაგადამზიდველს, რომელიც: ა) აღიარებულია ადმინისტრაციის მიერ ამ წესის VI თავის შესაბამისად; ბ) საერთაშორისო ხელშეკრულებაში რეგულარული საერთაშორისო საჰაერო მიმოსვლის (გადაყვანა-გადაზიდვის) განსახორციელებლად რეგულარული საერთაშორისო საჰაერო გადამზიდველის სტატუსის მინიჭების (დანიშვნის) მოთხოვნის არარსებობისას აკმაყოფილებს ამ წესის მე-3 მუხლის მე-10 პუნქტის „ა“ ქვეპუნქტით გათვალისწინებულ მოთხოვნებს. 4. საერთაშორისო ხელშეკრულებაში ან ამ მუხლის პირველი პუნქტის „ბ.ბ“ ქვეპუნქტით გათვალისწინებულ პირობებში შეზღუდვის არსებობისას საქართველოში რეგისტრირებული ავიაგადამზიდ-ველის დანიშვნა და/ან ფრენის სიხშირეების განაწილება ხორციელდება ამ წესის III თავის შესაბამისად. 5. საერთაშორისო ხელშეკრულებაში ან ამ მუხლის პირველი პუნქტის „ბ.ბ“ ქვეპუნქტით გათვალის-წინებულ პირობებში შეზღუდვის არარსებობის შემთხვევაში დანიშვნა და/ან ფრენის სიხშირეების განაწილება ხორციელდება ამ წესის II თავის შესაბამისად. 6. დანიშვნას/აღიარებას/ფრენის სიხშირეების განაწილებას, აგრეთვე დანიშვნაზე/აღიარებაზე/ფრენის სიხშირეების განაწილებაზე უარის თქმას ან დანიშვნის/აღიარების გაუქმებას ახორციელებს ადმინისტრაცია, ამ წესით განსაზღვრული მოთხოვნების შესაბამისად. 7. ამ წესით განსაზღვრული მოთხოვნების დაცვის ზედამხედველობას ახორციელებს ადმინისტრაცია, კანონმდებლობით დადგენილი წესით. 8. კონკრეტულ საერთაშორისო საჰაერო ხაზზე შეზღუდვის არსებობისას პირველივე დანიშვნის/სიხშირის მაძიებლის მიერ ადმინისტრაციაში განცხადების წარდგენისას, ასევე ამ წესის მე-15 მუხლის პირველი პუნქტის „ა.ე“ და „ბ.გ“ ქვეპუნქტებით გათვალისწინებულ შემთხვევებში, ადმინისტრაცია დაუყოვნებლივ აქვეყნებს ადმინისტრაციის ოფიციალურ ვებგვერდზე ინფორმაციას და უგზავნის წერილობით შეტყობინებას საქართველოში რეგისტრირებულ მოქმედ ავიაკომპანიებს (რომლებიც ახორციელებენ რეგულარულ სამგზავრო გადაყვანა-გადაზიდვებს). 9. საერთაშორისო ხელშეკრულებით ისეთი ახალი პირობების დაწესებისას, რომელიც ადგენს კონკრეტულ საერთაშორისო საჰაერო ხაზზე დანიშნული ავიაგადამზიდველების და/ან ფრენის სიხშირეების უფრო ნაკლებ რაოდენობას, ახალი პირობების დაწესებამდე, ამ საჰაერო ხაზზე ავიაგადამზიდველების დანიშვნის და/ან ფრენის სიხშირეების განაწილების თაობაზე ადმინისტრაციის მიერ მიღებული ყველა გადაწყვეტილება (შეტყობინება) კარგავს იურიდიულ ძალას და ავიაგადამზიდველების დანიშვნა და/ან ფრენის სიხშირეების განაწილება ხორციელდება ამ წესის მე-5 მუხლის შესაბამისად. 10. საერთაშორისო ხელშეკრულებაში რეგულარული საერთაშორისო საჰაერო მიმოსვლის (გადაყვანა-გადაზიდვის) განსახორციელებლად რეგულარული საერთაშორისო საჰაერო გადამზიდველის სტატუსის მინიჭების (დანიშვნის) მოთხოვნის არარსებობისას, ადმინისტრაცია: ა) უცხო ქვეყნის ავიაგადამზიდველს უმტკიცებს მის მიერ წარდგენილ ფრენის განრიგს, თუ: ა.ა) განრიგი შეთანხმებულია საქართველოს მომსახურე აეროპორტთან და საჰაერო მოძრაობის მომსახურების ორგანოსთან; ა.ბ) უცხო ავიაგადამზიდველი აკმაყოფილებს ამ წესის მე-16 მუხლის მე-2 პუნქტის „ა“, „გ“, „დ“ და „ე“ ქვეპუნქტების მოთხოვნებს; ბ) საქართველოს ავიაგადამზიდველს უმტკიცებს მის მიერ წარდგენილ ფრენის განრიგს, თუ: ბ.ა) განრიგი შეთანხმებულია საქართველოს მომსახურე აეროპორტთან და საჰაერო მოძრაობის მომსახურების ორგანოსთან; ბ.