მომზადების, პარლამენტის გადაწყვეტილებათა შესრულებისათვის ხელის შეწყობის, პარლამენტის წინაშე ანგარიშვალდებული ორგანოების და მთავრობის საქმიანობის კონტროლის მიზნით პარლამენტი თავისი უფლებამოსილების ვადით ქმნის კომიტეტებს, ნდობის ჯგუფს, ხოლო საჭიროების შემთხვევაში – ქვეკომიტეტებს. საქართველოს 1998 წლის 4 მარტის კანონი №1274 - პარლამენტის უწყებანი №13-14, 08.04.1998 წ., გვ.28     მუხლი 2🔗 კომიტეტების უფლებამოსილება, მათი შექმნისა და საქმიანობის წესი განისაზღვრება საქართველოს კონსტიტუციით, ამ კანონით, საქართველოს პარლამენტის რეგლამენტით და სხვა საკანონმდებლო აქტებით.     მუხლი 3🔗 კომიტეტების საქმიანობას საერთო კოორდინაციას უწევს პარლამენტის თავმჯდომარე. თავი II. კომიტეტები, მათი შექმნის წესი     მუხლი 4🔗 პარლამენტის კომიტეტებია: ა) აგრარულ საკითხთა; ბ) ადამიანის უფლებათა დაცვის, მოქალაქეთა პეტიციებისა და სამოქალაქო საზოგადოების მშენებლობის; გ) გადასახადებისა და შემოსავლების; დ) განათლების, მეცნიერების, კულტურისა და სპორტის; ე) გარემოს დაცვისა და ბუნებრივი რესურსების; ვ) დარგობრივი ეკონომიკის; ზ) ეკონომიკური პოლიტიკის; თ) სამოქალაქო ინტეგრაციის; ი) თავდაცვისა და უშიშროების; კ) რეგიონული პოლიტიკისა და თვითმმართველობის; ლ) იურიდიულ საკითხთა, კანონიერებისა და ადმინისტრაციული რეფორმების; მ) მთიანი რეგიონებისა და განსახლების; ნ) საგარეო ურთიერთობათა; ო) საპროცედურო საკითხთა და წესების; პ) საფინანსო-საბიუჯეტო; ჟ) ჯანმრთელობის დაცვისა და სოციალურ საკითხთა. წლის 8 დეკემბრის კანონი №56 - სსმ I, №48(55), 16.12.1999 წ., მუხ.243     მუხლი 5🔗  კომიტეტის თავმჯდომარეს პარლამენტის უფლებამოსილების ვადით, პარლამენტის წევრთაგან ირჩევს პარლამენტი. კომიტეტის თავმჯდომარის კანდიდატის დასახელების უფლება აქვთ პარლამენტის თავმჯდომარეს, პარლამენტის წევრთა არანაკლებ ათკაციან ჯგუფს, რომლებიც არ შედიან არც ერთ საპარლამენტო ფრაქციაში, საპარლამენტო ფრაქციას. განცხადება კანდიდატის დასახელების შესახებ წარედგინება სხდომის თავმჯდომარეს, რომელიც ადგენს კანდიდატთა ერთიან სიას დასახელების რიგითობის მიხედვით. კანდიდატთა დასახელების შემდეგ სხდომის თავმჯდომარე აქვეყნებს კანდიდატთა სიას და ითხოვს მათ თანხმობას კენჭი იყარონ კომიტეტის თავმჯდომარის თანამდებობაზე. კანდიდატს უფლება აქვს მოხსნას თავისი კანდიდატურა ყოველგვარი ახსნა-განმარტების გარეშე. გადაწყვეტილება კომიტეტის თავმჯდომარის არჩევის შესახებ მიღებულად ჩაითვლება, თუ მას მხარს დაუჭერს პარლამენტის წევრთა სიითი შემადგენლობის უმრავლესობა. თუ არჩევნებში ერთი კანდიდატი მონაწილეობდა და იგი ვერ აირჩა, ეწყობა ხელახალი არჩევნები. „თუ არჩევნებში მონაწილეობდა ორი კანდიდატი და ვერც ერთმა ვერ დააგროვა ხმების საჭირო რაოდენობა, მაშინ იმ კანდიდატს, რომელმაც ხმების მეტი რაოდენობა დააგროვა, ხელახლა ეყრება კენჭი. თუ კანდიდატმა ამ შემთხვევაშიც ვერ დააგროვა ხმების საჭირო რაოდენობა, ტარდება ხელახალი არჩევნები. თუ არჩევნებში მონაწილეობდა ორზე მეტი კანდიდატი და გამარჯვებული ვერ გამოვლინდა, ეწყობა არჩევნების მეორე ტური, რომელშიც კენჭს უყრიან იმ ორ კანდიდატს, რომლებმაც მეტი ხმა მიიღეს. თუ მეორე ტურში გასულმა კანდიდატმა მოხსნა თავისი კანდიდატურა, მის ნაცვლად კენჭი ეყრება მიღებული ხმების რაოდენობის მიხედვით მეორე ტურში გასული კანდიდატების მომდევნო კანდიდატს. თუ არჩევნების პირველ ტურში შეუძლებელია მხოლოდ ორი გამარჯვებულის გამოვლენა, მეორე ტურში კენჭი ეყრება იმ კანდიდატებს, რომლებმაც ხმების მიღებული რაოდენობის მიხედვით გაიყვეს