(3)This Agreemcnt shall not affect thc commitmcnts ofboth Parties lvhich stem irom other international agreements and shall not be used against the interesls, securityand territorial integrityof othcrstatcs. ARTICLE 2 Definltions For the purpose ofthis Agrecment: a) "Classified informrtion- means any information, document or material, regardless ofils physicalform, to which a particular classification levelhas been assigned in compliance with the legislations of the states of the Part,es and which shall be protected accordingly; b)"Classification level'means a catetory which, according to the legislation of the state of the Party, determines certain restriclions of access to classified information, measures of protectionand markings; c) "Contmctor' means an individual or a legal entity possessing the le8al capacity to conclude contracts according to the terms set forth in this Agreement and the legislations ofthe states ofthe Parties; d)"chssified contracf means any conrract, agreement or projeci tha! contains or involves access to classified information, or on the basis of which such information is generated; e)"Breach ofSecurlg/ means an act or omission conirary to the letislation of the state of the Party which results or may result in unauthorized disclosure or destruction, inisappropriation, damage or loss of alassificd information; 0 "OrigiDating party' means the Party including legal public and private entities oftle state of the respective Party, which generates and releases classified inFormation; g)'Recelvlng party' means the Party including legal public and private entities of the state of the respectlve Party. which receives Classified information; ▼ h)"Personnel securlty cleamnce certificate' means a document issued in accordancewith the legislation ofthe states ofthe Parties, which ascertains the ability of an individual to have access to classified info.mation in accordancewith Lherele!'antlegislationof his/herstate; i)'Facility sccurity clearauce cer(ficate" mcans a document issued by the Competent Security Autho ty, which ascertalns the physical and organizational capabllities of a legal entity to use and store classified information in accordance with the relevant legislatio n ofirs state, j) "Competent Securlty AuthoriB," means the insti!ution listed in article 3, empowered with authority ar national level which, in compliance with the legislations ofthe states oftle parties, €nsures the unitaryimplementation ofthe protective measures for Classilied information; kl'Need-to-know" means the prlnciple, according to which access to classitied lnformarlon may only be granted to a person who has a verified need to know such information in aonnection with his/her official duties, within the frametvork of which the information was released ro the Receiving party. (3) In order to achieve and maintain comparable standards of security, the Competent Secu ty Autlorities shall, on request, proyide each other with information about the security standards, procedures and practices for the protection of classitied ,nformation applied by the Parties, To this purpose, the may also agree on mutual visits in both states by Co npetent Security Authorities authorised omcials. (4) Ifthe need arise, the Competen! [3) The Competent Securit/ Authorities shall inform each other aboul any modifications regarding the personnel security clearance cerlillcates and facility security clearance certificates, which are connected to the cooperation under thisAgreemenL (4) On r€quesr, the ComPetent Security Auihorities of the Partics, taking into account the legislations oftheir states, shall assist each orher in the procedure of granting the personnel security clearance certificates and the facility security clearance certificates oftheir nationals living or faciliries located on the territory ofthe state ofthe other Party, [5) The Parties shall mulually recognize the pe.sonnel and faciliry security clearance certificates issued in accordance with the legislations of tIe states of the Parties, as regards tle access to classified information exchanged under thls AgreemenL ARTICLE 6 Measures ofprotection (1) ln compliance vvith this Agreemen! and th€ legislations of the stat€s of the Parties, the Parties shall implement all appropriaLe measures for the protection of classified information which is exchanged or created