ბ) საქართველოს ავიაგადამზიდველი აკმაყოფილებს ამ წესის მე-4 მუხლის მე-2 პუნქტის „გ“, „დ“ და „ე“ ქვეპუნქტების მოთხოვნებს. თავი II დანიშვნა და/ან ფრენის სიხშირეების განაწილება შეზღუდვის არარსებობის შემთხვევაში     მუხლი 4🔗. ავიაგადამზიდველის დანიშვნა და/ან ფრენის სიხშირეების განაწილება შეზღუდვის არარსებობის შემთხვევაში 1. შეზღუდვის არარსებობის შემთხვევაში დანიშნული ავიაგადამზიდველის სტატუსის მოსაპოვებლად საქართველოს ავიაგადამზიდველი ადმინისტრაციას წარუდგენს წერილობით განცხადებას, რომელიც უნდა აკმაყოფილებდეს საქართველოს ზოგადი ადმინისტრაციული კოდექსის 78-ე მუხლით გათვალისწინებულ მოთხოვნებს და შეიცავდეს: ა)  მითითებას იმის შესახებ, თუ რომელ კონკრეტულ საერთაშორისო საჰაერო ხაზ(ებ)ზე მოითხოვს მაძიებელი დანიშვნას; ბ)  ინფორმაციას იმის შესახებ, თუ როდიდან, აგრეთვე, რომელი საჰაერო ხომალდით (ხომალდებით) შესრულდება გადაყვანა-გადაზიდვა. 2. განცხადებას თან უნდა დაერთოს: ა) ამონაწერი მეწარმეთა და არასამეწარმეო (არაკომერციული) იურიდიული პირების რეესტრიდან; ბ) „ტექნიკური რეგლამენტის „საჰაერო ხომალდის ექსპლუატანტის სერტიფიცირების წესის დამტკიცების შესახებ“ საქართველოს ეკონომიკური განვითარების სამინისტროს ერთიანი სატრანსპორტო ადმინისტრაციის უფროსის 2008 წლის 21 იანვრის №10 ბრძანების შესაბამისად გაცემული საჰაერო ხომალდის ექსპლუატანტის სერტიფიკატის ასლი; გ) დანიშვნის მაძიებლის საკუთარი სამოქალაქო პასუხისმგებლობის სავალდებულო დაზღვევის დამადასტურებელი პოლისების ან ეკვივალენტური დოკუმენტების ასლები იმ შესაძლო ზიანის საკომპენსაციოდ, რომელიც შეიძლება მიადგეს ეკიპაჟის წევრს, მგზავრს, ტვირთს, ბარგს და მესამე პირს ამ ავიაგადამზიდველის მოქმედებით; დ) საჰაერო გადაყვანა-გადაზიდვის დოკუმენტების (სამგზავრო ბილეთი და ავიასატვირთო ზედნადები) ნიმუშები და/ან ელექტრონული გაყიდვების შემთხვევაში – შესაბამისი ინფორმაცია; ე) ამ მუხლის პირველი პუნქტის „ა“ ქვეპუნქტით გათვალისწინებული საჰაერო ხაზ(ებ)ის ექსპლუატაციისათვის შესაბამისი საჰაერო ხომალდების (ამასთან, არანაკლებ ორისა, რომელთა ბაზირების ადგილია საქართველო, და რომელთა ურთიერთჩანაცვლება, საჭიროების შემთხვევაში, შესაძლებელი იქნება მომხმარებელთა ინტერესების გათვალისწინებით), ასევე საფრენოსნო შემადგენლობის საკმარისი რაოდენობის, დანიშვნის მაძიებლის მფლობელობაში არსებობის დამადასტურებელი საბუთ(ებ)ი; ვ) საქართველოს მომსახურე აეროპორტსა და საჰაერო მოძრაობის მომსახურების ორგანოსთან შეთანხმებული რეგულარული საჰაერო მიმოსვლის განრიგის პროექტი (სიხშირეების განაწილების შემთხვევაში). 3. დანიშვნის მაძიებლის განცხადების და თანდართული საბუთების განხილვა ხორციელდება საქართველოს ზოგადი ადმინისტრაციული კოდექსის VI თავით განსაზღვრული მარტივი ადმინისტრაციული წარმოების წესით. 4. ამ მუხლის მე-2 პუნქტის „ე“ ქვეპუნქტით გათვალისწინებული საბუთ(ებ)ი უნდა აკმაყოფილებდეს დანიშვნის მაძიებლის მიერ ფრენების უსაფრთხოდ და რეგულარულად შესრულების თაობაზე საქართველოს კანონმდებლობით დადგენილ მოთხოვნებს. 5. დანიშვნის მაძიებლის მიერ წარდგენილი ამ მუხლის პირველი და მე-2 პუნქტებით გათვალისწინებული განცხადებისა და თანდართული საბუთების შესაბამისობისას ამ წესით განსაზღვრულ მოთხოვნებთან, ადმინისტრაცია, მაძიებლის მიერ ადმინისტრაციაში მოთხოვნის თაობაზე განცხადების წარდგენიდან 7 (შვიდი) სამუშაო დღის ვადაში იღებს გადაწყვეტილებას დანიშვნის მაძიებლისათვის დანიშნული ავიაგადამზიდველის სტატუსის მინიჭების თაობაზე. 