პირველი ან პირველი და მეორე ადგილი. არჩევნების მეორე ტურში არჩეულად ჩაითვლება კანდიდატი, რომელიც მეტ ხმას მიიღებს, მაგრამ არანაკლებ პარლამენტის წევრთა სიითი შემადგენლობის ერთი მესამედისა. არჩევნების მეორე ტურის შედეგები აისახება საქართველოს პარლამენტის გადაწყვეტილებით, რომელიც დამატებით კენჭისყრას არ საჭიროებს. თუ არჩევნების მეორე ტურში მონაწილე კანდიდატებმა ხმების თანაბარი რაოდენობა მიიღეს, გამარჯვებული გამოვლინდება პირველი ტურის შედეგების მიხედვით. თუ ამ წესით გამარჯვებული ვერ გამოვლინდა, ეწყობა ხელახალი არჩევნები. კომიტეტის თავმჯდომარის თანამდებობაზე ასარჩევად ერთი და იგივე კანდიდატის წარდგენა დაიშვება მხოლოდ ორჯერ. საქართველოს 1997 წლის 2 მაისის კანონი №689 - პარლამენტის უწყებანი №21-22, 31.05.1997 წ., გვ.8 საქართველოს 2002 წლის 15 მაისის კანონი №1431 - სსმ I, №11, 16.05.2002 წ., მუხ.45     მუხლი 6🔗 კომიტეტის თავმჯდომარე შეიძლება გადააყენოს პარლამენტმა, თუ ამას სათანადო წერილობითი დასაბუთებით მოითხოვს პარლამენტის თავმჯდომარე (ბიუროსთან შეთანხმებით), ბიურო, შესაბამისი კომიტეტის წევრთა არანაკლებ ორი მესამედი, პარლამენტის წევრთა არანაკლებ ერთი მეხუთედი. გადაწყვეტილება კომიტეტის თავმჯდომარის გადაყენების შესახებ მიღებულად ჩაითვლება, თუ წინადადებას მისი გადაყენების შესახებ მხარს დაუჭერს პარლამენტის წევრთა სიითი შემადგენლობის უმრავლესობა. საქართველოს 1997 წლის 2 მაისის კანონი №689 - პარლამენტის უწყებანი №21-22, 31.05.1997 წ., გვ.8     მუხლი 7🔗 კომიტეტის თავმჯდომარეს შეუძლია ნებისმიერ დროს, ყოველგვარი ახსნა-განმარტების გარეშე განაცხადოს თავისი გადადგომის შესახებ. შესაბამისი განცხადება წარედგინება პარლამენტის ბიუროს, რომელიც გააცნობს მას პარლამენტს. კომიტეტის თავმჯდომარე გადამდგარად ითვლება განცხადების ბიუროში წარდგენის დროიდან. პარლამენტი ცნობად იღებს კომიტეტის თავმჯდომარის განცხადებას.     მუხლი 8🔗  კომიტეტის თავმჯდომარის გადადგომის, გადაყენების ან მისი, როგორც პარლამენტის წევრის, უფლებამოსილების ვადამდე შეწყვეტის შემთხვევაში პარლამენტი ათი დღის განმავლობაში ამ კანონის მე-5 მუხლით გათვალისწინებული წესით ირჩევს კომიტეტის ახალ თავმჯდომარეს. იმ შემთხვევაში, თუ სესიის დამთავრებამდე დარჩენილია ათ დღეზე ნაკლები, საკითხი განიხილება მორიგი სესიის პირველსავე სხდომაზე. საქართველოს 1997 წლის 2 მაისის კანონი №689 - პარლამენტის უწყებანი №21-22, 31.05.1997 წ., გვ.8     მუხლი 9🔗 კომიტეტის შემადგენლობა, როგორც წესი, განისაზღვრება საპარლამენტო ფრაქციათა წარმომადგენლობის და პარლამენტის იმ წევრთა რაოდენობის პროპორციულად, რომლებიც არ შედიან არც ერთ საპარლამენტო ფრაქციაში. კომიტეტის შემადგენლობა განისაზღვრება პარლამენტის არანაკლებ 10 წევრით. კომიტეტში გაწევრიანების შესახებ პარლამენტის წევრი განცხადებით მიმართავს შესაბამისი კომიტეტის თავმჯდომარეს. განცხადების საფუძველზე კომიტეტის თავმჯდომარე, ამ მუხლის პირველი ნაწილის მოთხოვნათა დაცვით, ადგენს კომიტეტის წევრთა სიას. კომიტეტის შემადგენლობა ასარჩევად წარედგინება პარლამენტის უახლოეს სხდომას. კომიტეტის შემადგენლობაში შეიძლება იყოს მხოლოდ პარლამენტის წევრი. პარლამენტის წევრი ვალდებულია, იყოს ერთი კომიტეტის შემადგენლობაში. პარლამენტის წევრის მეორე კომიტეტში გაწევრიანების საკითხს განსაზღვრავს მისი ფრაქცია კვოტირებით დადგენილი დამატებითი ადგილების რაოდენობის შესაბამისად. პარლამენტის თავმჯდომარე, მისი მოადგილეები, არ შეიძლება იყვნენ კომიტეტის შემადგენლობაში. საქართველოს 1997 წლის 2 