under this Agreemenl The same level of protection shall be ensured for the received classilied information as it is provided for the national classified intormafion with the equival€ntclassificationlevel accoadingtoArticle4. [2) The receiving party shall mark the received classified information with irs ou/n national classification Ievel, in accordance with the equivalences referred to in article 4. (3) The receivin8 party shall neither use a lo\,,,er classification level for the received classified information nor declassiry ihis information without the prior writt€n consent of the originatin8 parry. The originating party shall inform the rcceiving party, tlrough its Competcnt Security Authority ofany changes in the classificationlevel of theexchanged information. (4) The assignment of a classification level lo iointly created classified information, its change or the declassilication of this information shall be made upon common consent ofthe Parties. (5) Each Party shall ensure that classified information received from the othcr Party is used only for the purpose forwhich such information has been released. The originating party may impose special requlrements for the released classilied information, [6) TraNlation and reproduction of classified information shall be made according to the followlng procedures: a) the individuals shall hold the appropriate personnel security clearance certiricales; b) tle translation and the reproduction shall be marked and placed under the same protection as the original classified Information; c) the translations and the number of reprodu€tions shall be limiled to that required foa omcial purposes; d) the translation shall bear an appropriate note in the language into which it is translated indicating that it contains classified information received from the o ginatingparty. (7) Translat,oni and reproductions of classilied information may be limited or excluded by th€ originating party. (B) Classified information marked as LdllRoJR LJOPIBq0/STRICT SECRET shall be translated and reproduced only with the prjor written consent of the originatinB party. The originating party shall be promplly notilied about destruction. ARTICLE 7 Transmlssion of classifi ed lnformation [1) Classified informarion shall be transmitted by diplomatic channels, military courier or other ineans a8reed on by the Competent Security Authorities, in accordance with the le8islations o[ their states. The receiving party shall acknowledge in writing the receipt ofthe classified information. [2) lfa large consigdment containing classified information is to be transmined the Comperent Security Authorities shall agree upon the means of transporration, the route and securify measures foreach such case. ARTICLE 8 Visils (1) Visits entailing access ro classified informarion by cirizens ofthe srare ofone Party to the territory ofthe state of the other Party are subject to prior wrinen authorisation given by the Competent Security Authority of the host party, accordlng to the Iegislation oflts state. (2) The request for visit shall be submttted at least twenty days before the visit !hrough the Competent Security Authorities, unless otherwise agr€ed between lhem, ln urgent cases, the request for visit shall be rmnsmitted at least five working days in advance. (3)The request for visit shall includer a) visitor's first and last name, place and date of birth, nationality, passport or identifi cation card number; b) name of the establishment, facility or organisation tle visiloa represents or belongs to, c) nameand address ofthe esrablishmenr, facility or ortanisation to be visited; d) confirmation of the visitoy's personnel security clearance certificate, its validity and tle classification level ofthe information up to which it may grant access; e) obrect and purpose of the visit or visits; 0 expected date and duratlon of the rcqucstcd visit or visits, and in case of ― recufilng visits, the total period covered by thevisits should bestated; g) name and phone number ofthe contact person at the esfablishment, facility 0r organisation to be visited, previous contacts and any other information useful to detennine the justification of tle visit or visits; h) date, signature and stamping of the otficial seal of tle Comperent Security Authority. (4) The Competent Security Authority ofthe Party receivint the requcst for