6. ამ მუხლის შესაბამისად დანიშნული ავიაგადამზიდველის ფრენის სიხშირეები შეუზღუდავია. თავი III დანიშვნა და/ან ფრენის სიხშირეების განაწილება შეზღუდვის არსებობის შემთხვევაში     მუხლი 5🔗. ავიაგადამზიდველის დანიშვნა და/ან ფრენის სიხშირეების განაწილება შეზღუდვის არსებობის შემთხვევაში 1. შეზღუდვის არსებობის შემთხვევაში ავიაგადამზიდველის დანიშვნა და/ან ფრენის სიხშირეების განაწილება ხორციელდება ამ წესის IV თავით განსაზღვრული აუქციონის წესით, გარდა ამ მუხლის მე-2 და მე-3 პუნქტებით განსაზღვრული შემთხვევებისა. 2. აუქციონი არ ტარდება და დანიშვნის მაძიებელს ამ წესის მე-4 მუხლის მოთხოვნების შესაბამისად მიენიჭება დანიშნული ავიაგადამზიდველის სტატუსი ან უარი ეთქმება ასეთი სტატუსის მინიჭებაზე, თუ მოთხოვნა დანიშნულ ავიაგადამზიდველთა რაოდენობაზე არ აჭარბებს შეზღუდვით განსაზღვრულ დანიშნულ ავიაგადამზიდველთა რაოდენობას. 3. აუქციონი არ ტარდება და სიხშირის მაძიებელს მიეცემა მოთხოვნილი ფრენის სიხშირე, თუ მოთხოვნა ფრენის სიხშირეთა რაოდენობაზე არ აჭარბებს შეზღუდვით განსაზღვრული ფრენის სიხშირეთა რაოდენობას. 4. დანიშვნის მაძიებელს დანიშნული ავიაგადამზიდველის სტატუსი ენიჭება, თუ მან გაიმარჯვა აუქციონში. 5. სიხშირის მაძიებელს ფრენის სიხშირის გამოყენების უფლება ენიჭება, თუ მან გაიმარჯვა აუქციონში. 6. ამ მუხლის მე-2 და მე-3 პუნქტებით განსაზღვრულ შემთხვევაში ადმინისტრაცია იღებს გადაწყვეტილებას ადმინისტრაციაში განცხადების რეგისტრაციიდან არა უადრეს 5 (ხუთი) და არა უგვიანეს 7 (შვიდი) სამუშაო დღის ვადაში. თავი IV აუქციონი     მუხლი 6🔗. აუქციონის გამართვა 1. აუქციონს მართავს ადმინისტრაცია. 2. აუქციონის გამართვისათვის ადმინისტრაციის უფროსის ბრძანებით იქმნება კომისია, რომლის უფლებამოსილება განისაზღვრება ამ თავით.     მუხლი 7🔗. აუქციონის გამართვის ვადები და გამოსაქვეყნებელი ინფორმაცია 1. ადმინისტრაცია განსაზღვრავს აუქციონის გამართვის კონკრეტულ თარიღს, ამზადებს და წერილობით აწვდის საინფორმაციო შეტყობინებას დანიშვნის და/ან სიხშირის მაძიებელთათვის. 2. ინფორმაციას აუქციონის გამართვის შესახებ აუქციონის გამართვამდე არა უგვიანეს 5 სამუშაო დღისა ადმინისტრაცია აქვეყნებს: ა) ადმინისტრაციის ოფიციალურ საიტზე; ბ) საქართველოს ზოგადი ადმინისტრაციული კოდექსის 56-ე მუხლის მე-2 ნაწილით განსაზღვრულ ბეჭდვით ორგანოში. 3. გამოსაქვეყნებელი ინფორმაცია უნდა შეიცავდეს: ა) დანიშვნის განმახორციელებლის და/ან სიხშირის გამცემის დასახელებას; ბ) კონკრეტული საერთაშორისო საჰაერო ხაზის დასახელებასა და მონაცემებს ამ საჰაერო ხაზზე შეზღუდვის და ამ შეზღუდვათა საფუძვლების შესახებ; გ) დანიშვნის და/ან სიხშირის მაძიებლის განცხადების მიღებისა და აუქციონის გამართვის ვადებს; დ) საქართველოს კანონმდებლობით გათვალისწინებულ დანიშვნის/ფრენის სიხშირეების განაწილების პირობებს; ე) გამარჯვებულის გამოვლენის კრიტერიუმს; ვ) საწყისი ფასის ოდენობას; ზ) ბეს ოდენობას; თ) დანიშვნით/ფრენის სიხშირის განაწილებით მინიჭებული უფლებების განხორციელების დაწყების ვადას, ფრენების რეგულარობასთან დაკავშირებულ მოთხოვნებს და სხვ. 4. აუქციონში მონაწილეობის თაობაზე განცხადება მიიღება აუქციონის გამართვამდე არა უგვიანეს 3 (სამი) სამუშაო დღისა. 5. განცხადების მიღების დადგენილი ვადის გასვლის შემდეგ შესული განცხადება არ მიიღება.     მუხლი 8🔗. აუქციონის გამართვის პირობა. აუქციონის ობიექტი 1. აუქციონის გამართვის პირობაა შემთხვევა, როდესაც კონკრეტულ საერთაშორისო საჰაერო ხაზ(ებ)ზე დაწესებულია შეზღუდვა და მოთხოვნა აჭარბებს შეზღუდვით გათვალისწინებულ რაოდენობას: ა) ფრენის სიხშირეებზე; ბ) დანიშნულ ავიაგადამზიდველთა რაოდენობაზე. 2. აუქციონი ჩაშლილად ითვლება, თუ მისმა ვერც ერთმა მონაწილემ ვერ დააკმაყოფილა ამ წესითა და საქართველოს კანონმდებლობით დადგენილი მოთხოვნები. 