მაისის კანონი №689 - პარლამენტის უწყებანი №21-22, 31.05.1997 წ., გვ.8 საქართველოს 2002 წლის 3 დეკემბრის კანონი №1803 - სსმ I, №32, 20.12.2002 წ., მუხ.151     მუხლი 10🔗  პარლამენტის წევრს კომიტეტში გაწევრიანებაზე შეიძლება უარი ეთქვას მხოლოდ ამ კანონის მე-9 მუხლში მითითებული საფუძვლებით. კომიტეტის წევრს შეუძლია ნებისმიერ დროს გავიდეს კომიტეტის შემადგენლობიდან. გადაწყვეტილებას პარლამენტის წევრის განცხადების საფუძველზე მისი სხვა კომიტეტში გადასვლის შესახებ იღებს პარლამენტი.     მუხლი 11🔗  კომიტეტის პირველ საორგანიზაციო სხდომას იწვევს კომიტეტის თავმჯდომარე პარლამენტის მიერ შესაბამისი კომიტეტის შემადგენლობის არჩევიდან არა უგვიანეს სამი დღისა. კომიტეტის პირველი საორგანიზაციო სხდომა განსაზღვრავს კომიტეტის სტრუქტურას, შეიმუშავებს კომიტეტის დებულებას და ირჩევს კომიტეტის ხელმძღვანელ პირებს. საორგანიზაციო სხდომის ოქმი და კომიტეტის დებულება დასამტკიცებლად წარედგინება პარლამენტის ბიუროს.     მუხლი 12🔗  კომიტეტი თავის წევრთაგან უფლებამოსილების ვადით, ფარული კენჭისყრით, წევრთა უმრავლესობით ირჩევს კომიტეტის თავმჯდომარის პირველ მოადგილეს, მოადგილეს და დასამტკიცებლად წარუდგენს პარლამენტის ბიუროს. კომიტეტის თავმჯდომარის მოადგილე აირჩევა ოპოზიციური ფრაქციის წარდგინებით. თუ არჩევნებში მონაწილეობდა ერთი კანდიდატი და იგი არ აირჩა, ეწყობა ხელახალი არჩევნები. თუ არჩევნებში მონაწილეობდა ორი კანდიდატი და ვერც ერთმა ვერ დააგროვა ხმების საჭირო რაოდენობა, მაშინ იმ კანდიდატს, რომელმაც ხმების მეტი რაოდენობა დააგროვა, ხელახლა ეყრება კენჭი. თუ კანდიდატმა ამ შემთხვევაშიც ვერ დააგროვა ხმების საჭირო რაოდენობა, ტარდება ხელახალი არჩევნები. თუ არჩევნებში მონაწილეობდა ორზე მეტი კანდიდატი და გამარჯვებული ვერ გამოვლინდა, ეწყობა არჩევნების მეორე ტური, რომელშიც კენჭს უყრიან იმ ორ კანდიდატს, რომლებმაც მეტი ხმა მიიღეს. თუ გამარჯვებული ვერ გამოვლინდა, ეწყობა ხელახალი არჩევნები. კომიტეტის თავმჯდომარის პირველი მოადგილის და მოადგილის თანამდებობაზე ასარჩევად ერთი და იგივე კანდიდატის წარდგენა დაიშვება მხოლოდ ორჯერ. საქართველოს 1997 წლის 2 მაისის კანონი №689 - პარლამენტის უწყებანი №21-22, 31.05.1997 წ., გვ.8 საქართველოს 1999 წლის 25 ნოემბრსი კანონი №14 - სსმ I, №45(52), 26.11.1999 წ., მუხ.235 თავი III. კომიტეტის უფლებამოსილება     მუხლი 13🔗 კომიტეტი თავისი კომპეტენციის ფარგლებში: 1. შეიმუშავებს, განიხილავს და პარლამენტის სხდომისათვის ამზადებს კანონების, პარლამენტის დადგენილებებისა და სხვა გადაწყვეტილებების პროექტებს; 2. განიხილავს პარლამენტის მიერ ასარჩევ, დასანიშნ ან დასამტკიცებელ კანდიდატურებს და დასკვნებს წარუდგენს პარლამენტის ბიუროს; 3. განიხილავს ბიუჯეტის შესაბამის თავებსა და ნაწილებს, შეიმუშავებს დასკვნებს; 4. აკონტროლებს კანონების, პარლამენტის დადგენილებებისა და სხვა გადაწყვეტილებების შესრულებას, მთავრობის, საქართველოს პარლამენტის წინაშე ანგარიშვალდებული ორგანოების კანონქვემდებარე აქტების შესაბამისობას საქართველოს რესპუბლიკის კანონმდებლობასთან და საჭიროების შემთხვევაში შესაბამის დასკვნას წარუდგენს პარლამენტს; 5. განახორციელებს კონტროლს პარლამენტის წინაშე ანგარიშვალდებული სახელმწიფო ორგანოების და მთავრობის საქმიანობაზე და საჭიროების შემთხვევაში შესაბამის დასკვნას წარუდგენს პარლამენტს; 6. წყვეტს თავისი საქმიანობის ორგანიზაციულ საკითხებს. კომიტეტს აქვს საკანონმდებლო ინიციატივის უფლება. 