AGREEMENT be●Ⅳeen GEORGIA and THE REPLIBLIC OF ESTONIA ON THE EXCHANGE AND PROTECTION OF CLASSIFIED INFORMATION PREAMBLE Ceorgia and The Republic of Estonia (hcreinafter refened ro as ,the Panies'), in funhcrance of mutual co-operation to ensure Ole protccrion of classificd information, confirming that this Agreemcnr shall not alIect rhc commitmcnts of both partics which stcm from otlpr intcmationsl agreements and tlnt it shsll not bc uscd agairLst thc interests, securiry and tcrritorial integlity of l}le psrtics or othcr statcs, hsvc agrced as follows: ARTICLE I APPLICABILITY l, Classificd information provided dircclly or indirecrly by one pafiy to the other Party or lo thc reprcs€ntativc of the Pany, shall be protectcd acrording to the terms sel forth in this AgrEement and in accordance with the national lcgislatioD ofthe Panies. This Agreement does nol intcnd an obligation of a Pafly to trarufer to the olhcr Party any classified information, but ir is considcred to dcfine prorective aad other relsled appropriate measures ro b€ realized by thc rcceiving Party ofthe classificd informarion willingly transfercd by the originating Pany. ARTICLE 2. DEFI N*ITIONS For the purposes ofthis Agreement: l. "Clsssificd informarioo" means any oral or wrincn information regardlcss ofthc rypc/mcaDs of rccording media, and any matcrial objects, which contaiD information declared by the Panies as classifiei informarion and which is markcd according to the legislation ofa Pany. 2. "Conuacf'means an agrcement between two or morE conkaclors, defining their rights and obligarions. 3. 4. "Classified contact" means I contract, which contains classified information. "Conkactor" means a natunl or lcgal person possessing rhe authority to undert ke contracts, 5. "Subcontractor" means a natural or legal pcrson that according to thc lcgislation of thc Paflies and within the authoriry granled to him by the conrractor is cligible to conclude subcontracts. 6. "Secuity cleamnce" means a positive determination slemming from an investigative procedure that shall ascenain the loya.lty ard trustwo(hiness of a person as well as other security aspects in accordance with thc national legislation. Such dctcrmirErion enables a person to be Sranted sccess and pcrmission to handlc classified information on a cenain level witlrou! security risk. 7. PROTECTION OF CLASSIFIED TNFORMATION The Parties shall ensure that: No iadividual shall be entitled to havc scccss to the classified information solely by virtue of ran}, appointrnent or on the bases of security clearance. Access to the classified informalion shatl b€ granled only to those individruls who have "nced. to-know" and who havc been granted security clearanc€ or authorizei lo sccess classified information in accordance with rhe national lcgislatioD of the appopriate Party The receiving Party shall take the rcsponsibility not to pass the classifred informotion received under this Agrecment to a third Party without thc prior wrincn consent of the originating Parly. Thc rcceiving Party shall afford thc classificd information a degree of prorcction equivalent to that afforded ir by thc originating Party in accordance with the equivalEnce given in Anicle 4. The rec€iving Pady shall not use the classified information for ary othcr purpose than the one for which it w8s provided. SECUzuTY CLEARANCES I, The determioation on the graflring of a sccurity clearance to an individual shall be consistent with the nalional legislation and shall be based upon all available information indicating whethcr the individual is of unquestioned loyalty, integrity and of such habits and associates as to calt no doubt upon his or her discretion or good judgment. Authorizations for visits by individuals of onc Pany to thc olher Party, entailing acccss to classified information, shall be limitcd to those D€ccssary for olficial puposes. The coErpetent authority of thc host Pafiy shall advisc thc entity conc.med oo the proposed visit, ard the highcs lcvel of cl&ssificd information th8t may b€ fimish€d to the visitor. ARTICLE IO, ACCOTNTABILITY AND CONTROL The Panics will elaboratc accountability and conhll procedures to manage the distribution and access to classified information, The Paflies shall hold a registry of all classified information rcceived ftom and dispatched to the other Pafly. 3. Each organization (instilution, company) processing classified information received from the other Party shall hold a registry of a.ll the classificd information received. Such registrics shall be subjecled to the control of thc competent Eulhorities in accordalcc with the nationsl legislation ARTICLE I I MARKINC, TRANSLATION AND REPRODUCTlON OF CLASSIFIED INFORMATION l. Upon the sending ofinformation the originating Pany shall mark on it the namc of the originating Party and the classification level in English. The received information shall be marked with a national security classification marking by the receiving Psrty that will afford a degree ofprotection equivaleot to that afforded it by the o ginating Pany as determincd under Article 4. When classificd information is rcproduccd, atl original s€curity ma*ings thercon shall also bc rcFoduc.d or marked on clch copy. LOSS OR COMPROMISE Thc receiving Parry shall inform thc oriBinating pany irnmcdiately of all losses or compromises, as well as possiblc losses or compromiscs, of its classificd information and thc receiving Pary shall idtiate an investigation to detqmine the circumstanccs. Thc rE(rivhg Pafiy shall forward thc resull of the invcstigation and information rcguding mcasures taken to prevent recurcnce of such cvcnt to thc originating parly. ARTICLE I4, REVIEW OF SECURITY SYSTEMS Implcmcntation of the security requircmeDts prescrihd by this Agrccment can be advenced through reciprocal visis by rcpreserlatives of rhe competenr authorities of he Paiies, Accordingly, rhe reprcsentativcs of a pany, ancr prior consultation, shall bc pcrmitled to visit the other Party, to discuss, and view fiathand, thc implcmcnting procedures of thc othcr Pany in the intcrcst of achicving rcasonablc comparabitity of the sccurity systems. Each Palty sball assist thc reprcscntalives of rhc other perty in determining whether classified information provided by the othcr party is being adequatcly protcctcd. ARTICLE I5, CONTRACTS l. SE'TTLEMENT OF DISPUTES Ary disputc r€gsrding the interpretation or application of this Agreemenr shall be rcsolvcd by consultation between the competcnt authorities ofthe state or, in thc css€ that such a settlement is impossible to reach, bctween duly authorized rcprcscntatives of the Padies and shall not b€ refcrred to any national or intemational tribunEl or scnlerDeflt. ARTICLE I8. FTNAL PROVISIONS This Agretment is concluded for an indclerminate period of rimc and shall cntcr into force upon the receipt of the last notification ftom the P8riies confiming the complcl.ion of neccssary intcmal procedures. Each Pany may lerminale this Agreement by written notice forwarded to thc other Party. The terminaiion shall enter into force six months after the date of rec€ipt of the notification.