3. აუქციონის ობიექტს წარმოადგენს: ა) ამ მუხლის პირველი პუნქტის „ა“ ქვეპუნქტით გათვალისწინებულ შემთხვევაში აუქციონზე წარდგენილ კონკრეტულ საერთაშორისო საჰაერო ხაზზე გადაყვანა-გადაზიდვის განხორციელების კვირაში ერთი სიხშირე, გარდა ამ წესის მე-12 მუხლის მე-18 პუნქტით გათვალისწინებული შემთხვევისა; ბ) ამ მუხლის პირველი პუნქტის „ბ“ ქვეპუნქტით გათვალისწინებულ შემთხვევაში აუქციონზე წარდგენილ კონკრეტულ საერთაშორისო საჰაერო ხაზზე დანიშნული ავიაგადამზიდველის სტატუსის მინიჭება.     მუხლი 9🔗. განცხადება აუქციონში მონაწილეობის თაობაზე 1. აუქციონში მონაწილეობის უფლება აქვს მხოლოდ საქართველოში რეგისტრირებულ ავიაგადამზიდველს. 2. დანიშნული ავიაგადამზიდველის სტატუსის მინიჭებასთან დაკავშირებულ აუქციონში მონაწილეობის უფლება აქვს მხოლოდ დანიშვნის მაძიებელს, რომელმაც ადმინისტრაციას უნდა წარუდგინოს: ა) ამ წესის მე-4 მუხლის პირველი და მე-2 პუნქტებით განსაზღვრული განცხადება და საბუთები; ბ) აუქციონში მონაწილეობისათვის ბეს შეტანის დამადასტურებელი საბუთი. 3. ფრენის სიხშირეების განაწილებასთან დაკავშირებულ აუქციონში მონაწილეობის უფლება აქვს მხოლოდ დანიშნულ ავიაგადამზიდველს, რომელმაც განცხადებასთან ერთად ადმინისტრაციას უნდა წარუდგინოს აუქციონში მონაწილეობისათვის ბეს შეტანის დამადასტურებელი საბუთი. 4. განცხადების გარეშე მაძიებელი აუქციონზე არ დაიშვება. 5. აუქციონში მონაწილეობის თაობაზე განცხადების მიღება წყდება დადგენილ დღეს და საათზე. 6. კომისია აუქციონის ჩატარების თარიღამდე არა უგვიანეს 1 (ერთი) სამუშაო დღისა ადგენს მაძიებლის მიერ წარდგენილი საბუთების კანონმდებლობით დადგენილ მოთხოვნებთან შესაბამისობას. 7. მაძიებელი უფლებამოსილია დოკუმენტაციის მიღების ვადის დასრულებამდე მოახდინოს დაშვებული უზუსტობების გასწორება.     მუხლი 10🔗. კომისიის შემადგენლობა 1. კომისიის შემადგენლობაში შედიან კომისიის თავმჯდომარე, თავმჯდომარის მოადგილე და წევრები. 2. კომისიის თავმჯდომარის მოადგილე ცვლის თავმჯდომარეს მისი არყოფნის შემთხვევაში. 3. კომისიის თავმჯდომარეს, თავმჯდომარის მოადგილეს, წევრთა რაოდენობასა და წევრებს განსაზღვრავს ადმინისტრაციის უფროსი. 4. საჭიროების შემთხვევაში, კომისია შეიძლება დაკომპლექტდეს სხვა უწყებებისა და ორგანიზაციების წარმომადგენლ(ებ)ით, მოქმედი კანონმდებლობის შესაბამისად. 5. კომისიის წევრების შერჩევისას მხედველობაში მიიღება საქართველოს ზოგადი ადმინისტრაციული კოდექსის 92-ე მუხლით გათვალისწინებული დებულებები. 6. კომისიის წევრებს შორის მოვალეობებს ანაწილებს და მუშაობის რეჟიმს განსაზღვრავს კომისიის თავმჯდომარე. კომისიის წევრებიდან ერთ-ერთი ასრულებს კომისიის მდივნის ფუნქციას. 7. კომისიის თავმჯდომარე პასუხისმგებელია კომისიის მუშაობის სრულ ორგანიზებაზე.     მუხლი 11🔗. უარი აუქციონში მონაწილეობის მიღების თაობაზე აუქციონში მონაწილეობის თაობაზე მაძიებელს უარი ეთქმება, თუ: ა) მაძიებლის მიერ არასრულყოფილად იქნა წარდგენილი ამ წესის მე-4 მუხლის პირველი და მე-2 პუნქტებით განსაზღვრული საბუთები; ბ) მის მიერ წარდგენილი განცხადება და თანდართული საბუთები არ აკმაყოფილებს ამ წესით დადგენილ მოთხოვნებს და დოკუმენტაციის მიღების ვადის დასრულებამდე არ იქნა გამოსწორებული მაძიებლის მიერ; გ) კანონმდებლობით დადგენილი მოთხოვნების საფუძველზე არ შეიძლება მონაწილეობდეს დანიშნულ აუქციონში.     მუხლი 12🔗. აუქციონის გამართვის წესი 1. აუქციონი ტარდება ღია წესით. 