visit shall lnform, in due timq the Competent Security Authority of the requesring Party about the decision. (5) orlce the vlsit has been apprcve4 the Competent Sedrrity Authority of the host Parfy shall provide a copy of the request fo. visit to the securiry omcer of the establlshmem, facility or oBanisation to be vlsited. (5) The validity of the visit authorisation shall not exce€d twelve months. [7) For classifled contracts t]e Parties may agree on lists ofautho zed persons to make recurrinS visits. Those llsts are valid for an lnitial period of twelve months. Further details of the recu..ing vislts arc subiect to the co-ordination directly between the representatives of the entitles ilvolved, according to the terms and conditiorls agreed upon. (8) All visltors shall comply with the sgqurlty regulatioN and instructions of the host Party. V (9) The Pardes shall gu.rante€ the protedion of personal data of the visitors according to the legislations oftieir states. ARTICLE 9 Classilied contracts (1) ln the event that a Patty or a legal entity of its state intendr to conclude a classiffed contsct to be performed within the teritory of the state ofthe other Party, then tle Party on whose state territory tle pe.formance is taldng place wlll assume responslblllty for th€ protectlon o[classified information related to tha conEact ln accordanct wlth the leglslatlon oflts state alrd this AgreemenL (2) 0n request, tle Competent Security Authorldes shall confirm whether the proposed contractors as well as the individuals participating in pre-contractual negotladons or in the performance of classified contracts have been issued approprtate facllity secudty clearance certif,cates ard personnel security clearance certincates, before accesslnt classified infomalon of the originating party. (3) Every classihed contrad con.lud€d between conh-actors, under the provlslons of tiis Agreement, shall include an appropriate security annex identlMng at leasttie following aspects: a) a listing of dassiffed information related to the classified contract and its classificationlevels; b) procedure for the communication ofchanges in the classifiaation levels of the exchanged information; c) communication channels and means for electromagnelic transmission; d) procedurc for the transportation ofclassified informalion; e) an obligation to notiry any actualor suspecled breach ofsecurity. [4) A copy ofthe security annex ofany classified contract shall be forwarded to the Competent Security Authority of the Pany on whose territory the classified contract is to be performed. in order to allow adequatc security supervision and control. (6) Any sub-contractor must fulfill he same security obligations as the contraclor, [7) The Competent Security Authorities may agree on mutual visits in order to analyze the efficiency of the measures adopted by a contractor or a subcontractor for the protection of classified information involved in a .lassified contracL [8) The Parties shall ensure protecdon ofcopyrights, industrial property rights including patents, trade secrels and any other rights connected with the classil'ied information exchanged between their states, according to the legislations of their states. (9) Further detailed procedures related to classified conrracts may be agreed upon berween the Competenr Security Authorities ofthe Parties. V ARTICLE 1O Brcach ofsecurity [1) In case ofa breach of securiry involving classified information originared by and received from the other Party, the Competent Security Authority in whose state the breach occurred shall inform the Competent Security Authority of the originating party as soon as posslble and cnsure the appropriate investiSation. The Parties shall, ifrequired, cooperate during the investigation. 