Agreement BETWEEN THE GOVERNMENT OF GEORGIA AND THE UNITED NATIONS DEVELOPMENT PROGRAMME The United Nations Development Programme, hereinafter referred to as'UNDP' on the one part, and The Government of Georgia on lhe other part, and together, jointly refened to as the'Parties' Whereas: Recalling lhe provisions of the Agreement between the Republic ol Georgia and the UNDP relating to UNDP'S assistance to the country concluded on 1 July 1994 (Standard Basic Assistance Agreement "SBM'), which states rinler alra that the Government shall appl,, to the United Nations and its organs, inclucing the UNDP, the privileges and immunities provtded in the Convention on the Privrleges and lmmunities of the United Nations, 1946 (lhe Convention); Not,hg that Section 8 of Article ll of the Convention on the Privileges and immunities of the United Nations provides inter-alia that "while the United Nalions wil not, as a general rule, claim exemption lrom excisa duties and from taxes on lhe sale ol movable and inmovable property which lorm patl of the price to be paid, nevedheless when the lJnited Nations is making impodanl purchases for official use of papetty on which such dulies and taxes have been charged or are chargeable, Membets will, whenever possble, make appropdate adminislrative afiangements lot lhe remission ot return ol the amount of duly or tax" I Recognizing that since the inception of UNDP operations in Georgia, the Government of Georgia has as a matter of practice exempted UNDP from payment of duties and taxes in respect of its otficial activities; Considering the administrative burden and expense that may be incurred in administering a riechanism for return of duties and taxes under the Convention obligations, Have agreed upon the following: Articie 1 - purpose ln consistence with the Convention, this agreement sets out detailed provisions for the Government of Georgia to continue to exempt the UNDP from the payment of duties and taxes in connection with all of ds official activities as set out in the SBM, including those related to development projects, as well as country ofilce administrative procurement. Articlo 2 - Taxation and Customs provisions Programmevprojecls and contracls flnanced wholly or partly by UNDP shall be exempl from all taxes, custom duties, fees or other flscal charges that have an equal effecl, irrespective of these being effeclve at present or lo be introduced in the future In particular: 1. Any goods imported for the purpose of implementing actions financed by the UNDP shall not be subject to customs and import duties, taxes or any other charges having equivalent etlecl imposed by the Government of Georgia or any administration thereof. 2. Upon the request of UNDP, the Government of Georgia shall ensure, within limits of its compelence and in compliance with national legislation, that the imports concerned will be released in time from the point of legal custom entry for delivery to the recipient as required for the normal implementation of lhc contract. 3. Conkacts and project activities tlnanced by UNDP shall not be subject to taxes or other fiscal charges having effect in Georgia, whether such charges exist or are to be instituted, whether the contract is concluded with persons from Georgia or elsewhere. 4. Where a contract concerns supply of goods origrnating in Georgia, the contract shall b€ concluded on the basis of the net price excluding taxes. The term 'goods" should be understood as any producl, services and/or rights assigned for sale. Arilcle 3 - Dlsputes Any claim or dispute arising under or in connection with the provisions of this agreement shall be handled pursuant to the relevant provisions of the SBAA Article 4 - Entry into force This Agreement shall enter into force on the date of exchange of the last notification act confirming the completion by contractrng pariies of their appropriate procedures necessary for its entry rnto torce Article 5 - Modifications Amendments and addendums to this agreement shall be in writing at any time upon mutual agreement by the parties, which shall enter into force on the date of exchange of the last notification acl conflrming the completron by contracting parties of their appropriate procedures.