2. ბეს ოდენობა განისაზღვრება სააუქციონო საწყისი ფასის 20%-ით, რომელიც შეტანილ უნდა იქნეს სახელმწიფო ხაზინის ერთიან ანგარიშზე და უკან უბრუნდება მაძიებელს დამარცხების შემთხვევაში. გამარჯვების შემთხვევაში ბე ჩაითვლება აუქციონზე გადახდილი თანხის ანგარიშში. 3. თუ მაძიებელი განცხადების წარდგენის ვადის დასრულებამდე უარს იტყვის აუქციონში მონაწილეობის თაობაზე, მის მიერ გადახდილი ბე ექვემდებარება დაბრუნებას. 4. მაძიებლის მიერ აუქციონზე გამოუცხადებლობის შემთხვევაში გადახდილი ბე დაბრუნებას არ ექვემდებარება. 5. აუქციონის დაწყებამდე კომისიის თავმჯდომარე სთხოვს მაძიებელთა წარმომადგენლებს შესაბამისი წარმომადგენლობის დამადასტურებელ საბუთს. აუქციონში მონაწილეებს კომისია ანიჭებს მონაწილის ნომერს. 6. კომისიის თავმჯდომარე აცხადებს სააუქციონო ობიექტს, პირობებს, აგრეთვე ამ წესის მე-7 მუხლის მე-3 პუნქტით გათვალისწინებული ინფორმაციის სხვა მონაცემებს. 7. აუქციონის დასაწყისად ითვლება კომისიის თავმჯდომარის მიერ საწყისი ფასის გამოცხადება. 8. აუქციონის მსვლელობისას აუქციონის ნორმალური ფუნქციონირების უზრუნველყოფისათვის კომისიის თავმჯდომარეს უფლება აქვს ხელშემშლელი პირი ორი შენიშვნის შემდეგ გააძევოს დარბაზიდან. 9. აუქციონის მსვლელობისას აუქციონის მონაწილე სწევს ხელს და ასახელებს თავის ფასს, რომელიც არ უნდა იყოს საწყის ფასზე ნაკლები. ბიჯი (ორი ერთმანეთის მომდევნო მონაწილის მიერ დასახელებულ ფასთა შორის სხვაობა) არ უნდა იყოს საწყისი ფასის 10 პროცენტზე ნაკლები. 10. კომისიის თავმჯდომარე საბოლოო მაქსიმალური ფასის სამჯერადი გამოცხადების შემდეგ აცხადებს სააუქციონო ობიექტს აუქციონის წესით შეძენილად იმ მონაწილის მიერ, ვინც დაასახელა მაქსიმალური ფასი. ეს მონაწილე ცხადდება გამარჯვებულად. გამოცხადებებს შორის დროის ინტერვალი არ შეიძლება აღემატებოდეს 2 წუთს. 11. აუქციონის მიმდინარეობა აისახება სხდომის ოქმში, რომელსაც აუქციონის დამთავრების შემდეგ ხელს აწერენ კომისიის თავმჯდომარე და კომისიის მდივანი. სხდომის ოქმი იკინძება და მოწმდება ადმინისტრაციის ბეჭდით. ოქმში სავალდებულოდ აისახება თითოეული მონაწილის მიერ დასახელებული მაქსიმალური ფასი. 12. აუქციონში გამარჯვებულის მიერ დასახელებული და, შესაბამისად გადახდილი თანხა მიიმართება სახელმწიფო ბიუჯეტში. 13. იმ შემთხვევაში, თუ აუქციონი არ შედგა იმ მიზეზით, რომ აუქციონში მონაწილეობა არ მიიღეს გამოცხადებულმა პირებმა, აუქციონი ცხადდება ჩაშლილად და მონაწილეებს გადახდილი ბე უკან არ უბრუნდება. 14. ავიაგადამზიდველის დანიშვნის და/ან ფრენის სიხშირის განაწილების დამადასტურებელი შეტყობინება იგზავნება აუქციონში გამარჯვებულის მიერ დასახელებული თანხის სრულად გადახდის დამადასტურებელი დოკუმენტის ადმინისტრაციაში წარდგენიდან 3 სამუშაო დღის ვადაში. აღნიშნული თანხის გადახდის დამადასტურებელი დოკუმენტი უნდა წარედგინოს ადმინისტრაციას აუქციონის ჩატარებიდან 2 სამუშაო დღის ვადაში. 15. აუქციონში გამარჯვებულის მიერ დასახელებული თანხის ამ მუხლის მე-14 პუნქტით დადგენილ ვადაში გადაუხდელობის შემთხვევაში აუქციონი ჩაშლილად ცხადდება. აუქციონში გამარჯვებულს გადახდილი ბე უკან არ უბრუნდება. 16. თუ აუქციონში მხოლოდ ერთი მაძიებელი მონაწილეობს, იგი ჩაითვლება გამარჯვებულად საწყისი ფასის გადახდაზე თანხმობის დადასტურების შემთხვევაში. 17. იმ შემთხვევაში, თუ შეზღუდვა დაწესებულია როგორც დანიშნულ ავიაგადამზიდველთა რაოდენობაზე (ერთზე მეტი), ისე ფრენის სიხშირეზე, მაშინ ამ წესის განსაზღვრული მოთხოვნით ჯერ დგინდება გამარჯვებულები დანიშნულ ავიაგადამზიდველთა რაოდენობაზე, რომლებიც შემდგომ იღებენ მონაწილეობას ფრენის სიხშირეების განაწილებასთან დაკავშირებულ აუქციონში. 