7. თუ კომიტეტის თავმჯდომარის მოადგილე კომიტეტის კომპეტენციას მიკუთვნებულ საკითხთან დაკავშირებით არ ეთანხმება კომიტეტის პოზიციას, მას უფლება აქვს პარლამენტის პლენარულ სხდომას კომიტეტის მოხსენების შემდეგ წარუდგინოს საკუთარი ალტერნატიული მოსაზრება. საქართველოს 1999 წლის 25 ნოემბრსი კანონი №14 - სსმ I, №45(52), 26.11.1999 წ., მუხ.235     მუხლი 14🔗 პარლამენტის წინაშე ანგარიშვალდებული ორგანოების თანამდებობის პირები და მთავრობის წევრები, კომიტეტის, აგრეთვე თავისი უფლებამოსილების ფარგლებში, ქვეკომიტეტის მოთხოვნით ვალდებულნი არიან კომიტეტის ან ქვეკომიტეტის მიერ დადგენილ ვადაში წარმოადგინონ შესაბამისი დოკუმენტები, დასკვნები და სხვა საჭირო მასალები. სახელმწიფო ან სამხედრო საიდუმლოების შემცველი ცნობების წარდგენის წესი განისაზღვრება კანონით.     მუხლი 15🔗  კომიტეტის მოთხოვნით პარლამენტის წინაშე ანგარიშვალდებული ორგანოების თანამდებობის პირები და მთავრობის წევრები ან მათი წარმომადგენლები ვალდებულნი არიან გამოცხადნენ კომიტეტის სხდომაზე და განსახილველ საკითხზე განმარტება მისცენ კომიტეტს. კომიტეტის სხდომის თარიღი მათ უნდა ეცნობოთ სხდომამდე არა უგვიანეს 2 დღისა.     მუხლი 16🔗  კომიტეტები იხილავენ თავიანთი გამგებლობის სფეროში კანონით განსაზღვრულ პირთა თანამდებობაზე არჩევის, დანიშვნის ან დამტკიცების საკითხებს. თანამდებობაზე ასარჩევი, დასანიშნი ან დასამტკიცებელი პირის კანდიდატურას კომიტეტს წარუდგენს პარლამენტის თავმჯდომარე. კომიტეტი უფლებამოსილია მოსთხოვოს თანამდებობაზე ასარჩევ, დასანიშნ ან დასამტკიცებელ პირს წერილობითი ინფორმაცია მისი ბიოგრაფიული ცნობების, შრომითი გამოცდილებისა და პროფესიული ცოდნის შესახებ. მიღებული ინფორმაციის საფუძველზე კომიტეტი ამზადებს დასკვნას თანამდებობაზე ასარჩევი, დასანიშნი ან დასამტკიცებელი პირის შესახებ. დასკვნა მიიღება ფარული კენჭისყრით, კომიტეტის სხდომაზე დამსწრე წევრთა უმრავლესობით. კომიტეტის დასკვნა წარედგინება ბიუროს, რომელიც გადასცემს მას პრეზიდენტსა და პარლამენტს. საქართველოს 2001 წლის 21 დეკემბრის კანონი №1226 - სსმ I, №1, 10.01.2002 წ., მუხ.7     მუხლი 17🔗 პარლამენტის სესიის განსახილველად გასატან ყველა კანონპროექტს ამზადებს ან განიხილავს შესაბამისი კომიტეტი. კომიტეტები, მათ გამგებლობას მიკუთვნებული დარგების მიხედვით, შეისწავლიან და აანალიზებენ მოქმედი კანონმდებლობის შესრულების მდგომარეობას, იღებენ ზომებს კანონთა შესრულების უზრუნველსაყოფად საკანონმდებლო ხარვეზების აღმოსაფხვრელად, ამზადებენ წინადადებებს კანონმდებლობაში აუცილებელი ცვლილებებისა და დამატებების შეტანის შესახებ.     მუხლი 18🔗 კომიტეტები, მათ გამგებლობას მიკუთვნებულ საკითხებზე ინფორმაციების მოსმენის, კონტროლისა და შემოწმების შედეგად გამოვლენილ კანონის დარღვევებზე შეიმუშავებენ და გზავნიან რეკომენდაციებს აღმასრულებელი ხელისუფლების ცენტრალურ და საქართველოს პარლამენტის წინაშე ანგარიშვალდებულ ორგანოებში. რეკომენდაციების განხილვის შედეგების ან მიღებული ზომების შესახებ უნდა ეცნობოს კომიტეტს არა უგვიანეს ერთი თვისა ან მის მიერ დადგენილ ვადაში.     მუხლი 19🔗  კომიტეტის მოთხოვნის შეუსრულებლობისათვის თანამდებობის პირის პასუხისმგებლობა განისაზღვრება კანონით.     