(l) Cchcimhalrungsgrade werden auf E6uchen der zusdndigen Behdrde der herausgebenden Verlragspa(€i von der zust{ndigen Bchdrde der die betreffende Verschlusssache empt'angenden Ve(ragspaflei oder aufderen Veranlassung geanden oder aufgehoben. Sie gewlihren diesen Verschlusssachen innerhalb der Grenzen der jeweiligcn innersraarlichen Geselze und sonstigen Vo6chriften der Venragspaneien mindestens den -7 - gleichcn Schulz wie ar von d.r empfangenden Vcrtragspanci fIr cigcn€ Verschlusssachen dcs vcrgleichbaren Gcheimhaltungsgrads geforden wird. (2) Die Da0er des Ceheimschutzes bcmissr sich nach den jeweiligen innerstaatlichen CeseEen und sonstigen Vorschriften der herausgebcnden Venragspanei. (J) Die Verschlusssachen werdcn ausschlieBlich flr den angegebenen Zwcck verwendct. Die empfangcnde Venragspanei darf Verschlusssachen \ycder bckanntgeben oder nutzen noch ihre Bek6nntgabe oder Nuutzung geslatlen. es sei denn, dies geschiehr fllr die Zlvecke und mil den erw-aigen Bcschrlnkungen, die von oder aufVcrsnlassung der hemusgeb€nden Vcrtragspanci festgel€gt worden sind. Ein€r geSenteiligen Regelung muss die hemusSebendc Venragspa(ei schriftlich zugestimmt haben. (4) Die Verschlusssachcn kdnnen im Einklang mit den jeweiligen innerstaatlichcn Cesetzen und sonstigen Vorschriftcn der Vertragspaneien zuganglich gemacht werden. Die Ermachtigung zum ZuCanE sctzt eine Sicherheitsi:berpr0fung vorsus, dic mindesrens so stren8 sein muss rvic diejenige. die liir den Zugang zu inncrstaadichen Verschlusssachen des rergleichbaren Ceh.imhaltungsgrads durchgelilhrt \vird. (5) Der Zugang zu Verschlusssachen des Ceheimhaltungsgrads boq.ogaq,o / VSVERTRAULICH und hdher durch eins Person mit der Sraatsangehdrigkeit des Slaares einer Venragspartei wird ohnc vorherige Cenehmi8ung dcr hcrausg.bcndcn Vertragspsrlci BeqAhn. (6) Sicherheirsnberpriifungen von Slaa6angehdrigen des Staates der Venragspanei, die ihren Auf'enrhalr im eigenen Staal haben und dort Zugang zu Verschlusssachen benotigen, $erden von dercn zusdndigeo Behorden vorgenommen. (1) Sichcdreitsuberpriifungen von Slaarsangehtiriaen dcs Staatcs eincr Venragspanci. die seil rDindestens f-ttnl Jahren ihren rechtniiRigen Autenthalt im Staat der anderen -E, Vertragspanei hab€n und sich dort um einc sicherhrilsempfindliche Tatigkeit bcwerben, \yerdcn hingcgan von der zustUndigen Behdrde dieser Venragspanci im Einklang mil ihren inneNtaatlichen Cesctzen und sonsiigen Vo.schriften durchgcfllhrt; sie crsucht die zustdndige Bchdrde dcr anderen Vcrtagspanei, gcgebcnenfalls Sich€rheitsprofrrngcn durchzuftihren. (8) Die Venragsparteien sorgen innerhalb des Hoheilsgebietes ihrcsjeweiligen Stoates fUr die Durchllihrung der erford.rlichen Sicherheitsinspektionen und flr die Einhaltung dics.s Abkommens. A.tikcl 5 Vcmichtung und Rllckglbc von V.rschlusssachcn (l) Ve6chlusssachen sind zu vernichlen, wcnn a) sie nicht im Einklang mit diesem Abkornmen geschutzl oder venvendet rverden kdnnen oder b) dic herausgebende Vcrlragspanci ihrc Vernichtung vcrlangl. (2) Schriftliche Verschlusssachen sind so zu vemichren, dass dic Wiederherstellung der in ihnen enthahenen vertmulichcn lnformadoncn