AGREEMENT between the Government ofGeorgia and the Government of Hungary on the lnternational Transport of Passengers and Goods by Road The Government of Gcorgia and thc Government of Hungary (hereinafter the Conrracting PartiesJ, Desiring to regulate and improve the transport of passengers and goods by road between the two countries and the transit traffic based on reciprocity, cooperation and mutual interests, Havc agreed as follows: I. II. TIIANSPORT OF PASSENGERS Rcgular transport of Passengers Ar{icle 3 (1) Regular transport of passengers by bus shall be subject to permit' tlre izj fti" .orpo,ent autiorities of the Contracting Parties shall issuc permits for re8ular transport of passengcrs bctween the States for the part of the route in their own territories. Thc competent authorities of the Contracting Parties shall, in linc with the relevant national legislation, iointly define the permifs period oI validity and they approve the timetable, the route and the applicable fares. (3) The application for the permit referred in section (2) of this Articlc shall be submitted to the competent authorify of the State of the other Contracting Party through tle competent authority of the State of the Contracting Party where the carrier is seated. (4) The applications according to section (3) of this Article shall include the following data: (4.1) first and second name of thc applicant carrier or namc and scat of the carrier company. (4.2) type of transport, (4.3) period of validity of the pcrmit in the application. (4.4J period ofoperahon and thc envisaged frcquenry oflines (4.5) exact routc, stops fstops for embarking and disembarking of passengcrs, resting places, border crossing points), (4.6) route length in hlometcrs: to the destination and back, (4.7) route length per day, (4.8) driving and resting timc of the dt'ivcrs, (4.9) 6metable, (4.10) farcs for transport ofpassengers ftarifitabtcs] and trave] conditions. III. (2) Should any of the provision of the present Agreement or the national legislation of the State of the other Contracting Party be breached by the carrier registered in the state territory of the either Contracting Party, the competent authority of the Contracting Party in the territory where breach of the provisions took place informs, besides conducting its own legal proceedings, the competent authority of the State of the Contracting Party of registrations, which shall take the necessaty steps that are provided by its own national legislation. (3) Competent authorities of the States of the Contracting Parties shall inform each other about sanctions imposed by them as per section (2) of this Article. Articlo 10 (1J Whcn cntering thc state territory of thc other Contracting Parry thc iairier shall present upon the call of the competent authoriry the document certifying the validity of the third party liability insurance providing coveragc of damage caused to other Parties. (2) Should a bus or a motor vehicle fail to have t}tc doctttncnt mentioned in iection (f) of this Article the carrier, when entcring the state territory of the other Conrracting Party, shall effect lhird pafty liability insurancc according to the national legislarion in force. Articlc 11 The buses ind coaches, also vehicles having pcrmits without payment' shall affect neither taxes, tolls and duties imposed on the transport of certain sections of motorways, tunnels, bridges and other public road facilitios nor duties and tolls ihargea according to thc national Iegislation of the Contracting Parties in case of exceeding permissible dimensions, weight and/or axle load of motor vchicles. Article 12 (1) When cntering the state territory of thc State of Georgia the following items are exempt from taxes, duties, customs dutics and charges with the equivalent effect, as well as from export and import restrictions and prohlbltlons: (1.1) fuel held In the built-in tank designed by the manufacturer of the vehicle or bus to the given makc of the motor vehlcle or bus in order to drive that vehicle per transportation. (1.2) spare parts and tools necessary to repair the motor vehicle or bus carrying out international transport covered by the present agreement and damaged on thc way, which are imported temporarily in the territory of Georgia based on the document certified by the q.lstoms omce of entry. (2J 0n application of section (1) of this Afticle tools and non-used or replaced spare parts indicated in point (1.2J shall be returned to the state of registration of the vehicle or bus, or they shall be destroyed under thc supervision of the customs authority. (3) Concerning the traffic governed by the prcsent Agreement, lvith regard to section (2) ofArticle 1 of the present agreement as well, at the entry to its territory Ilungary grants the exemptions and preferences in terms of customs duties and charges with the equivalent effect and exemptions from export and import restrlctions and prohibitions according to the customs legislatron in force of the European Union and bascd on the procedures and rules set therein. [4) Concerning the traffic govcrncd by this Agreement, with regard to scction (2) of Article 1 of this Agreement, the goods dcfined in sub-sections (1.1J and (1.2) of section (1) of this Article shall be exempt from value added tax (VAT) pursuant to the actual VAT legislation of the European Union at the entry to the tcrntory ofthe State of [lungary' (5) Tools and non-used spare parts imported temporarily into the territory ofHungary, necessary to rePair aGeorgian motor vehicle or bus carrying out in6rnational transport covered by this Agreement and damaged on the way in the territory of Hungary, as well as the replaced spare parts shall be exported or shall be destroyed at carricy's expenses under the supervision of the clstoms authoritY. Artlclc 13 The cabotage in general is not allowed unless the compctent authority of the State of the Contractint Party concerned issucs a special authorization for iu Article 14 With regard to border and customs control, as well as supervision of compliance with veterinary, phytosanitary epidemic, environment and natural conservation rules, the Contracting Parties shall apply their own national legislation and the provisions of those international agreements with the involvement of both Contracting Parties. Artlcle 15 In case of transport of seriously injured persons, rcgular transport of pcrsons by bus or motor vehicles carryrng animals, quickly spoiling or dangerous goods, the competent border control bodies and other control authorities at the state border shall implement out of turn the border and customs control, as well as supervision of compliance with veterinary, phitosanitary, epidemic, environment and narural conservations rules, Article 16 (1) The competcnt authoritres in Georgia and IIungary are the Ministries responsible for transport and other relevant authorities responsible for road transport. (2) In order to implement and apply the present agrecment the Contracting Parties shall set up a Joint Committee made of the rcpresentatives of the competent bod ics. (3) The competcnt bodics of thc Statcs of thc Contracting Parties arc entitled to invite also other expcrts to the Joint Committee sessions. (4) Joint Committee meetin8s are to be held upon request of either Contracting Party, alternately in the state territory of one of the Contracting Parties. (5) The loint Committee is entitled to initiate amendment or completion of the present Agreement. Articlc 1'l [1) Thc present Agreenrcnt shall be conclutlc<l for an indcterminatc period of time. (2) Thc present Agrecment shall cntcr into force on the 30th day following the day on which the Parties rcceive the last noHficarion through diplomatic channels no rying each other on the completion of internal procedures necessary for the entry into forcc ofthis AgreemenL (3) The present Agreement may be amended and modified by a written mutual consent of the parties, which shall be formed as a separate document and enter into force according to the samc proccdures as this Agreement enters into force. Document formed thereby, shall constitute an htegral part orthe ASrreemenL (4) The present Agreement may be terminated by either of the Contracting Parties in writing through diplomatic channels. The Agrcement shall repeal after twelve (12) months from the day when the other Contracting Party have received the diplomatic notification about the intention to terminate it. (5J With the entry into force of the present Agreement, the Agreement on iniernational motor vehicle transport signed in Budapest on 19 march 1956 bewveen The Government of the Peoplc's Republic of HunFry and the Governnent of the Union of Soviet Socialist Reptrblics will be tcrminated in the relation benveen Georyia and IIungary.