მუხლი 19🔗​1 კომიტეტს უფლება აქვს თავისი საქმიანობის საჭიროებიდან გამომდინარე, პარლამენტის რეგლამენტით განსაზღვრული წესის შესაბამისად დასვას საკითხი მის შემადგენლობაში შემავალი პარლამენტის წევრისთვის საქართველოს ტერიტორიაზე მოქმედ სასჯელაღსრულების დაწესებულებაში სპეციალური ნებართვის გარეშე შესვლის უფლების მინიჭების შესახებ. საქართველოს 2000 წლის 20 აპრილის კანონი №255 - სსმ I, №16, 02.05.2000 წ., მუხ.40 თავი IV. კომიტეტის მუშაობის წესი     მუხლი 20🔗  კომიტეტის თავმჯდომარე: ა) იწვევს და თავმჯდომარეობს კომიტეტის სხდომებს; ბ) წარმოადგენს კომიტეტს პარლამენტში, პარლამენტის გარეთ და შესაბამის საპარლამენტთაშორისო ურთიერთობებში; გ) ხელს აწერს კომიტეტის გადაწყვეტილებებს, დასკვნებსა და სხდომის ოქმებს; დ) ხელმძღვანელობს და საერთო კოორდინაციას უწევს ქვეკომიტეტების მუშაობას; ე) საერთო ხელმძღვანელობას უწევს კომიტეტის აპარატს; ვ) ანაწილებს ფუნქციებს პირველ მოადგილესა და მოადგილეებს შორის; ზ) ყოველი წლის შედეგების მიხედვით, საშემოდგომო სესიის დაწყებისას, წარუდგენს პარლამენტს გაწეული საქმიანობის მოკლე წერილობით ანგარიშს; თ) ახორციელებს ამ კანონით, საქართველოს პარლამენტის რეგლამენტით და სხვა საკანონმდებლო აქტებით მინიჭებულ უფლებამოსილებებს.     მუხლი 21🔗 კომიტეტის თავმჯდომარის გადადგომის, გადაყენების, მის მიერ უფლებამოსილების განხორციელების შეუძლებლობის ან მისი, როგორც პარლამენტის წევრის, უფლებამოსილების ვადამდე შეწყვეტის შემთხვევაში კომიტეტის თავმჯდომარის უფლებამოსილებას ახორციელებს მისი პირველი მოადგილე ან მოადგილე. საქართველოს 1997 წლის 2 მაისის კანონი №689 - პარლამენტის უწყებანი №21-22, 31.05.1997 წ., გვ.8     მუხლი 22🔗  კომიტეტის საქმიანობის ძირითადი მიმართულებების მიხედვით იქმნება ქვეკომიტეტები არანაკლებ სამი წევრის შემადგენლობით. ქვეკომიტეტის შექმნის საკითხზე კომიტეტი იღებს გადაწყვეტილებას, რომელსაც პარლამენტი ამტკიცებს დადგენილებით. ქვეკომიტეტში გაწევრიანების მსურველი კომიტეტის წევრები განცხადებით მიმართავენ კომიტეტის თავმჯდომარეს. ქვეკომიტეტის შემადგენლობას ამტკიცებს კომიტეტის სხდომა.  2. ამ კანონის მე-12 მუხლით გათვალისწინებული წესით კომიტეტი ქვეკომიტეტის წევრთაგან ირჩევს ქვეკომიტეტის თავმჯდომარეს, რომელსაც ამტკიცებს პარლამენტის ბიურო. საქართველოს აღმასრულებელი ხელისუფლების ორგანოების სპეციალური პროგრამებისა და საიდუმლო საქმიანობის საბიუჯეტო კონტროლის მიზნით საქართველოს პარლამენტის თავდაცვისა და უშიშროების კომიტეტში მის წევრთაგან იქმნება ნდობის ჯგუფი. ნდობის ჯგუფის შემადგენლობა, კომპეტენცია, შექმნისა და საქმიანობის წესი განისაზღვრება კანონით. საქართველოს 1997 წლის 2 მაისის №270 - სსმ I, №17, 12.05.2000 წ., მუხ.42     მუხლი 23🔗  ქვეკომიტეტის სხდომას იწვევს მისი თავმჯდომარე. სხდომა უფლებამოსილია, თუ მას ესწრება წევრთა უმრავლესობა. ქვეკომიტეტის წევრები ვალდებული არიან, დაესწრონ სხდომებს. ქვეკომიტეტი ატარებს ღია ან დახურულ სხდომას. სხდომის დრო წინასწარ ცხადდება. გადაწყვეტილება მიიღება ღია ან ფარული კენჭისყრით, დამსწრეთა ხმების უმრავლესობით. ქვეკომიტეტი იღებს დასკვნებსა და მიმართვებს, რომლებიც, როგორც წესი, წარედგინება კომიტეტის სხდომას. ქვეკომიტეტის სხდომას სათათბირო ხმის უფლებით შეიძლება ესწრებოდნენ პარლამენტის წევრები, აღმასრულებელი ხელისუფლების წარმომადგენლები, მოწვეული პირები. ქვეკომიტეტი უფლებამოსილია, დასვას წინადადება კომიტეტის სხდომის დღის წესრიგში საკითხის შეტანის თაობაზე. კომიტეტის სხდომაზე ქვეკომიტეტის სახელით შეიძლება კენჭისყრაზე დადგეს განსაკუთრებული ან ალტერნატიული მოსაზრება. თუ კომიტეტი არ დაეთანხმა ქვეკომიტეტის მოსაზრებას, ქვეკომიტეტი წევრთა სრული შემადგენლობის გადაწყვეტილებით უფლებამოსილია, გააკეთოს განცხადება პარლამენტის სხდომაზე. ქვეკომიტეტის სხვა უფლებამოსილებანი განისაზღვრება შესაბამისი კომიტეტის დებულებით. საქართველოს 1997 წლის 2 მაისის კანონი №689 - პარლამენტის უწყებანი №21-22, 31.05.1997 წ., გვ.8     მუხლი 24🔗  კომიტეტის სამუშაო გეგმით გათვალისწინებული ცალკეული საკითხების მომზადების მიზნით კომიტეტს, აგრეთვე ქვეკომიტეტს შეუძლიათ შექმნან სამუშაო ჯგუფები კომიტეტის წევრების, წამყვანი სპეციალისტებისა და მოწვეული ექსპერტების მონაწილეობით.     