9 (2) In lase the b.each of security occurs on the territory of a third state the Competent Security Authority ofdle dispatching party shall take tle actions as of paragraph 1. (3) ln any case, the Conpetent Security Authority of the receiving party shall infom the Competent Securlty Autho ty of the orlglnating party in writing about the circumstances of the breach of security, the extent of the damate, the meanrres taken for its mitigadon and the outcome of the hvestigation. In any case such notlficadon must contain enough details so that tle originating party may fully assess tle consequences. ARTICLE 11 Settlemeht ofdisputes Any dispute regarding the interpretation or application of this Agreement shall be settled by consultations and/or negotiations between the Parties and shall not be referred to any national or international court or third Party for selllemenl Pendlng such consultations, the Parties shall continue to fullil their obligations deriving from this AgreemenL ARTICLE 12 Expenscs Each Party shall cover its own expenses illcurred in connection with tle implemsntation of this AgreenenL ARTICLE 13 Final provislons V (1) This Agreement is concluded for an indefinite period and shall enter into force on the first day ofthe next month following the day ofthe receipt ofthe last written notification, by which the Parties shall noriry each other on the completion of internal procedures necessary for tle entry into force of rhis AgrccmenL (2) Changes and additioN may bc rnlroduccd !o the Agreemen! upon murual consent oftle Parties, which shall be formcd as a separate document.nd entcr into force in accordance with th€ first paragraph of this article. The document formed thereby, shall constitute an integral part ofthis Agreement. 10 (3) The Parties shall promptly noliry each other of any changes to thc legislations of their states that would aflect the protection of classified lnformation under this AgreemenL ln such case, the Parties shall consult to consider possible changes to this Agreemenl In the meantime, classilled informatlon shall continue to be protected as provided herein. (4) Each Party has the right to terminate this Agreement in writing at any time. ln such a case the validity ofthe Agreement shall expire 6 monrhs follorvlng the day on whlch the termination notice was rcceived by the other Parry, (5) Notwithstanding the termination ofthis Agrcement, all classified information exchanged under this Agreement shall contjnue to be protected in accordance with the provisions set forth herei'l until the originating party dispcnses the receiving party from this obligation. (3) Prezentul Acord nu va afecta obliSatiile cclor doutr Pr4i cc dcrivtr din altc acorduri internalionale ti nu va Ii folosit impotriva intereselor, securitllii $i lntegrittr9i terltoriale ale altor s!atc. ARTICOLUL 2 D€finilii in sensul prezentului Acord: a)"lnformafle Clasificattr" lnseamntr orice informagie, document sau materlal, indiferent de forma fizicl a acesteia, cereia i s-a atribuit un anumlt nivel de clasificare in conformitate cu legislatiile statelor Ptr4ilor ti care va fi protejatl corespunzator; b),,Nlvet de Clasificarc'lnseamni o categorie care, ln conformitate cu legislalia statului P:4ii, determinl anumite restri4ii privind accesul la informalii clasificate, mtrsuri de proteclie Ii marcajej c) .Contrachnf lnseamnl o persoan6 fizictr sau iuridica abilitat, sa incheie contracte ln conformitate cu cerinlele menlionate in prezentul Acord ti cu Iegislaliile statelor Peqilor; d)"Contract Clasificaf lnseamnl orice contract, acord sau proicct care conllne sau lmplictr accesul la informalii clasiticate sau in baza caruia sunt generaie aslfel de informalii; e)Jncident de Securitate" inseamntr o acliune sau omisiune aontrartr legislaliei statului Pe4ii care are sau poate avea drept rezultat dezvSluirea sau distrugerea neautorizat , insu$irea ilegald, deteriorarea sau plerderea informatiilor clasiRcate; 0 ,Partea EmiteDti" lnseamnl Partea, inclusiv persoane juridice de drept public sau privat din statul Plrlil respective, care genereaz, Si transmile informalil clasifi cate; g),Partea Prlmitoare'inseamntr Partea, inclusiv persoane juridicc de drept public sau privat din statul Pr4ii respective, care primcate informatii claslficate; V h),Certificat de Securitate a Pcrsonalului'tnseamntr un document emis in conformitate cu legislatia statelor Ptr4ilor, prin care se atesg abilitarea unei persoane de a avea acces la informali clasificate ln conformitate cu legislatia relevant a statului acesteia; i) ,Certlficat de Securitate Industriali" inseamntr un document emis dc Autoritatea Competenttr de Securitatg prin care se atesttr ctr o persoanl Juridice arc capacitarea fizid ti organizatorictr de a utiliza tl dePozlta lnforma!ii clasificate,in conformitate cu lcBislatia rclevanti a statului stru; i) .Autoritate Competente de Securitate" inseamnl institulia menllonat, la arL 3, lnvestittr cu autorilate la nlvel