(hereinafier refened to as the "Contrdcting Parties").
Considering the friendly relations between the two countr ies,
Convinced that the intemational cooperation has a great importance
in the tight against crime, espcially organised or serious crimes, tenorism,
iJrug-related crimes, traflicking in arms and human beings, illega.l migration
ard unlawful smuggling of persons,
Wilh a view to the reinforccment and deepening of co-operarion
between the competent agencies in the interest of their common security.
Wirh a vierv to combatiDg intemalional organised crime even nore
cfficiently rhrough their co-ordinaled actiorl.
Considcring their obligations deriving from intemational
undertakings and theil inlemal larvs.

CTIAP'TER I
Generrl Provisions
Article I
Definltions
For the purpose ofthis Agreement:

accordance with the internal larys ofthe states of the Contracting Partiesl

Article 2
Thc Scope of Co-operation
(I)
With a view ro protecting public order and public safety rhe
Contracting Parties shall enhance their co-operation in the fielcl of
prevention snd detection of criminal offences (hereinafter: crime
suppression) sancl.ioned under the intemal laws of the states of both
Contracting Parties wilh imprisolrment of at least one year.
(2)
Either Contracting Pafly may refuse co-opemtion in pafl or in full or
may subject it to conditions if such co-operation endangers or violates its
sovereignty, security, public order or if it is contrary to i$ intmal laws.
(i)
Rcquests tbr co-operation conceming military cr.imes or crimos
committet'l for political reasons shall not be submiucd and shall not be
executed, An acl shall not be deemed a political crime if in the course of its
perpctration - rvi$ regard to all the circunstances including the aim sought
to be achieved, the motivc, lhe modus operandi and the means used or
intended to use the law aspects offie act outweighs its political nature.
(4)
Co-operation based on this Ageement shall not exrend to mutual
legal assisance lr4rich is under the conlpetence o[ the iu<jicia] authoriries of
the Contracting Pariies,
CHAPTER II
General Rules of Co-operation
Article 3
Co-operatioo based on Request
(
l)
With a view to the imple me nralion of the provisions of rhis
r\greement, the competent agencies shall - in accordance with internal laws
of the states of the Contracting Parties and the provisions of this Agrcemcnt
- co-operate and provide assistance to one onother based on request.
(2)
Unless otherwise provided in rlris Agreemenl requests and responses
therero shall be sent and received in *riting (including transmission by
telefax and thc electronic telecommunications networks) tfuough the central
contact agencies. In urgent cases, requests can also be made verbally; verbal
requcsts shall be confirmed in rwiting wirhout any delav.
(j)
lf. according lo tle inlemal lau,s of the states of the Contracting
Parties, the permission. consent, al)proval or agrcement of the judioial
authoritios is required for sending or executing requests, requests may be
sent and lheir execution may be comrnenced only after suoh permission.

(4) Il the requested competent agency does not have the power or
compelence to execute the requesl, it shall forward the requesl to the agency
having powcr and competence and notift the requesting competenr agency
thereof.
(5) The requesting competent agency may request the requesred
cornpetelt agency to execute ils rcquest accordiDg to the rules and
conditions or by applying the technical methods indicared by it. If,
according to thc conditions set fonh in rhe request, its execution is possible
only in part or not at all. the rrquested central contacl ageocy shall nolify thc
requesting central contact agency without any delay. At the same time. it
shall indicate the conditions under which the request can be executed.
(6)
If upon receipt of the request it becomcs eyident that its execution is
nor possible rvithin ihe time limit set forth therein and the reasons given in
lhe request tbr setting the time limit reveal that a dela,v would jeopardise rhe
succcss of lhe procedure of rhe requesting comp€tent agency, rhe requesled
compelent authoriry or central contact agency shall immediately noti$ the
requesting central contacl agency oflhe time needetl for the execution of the
request.
(7)
Follo*ing norification according to paragraphs (5) and (6), the
reqLresting c€ntrul contact agency shall declare rvhether it still requires the

Article 4
Thc Contents ofthc Request and the Applicable Lrnguage
(l)