18. ამ მუხლის მე-17 პუნქტით გათვალისწინებულ შემთხვევაში, თუ დანიშნულ ავიაგადამზიდველთა რაოდენობა შეზღუდულია ერთამდე, მაშინ აუქციონში გამარჯვებული ავტომატურად იღებს ფრენის ყველა სიხშირის შესრულების უფლებას. 19. თუ აუქციონის გახსნილად გამოცხადებისას დადგინდა, რომ აუქციონში არ მონაწილეობს ყველა მაძიებელი და აუქციონში მონაწილე მაძიებელთა მიერ მოთხოვნილი დანიშვნის და/ან სიხშირეთა ჯამური მოთხოვნა არ აჭარბებს შეზღუდვით დადგენილ ოდენობას, აუქციონი წყდება და აუქციონში მონაწილე მაძიებლები მათ მიერ საწყისი ფასის გადახდაზე თანხმობის დადასტურების შემთხვევაში ცხადდებიან გამარჯვებულად.     მუხლი 13🔗. საწყისი ფასი. დანიშვნის/ფრენის სიხშირის მოქმედების ვადა 1. საწყისი ფასი შეადგენს: ა) ფრენის ერთ სიხშირეზე – 100 ლარს; ბ) დანიშნული ავიაგადამზიდველის სტატუსის მინიჭებაზე – 500 ლარს. 2. დანიშვნის/ფრენის სიხშირის განაწილება მოქმედებს განუსაზღვრელი ვადით. თავი V დანიშვნაზე/ფრენის სიხშირის განაწილებაზე უარის თქმისა და გაუქმების საფუძველი     მუხლი 14🔗. ავიაგადამზიდველის დანიშვნაზე/ფრენის სიხშირის განაწილებაზე უარის თქმის საფუძველი 1. მაძიებელს დანიშნული ავიაგადამზიდველის სტატუსის მინიჭების ან ფრენის სიხშირის განაწილების თაობაზე უარი ეთქმება, თუ: ა) მაძიებელი დამარცხდა ამ წესის IV თავით განსაზღვრულ აუქციონში; ბ) მაძიებლის მიერ ამ წესის მოთხოვნის შესაბამისად წარდგენილი განცხადება და თანდართული საბუთები არ აკმაყოფილებს საქართველოს კანონმდებლობით დადგენილ მოთხოვნებს; გ) მაძიებელს, ამ წესის მე-15 მუხლის პირველი პუნქტის „ა.ე“ და/ან „ბ.გ“ ქვეპუნქტების საფუძველზე, გაუუქმდა მოთხოვნილ საჰაერო ხაზზე დანიშნული ავიაგადამზიდველის სტატუსი და/ან ფრენის სიხშირე და გაუქმებიდან არ გასულა 1 (ერთი) წელი. 2. მაძიებლისათვის უარის თქმის შესახებ გადაწყვეტილებაში დასაბუთებული უნდა იყოს უარის თქმის საფუძველი. უარი შეიძლება გასაჩივრდეს საქართველოს კანონმდებლობით დადგენილი წესით.     მუხლი 15🔗. ავიაგადამზიდველის დანიშვნის და/ან ფრენის სიხშირის გაუქმების საფუძვლები 1. ადმინისტრაცია: ა) აუქმებს ავიაგადამზიდველის დანიშვნას ამ ქვეპუნქტით განსაზღვრული ერთ-ერთი შემთხვევის არსებობისას: ა.ა) დანიშნული ავიაგადამზიდველის მოთხოვნა; ა.ბ) დანიშნული ავიაგადამზიდველის ლიკვიდაცია; ა.გ) დანიშნული ავიაგადამზიდველის საჰაერო ხომალდის ექსპლუატანტის სერტიფიკატის გაუქმება; ა.დ) ფრენის ყველა სიხშირის გაუქმება; ა.ე) დანიშვნის თარიღიდან სამი თვის განმავლობაში რეგულარული საჰაერო გადაყვანა-გადაზიდვის შეუსრულებლობა, თუ სხვა ავიაგადამზიდველმა გამოთქვა აღნიშნულ საჰაერო ხაზზე ფრენების განხორციელების სურვილი და არსებული შეზღუდვის გამო შეუძლებელია მისი საჰაერო ხაზზე დაშვება; ა.ვ) ამ წესის მე-3 მუხლის მე-9 პუნქტით განსაზღვრული შემთხვევისას; ბ) აუქმებს ფრენის სიხშირეს ამ ქვეპუნქტით განსაზღვრული ერთ-ერთი შემთხვევის არსებობისას: ბ.ა) დანიშნული ავიაგადამზიდველის მოთხოვნა; ბ.ბ) ავიაგადამზიდველის დანიშვნის გაუქმება; ბ.გ) დანიშნული ავიაგადამზიდველის მიერ სანავიგაციო სეზონზე (ნოემბერი-მარტი, აპრილი-ოქტომბერი) ადმინისტრაციის მიერ დამტკიცებული განრიგით გათვალისწინებული მოცემული მიმართულებით რეგულარული რეისების არასაპატიო მიზეზით ჩაშლის 3 (სამი) შემთხვევა, თუ სხვა ავიაგადამზიდველმა, ამ სანავიგაციო სეზონის განმავლობაში გამოთქვა აღნიშნულ საჰაერო ხაზზე ფრენების განხორციელების სურვილი და არსებული შეზღუდვის გამო შეუძლებელია მისი საჰაერო ხაზზე დაშვება (ამ შემთხვევაში, უქმდება განრიგით გათვალისწინებული ჩაშლილი რეისებიდან ის სიხშირე, რომელზეც სხვა ავიაგადამზიდველი გამოთქვამს სურვილს); ბ.