The Agreement between the Government of the Republac of Turkey and the Govemment Georgia tor Cooperation on Military Fields of Training. Technics and Science dated 04 Aprit, 1996 have agreed on thc topics listed below; V ART!CLE l DEF!NIT:ONS The fo‖ owing dennitiOns sha‖ apply in this Memoranduln of understandingi 1. Sending Nation (SN) For the purposes of this Memorandum of Understanding, the nation sends the troops that shall deploy together with the supportang comporEnts as well as civtla components, ships, aircraft, vehicles, ammuntion. equipment, missile and air, sea and g operational sources to the tenitones, arrspace and tenitorial waters of the Host Nation to condu the exercrse 2. Host Nation (HN): For the purposes of this Memorandum of Undectanding, the nation welcames and hosts the PARTIES ofthe SN within its bo.ders. 3. Host Nation Support (HNS); The civilian and military services provided by the HN to the dunng the execution of the exercjse. 4 Military Authorities: This is the appropriate institutaon or military unit selecled among ∨ PARTIES or the determined Armed Forces that are stated in the application order if n€cessary 5 Training Tenain: The terrain or sea aree as well as the airspace over it prepared by the HN the execution of the exercise and lemporarily allocated for the use of the PARTIES 6. Exercises and Trainings lt covers the commitments and unrlateral, bilateral and mult‖ a exercises that involve units and individuals and also exchange of units and transfer of authonty unitsi it does nol cover the trainings ol the individuals in the courses 7. Senior Representativ€ of the Sendang Nataonr The senior foreign personnel who has suFrervrsion and control authority over the p€.sonnel sent by the participating nations to serue the exercrse or to take pan in the Observer's Oay. ln the event that the SN representatives sent partrcrpate in the Observer's Day are senior rn rank and position to the senior representative of sending nation, the most senior personnel parlicipatang in the Obseruer's Oay shall b€ the Representative of the Sending Natron and shall be entitled to use the nghts and author.ties in this Mernorandum ot Understandrng from the beg nnrng of the Obse.ve. s Day until the end Observer's Day and the personnel panicipating in the Observeas Day leaves the HN 8. Note of Accession: The document that rndrcates the final resolution about the partrcipation of nations invited to the exercise by the HN. 9 Nole of lntention: The document that declares the intention about the particapation ofthe natlon invited to the exercise by the HN. ARTICLE 2 A:M ANO SCOPE 1. The purpose of this Memorandum of Understanding is to dent(y policies, responsibilities an general procedures regarding the realization of the services to be provided by the HN lo th PARTIES in the scope of this exercise and HNS. This fulemorandum shall also clarify standards. types, levels and methods ol the support to be provided by the HN to the SN during erercise 2. Thrs Memorandum of Understanding shall not be construed to affect the existing rights a obligations of the PARTIES under olher intemational agreements to which they are PARTIES ARTICLE 3 RESPONSIBILITIES OF THE HOST NATION V Wthin the framework of the provisions of this Memorandum of UMerstanding; 1 HN shall invite the panicipating nations to the exercise in a timely manner' 2 ln compliance with the ratrfred exercise and supported plans, by delegating power and taking necessary measures, HN shall assist in a Receiving the SN forces in the Specilied Entry PoinuPoints b. ARTICLE 4 RESPONSIBILITIES OF THE SENOING NATION Within the lramework o{ the provisions of this fi,iemorandum of Understanding the Sending (SN)lorce 1. During the exercise, if it has any demand about the protedion of its forces part'cipating in t e)(ercise it shall no(ify the HN authorities of these demands within a reasonable time frame the erercise stans. 5 ARTICLE 5 LOGISTICS ANO FINANCE 1. Exercise and training aclivities shall be conducled using the preseni National Logistic Sup Plans and wthin the capabilities and procedures of the HN. 2. The military personnel of the PARTIES shall record the procedures followed among PARTIES, 3. The military authorities of the HN shall not provde the SN any services except those identified this MOU. ln case of a request by the SN for any good or servic€, these goods or services rnay procured from the market provided lhat the SN bear the prices and for this purpose, the SN make a contracl with the third persons. 4. No requests shall be made for tax exemption or reduction in any way in the acls of procurem ol goods and services relaling to the contract that shall be made by the SN authorities with third persons wthrn the framework of the abovementioned article. 5. The HN shall conducl the taxation and customs procedures to the extent that the cunent regulations and intemational agroements allow considering the most convenient conditions to interest of the SN 6. The SN shall obey the provisions and lhe procedures of the HN for taxation and custo depending upon the related bilateral Agreement. 