მუხლი 25🔗 კომიტეტის წევრს უფლება აქვს თანაბარ საწყისებზე მონაწილეობდეს კომიტეტის მუშაობაში, გამოთქვას განსახილველ საკითხებზე თავისი წინადადებები, მოსაზრებები და შენიშვნები, აირჩიოს და არჩეულ იქნეს კომიტეტის თუ ქვეკომიტეტის ხელმძღვანელობაში, მონაწილეობა მიიღოს კომიტეტის სამუშაო ორგანოებში, დაიკავოს განსხვავებული პოზიცია და სესიაზე საკითხის განხილვისას გამოთქვას მოსაზრება ამის თაობაზე. კომიტეტის წევრის მიერ შრომის დისციპლინის არაერთგზის უხეში დარღვევისა და დაკისრებულ მოვალეობათა შეუსრულებლობის შემთხვევაში კომიტეტმა შეიძლება ეს საკითხი გადასცეს საპროცედურო კომიტეტს. გადაწყვეტილება ამის თაობაზე მიიღება კომიტეტის წევრთა უმრავლესობით. პასუხისმგებლობის წესი და ფორმები განისაზღვრება პარლამენტის რეგლამენტით. საქართველოს 1997 წლის 2 მაისის კანონი №689 - პარლამენტის უწყებანი №21-22, 31.05.1997 წ., გვ.8     მუხლი 26🔗  კომიტეტი პარლამენტის მიერ მიღებული გადაწყვეტილების, შემოსული წინადადებების, საკანონმდებლო ინიციატივის წესით წარმოდგენილი კანონპროექტების საფუძველზე შეიმუშავებს მიმდინარე და პერსპექტიულ სამუშაო გეგმებს. მიმდინარე გეგმა მოიცავს ერთ საპარლამენტო სესიას, პერსპექტიული გეგმა დგება კომიტეტის უფლებამოსილების ვადით. გეგმას იღებენ კომიტეტის სხდომაზე, მას ხელს აწერს კომიტეტის თავმჯდომარე, რის შემდეგაც დასამტკიცებლად გადაეცემა პარლამენტის ბიუროს.     მუხლი 27🔗  კომიტეტის სხდომას იწვევს და წარმართავს კომიტეტის თავმჯდომარე, მისი არყოფნის დროს – მისი რომელიმე მოადგილე. კომიტეტის სხდომების ჩატარების პერიოდულობას განსაზღვრავს კომიტეტი, მაგრამ არანაკლებ თვეში ორი სხდომისა. კომიტეტის სხდომა უფლებამოსილია, თუ მას ესწრება წევრთა ნახევარზე მეტი. კომიტეტის წევრები ვალდებული არიან დაესწრონ კომიტეტის სხდომას და მონაწილეობა მიიღონ მის მუშაობაში. გადაწყვეტილება მიიღება ღია ან ფარული კენჭისყრით, სხდომაზე დამსწრე წევრთა ხმების უმრავლესობით, გარდა რეგლამენტით გათვალისწინებული შემთხვევებისა. ღია კენჭისყრის დროს ხმების გაყოფისას გადამწყვეტია თავმჯდომარის ხმა. კომიტეტის რიგგარეშე სხდომას იწვევს კომიტეტის თავმჯდომარე თავისი ინიციატივით, პარლამენტის თავმჯდომარის, პარლამენტის ბიუროს, ქვეკომიტეტის ან კომიტეტის წევრთა ერთი მესამედის მოთხოვნით. დღის წესრიგიდან საკითხის მოხსნას ან ახლის შეტანას სჭირდება დამსწრე წევრთა ხმების ორი მესამედი. კომიტეტი მართავს ღია ან დახურულ სხდომებს კომიტეტის გადაწყვეტილებით და კანონით განსაზღვრულ შემთხვევებში. დღის წესრიგი და სხდომის თარიღი, როგორც წესი, წინასწარ ცხადდება. სხდომას სათათბირო ხმის უფლებით შეიძლება ესწრებოდნენ პარლამენტის წევრები, მთავრობის წევრები და მოწვეული პირები, სხვა კომიტეტების, ფრაქციების წარმომადგენლები. ლობისტური საქმიანობის შესახებ დავალების ხელშეკრულებით გათვალისწინებული ნორმატიული აქტის (მისგან გამომდინარე ნორმატიული აქტების), ნორმატიული აქტის პროექტის (მისგან გამომდინარე ნორმატიული აქტების პროექტების) განხილვის დროს კომიტეტის ღია სხდომაზე დასწრების უფლება აქვს პარლამენტში კანონით დადგენილი წესით რეგისტრირებულ ლობისტს. მას კომიტეტის გადაწყვეტილებით შეიძლება მიენიჭოს რეგლამენტირებული