nalional care, ln conformitate cu legislaliile statelor Ptrrlilor, asigurtr implementarea unirarl a mlsurilorde prole.tie a info rmaliilor clasificate; k),Necesltatea de a cu[oatte" inseamntr principiul conform cJruia accesul la informarii clasilicate poate fi acordat numai acelei persoane lndreptelir, si cunoasca asffelde lnformatii,ln virtutea lndatoririlor sale de serviciu, ln contextul in care informaliile au fosttransmise Ptrrlii Primitoare. ARTICOLUL 6 Misuri de protecge (1) in conformitate cu prezentul Acord ti cu le8islaFite statelor Plrlito., Prriilc vor implementa toate mlsurile corespunz5toare pentru protecria informatiilor clasificate schlmbate sau produse ln baza arestui Acord. Pdrlile vor asigud pentru informaliile clasificate primite acelati nivel de proteqie ca ti penlru informatille clasificate nationale avand nivel de clasificare ech,valenL in conformitate cu arl 4. (2) Partea primltoare va marca informaliile clasificate primite cu proprllle niveluri de clasificare nalionale, in conformitale cu echivalenlele prevtrzule la ‐ arL 4. (3) Partea primitoare nu va sctrdea nivelu) de clasificare al informaliilor clasificate primite $i nici nu va declasilica aceste informalii feri acordul prealabilscris al p!4ii emitente. Parlea emitenttr va informa Partea primitoare, prin Autoritatea Cornpetenta de Securitate, asupra oricdror modifictrrl survenite in nivelurile de clasificare ale informaliilor schlmba!e. (4) Atribuirea unui nivel de clasilicare pcntru informaiiile clasificate create ln comun, modifi@rea acestuia sau declasiticarea acestor informalii se va reallza cu acordul Pa4ilor. (5) Fiecare Parte se va asigura ctr informaliile clasincate primite de la cealalt! Parte vot fi utilizate doarin scopul pentru care acesteaau fost transmise, Parlea emltenttr poate impune cerinle specificc pentru informaliile clasificatc lransmise. ▼ (6) Traducerca gi multiplicarea informaliilor clasificate se vor realiza conform urmtrtoarelor proceduri: a) persoanele trebuie str detintr certili.ate de securitate a personalului corespunzitoare; b) traducerea copia vor fi marcale $i protejate ln acela$i mod ca Si informaliile clasifi cate originale; c) traducerlle ii numrrul copiilorse vor limita la cel necesar scopurilor oficlalei d) traducerea va conline o [ot{ corespunzitoare in limba ln care a fost efectuari traducerea, in care se va specifica faptul c: aceasta contine informalii clasificale primite de la Partea emirenti. ti (7) Traducerile ti multipliclrile informaliilor clasificate pot fi limitale sau excluse de citre Partea emitenti. (B) lnformaliile clasificate marcate sruliad saidumlo/STRICT SECRET vor fi traduse ti multiplicate numai cu acordul prealabil scris al Pe4ii emitente. (9) lnformaliile clasificate marcate gansakuTrebuli mniSvnelobis/STRICT SECRET DE IMPoRTANTA DEOSEBITA nu vor fi multiplicate de cArre Partea primitoare ti vor fi traduse numai cu acordul prealabil scris al Pl4ii emitente. (10) Distrugerea informatiilor clasi,lcate se va realiza ln conformitate cu legisla!ia statului Pr4ii primitoare astfellncat reconstru4ja pariiall sau tor.l, a aceslora s5 nu fie posibiltr. Partea em,tenta va li imediat notilicatl cu privire la disrrugere. lnformaliile clasificale gansakuTrebuli mnisvnelobis/STRlcT SECREI DE IMPoRTANTA DEoSEBITA nu vor fi distruse, ci returnate Pirlii emitente. ー (11) In cazul ln qdre este imposibil! protejarea sau returnarea informaliilor claslflcate generate sau transmise ln baza prezentulul Acord, acestea vor fj distruse imediat. Partea primitoare va notifica ln cel mai scult timp Partea emltenttr cu privire Ia dislrugerea informaIiilor clasiflcate. (12) Paftea primitoare nu va disemina informaliile clasilicate primite sau creale ln comun ln beza prezentulul Acord ctrtre niciun siat te4, organizalje internalionalr, entitate sau cetilean al unui stat te4 IU re acordul prealabil scrjs alPar'ii emitente. ARTICOLULT Tmnsmiterea lnformaliiloa ctasifi cate (1) Informatiile clasificate vor fi transmise prin canale djptomatice, curicri militari sau alte mijloace convenite de Autorittrgile Competente de Securitare, ln conformltate cu legislaliile statelor acestora. Partea primitoare va confirma ln scris primirea i nformaliilor clasificate. (2) Daci existi un volum mare de informalii clasificate ce trebuie tmnsmis, Autorlttrtlle Competente de Securitate vor conveni mijloacele de