C]IAPTER III
Forms of Co-operation
Article S
Exchange of Information
(l) The competent agencies, upon rcquest, shall transfer the following
information:
a) data about the persons involved in the comrnission of crime,
information with regard lo p€rpetrators, leaders of organised crime
associations and groups of criminals, Ihe connections among and
structure lhereof, typical conducr of perpetrators and groups,
planned. aflemptcd or committed criminal offcnces. in particular data
rElated to the time, place. modus operandi. informalion on special
circumstiurces ond the measures taken, whsrever it is necessary for
crime suppression;
b) information on objects in rcspect of which the criminal offence has
been commined, or w'hich contain traces of the criminal offence, or
were used or intended to be used as inslruments of crime, or
originating from a criminal offence;
c) data on the proceeds ofcrirne;
d) data liom criminol data basis accessible to compctcnt authorities;
e) information on the idenfitv of persons, their placc of stay and home
address:
f) infornration on docurnents constituting the right to drive road
vehicles;

identification data of motor vehicles;

and paragraph (2) of this Article may be transmitted between and executed
directly by the competent agcncies in case the exchange of information
through the central contact points would suffer such delay that would
scverely endanger ths interests of crimc detection.
(4)
ln particular cases the centnl contact agency of a Contracling Pany
may trarsfer iuformalion cven without a request if it can be reasollably
prcsumed that this inibrmation is necessary for thc compelent agencies of
rhc other Contractiug Party to eliminale concrctc threats to public order or to
combat crimcs.
(5)
In Ure course 0f the cxchange of information upon this Anicle, rhe
compcteDt agencies may cxchange requcsLs containing classified data.
Article 6
Analysis of the Public Order ond the Criminal Situstion
'fhe
competent agencies shall regularly exchange information and
analyscs concerning their stalcs' criminal situation and the situation of the
public order. The competent agencies may jointly anatyse the cole issucs of
the criminal situation ard crimc prcvcntion aud discuss and agrce on the
action to bc taken.
Article 7
Taking Action in Urgent Csses
(I)
l he cornpercnr agencies may. within the territory of their own st[tes,
upon a rcquest, ir: accordance rvirh their state's intemal laws. cany out
identity checks. scarch tbr wanted persons and establish their whereabouts.
and conduct intensive checks in public places, if the interest of crime
suppressiou requires urgenl measures.
(2)

Article 8
Controlled Dclivery
(l) Thc conrpetent agencics of a Contracling Party through the cental
contact agc[cies may rcquest from the competent agencics of anoher
Contracting Party to supen,ise illegal and suspicious consignmcnts to poss
out of, Lhrough or inro the ferritory of its o\rr state in ordcr to detect crime,
and identif-v pcrsons having participated in the commission ofa criminal act.
(Z)
In addirion to rhe data set forrh in Article 4 Paragraph (l) of this
Agteement, thc request for controllcd delivcry shall include:
a)
The content of tle consigrunent" its expected route and duration, the
mode of Eansportation Bnd data concerning the identification of the mcans
of transportarion;
b)
Thc mode ofescort;
c)
Dats conc€rning the technical instruments to be used;
d)
The nunrber ofparlicipants and participation of undercover olficers,
ifally, in the escort on re part of the requesting competent agencyi
e)
The mode of maintaining contact with the participants in the
controlled dclivery;

Circumstances ofthe handing over and taking over ofthe
consignnrent;

Measures to be taken in tie case ofapprehension;

permission according to Puu'agraph (2) hereof. The arrangement shall
contain the malters set fonh in Palagraphs (3) and (6),

The activities of the undercover oilicer shall be immcdiatcly
suspended if so requested by the requested competcnt aBency.
(6)
1he actioru of the undercover officer shall be govcmed by the
internal laws of the state of the requested competent agency. The undercover
officer car take only actions, permitted by the inlemal laws of the states of
both Contracting Parties.
Article l0
Co-operation in the Witness Protection Program
(l)
1hc Contracting Parties may request via their competent agencies

(2)
The person lr: be protcctcd must have been placed r,rnder the national
Witness Protection Program of the requesting ConEacting Party bcforc
transferring. In case of urgent necd thc lransfer may bc implemented if it is
presumable tlrBt the person to b€ protected has been taken into the national
Witness Pmtection Program of the r€questing Contracting Parly (emergency
measure). Protecied peNons ma)- only benefit from the forms of protection
that are provided for by the intemal laws on r,v-itness protection of the state
of the requested agency.
(3)
In addition to the data specitied in Article 4 Paragaph (l) of this
Ageement. the request referred to under Paragraph (l) shall include:

Controcting Parties shall, in writing, agree on the details of the protcction

Article ll
Setting Up Joint Crim€ Detcction Teams
(l) The competent agencies may, 6y ad hoc arrangemenl, set up joint
crime detection tcams if this is necessary for the successful deteclion of
criminal acls, committed or aflempted in the lenitory of their stares.
(2)

particular:
a)
Ihe descliprion of the criminal act for the detection of which the
joint crime detection team rvas set up;
b)
The area, the conditions and the duration of operstion and thc
couditious of extension;
c)
The composition and rhe leader ofthejoint crime dctection tcarr;
d)
The rights and obligalions ofthe seconded member o[thejoint crime
detection leam;

e)
Information conceming the rules goveming the criminal liability of
the seconded member of *tc joint crime detection team as well as
hiVher civil liabilit-v for damage caused within the scope of hiMrcr
operotion;