სიტყვის უფლება. კომიტეტის სხდომაზე დასასწრებად შეიძლება მოწვეულ იქნენ დადგენილი წესით აკრედიტებული მასობრივი ინფორმაციის საშუალებათა წარმომადგენლები, მოეწყოს კომიტეტის სხდომის რადიო და ტელერეპორტაჟი. ინფორმაცია კომიტეტის სხდომის შედეგების შესახებ შეიძლება გამოქვეყნდეს პრესაში. კომიტეტი ატარებს რეფერენტულ სხდომებს იმ საკითხების განსახილველად, რომლებიც უნდა წარედგინოს პარლამენტს, სათათბირო სხდომებს – აზრთა გაზიარებისათვის, საკანონპროექტო სხდომებს – კანონპროქტთა განხილვისათვის, სარედაქციო სხდომებს – კანონპროქტის ან მისი ნაწილის განმეორებით განხილვისათვის, საინფორმაციო სხდომებს – შესაბამისი დარგის სამინისტროებისა და სხვა სახელმწიფო ორგანოთა შეთანხმებით ან ბიუროს გადაწყვეტილებით შეიძლება ჩატარდეს კომიტეტების ერთობლივი სხდომა. ერთობლივ სხდომაზე კენჭისყრა არ ტარდება. ერთობლივი სხდომის შედეგების მიხედვით კანონპროექტი ან საკითხი შეიძლება შესწორდეს ან მთლიანად გადამუშავდეს. საქართველოს 1997 წლის 2 მაისის კანონი №689 - პარლამენტის უწყებანი №21-22, 31.05.1997 წ., გვ.8     მუხლი 29🔗  საკანონმდებლო ინიციატივის სუბიექტის მიერ შემოტანილ კანონპროექტს პარლამენტის ბიუროს გადაწყვეტილებით შესაბამის კომიტეტს განსახილველად გადასცემს საქართველოს პარლამენტის თავმჯდომარე. კომიტეტმა პარლამენტის ბიუროს მიერ დადგენილ ვადაში უნდა განიხილოს შემოსული კანონპროექტი. თუ ობიექტური მიზეზების გამო ეს ვერ მოხერხდა, განხილვის ვადას გააგრძელებს პარლამენტის თავმჯდომარე. კანონპროექტი კომიტეტის სხდომაზე განიხილება მუხლობრივად. კომიტეტის ნებისმიერ წევრს შეუძლია გამოთქვას შენიშვნები და წარადგინოს შესწორებები თუ დამატებები, რომლებიც საჭიროების შემთხვევაში მიიღება კენჭისყრით.     მუხლი 30🔗  რეფერენტულ, საკანონპროექტო და საინფორმაციო სხდომებზე განხილული საკითხების პარლამენტის ბიუროსათვის წარდგენის წინ ეწყობა საკომიტეტო მოსმენა. საკომიტეტო მოსმენა ტარდება საჯაროდ. ინფორმაცია საკომიტეტო მოსმენის თაობაზე ქვეყნდება, როგორც წესი, მოსმენამდე არა უგვიანეს 7 დღისა. საკომიტეტო მოსმენის შემდეგ საკითხი შეიძლება მიჩნეულ იქნეს პლენარულ სხდომაზე განხილვისათვის მოსამზადებლად, არასაკმარისად მომზადებულად ან მიუღებლად. კომიტეტი კანონპროექტს ან სხვა განსახილველ საკითხს მომზადებულად ცნობს კენჭისყრაში მონაწილე კომიტეტის წევრთა უმრავლესობით. ამის შემდეგ კომიტეტი ამტკიცებს პარლამენტის სხდომაზე კანონპროექტის ან კომიტეტის პოზიციის წარმდგენს. მომზადებული საკითხი გადაეცემა პარლამენტის ბიუროს სესიის პლენარული სხდომის დღის წესრიგში გასათვალისწინებლად. თუ კომიტეტის მიერ შეტანილი საკითხი პარლამენტის ბიურომ უარყო, კომიტეტი უფლებამოსილია, საკითხი შეიტანოს პარლამენტის სხდომაზე განსახილველად, გარდა ამ კანონის მე-16 მუხლით გათვალისწინებული შემთხვევებისა. თუ კომიტეტში განხილულ საკითხთან დაკავშირებით შესაბამისი კომიტეტის წევრთა არანაკლებ ერთ მესამედს აქვს განსხვავებული აზრი, ისინი უფლებამოსილი არიან გააკეთონ განცხადება პარლამენტის სხდომაზე. კანონპროექტის შემტანმა კომიტეტმა შეიძლება სათანადო მოტივირებით გამოითხოვოს იგი პირველი მოსმენით მის საქმიანობის უზრუნველსაყოფად იქმნება პარლამენტის კომიტეტის აპარატი, რომელიც წარმოადგენს კომიტეტისადმი დაქვემდებარებულ პარლამენტის აპარატის მუდმივმოქმედ სტრუქტურულ ერთეულს. 