Article 2 ISSUANCE OF SEAFARERS' IDENTITY DOCUN4ENTS l. Each Niember for vvhich this Convention is in fbrce shall issue to each of its nationals rvho is a seafarer and makes an applicatiorl to that eft'ect a seafhrers' identit;- docunrent conforrning to the provisions of Article 3 of this Convention. 2. Unless otherrvise provided tbr in this Convention, the issuance of seafarers' identitl.' documents may' be subject to the same conditions as those prescribed by national lau,s and regulations for the issuance of travel documents. 3. Each Vember ma,v also issue seafarers'identitl'documents referred to in paragraph I to seafarers who havc been granted the status of perrnanent resident in its territor'1.,. Pelmanent residents shall in allcases travel in contbrmitl'rvith the provisions of Article 6, paragraph 7. 4. I he seafarers' identity document covered by this Convention shall contbrn.r - in its content - to the |nodel set out in Annex I hereto. The tbrm ofthe document and the materials used in it shall be consistent with the general specifications set out in rhe model, rvhich shall be bascd on the criteria set out below. The maximum validity of a seafarers' identitl, document shall be determined in accordance n,ith the lau,s and regulations of the issuing State and shall in no case exceed ten years. subject to renerval after the first five vears. 7. Article 4 \ATIONAL ELECTRONIC DATABASE l. Each Member shall ensure that a record oleach seafarers' identit;,docunrent issued, suspended or lvithdrawn by it is stored in an electronic database. l-he necessary measures shall be ral(en to secure the database f,rom interference or unauthorized access. 2. The information contained in the record shall be restricted to details rvhich are essential for the purposes of verifying a sealarers' identity document or the status of a seafarer and rvhich are consistent nith the seafarer's right to privacy'and r.r,hich nreer all applicable data protection requirements. The details are set out in Annex ll hereto. shich may'be amended in the manner provided tbr in Article 8 belorry. taking account of the need to give Members suft'icient time to mal<e any necessary revisions of tlreir national database svstems. 3. Processes and procedures shall be in place to ensure the necessar)'security tbr: (a) the production and delivery' ol blank seafarers' identit) documents; (b) the custody, handling and accountability fbr blank and completed seat'arers'identity documents: (c) the processing ofapplications. the completion ofthe blank seaiarels'identity documents into personalized seafarers' idcntity documents by the authority and unit responsible tbr issuing them and the delivery of the seafhrers'identit) documents: (d) the operation and rnaintenance olthe database: and (e) the quality control of procedures and periodic evaluations. 3. Subject to paragraph 2 above. Annex lll may be amendcd in the manner provided for in Article 8, taking account of the need to give Members sufficient time to make any' necessary revisions to their processes and procedures. 4. Each tr1ember shallcarry out au independent evaluation of the administration of its svstern tbr issuing seafarers'identity documents. including quality-control procedures, at Ieasl every five yeam. Reports on such evaluations, subject to the removal ofany confidential rraterial, shall be provided to the Director-Ceneral ofthe lnternational Labour Office rvith a copy to the represcntative olganizations ofshiporvners and seatarers in the Vlember concerned. This reporting requirement shall be rvithout prejudice to the obligations olMernbers under anicle 22 of the Constitution of the International Labour Organisation. 5. The lnternational Labour OfIlce shall make these evalualion reports available to illembers. Any disclosure, otlrer than those aLrthorized by this Convention. shall require thc consent oflhe reporting l\4embcr. 6. The Coverning Body ofthe lnternational Labour Office. acting on the basis ofall relcvant information in accordance r.virh arrangements made by it, shall approve a lisr ol\lernbels rvhich tirlly rneet rhe minimunr requirerlents ret'erred to in paragraph I above. 7. Cusrody, handling and accountabilitv for blank and complered SlDs 2.1. All operations relating to the issuance process (including the custody ofblank. voided and completed SlDs. the implements and materials for complering them, the processing of applications, the issuance ofSIDs. the nraintenance and the securiry ofdatabases) should be carried out under the direct control ofthe issuing authority. 2.2. The issuing aurholity should prepare an appraisal o{'allotficials involved irr the issuance process establishing. in the case ofeach ofthem. a record ofreliability. tr.ustwonhiness and loya1t1.. 2.3. The issuing authorit.y should ensure rhat no officials involved in the issuance process are members of the same immediate famil). 2.4. The individual responsibilitics ofthe otllcials involved in rhe issuance process should be adequarel)' defi ned by' the issuing authorit),. 2.5. \o singlc official should be responsible for calrfing out all rhe operarions requircd in the processing ofan application lbr a SID and the prepararion ofthe corresponding SlD. The otlicial rvho assigns applicatiorrs to an official responsible tbr issuirrg SlDs should not be involved in the issuance process.'l'here should be a rotation in thc officials assigned to the dift'erent duties related to the processing oiapplications and the issuance of SIDs. 2.6. The applicant should not be issued r.vith a SID for so long as he or she possesses another SID. 3.9.1 . An early renerval system should apply in circumstances rvhere a seafarer is au,are in advance that the period ofservice is such that he or she rvill bc unable to make his or her application at the date olexpiry or reneu,al: 3.9.2. The proof that the applicant is a seat'arer'. rvithirr the meaning of Article I of this Convention should at least consist oft 3. I 0. I . a previous SlD. or a seafare rs' discharge book; or 3.10.2. a certificate of conrpetenc,v", qualification or other relevant trainirrg; or 3.10.3. equall.v cogent evidence. 