Organisational measures and bearing the costs of operation.
(3) The member of the requesting comPetent agency seconded to the
joint crime detection team shall not be authorised to take independent ac[on
io the tenitory of the state of the requested cornpetent agenc]'.

joint crime delection te3m may transfer non-classified data and information
in hislher posscssion to the nrcmberu of the requested competent sgency
pafiicipaling in the joint crimc detection team in the same csscs ard under
the same conditions as in the case of transferring such information to hiVher
oPn competent agenc!'.
(5)
Access to classified data classified by the competent agencies
necessaq, for the Rork of the joint crtne detection team shall be granted to
the seconded oUicers ofthe comPetent agency ofthe other Contracting Pany
by the head of the authority having set up the joint crime detection tcam
according to the intemal laws of its own state. To ransfer data classified by
authorities not panicipating in the co-operalion the consent of the classiltsr
shall be obtained.
Articlc l2
Covert gathering of information
(l)
The competent agcncies of the Contlacting Parties may, in the
course of crime detectiorl upon requesl aad in accordance with the internal
laws of their statcs, covertly gather infomration and inform each other of the
results.
(2)
In addition to the data set forth in Article 4 Paragraph (l) of this
.A,greement, the request for coven gathcring ofinforntation shall includc:
a) indication ofthe instrument or method;
b) the dumtion ofthe covert measure;
c) the scope ofdata to be record€d and transfened;
d.; the manner oftransferring the datai
e) the nranner of providing assistance in the event of the covert

Co-operation relared to the implernencation of readmission
agreenrcnts;
d) Transl'er ol'inlbrmation required for the performance of the tasks of
thc authorities cntrusted wirh rhc prevention of threats jeopardising the
public order.
(l)
The liaison ofllcer shall have o consuhing role supporting the
compctcnt agencies and shall not be authorised to carry out measures of
crime prevcntion and crime suppression independently.
Articlc l4
Co-operation in the Fields of Training and Crime Prevention
(l)
]'hc cooperation in thc ficld of uaining shall extend to the
tbllowing:
a)
Ilxchange ofcurricula and teaching materials;

b)
Joint seminars and presentations, organisation ofjoint courses and
conferences;
c)
InvitatioDs ofthe reprcsentatives of the other compelent agencies as
obsewcrs, presentation ofexercises and special deployment actions;
d)
Ensuring the participation of the representatives of the other
competent agencies in courses.
(2)
The centtal contact agencies shall co-operate in exploring and
exchanging rrelhods of crime prevention approved at national level grd in
the organisation of expert consulting needed for the implementation of
crimc prcvention melhods.
Article 15
Coop€rstion in combating corrupaion rnd malfeasance in office
Tlre competent agencies of the Contracting Parties under this
Agreemeut shall cooperate in combating comrption ard malfeasance in
office. 'fhe cooperation covers the exchange of experiences in conncction
rdth applying the inremal laws concerned and preventing comrption, and
the exchangc of information and analyses regarding the possible reasons of
corruption and malt'easance and the development trends.
CHAPTER IV
Lcgal Rclations in tbe Territory of the stste of the other Contrrcaing
Prrty
.Articl€ l6
Rights and obligations of the oflicers
(l) l-he ollicers of the competent agencies ore entitled to wear thcir
unif'orm and obliged to carry their service identiry card in the couse of the
performance of their duties arising ftom this Agreement in the tenitory of
(hc statc of the other Contracting Pany. They are not entitled to carry their
sen,iu: weapon and service equipmenl, and to use means of restraint.
(2)
The undercover officer r€fen€d to in Article 9 of lhis Agreemenr
may enter the territory of the state of the other Contracting Pany with a
coven docurnent, may stay thcre with the necessary coven documents for
the duralion of performing hivher duties. In individu,al cases undercover
ofiicers nray carrv tirearms and use nreans of restraint. The conditions shall
be specified in thc od hoc anurgement dehned in Paragraph (4) of Article 9

of this Agrecment in accordance wilh internal laws of the states of the
ContracLing Parties.
Article l7
Service Relations and th€ Protection of the Members of Competent

and assistance to the memb€r of the competent agency of the other

Rules of Criminal Liability
The members of thc compctcnt ugencies performing lhcir dutlcs