transport, traseulti mesurile de securitate pentru fiecare cazln parte, [3) lnformaliile Clasific?te vor li transmise electronic in form; criprata, prin urilizarea mijloacelor ti dispozitivelor criptografice acceptace reciproc de Autorittr$le Competente de Securitale ln conformitate cu legislaliile statelor acestora, 6 ARTICOLUL 8 Vizite (1) Vizitele ce implici acces la informatii clasificate efectuate de cetilenii din statul uneia dintre PI4i pe teritoriul statului celeilalte pirIi sunt supuse aprobArii prealabile scrise a Autorit,lii Competente de Securitate a pe4ii gazdi, inconformitate cu legislaliastatului acesreia. (2) Cererea de vizitl va ll transmistr cu cel pulin dou5zeci de zile inainte de vizittr, prin intermediul Autoriglilor Competcnte de SecuriLate, dace acestea nu au convenit altfel. In cazuri urgente, cererea de vizittr va fi transmisa cu cel putin cinci zile lucrtrtoare ln avans. (3) Cererea de vizittr va cuprinde: ν a. numele ti prenumele vizitatorului, data $i locul nagterii, cetelenia, numtrrul pataportului sau al cerfii de identitate; b. numele instituliei, companiei sau organizafiei pe care o reprezinlA sau din ca.e face parte vizltatorul; c. denumirea ti adresa inttitufiei, companieisau organizatiei ce urmeazE sl fievizitati; d. conJirmarea delnerii certilicarului de securitate a personalului de ctrtre vizitator, valabilitatea aces[uia ti nivelul de clasillcare al informaIiilor pantr la care acesta poate acorda acces vizitatorului; e, obiectiwl tiscopulvizitei 5au vizitelor; I data ti durata preconizate pentru vizira sau vizitele solicitate, iar in cazul vizitelor repetatq se va mentiona perioada totall a acestora; ▼ g. numele ti numrrul de telefon ale persoanei de conract din cadrul institutiei, companiei sau organizatiei ce urmeazi a fi vizitate, contactele antedoare ti orice alte informalii utile pentru iustificarea viziiei sau vizitelor; h. data, semnetura $i gtampila oficialtr a Autoritefii Competente de Securitate, [4] Autoritatea Competeng de Securitate a Pl4ii care primette cererea de vizit va informa. ln dmp util, Autoritalea Competenti de Securitate a Perlii solicitante cu privire la decizla luat . [5) Dupi aprobarea vizitei, Autoritatea Competenttr de Securitate a Pi4ii gazdd va transmite functionaruluj de securitate din institulia, compania sau organizafia ce urmeaz, a fi vizitrti un exemplar al cererii de vizittr(6) Valabilitatea autorizafieide vizitl nu va deptrti doutrs prezece luni, [7) ln cazul contractelor clasificate, Pl4ile pot conveni asupra unor liste de persoane autorizate penlru efeatuarea de vizite repetate. Aceste liste sunt valabile pentru o perioadtr initial, de doutrsprezece luni. Detaliile privind vizitele repetate vor fi stabilite direct de reprezentantii organizaliilor implicate, ln conformitate cu termenii Sl conditiile convenite. (8) Toli vizltatorii vor respecta reglementlrile Si instrucliunile de securitate ale Pd4ii gazdA. (9) Pe4ile vor Sar.nta proteqia datelor p€rsonale ale vizitatorilor in ー conformitate cu legrslatjile statelor acestora, ARTICOLUL 9 Contracte clasificate (1) ln cazul in care o Parte sau o persoani juridlctr din statul siu intenrioneazl sl lncheie un contract clasihcat ce urmeaze a se derula pe teritoriul statului celeilalte Ptr4i, atunci Partea pe teritoriul ctrreia se deruleazl contractul iti va asuma responsabilitatea de a proteja informaliile clasificate Iegate de contracl in conformltate cu legislalia statuluislu $i cu prezenlul Acord. (2) La cerere Autoritltile Competente de Securitate vor .onfirma dactr au [ost eliberate Certificate de Securitale lndustriall ti Certificate de Securitate a Personalului corespunzltoare persoanelor $i contractanlilor proputi str participe Ia negoci€rile pre_contractuale sau la derularea contractelor clasitlcate anterior accese rii de ctrtre acettia a informaliilor clasificate ale Plrliiemilente. ▼ (3J Fiecare contract clasificat incheiar lntre contractanli, in conformitate cu anextr de securitate prevederile prezentului Acord, va cuprinde pulin aspecre: cel urmetoarele care suntmen!ionate corespunztrtoareln gestionate tn cadrul contractului clasificate a) lista lnformaliilor ale acestora; clasiricatSl nivelurile de clasificare b) procedura de comunicare a modificirilor aPirute in nivelurile de o clasificare ale i nformaliilor schlmbate; c) canale de comunicare ti miiloace de transmitere