დ) ამ წესის მე-3 მუხლის მე-9 პუნქტით განსაზღვრული შემთხვევისას. 2. რეისის ჩაშლა საპატიოდ ჩაითვლება, თუ იგი გამოწვეულია ავიაგადამზიდველისაგან დამოუკიდებელი დაუძლეველი გარემოებებით ან თუ ავიაგადამზიდველი განრიგით გათვალისწინებული რეისის დრომდე არანაკლებ ათი დღით ადრე აღნიშნულის შესახებ აცნობებს ადმინისტრაციას (ასეთი შეტყობინება არ უნდა იყოს სეზონის განმავლობაში 5-ზე მეტი). თავი VI უცხო ქვეყნის ავიაგადამზიდველის აღიარება, აღიარებაზე უარის თქმა, აღიარების გაუქმება     მუხლი 16🔗. აღიარების მისაღებად წარსადგენი საბუთები 1. აღიარების მისაღებად უცხო ქვეყნის ავიაგადამზიდველი მიმართავს ადმინისტრაციას განცხადებით, რომელიც უნდა შეიცავდეს: ა) მითითებას იმის შესახებ, თუ კონკრეტულად რომელ საერთაშორისო საჰაერო ხაზზე აპირებს იგი რეგულარული საჰაერო გადაყვანა-გადაზიდვის განხორციელებას; ბ) ინფორმაციას იმის შესახებ, თუ როდიდან, და კვირაში რა სიხშირით, აგრეთვე, რომელი საჰაერო ხომალდით (ხომალდებით) შესრულდება გადაყვანა-გადაზიდვა. 2. განცხადებას უნდა დაერთოს შემდეგი საბუთები: ა) შესაბამისი უცხო სახელმწიფოს კომპეტენტური ორგანოს მიერ გაცემული ავიაგადამზიდველის საჰაერო ხომალდის ექსპლუატანტის მოწმობის (სერტიფიკატის) ასლი; ბ) შესაბამისი უცხო სახელმწიფოს კომპეტენტური ორგანოს მიერ ავიაგადამზიდველის დანიშვნის დამადასტურებელი საბუთი; გ) უცხო ქვეყნის ავიაგადამზიდველის საკუთარი სამოქალაქო პასუხისმგებლობის სავალდებულო დაზღვევის დამადასტურებელი პოლისების ან ეკვივალენტური დოკუმენტების ასლები იმ შესაძლო ზიანის საკომპენსაციოდ, რომელიც შეიძლება მიადგეს მგზავრს, ტვირთს, ბარგს ან/და მესამე პირს ამ ავიაგადამზიდველის ქმედებით; დ) გადაყვანა-გადაზიდვის განსახორციელებლად გამოსაყენებელი დოკუმენტების ნიმუშები (სამგზავრო ბილეთი, სატვირთო ზედნადები) და/ან ელექტრონული გაყიდვების შემთხვევაში – შესაბამისი ინფორმაცია; ე) საავიაციო უშიშროების უზრუნველყოფის პროგრამა (წესი); ვ) საქართველოს მომსახურე აეროპორტთან და საჰაერო მოძრაობის მომსახურების ორგანოსთან შეთანხმებული რეგულარული საჰაერო მიმოსვლის განრიგის პროექტი; ზ) სხვა საბუთ(ებ)ი, თუ ეს გათვალისწინებულია საერთაშორისო ხელშეკრულებით ან ამ წესის მე-3 მუხლის პირველი პუნქტის „ბ.ა“ ქვეპუნქტით დადგენილი პირობებით.     მუხლი 17🔗. აღიარების მისაღებად წარდგენილი საბუთების განხილვის წესი 1. აღიარების მისაღებად წარდგენილი საბუთების განხილვა ხორციელდება საქართველოს ზოგადი ადმინისტრაციული კოდექსის VI თავით განსაზღვრული მარტივი ადმინისტრაციული წარმოების წესით. 2. ადმინისტრაცია ვალდებულია, აღიარების ან აღიარებაზე უარის თქმის შესახებ გადაწყვეტილება გამოიტანოს და წერილობით შეატყობინოს განმცხადებელს განცხადებისა და თანდართული საბუთების სრული პაკეტის წარდგენიდან 15 დღის განმავლობაში, თუ საერთაშორისო ხელშეკრულება სხვა ვადას არ ითვალისწინებს.     მუხლი 18🔗. აღიარება ან აღიარებაზე უარის თქმის საფუძველი 1. უცხო ქვეყნის ავიაგადამზიდველის მიერ წარდგენილი, ამ წესის მე-16 მუხლით გათვალისწინებული განცხადებისა და თანდართული საბუთების ამ წესით განსაზღვრულ მოთხოვნებთან შესაბამისობისას, ადმინისტრაცია აღიარებს უცხო ქვეყნის ავიაგადამზიდველს – უმტკიცებს მას ამ წესის შესაბამისად წარდგენილი რეგულარული საჰაერო მიმოსვლის ფრენის განრიგს. 