Rules of Civil Liability
(l)
When a member ofthe competent agencies performs his/her duties in
the tenitory of the state of the other Contracring Pa(y in accordance with
the provisions of this Agreemcnt, thc Conhacting Party scnding him/her
shalt bc liablc fbr any damage caused by him/hcr in thc couLse of his4rcr
operation in accordance with the internal laws of thc state of l.he Contracdng
Pady in whose statc's tcrritory thc darnage rvas caused.
(2) lf a membcr of thc competent agency of one Contracting Party causes
any damage to lhe competent agency of the other ConEacting Party. the
claim fbr thc reimbursement of the dau,age *,ill be rvaived, unless such
damage is caused inteflionally or by gross negligence.
(3) If a rnembcl of thc competent agency of one Contracting Party causes
any damage to a third person in lhe lenitory of the state of the other
Contracting Party. the former shnll fullv reimburse the compensation u,hich
was paid by the latter ibr the damage.

CHAPTER V
Dats Protection
Article 20
Rules of Dsta Processing
(l)
Thc processing of data shall be perlbrmed in sccordsnce rvith thc
tbllowing provisions:
a) 'lhe request shall indicate the type of data required and the purpose
and legal grounds of their use;
b)
The data rcceiving conlpetent agency (hereinafrer the rccipient) may
use data exclusively for the purposes specified in this Agrccment and undcr
the conditjons slipulated by the data ransmiBing competent agency
(hereinafter the sender), The recipient shall provide information to tho
sender upon request on the use ofthe data Uansferred by the sender;

Prior to the trdnsfer of the datq the sender, having ascertained that
the transfer of thc data was necessary for the purposc indicatcd. ard .,r'as
proportionate lo it and was in linc with its state's intemal lar,vs, shall make
sure that thc data to be transfsrred is concct;
d)
Upon lransferring the data- the sender shall, in line rvitlr its state's
inlemal larvs. indicste the time limits lbr the ret€ntion of data, upon the
expiry of which the recipient musl erase or block the data or review wherher
or not they are slill needed. Irrespcctive of these limits thc data transfcrred
shall be delctcd as soon zrs they are no longer rcquired for the pu4r,ose for
which they were transfened.
e) Data nray be transfened solely Io the authorised competent agencies
referred to in Article I of this Agreemcnt. The data may be forwarded to
other agencics rvith the prior written consent of the sender based on an
examination of the conditions set. forth in Point c);

D The agencies processing the data shall keep records of the data
trarsferrcd and received under this Agreement which shall contain al leasr
the following: lhe purposc and content of lhe data provided, the lcgal gound
of the transmission. thc type of the tbrwarded data, the transmitting and
receiving agency and the time and dale of the tra-nsfcr, and the data
neccssary for the identification of the data subject. On-linc provision of data
shall be automatically recorded. Tlre records shall be kept for the period
specified in the inremal la$s applicable to such dara, but at least for five
years. The records may only be used to supervise the compliance with the
rules of data protection.
(2) The Contrsctiug Parties are requircd to take all the necessary
organiiational and t{rchl)ical mcirsures in order to provide thc ef}icient
protcclion of data. aud against tlre unauthoriscd acoess, disclosure, altcrution
and destrucrion of il without any prelinrinary consent.
(3)
The indcpcndcnt dala prorection supervisory authorities of the
Contractinc Parties which shall bc responsible for ensurinB respect tbr thc
principles arld rtrlcs contained ilr this Agreement sre entitled to control the
compliarce with the rLrles on data processing under this Agreement.
(4)
This Agreenrent does not provide a basis for requests to transfer data
or information lo be used as evidence in criminal proceedings. Data or
intbrmation transfened in line with this Agrcemenr must not be used for
muual assislance in crimiDal matters withoul the prior consent of the
trrurslbrring Contraotiflg Party, ',vhich is to be given in line rvith its state,s
internal laws arrd in compliance with any applicable bi- or multilateral
agreements on mutual assistance in criminal matters.
Article 2I
lnformotion io thc Data Subject
(1)
Tho Contlacting Parties shall en-sue that rhe dars subject is
informed regarding thc processing of hisihcr pcrsonal data by their
competent agencies. Derogation fronr this Anicle shall be allowed r*,hen
such derogation conslilutcs a necessalJ measure in the interest of
protecting state securitl,, public safety or the suppression of criminal acls,
thc rights and ficcdoms ofdata subjecr or others,
(2) When persr.rnal data has been trarsferred, each competent agency
may, in accordance rvith tie provisions of its state's inlemal laws, ask that
the competent agency of the other Contracting party does not inform the
data subject. In such case the latter comp€tent agency shall not infom the
data subject rvithout the prior consent of the competent agency of the other
Conlracting Pany. In auy orher cases rhe recipient pany shall consull the
scnder Party as to whether it may inform the datr subject about his/her
pcrsonal and sensitivc dara kepr in thc rscords ard about the purpose of their
usc. The recipient Party shall conrply with the insrrustions givcn by rhe
sender Party.
(3)
The data subject shall be enabled to obrain, as rhe case may be,
recdfication, crasure or blocking of his/her personal and sensitive data if
these have been processed conkary to the provisions of this Agreement, and