7 The SN, if nec€ssary and upon the request of the HN, shall assign liaison personnel at entry departure pornls for the coordination of all the logistic activities with the civilian authonties. I The SN shall not transfer the capability of supporl and servic€ temporarily or permanently another nation or organization without the written consent of the HN. 9 The weapon ammunition and equipmenl brought by SN will be kept under lock and key i place that will be allocated by the HN except for the exercise no personnel shall have and ca ∨ weapon and ammunitron on himself in the ciulian environment Upon the request of the SN, HN may allow the use of weapon, mate.ial equipment and ammunrtion to be used during exercise temporanly and free of charge. \ryhether the provision of said weapon, m equipment and ammunition is possible or not shall be established by the HN. 10 Allthe materials provided forthe SN force for temporary use shall be used carefully and for the conosaon during the normal use; they shall be delivered to the related military adhorities the HN in the same condition as in the time when they we.e taken. 1 1 The SN and the HN may agree upon the matter that the payment will be made in the form cash or transfer of equivalent money for the suppo( items and services that cannot be pr free of charge through bilateral agreement ln addition; a. The payment to be made for the purchases of the HN trom civilian companies on beha th€ SN forces may not be a greater than that HN would make lor its purchase$. Additionally, diffsr€nces such as delivery schedule and location a.e taken into account b. The greater amount ot expenses than the one paid by the HN for the materials and servi transfened by the HN for the SN shall not be borne 12 Any expenses on behalf of the SN without the knowledge of the SN authorities shall be avoide and no property and service shall be purchased without the information of the SN authorities. The SN shall use the tacilities of the HN and conduct the training activities in accordance the HN and its armed forces security rules and regulalions. 19. The SN members shall comply with the legislation of the HN and shall not have political acts discourse during their stay withln the borders of the HN. 2. ln the events b€tween the SN personnelthal are not regarded as cnme according to HN law mvrtng the execution of the penal and disciplinary legislation according to Military Disciplinary Law the mihary dasciplinary legislation of the SN shall be apptied. 3 ln the events between the SN personnel and the HN and olher PARTIES lhat are not regarde as crime accordrng to HN law but inviting the execution of the penal and [rilitary discrplt legislalron the said event shall be reported to the senior representatrve of the SN whose person rs thoughl to have violated the dtsqpline and a requesl shall be rrade for the necessary actron Th senior representative of the SN shall give the satisfactory information about the action taken for event to the demanding PARTY 4. ln lhe event of the sirhes thal were commitled by the SN personnel against its own person the HN personnel or olher SN personnel withrn the borders of the HN and that are not included i disciplrnary legislation. the taw and tegislatlon of the HN shall be applted and the authority shall the courls ot the HN. 5. Ihe PARTIES shall make no claim for pecuniary damages and the damages for mental angur aboul the damages to other's military and civitian properties caused by the pertormance of exercise aclivities or during the exerclse excluding the cases of intention or gross negligence a they shall be regarded as renounced their claims. 6 The PARTIES 6hall bilaterally renounce their claims for pecuniary damages and the dam for mental anguish about the events of injury and death caused by the performanc€ of the aclivit€s or dunng the exerose €xcluding the cases of intentton or g.oss negligence. 7 The claims for pecunaary damages and the damages for mental angutsh em€rging trom damages to thrrd persons (rnctuding the cases of death and rn,ury) caused by the SN membeG account ot duty and within lhe scope of the execution of the exercise activities shall be concl in accordance with the HN Law and only the SN and its personnel shall be responsible for th damages. ln the events that more than one SN member or SN and HN members havo the joi responsihlity, the responsibility sha{ be shared among the retated countries in proponion to deliciencles 8. The claims for pecuniary damages and the damages for mental anguish emerging from damages to third persons (includtng the cases of death and injury) caused by lhe SN mem without ac.ounl of duty and within the scope of the execution ot the exercise ac,tivities shall concluded in accordance with the HN Law and only the SN and ats personnel shall be res for these damages. ln the events that mo.e than one SN member or SN and HN members the joint responsibility, the responsibility shall be shared among the related countnes in proporti to therr deflcisncies. 8 I The SN is obliged to rnform the HN immediately of the situation of and the necossary intormati about rls personnel who leaves the place where he is needed more than 24 hours and who location as not known. 10 ln case of any dispute about which action or activity conslsted of gross negligence or or about whother any action is within the scope of disciplanary legislation or not, the dispute sh be resolved according to the cunent pranciples of HN Law. 11. PARTIES agree upon providing the necessary legal assistance, in this context, upon prep the necessary legal documents together, exchanging the necessary information and and assisting (he investigation agencies with their !,o.k in occunence of any legal dispute 1 2 If any SN personnel are taken into custody under the law of HN the personnel who conduct exercise and the training aclivity shall inform the senior representalives of HN and SN immed of the event 13. ARTICLE 7 coilllxAND At{o coNTRoL 1. Command and control regulations shall comply with the plans and procedures concerning exercise or the plans and procedures agreed by the PARTIES. 