2. აღიარების მაძიებელს აღიარებაზე უარი ეთქმება, თუ წარდგენილი საბუთები არ აკმაყოფილებს საქართველოს კანონმდებლობისა და საერთაშორისო ხელშეკრულების მოთხოვნებს. 3. გადაწყვეტილება აღიარების გაცემაზე უარის თქმის შესახებ დასაბუთებული უნდა იყოს. უარი შეიძლება გასაჩივრდეს საქართველოს კანონმდებლობით დადგენილი წესით.     მუხლი 19🔗. აღიარების გაუქმება ადმინისტრაციას უფლება აქვს გააუქმოს აღიარებული უცხო ქვეყნის ავიაგადამზიდველის სტატუსი აღიარების თაობაზე საერთაშორისო ხელშეკრულებით ან ამ წესის მე-3 მუხლის პირველი პუნქტის „ბ.ა“ ქვეპუნქტით განსაზღვრული პირობების შესაბამისად. თავი VII დანიშნული/აღიარებული ავიაგადამზიდველის უფლებამოსილება. უწყებრივი რეესტრი     მუხლი 20🔗. დანიშნული/აღიარებული ავიაგადამზიდველის უფლებამოსილება დანიშნული/აღიარებული ავიაგადამზიდველი უფლებამოსილია: ა) განახორციელოს დანიშვნით/აღიარებით გათვალისწინებულ საერთაშორისო საჰაერო ხაზზე რეგულარული გადაყვანა-გადაზიდვები საქართველოსა და შესაბამისი უცხო სახელმწიფოს კანონმდებლობის, აგრეთვე საერთაშორისო ხელშეკრულების შესაბამისად; ბ) არ დაუშვას დანიშვნით/აღიარებით მინიჭებულ უფლებათა სხვა ავიაგადამზიდველისათვის გადაცემა; გ) ამ წესის მე-4 მუხლის მე-2 პუნქტის და მე-16 მუხლის მე-2 პუნქტის მოთხოვნების შესაბამისად წარდგენილ საბუთებში გათვალისწინებული ინფორმაციის ცვლილების შემთხვევაში, ცვლილებიდან 7 დღის ვადაში აცნობოს ადმინისტრაციას; დ) მოითხოვოს არარეგულარული საჰაერო გადაყვანა-გადაზიდვის შესრულების შეზღუდვა იმ საჰაერო ხაზზე, რომელზედაც იგი ახორციელებს რეგულარულ გადაყვანა-გადაზიდვას; ე) განახორციელოს კანონმდებლობით დადგენილი სხვა უფლებამოსილება.     მუხლი 21🔗. ოდანიშვნის/აღიარების უწყებრივი რეესტრი 1. ადმინისტრაციას მონაცემები შეაქვს დანიშვნის/აღიარების უწყებრივ რეესტრში, გადაწყვეტილების მიღებიდან 2 (ორი) სამუშაო დღის ვადაში. 2. დანიშვნის/აღიარების უწყებრივ რეესტრში აისახება შემდეგი მონაცემები: ა) დანიშნული/აღიარებული ავიაგადამზიდველის საფირმო სახელწოდება; ბ) რეგულარული საერთაშორისო საჰაერო მიმოსვლის კონკრეტული საჰაერო ხაზი (მარშრუტი); გ) დანიშვნის/აღიარების თაობაზე გადაწყვეტილების მიღების თარიღი; დ) დანიშვნის/აღიარების გაუქმებასთან დაკავშირებული ინფორმაცია; ე) ამ წესის 22-ე მუხლის პირველი პუნქტის „ა“ ქვეპუნქტით გათვალისწინებული ავიაგადამზიდველების მონაცემები. 3. ნებისმიერ დაინტერესებულ პირს უფლება აქვს გაეცნოს დანიშვნის/აღიარების უწყებრივი რეესტრის მონაცემებს. თავი VIII გარდამავალი დებულებები     მუხლი 22🔗. გარდამავალი დებულებები 1. ამ წესის ამოქმედებამდე კონკრეტულ საერთაშორისო საჰაერო ხაზზე: ა) რეგულარული საჰაერო მიმოსვლის განმახორციელებელი საქართველოს/უცხო ქვეყნის ავიაგადამზიდ-ველი არის ამ წესის შესაბამისად დანიშნული/აღიარებული ავიაგადამზიდველი და მათი მოთხოვნის შემ-თხვევაში, ადმინისტრაცია ვალდებულია გასცეს შესაბამისი წერილობითი დადასტურება; ბ) ფრენის სიხშირეებზე შეზღუდვის არსებობისას, ამ პუნქტის „ა“ ქვეპუნქტით განსაზღვრული, საქარ-თველოს დანიშნული ავიაგადამზიდველების დამტკიცებული განრიგით განსაზღვრული ფრენის სიხშირეების რაოდენობა წარმოადგენს ამ წესის შესაბამისად მათზე განაწილებულ ფრენის სიხშირეებს და მათი მოთხოვნის შემთხვევაში, ადმინისტრაცია ვალდებულია გასცეს შესაბამისი დადასტურება. 2. ამ მუხლის პირველი პუნქტით გათვალისწინებული ავიაგადამზიდველ(ებ)ის მიმართ ვრცელდება ამ წესით განსაზღვრული დანიშვნის/ფრენის სიხშირის/აღიარების გაუქმების მოთხოვნები.