ausgcschlosscn isl. (.li Die Vemichtung schriftlicher Verschlusssachen erfolgt im Einklang mit dcn innerstaallichen Gesctzen und sonstigen Vorcchriften der Vcrtragspaneien. (4) Ccgenstlndliche Vercchlusssa.hen sind so zu vernichr.n. dass sic nicht \rieder2uerkennen sind. oder so zu verflndern. dass die volltundige oder tcilweisr Wiedcrherstellung der veftraulichen lnfonnalionen autgeschlossen ist. -9(5) Die heEusgebende Vcrtragspartei isl unvcrzoglich ob€r die Vemichtung zu informicrcn. (6) Auf Erslchen der hcrausgebendcn Vc(ragspartei wcrdcn Verschlusssachcn zur0ckgegeben. Anikel6 Vergabe von Verschlusssachentullrlgen (l) Vor Vergab€ eines Ve6chlusssachenauftrags holt der Auftnggeber 0ber die rllr ihn zustdndige Beh6rde bei der fllr dcn Aufrmgnchmer zustundig.n Behdrdc cinen sicherheirsbescheid cin, um sich vcrgewissern zu konnen, ob der in Aussicht genommene Auftragnehmer der Ceheimschutzaufsichr durch die zustandigc Behurde dieser Venragspanei unterliegt und ob cr die fllr die Durchfllhrung des Vcrschlusssechenauftmgs erforderlichen GeheimschuEvorkehrungen geroffen hat. lst cin Auftragnchmer noch nicht in der Ceheimschutzbetreuung, kann hierum e60cht rvcrdcn. (2) Ein Sicherheirsbeschcid ist auch dann einzuholen. wenn ein Unternehmen zur Abgab€ einrj Angebots aufgeforden worden i$ und im Rahmen des Ausschreibungsverfahrens bereils vor Erteilung des Vcrschlusssachenauftrags Ve6chlusssachen 0bergeben werden m0ssen. (3) In den Fallen der AbsItzg I und 2 wird das folgende vcrfahren sngewendet: l. EEuchen um Ausstellung cines Sichcrhei$bcscheids flir A!ftragnehmer aus dem Sraal dcr andcrcn Vcrtragspartci enthalten Angabcn ober dss Vorhaben sowi. dic An. den Umfang und den Cehcimhallungsgrad der dem AufiEgnchmer vomussichtlich zu llberlassendcn oder bei ihm entstehenden Verschlusssachen. 2. Sichcrheitsbeschcide mijssen nebcn der vollst{ndigen Bezeichnung des - t0 - Untemehmens, sciner Postanschrifi und dcm Namcn des Sicherheitsbcvollmechtigten sowi! desscn Tclcfon- und Faxnummcm und gegebeneflfalls E-Msil-Adresse insbesondere Angaben darubar erhahen, in welchem Umfang und bis zu wclcham Ceheimhaltungsgrad bei dem betreffenden Unlernehmcn CcheimschutzmaBnahmen auf der Grundlage innerstaatlichcr Cesetze und sonstiger Vorschriften gcroffen worden sind. 3. Die zusundigen Behorden der Venmgspsneien teilen es einander mh, wenn sich die den ausgeslellten Sichcrheitsbescheiden zugrunde licgcndcn Sachverhalte lindern. 4. Der AusEusch dicser Mitteilungen zwischen den zusrandi8€n Behorden der Venragspaneien arfolgt in dcr Landcssprache der zu unterrichtendcn Behdrde oder in englischer Sprache. 5. Sicherheitsb€scheide und an die jeweils zustendigcn Behorden der Venragspaneien grrich[cte Ersuchcn um Ausstcllung von Sichcrhcitsbeschciden sind schrifilich zu ubermitteln. (3) Die ,lir den Aunraggeber zustandige Behdrdc benennt dem Auftragnehmer in eincr gesonderten Aufstcllung (Einsrufungsliste) s{mlliche Vorgenge, die ciner verschlusssachencinslufung bediirfen. legl dcn erfordcrlichen Gehcimhaltungsgrad fesr und veranlasst. dass diese Aufslellung dem Verschlusssachcnauftrag sls Anh.ng beigefiigl wird. Die