electromagnerrctr; dJ procedura de transporta informaFilor clasificate; ej-oUtigalia de a informa despre orice incident de securitate survenit efectiv sau posibil, (4) 0 copie a anexei de securitate a oricArui contract clasificat va fi transmistr AutoritElii Competente de Securitate a Ptrrlii pe teritodul clreia urmeaztr se se deruleze contractul clasificat in vederea asigurtrrii unei supravegheri si unui control de securitate corespunzitoare. (5) Contractele clasificate care implic5 informalit SezRudull sargeblobisTvis/SEcRET DE SERVICIU vor conline o rlauz; in care sunt specincate mlsurile minime ce urmeaztr a fi implementate pcntru proteclia acestei categorii de lnformarii Ctasificate. [6) orice sub-contractant trebuie str indeplineasctr aceleati obligaiii de securitate ca Si Contractanlul. [7) Autoritelile Competente de Securitate pot conveni asupra unor vizite reclproce in vederea analizirii elicienlei mdsurilor adoptate de contractant sau de sub-contractant penlru proteclia informatiilor clasificate vehlculate tn conlractul clasificaL [B) Pe4ile vor asigura proteclia drepturilor de autor, a drepturilor de proprietate indusrrialtr - inclusiv licenlele, secretele comerciale $i a orictrror alte drepturi legate de informatiile clasificate schimbate intre statele lor, in conformitate cu legislaliile statelor Ptr4ilor. [9) Autorititile Competenle de Securilate ale P54ilor pot conveni ti asupra altor proceduri detaliate referitoare la contractele clasificate. ARTICOLUL 1O hcldente de securitate [1) ln cazul producerii unui incident de securitatc care implic, informalii claslficate emise ti primite de la cealalttr Partg Autoritatea Competenttr de Securitate din statul ln care s-a produs incidentul de securitate va informa imediat Autoritatea Competentl de Securitate a Plrtii emitente tl va asigura investigalia de securitate adecvatl. DacI esre necesar, Pi4ile vor coopere pe parcursul investigaliei. (2) ln situatia tn care incidentul de securitate are loc pe teritoriul unui stat (er!, Autoritatea Compelenttr de Seauritate a P64ii care a transmis informaliile va a4iona conform alin. (1), 9 (3) ln oricare dintre cazuri, Autoritatea Competenttr de Securitate a pe4ii primitoare va informa ln scris Autoritatea Competent, de Securitate a pedii emltente cu privire la circumstanlele producerii incidenfului de securitate, lntinderea prejudiciuluL mrsurile adoptare penlru drmtnuarea prejudiciului $i rezultatul investigafiei. In oricare dintre cazuri notincarea respectiv, trebuie str cuprindi suficiente delalii pentru ca Partea emitenti si poatd evalua De deDIin aonsecinlele. ARTICOLUL 11 Solutlonarea difercndclor orice diferend privind lnterpretarea sau implementarea prezentului Acord se va soluliona prin consuluri $l / sau negocieri tntre prrti ti nu va fi deferit spre solulionare unei instante nalionale sau internalionale ori unui te4 Pe durata consulgrilor, Pd4ile vor continua sa-9i lndeplincasci oblitatiile cc derivtrdln prezentulAcord. ARTICOLUL 12 Cheltulel: Flecare Parte va suporta cheltuiellle propril generate de implementarea pre2entului Acord ARTICOLUL 13 Dlspozilil finale (1) PrezentulAcord se lncheie pe o perioade nedeterminatd de rimp ti inrri tn vigoare ln prima zi a urmitoarei luni de la data primirii uliimei notificlrl scrise prin care Prrfile se informeazl reciproc de faptul ctr au Fost indeplinite procedurile interne necesare pentru intrarea in vigoare a prezentului Acord. (2) Prezentul Acord poate fi modillcat ti completat pe baza consimitrmantului reciproc al Pl4ilor. Modificerile vor forma un document separat ti vor intra in vigoare ln conformitate cu alin.[1) al acestui articol. Documentul astfel constituit va face parte integrant din prezentul Acord. (3) Plrllle se vor informa reciprog cu promptitudine, cu privire la orice modifictrri survenite in legislaliile statelor acestora care ar putea afecta protectla lnformarillor clasificate la care se referl prezentul Acord. ln accst caz, Ptrrlile se vor consu^lta ln legrtur: cu oportunitatea unor posibile modrficiri alc prezentului Acord. In tot acest timp, informaliile clasificate vor contjnua sI fie proterate conform prezentului Acord. 10 (4) Fiecare Pafte are dreptul str denunle oricand. in scrit prezentul Acord, In acesl ca& valabililalea acestuia expirtr duptr 6 luni de la data la care notificarea de denunlare a fost primirl de cealall-I Parte.
