Ministry of lorcign Allairs of Ceorgia presents its complimeflts to the Technical
Secretadat of the Organization for the Prohibition of Chemical Weapons (OPCW) and has
the honor 1o express its rcadincss lo sign the Agreement between Georgia and the
Orgalization lor the Protection of Chemical Weapons on lhe Privileges and Immu[ities of
the 0PCW.
Ministry of Forcign Affairs of Georgia kindly asks the ]'echnical Secretariat of the
Organization for the Prohibition of Chemical weapons (OPCW) to inform the Ministry
concerring the venue and the date lbr the ceremony of the signature and the identity ofthc

territory of Georgia for purposes speciried in the Convention, pursuant to thc
legislalion in force on the terrilory ofGcorgia.

The officials ofthe OPCW shall be exempt from national service obligations, provided
that. in relation to nationals of Georgia, such exemption shall be confined to officials
of the OPCW r^hosc names havc, by reason of their duties, bccn placed upon a list
compiled by the Director-Gcneral of the OPCW and approved by Gcorgia -Should

In additio! 10 the privileSes and immunities specified in paragraphs 1,2 and 3 ofthis
Arricle, the Dircctor-Gencral ofrhc OPCW shall be accordcd on behalf of hirnself and
his spouse, the p.ivileges and immunities, exemptions arld facilities accorded to
diplomatic agents on behalf of themselves and their spouses, in accordaice with
intcmational law. The same privileges and immunities, exemptions and facilitics shall
also be accorded ro a senior official of the OPCW acting on behalf of the
Director-Gencral.
5. Privileges and immunitics are granted to oflicials ofthe OPCW in thc interests ofthe
OPCW, and nor for the prsonal benefit oflhe individuals tlremselvcs. It is thc duty of
all pcrsons enjoying such privileges and immunitics to obscrve in all other.especls the
legislation of Georgia. Thc OPCW shall have thc riSht and the duty to waive the
immunity ofan)'omcial olthc OPCW in any casc [hcre, in its opinion, the irnmunity
would impcde tlre course ofjusticc and can be waived vr'ithout prejudice to the interests
of the OPCw.

The OPCW shall cooperate al all times with the appropriate aulhorilies of Ceor8ia to
facilitate the prop€r administration ofjustice, and shall secure lhe observance ofpolice
regulalions iutd prevcnt lhc occurrcncc of a-ny abusc in connection with the Privileges'
immunities and facilities m€ntioned in this Aniclc.
ARTICLE 7
EXPERTS
1. Experts shall be accorded the following privileges and immunities so far a-s is
necessary for the etfecti\e exercise of their funcdons, includin8 thc lime spent on
joumcys in connection {ith such firnclions.
(a)
immunity from personal arrest or detention snd ftom seizurc of their personal
baggage;
(b)
in respect ofwords spoken or written or acts done by them in the performance
of their official functions, immunity from legal process of every kind, such
immunity to continue notwithstanding that the persotls concemed are no longcr
pcrfonuing official functions for thc OPCW;
(c)
(d)
inviolability for all papers, documenls and omcial malerial;
(e)
for thc purposes of their communicalions with the oPCW, the righl to usc
codes and lo rcceive pap€rs or correspondence by courier or in sealed bags;
the same facilities in lespect of cunency and exchaoge restrictions as arc
ac{orded to reptesentatives of foreign Govemmcnts on temporary official
missions;
(f)
thc same immunities snd facilitics in respcct of their peEonal baggage as are
accorded to m€mbers of compatable rank ofdiplomatic missions.

ARTICLE 8
ABUSE OF PRIVILEGE
Ifceorgia considers thal there has becn an abuse ofa privilege or immunity conferred
by this Agreemenl, consultations shall be held berween Georgia and the OPCW to
detcrmine whethcr anv such abuse has occuned and, if so, to attempt to ensute lhat no
rcpetition occurs. If such consulutions fail to achieve a result satisfaclory to Georgia
and the ol,Cw, the question whelier an abusc ofa privile8e or immunity has occurred
shallbe s€ttled by a procedure in accordance \rith Articlc 10.

Pcrsons included in onc of&e categories under A-rticles 6 and ? shall not be rcquircd
by the territorial authorities to lea\e the territor,v of Georgia on account of any
aitivities by them in thcir offciol capacity. ln the case, however. ofabuse ofprivilegos
committed by any such person in activilics outside oflicial functions, the person may
bc requircd to leavc by tie Govemment of Georgia. provided thar the order to le-ave the
country h6s been issued by the teftitorial authorilies with the approval of the Foreign
lvlinister of Georgia. Such approval shall be given only in consultation with the
Director-(ieneral ofthe OPCW. Ifexpulsion proceedings arc talen against the person'

ARTICLE 9
TRAI'EL I'OCUMENTS AND VISAS
l. Geoigia shall recognisc and accept as valid the Urited Nations laissez-pa'sser issued to
the ofucia.ls of tiebPCw, in accordance *ith special OPCW anangemcnts, concluded
vrith the United Nations pulsuant to the Relationship Agreement betwecn the tjnited
Nations and the OPCW for thc purPose of carrying out their tasks related lo thc
Convention. Thc Director_Cencml shall notiry GeorSia of the relevant OPCW
allangements.

SETTLEMENT OT DISPUTES

Any dispute conceming the interpretation or application of this Agrccment, which is
noi scttied amicably. shall be referred for final decision to a tribunal ol three
arbitrators- at $e rcqucst of eithcr party to the dispute. Each party shall appoinl one
&$ilrator. The third. who shall b€ chairman ofthe tribunal, is to bc chosen by the lirst
two arbitralors.
Ifone ofthe parties fails to appoint an arbitrator and has not taten steps to do so within
two months iollowing a reque$ ftom the other pany to make such an appoinanenl. the
ofier party may requ;st the President oflhe Intemational Coun ofJuslice lo make such

themselves operate so as to abrogate, or derogate ftoin, any provisions of the
Convention or any .ights or obligetions which the OPCW may otherwise h&ve, acquire
or assume.
ARTICLE I2
FINAL PROVISIONS
l. This Agreement shall enter inlo force on rhe date ofdeposit with the Director-Cene.al
of an instrument of ratification of Ceorgia. It is understood that, \,,,hen an instlumcrlt of
ratilication is deposited by Georgia it will be in a position undei its national law to give
effect to the terms ofthis A$eement.
2. This Agrcement shall continue to be in force tbr so long as Georgia remains a State
Part-v to thc Convcntion.
3. The OPCW and Ceorgia may cntcr inio such supplemcntal aSreemcnts as may b(
necessary.
4. The present Agrecment may be amended aad modified by a writtcn mutual conscnt of
ihe Panics. which shall be formed as a scparate document, and shall cntcr into force on
the date ageed by the Parties as stipulated in such document. The document formed
thercby, shall constitute an integral part of the ASreement.