2. კომიტეტის აპარატი: ა) მონაწილეობს კომიტეტისა და ქვეკომიტეტების სამუშაო გეგმების, კომიტეტის სამუშაო გეგმით გათვალისწინებული კანონპროექტების, პარლამენტის დადგენილებებისა და სხვა გადაწყვეტილებათა პროექტების, კომიტეტის გადაწყვეტილებათა პროექტების შემუშავებაში, კანონპროექტებზე დასკვნების, შენიშვნებისა და წინადადებების მომზადებაში, კომიტეტის საკონტროლო, ორგანიზაციულ და სხვა საქმიანობაში; ახორციელებს საკონსულტაციო, ანალიტიკურ ფუნქციებს, ორგანიზაციულ-ტექნიკურ მომსახურებასა და საქმისწარმოებას; ბ) ასრულებს კანონმდებლობით, კომიტეტის, პარლამენტის აპარატისა და კომიტეტის აპარატის დებულებებით განსაზღვრულ სხვა ფუნქციებს. 3. კომიტეტის აპარატის სტრუქტურასა და საშტატო ოდენობას კომიტეტის თავმჯდომარის წარდგინებით და პარლამენტის აპარატის უფროსთან შეთანხმებით ამტკიცებს პარლამენტის თავმჯდომარე. საქართველოს 1998 წლის 29 მაისის კანონი №1400 - პარლამენტის უწყებანი №21-22, 14.06.1998 წ., გვ.5     მუხლი 32🔗 1. კომიტეტის აპარატის შემადგენლობაში შედიან კომიტეტის აპარატის უფროსი და სპეციალისტები. 2. კომიტეტის აპარატის უფროსი: ა) კომიტეტის თავმჯდომარესთან ერთად ახორციელებს კომიტეტის აპარატის საერთო ხელმძღვანელობას, კომიტეტის აპარატის მუშაკთა შორის ანაწილებს ფუნქციებსა და დავალებებს, პასუხისმგებელია კომიტეტის აპარატზე დაკისრებული ამოცანებისა და მოვალეობების შესრულებაზე, უზრუნველყოფს კომიტეტის აპარატისა და პარლამენტის აპარატის სხვა სტრუქტურულ ერთეულებს შორის ურთიერთობათა კოორდინაციას; ბ) ორგანიზაციას უწევს კომიტეტის სხდომების მომზადებას, მიღებულ გადაწყვეტილებათა და სხდომათა ოქმების გაფორმებას; გ) უზრუნველყოფს კომიტეტის აპარატის მუშაკთა მიერ შრომის დისციპლინის დაცვას, შეაქვს წინადადებები მათი წახალისებისა და დისციპლინური პასუხისმგებლობის შესახებ; დ) ახორციელებს კანონმდებლობით, კომიტეტის, პარლამენტის აპარატისა და კომიტეტის აპარატის დებულებებით განსაზღვრულ სხვა ფუნქციებს. 3. კომიტეტის სპეციალისტები: ა) მუშაობენ კომიტეტის დებულებით განსაზღვრულ დარგობრივ მიმართულებათა საკითხებზე; მონაწილეობენ კომიტეტის სამუშაო გეგმით გათვალისწინებული კანონპროექტების, პარლამენტის დადგენილებებისა და სხვა გადაწყვეტილებათა პროექტების, კომიტეტის გადაწყვეტილებათა პროექტების შემუშავებაში, ანალიზსა და განზოგადებაში, კანონპროექტებზე დასკვნების, მოხსენებების მომზადებაში, კომიტეტის საკონტროლო, ორგანიზაციულ და სხვა საქმიანობაში; ასრულებენ კომიტეტის თავმჯდომარისა და კომიტეტის დავალებებს; ბ) ახორციელებენ კანონმდებლობით, კომიტეტის, პარლამენტის აპარატისა და კომიტეტის აპარატის დებულებებით განსაზღვრულ სხვა ფუნქციებს. 4. კომიტეტის აპარატის უფროსსა და სპეციალისტებს კომიტეტის თავმჯდომარის წარდგინების საფუძველზე, „საჯარო სამსახურის შესახებ” კანონით დადგენილი წესით ნიშნავს და ათავისუფლებს პარლამენტის აპარატის უფროსი. საქართველოს 1998 წლის 29 მაისის კანონი №1400 - პარლამენტის უწყებანი №21-22, 14.06.1998 წ., გვ.5     მუხლი 33🔗  კომიტეტებთან, საჭიროების შემთხვევაში ქვეკომიტეტებთან, იქმნება სამეცნიერო-საკონსულტაციო საბჭოები, რომლებიც შედგება შესაბამისი დარგის კომპეტენტური, მოწვეული ექსპერტ-კონსულტანტებისაგან. საბჭოს შემადგენლობას ნიშნავს კომიტეტის თავმჯდომარე. სამეცნიერო-საკონსულტაციო საბჭოს სხდომებს, საჭიროების მიხედვით, იწვევს კომიტეტის, ქვეკომიტეტის თავმჯდომარე. შეიძლება ჩატარდეს კომიტეტის ან ქვეკომიტეტის და სამეცნიერო-საკონსულტაციო საბჭოს ერთობლივი სხდომა. სამეცნიერო-საკონსულტაციო საბჭოს წევრები ითვლებიან კომიტეტის ექსპერტ-კონსულტანტებად საზოგადოებრივ საწყისებზე. კომიტეტის თავმჯდომარეს, პარლამენტის თავმჯდომარესთან შეთანხმებით, კონკრეტული საკითხების