to have remedy if a request for confirmation or, as the case may be,
communication, rectificadon, erasure or blocking is not complied with.
Artlclc 22
Proteclion of Clgssilied Data
To protect the classiiied data and information received in the course
of the inrplementation of this Agreement, the competent agencies shall apply
the lbllowing provisions:
a)
The data classified according to the interna.l laws of the stare of the
sender Pany ransferring thc classified data shall be granred the same level
of protection by thc recipient Party receiving the classilied data as rhe
protection accordcd to the data supplied with the classification marking in
accordance with its intemal lans based on ths table of equivalence
constituting the annex to this Agreement. This annex shall constitute an
integral p8r1 ofthis Agreement;
b)
The sender Parly rransfcring the classified dala shall indicate rhe
period of validiti, ofthe transfened c)assified data;
c)
Ihe sender Padl' transfening the classified data shall noti&
immediately the recipient Party receiving 0re clirssified data in w ting of
any changes related to the data and of any modificarion in their
classification marking or period of validity or the terminalion of the
classification. Thc rccipient Pany* receiving the classified data shall modifo
lhe classilication marking or the period of validity or shall terminate
proccssing it ns classiticd data in nccordance with this norificatioD;
d)
Forwarding any clessificd data transfered under this Agreement to a
third state shall be permitted only with the w tten consent of the aurhorities
or person having competence according to the sender state's intemal la*s;
e)
The sender Parly transfcning the classified data shall be notified
immediately of any violation of thq interoal lau,s serving lhc protection of
the trausfened classified data done by the recipient Party receiving the
classified data, lhe notification shall exlend to the circumstances and
consequences of the violation of the internal laws. the measures takcn to
contain such consequences and the measures taken to prevent any future
riolation of these provisions.

Article 25
Dispute SetflemeDt
(l)
Disputes rhat may arise in relation to the interprelation or the
application of tfiis Agrcement shall be settled by the compelenr agencies by
way of consultations.

Should in course ofthe consultations refened to in pamgraph (l) an
agreem€nt is not rcached. the dispule shall be settled rhrough diplomatic
channels t.ithout involvement ofa rhird pany.
Article 26
Final provislons
(l)
This Agreement shall enter into force on the first day of the second
month follo*,ing lhe day of thc rcceipt of the last rvritien notification
through the diplomatic channels, by which the Contracting Pafiies sha]l
notify each other on the completion of internal procedures necessary for thc
entry into force of this Agreement.
(2)
Arnendments and modilications maybe introduced to this Agreement
upon mutual consent ol the Contracting Parties, which shall be formed as a
separate agreemenl and cnter into force in accordance with the first
paragraph of this Anicle. The agreement tbrmed thereby, shall conslirute an
integral part of this Agreement
(i)
This Agreement is concluded for an indefinite period and it may bc
terminated in rvriting by either Conracting Party through diplomatic
channels at any time. The Agreement shall lose effect on the first day
follorving the lapse of the sixth monlh following receipt of the written
noti fi cation on tenrtinalion

(4)
Either Contracting Party may sttspend the application of this
ngreement in parl or in full for a transitory period provided lhat it violatcs
'fhe Contracting
or jeopardises its sovereignty, security and public order.
Panies shall notify one another of inroducing or withdrawing such
measures tllrough diplomatic channels in writing without any delay. The
snspension of the itnplementation of this Agreement or its withdrawal shall
enler into lorce on the date ofreceiving ttle relevant notificalion.
(5)
The Article 22 and the aanex of this Agreement shall lose effect on
the day when the separate agreemenl regulating the exchange and mutual
protection of classified information enters into force between the
Contracting Panics.
(6)
1'he Contracting Pnrties sholl inform eBch other through diplomatic
channels on the names and contact details of the comPelent agencies as
undcr Anicle point of this A$eement, as well as on the names ancl
uontac( details o[ the agencies to implcmcnt the provisions ofArticles 8, I I
antl l5 and to supervise the provisions of Article 22 of this Agrecment,
wjthin thirty (30) days aftcr this Agreement enters inlo force, Thc
Contracting Panies shall infomt each other though diplomaric channels.

of their compelent agencies.