liir den Auiraggeber zustdndige Behdrde hat diese Aufstcllung auch der fUr den Auflragnehmer zuslAndigen Behdrde zu iibermitleln oder ihre Ubermittlung zu veranlasscn, (4) Die flr den Auftrag8eber zust{ndige Behtirde stelh sicher, dass dem Auflragnchmer Verschlusssachcn erst dann zugdnglich gemachl warden. wenn der cntsprccl"ende Sicherheirsbescheid der filr den Aufiragnehmer zustiindigen Behorde vorliegr. Der EmpfrnS einer verschlusssach' \ird von der zuslandigen Behdrdc oder auf deren veranlassung bes6tigt und di' Verschlusssache nach MaoSabe der innerslaallichen Cesetze und sonstigcn Vo6chrifien 8n den Emptlnger weile.geleitcl' (3) Die zust{ndigcn Behdrdcn kdnncn flir cin genau bczeichnetes Vothaben - allgem€in oder unter Festlegung von Beschrdnkungen - vercinbaren, dass Vc6chlusssachen del Oeheimhaltungsgrade broQga(,o / VS-VERTRAULICH und l,6gqorQ b)oQUAq'o / CEHEIM oufeinem andercn als dem amtlichcn Kuricrwcg befdrdctt wcrden d0rfen, sofem die Einhallung dcs amllichen Kuri€rwegs d.n Transpon oder die Ausflhrung eines Verschlusss{chenauimgs unangemesscn erschwcren Norde. ln deaanigen F}llen l. muss der Befbrderer zum Zugang zu Verschlusssachcn dcs vcrglcichbsrcn Ceheimhaltuntsgrads ermxahliSl sein: 2. muss bei dct abscndendcn zusdndigen Bch6.de ein vezeichnis der bcfdrdcrtcn vcrschlusssachen verblciben; ein Exemplar dieses Verzeichnisset i$ dem Empfiingcr zur Wciterleitung an die zustlndige Behorde zu ube.geben; 3. mussen die verschlusssachen nach den flr die lnlandsbefbrdeiung gcltcnden innerstaatlichen Ccsllzen und sonstiSen vorschtiffcn tcrpackt s€in: 4. muss die tibergabe der Verschlussslchen gcgcn EmpfanSsbescheinigtrng erfolSen und 5. rnuss dcr B.fdrderer €incn Kuriemusweis mit sich fllh.en, d.r von dcr zust[ndigen Bchdrdc des Staacs der abscndenden oder der empf.ngenden Behorde ausgestelh wurde. t4- (4) Fiir die Bcfdrderung von Verschlusssach€n von erhcblichem Umfang werdcn Tmnspon, Transponrveg und Begleitschutz in jedem Einzelfall durch die zustlndigcn Behdrden auf der Crundlage eines detaillienen Transponplans festgelegl. Eine unv.rschl0ssclte Uberminlung von Verschlusssachcn dieses Geheimhaltungsgrads ist nur zuldssig. wenn innerstaatliche Geseue und sonstige Vorschriften dem nichl enlgegenslehen, ein zugelassrncs VerschlUsselungssystem nicht verffigbar ist. die Ubermittlung ausschlieBlich innerhalb von Festnetzen erfolgt und Absender und Empfinger sich zuvor iiber die bcabsichtigle UbenraguIg ueeinigt haben. - t5 - Anikcl9 Bcsuche (l) Besuchern aus dem Hoheitsgebier des Sraares einer Venragspanei wird im Hoheilsgebiet des Slaates der anderen vcnragspanei Zugang zu Vcrschlusssachen so\r ic zu Einrichrungen. in denen an diesen gearbciler $.ird. grundsdtzlich nur mit vorheriger Erlaubnis der zusrdndigen Behd.de dcs Srarcs dcr zu besuchcndco Vcnragspartci ge\ylhrt. Sie $/ird nur Personen cneilt, welcha die Bedingung ,,Kenntnis nur, wenn ndtig" nachweislich erfilllen und im Einklang mit d€njcweiligcn innerslaadichcn Ges.rzen und sonstigen Vorschriften der Vertmgspancien zum Zugang zu Verschlusssachen ermlichliB sind. (2) Besuchsanmeldungcn sind rechtzciti8 und in Ubcreinstimmung mit