2 ln case of engagement, declaration of war or similar events the SN personnel shall not assigned in active operations in any way and the military authorities of the HN shall assrst th recerving instructions from their respecllve Governments ARTICLE 8 SECURITY OF THE CLASSIFIED INFORIIIATION ANO DOCUMENTS AND SAFETY SECURITY OF THE CLASSIFIED INFORMATION AND DOCUMENTS: 1. The collected and exchanged classified information conceming th€ exercise shall be used, saved, controlled and preserved in accordance wth the PARTIES' respeclive national laws regu atrons 2. The ciass ied information shall be forwarded only from Govemment to Govemment or thro the channels approved by the assigned security authorities oI the PARTIES ThiS kind information shall include security classificatign and shall have the security classillcation mark of country \,vhich it belongs on it. h Of 3 Ether PARTY shall classify the information. documents and materials. which a,e provided by other PARTY, at least wth an equal classification degree. which as used by the olhsr PARTY. an shall take the necessary measures to that end. 4. Each partrclpant shall ensure that the access to the classified information is limited to thoge wh have the necessary security authorization and those who have a special need to pa(icipate training or the exercise. 6. The SN shall not give any intormation, document or documents to be provided within lhe of the aclivities performed by its membe.s to other countries without wri(en approval ofthe HN 7. The HN shall not give any informatron, document or documents to be provided within the of the activaties performed by its members to other countries withoul written approval oflhe SN 8. The HN shall prevent the unautho.ized perconnel from entering the arealareas of training and exercise support withorJt permission. SAFETY: 1 . Each panicipant shall observe the measures taken by the HN pertaining to transporl, quarteri and the trarnrng and exercrse areas/factltltes ▼ ART:CLE 9 HEALTH SERVlCES 1. The SN shall be responsible for ensunng that its personnel rs in an appropriate condition terms of health for the participataon in the exercise and that he does not have any physical peGonal rnconvenience in this context. The SN shall submit the medical reporl indicating that medical condition ol ats own personnel is convenient for the participation in the exercise to the 45 (forty frve) days prior to the beginning of the exercise The SN personnel shall set off suffrcient amount of medicine and equipment during the predetermlned movement. 2 The HN shall provide the medical €mergency examination and dental em€rgency treatm during the period from the entry into HN lo the departure. This service shall b€ provided a. Through beneliting from available medical organizations (lnfirmary, Village Clinic, Hospital, General Government Hospitals excluding Special Ooctors and Sp€cial Hospitals) the aciive area of exercise. 10 b Through a first aid station comprised of medical team in the area of exercise. c ln a way to include military ambulance and a driver 3 The medical support and dental treatment support provided for the SN personnet shalt accomplished in a way to include the location and types of the facilities close to the exe arealar€as 4 The HN guarantees that it shall grve the first pflority to the passrng by, entry into and departu from its air space of all aircraft of the SN including evacuation helicopters in accordance wth national procedures in any emergency 5. Along with the emergency medical examination and dental emergency treatment, medi evacuatioh within the borders of the HN sha be provided by the HN (by mititary medi organizations) free of charge ln case of a necessity to transfer a patient to a hospital chosen the SN forces using the c€pabitities ol the HN, the authorities of the SN shafl take responsibility resulting from the exp€nses of transpo.t and the chosen hospital. 6 The authorities of the SN shall make lhe payments for the evacuation to the clvilian hos through aircraft and lor the civilian medical treatment ol ihe personnel provided by the HN utitizi any effective international or bilateral medical or social security agreement tf such an agreement not available, the SN authoritaes shall make the payment directly to the related instrtutions of HN, 7 The medical station shall provide emergency treatment and daaly rounds. The SN shall ensure that all its personnel have been vaccinated againsl the dise determined by World Health Organization before their entry nto the HN, and to that end, personnel shall be obliged to possegs the standard certitlcates of vaccination determined by ▼ Health Organization indicating the vaccination ot the personnel. 10. The SN shall p(event the participation of the personnel who have an illness in the exercise. the event that the personnel who have an illness that wll not cause any tnconvenience in term heallh panicipates in the exercise, it shall be ensured that the medicine of that peBonnel is a taken to the HN with him. ART!CLE 10 PROCEDURES TO BE FOLLOWEDiN THE EVENT OF DEATH OF THE CuEST PERSONN 1 .