den Gcserzcn und sonstisen Vorschriflen des Staates der Vertragspartei. in dessen Hoheilsgebiel die Besucher einzureisen wiinschen. der zustandigen Behorde dicser Vcnragspaaei voftulegen. Die zustdndigcn Bchdrden reilen cinandcr die Einzelheircn der Anmeldungcn mit und stellen den Schuu personenbezogener Daten sicher. Anikel I0 Konsultatiorcn (l) Diczunlndigen Eehurdcn der Venragspaneien nehmen von den im Hohehsgebier des Staatcs derjeweils ander€n Ve(ragspsnei geltcnden Bestimmungcn ober den Schutz von Vcrschlusssschcn Kennlnis. (2) Um einc enSe Zusammcnarbeit bei der Durchfllh.ung dieses Abkommens zu gewdhrleisran. konsultiercn die zustdndigcn Behdrden einander auf Ersuchcn ciner diasrr Bchdrden. (l) Jede Venragspanei erlaubt daritbcr hinaus der zustendigen BehOrdc der anderen Venragspanei. Besuche im Hoheitsgebiel ihres Staates zu machen. um mir ihrcn zustandigen Behdrden ihrc Verfahren und Einrichtungen zum Schlrtz von Verschlusssachen, die ihr von der anderen vertragspanei zur Verfugung gestellt wurden, zu erdnern. Jede Veiragspanci unlerst0tzt dicsc zustindige Behorde bei der Feststellung, ob solche Verschlusssschen, die ihr von der anderen Venragspanei zur Verltgung gestellt wurden, ausrcichend gcscholzt werden. (3) Die Vcrtrsgsparteien unterrichlen einrnder auf diplomstischcm Wegc Ub€r allc Anderungcn der zusrlndig.n Bchdrdcn und ihrrr Kontaktinform8tioncn. (1) Einc Andenrlg der zustiindigen Behdrden fthrt nicht zur Einleilung einer Andcrung dieses Abkommens. Anikel l5 Verhdllnis zu snderen Abkommen. Vereinbarungen und Absprachen Allc bestehenden Abkommcn, Vereinbarungen und Absprachcn zwischcn den - l9 Verlmgspancien oder den zustindigcn Bchdrden 0ber den Schulz von Verschlusssachen bleiben von diesem Abkommen un&ruhn. soweit sie diescm nichl enlgegenslehcn. A(ikel l6 Schlussbcstimmungen (t) Dieses Abkommen tritr an dem Tag in Krafi, 6n dem die Regierung von Georgien der Regierung der Bundesrepublik Deutschland notifizierl ha! dass die innerstaatlichen Voraussetzungen lur das Inkrafnrcten erlllllt sind. Ma0gebend ist der T69 des Eingangs der Norifikalion. (2) Dieses Abkommen B'ird aufunbcstimmtc Zcil gcschlosscn. (3) Dieses Abkommen kann einvernehmlich in Schriftform von dcn Vertragsparteien geandcn werden. Jede Venragspartei kann jedczeit schrifflich ei!€ Anderung dieses Abkommcns beantragen. Stelh eine Vertragspartei .incn entsprcchendeo Antrag, so tuhren die Vcnragspaneien vcrhandlungcn ober die Anderung dieses Abkommens durch. Solche Anderungen tretcn nach Absatz I in Kraft. (,1) Jadc Vertragspartei kann dieses Abkommen unler Einhal(ung ein€r Frist von sechs Monaren auf diplomarischem Wege schriftlich k0ndigen. lm Falle der K0ndigung sind die aufgrund diases Abkommens iibermineltcn oder beim Auflragnchmc. entstandcnen verschlusssachen wekefiin nach Anikel 4 zu behandelo, solange das Beslehen der l-linsrufung d ies rechlferrigt. (5) Die Registricrung dieses Abkomrnens beim Sckrctarial der Ver.inten Nationen nach Artikel 102 der Charta der Vereinten Nationen wird unverzuglich nach seinem lnkrafrlrctcn von der Vedmgspanei vemnlasst, in dcrcn Slaalsgcbiet das Abkommen gcschlossen wird.