3,I l. Supplementary' proof should be sought where deemed appropriate. 3.12. Allapplications should be subject to at least the following verifications by a competent otflcial of the issuing authority of'SlDs: 3. 12.I . veriflcation that the application is complete and shows no inconsistencl, raising doubts as to the truth of the statements made: 3.12.2. verification that the details given and the signature corrcspond to those on the applicant's passport or other reliable document; 3.12.3. verification, lvith the passport authoritv or other competent authority, of the gcnuineness ol'the passpott or other document produced; rvhere there is reason to doubt the genuineness ol the passport. the original should be sent to the authority concerned: otherrvise. a copy olthe relevaut pages may be sentl 3.12.4. comparison of the photograph provided. n'here appropriate, rvith the digital photograph referred to in section 3.4.2 above: 3.12.5. veri{lcation of the apparent genuineness of the certification referred ro in section 3.6 above; 3.12.6. r,erification that the proof ref'erred to irr sectiou 3.l0 substantiates that the applicant is indeed a seafarer: 3.lr2.7. verification, in the database referred to in Article 4 of the Convention, ro ensure thar a person corresponding to the applicant has not alreadl.'been issued rvith a SID; if the applicant has or maJ- have more than one nationality or any permanent residence outside tlre countr;- of nationalitv, the necessarv inquiries should also be made rvith the competent aurhorities of the other courrtr,v or cor"rntries concerned: 3.12.8. r,erification, in an5' relevant national or international database that may be accessible ro the issuing authority, to ensure that a person corresponding to rhe applicant does not constitute a possible security risk. 3.13. The official referred to in section 3.12 above should prepare brief notes for the record indicating the results oleach ofthe above verifications. and drawing attention to the facts that jLrstify the conclusion that the applicant is a seafarer. 3. I 4. Once fu lly' checked. the application, accornpanied by the supporting docunrents and the notes for the record. shou ld be lorrvarded to the official responsible for completion of the S ID to be issued to the applicant. 3.15. The completed SlD, accomparried bv the related t-ile in the issuing authority. should then be tblrvarded to a senior oticial of tlrat aurhority for approval. 3.16. The senior olficial should give such appror.al only il'satistied. after review ofat least the notes for the record, that the procedures havc been properly lbllorved and that the issuance of the SID to the applicant isjustitied. 3.17.'l his approval should be given in nriling and be accompanied by explanations concerning any leatures ofthe application that need special consideration. 1.18, The SID (together rvith the passport or similar document provided) should be handed to the applicant directly against leceipt. or sent to the applicant or, ifthc latrer has so requested. to his or her shipmaster or errployer in both cases by reliable postal communication requiring advice of receipt. l. I 9. When the S ID is issued to the applicant. the particu lars specified in A n nex ll to the Convention should be entered in the darabase referred to in Article,l ofthc Convenrion. 1.20. All annotations to be madc. such as. in particular. the briefnotes tbr the record (sce secrion 3.13 above) and the explanarions ret'erled to in section 3, I 7, should be kept in a safe place during lhe pcriod of validitl. of the SID and for three years afterrvards.'fhose annotations and explanations required bv section 3.17 should be recorded in a separate inrernal database. and rendered accessible: (a) to persons responsible lor monitoring operations; (b) to otlcials involved in the revierv ofapplications for SlDs; and (c) for n.aining pur.poses. i.22. When infolrnation is received suggesring rhat a SID was u,ronglv issued or rhar the conditions for its issuc are no longer applicabte. the matter should be promptly noritjed to the issuing authority rvith a view to its rapid r.vithdrarval. 3.23. Whcn a SID is suspended or rvithdrau,n rhe issuing authority should immediatel;.' update its dambase to indicate that this SID is not currently recognizcd. 3.24.|f an application for a SID is refused ol a decision is raken to suspend or sithdrarv a SlD, the applicant should be officiallf informed of his or her right ofappeal and fully informed olrhe reasons for the decision. 3.25. The procedures tbr appeal should be as rapid as possible and consistenr ivith rhe need tbr thir and cornplete consideration. 4. Operation, security and maintenance of the database 4.1. The issuing authority should make the necessar) arrangelnents and rules to implement Article 4 of this Convention. ensuring in parricular: 4. I .l . the availabilitl' ot a focal point or electronic access over 24 hours a day. seven da),s a week. as required under paragraphs 4. 5 and 6 olArticle,l ofthe Conrention: 1.1.2. the securit\ ol'the database: 4.1.3. the respecr for individLral lights in the srorage, handling and communication ofdata; 4.1 .4. the respect for the seafarer's righr to verifl,- the accuracv oidata relating to him or her and to have correctL-d. in a timely. manner, any inaccuracies found. 4.2. 1'he issuing authorit_v should draw up adequate procedures for prorecting the database, includ ing: 4.2. Quality control of procedures and periodic evaluations 5. L 'l'he issuing authority- should appoint a senior official of recognized integritl-. Ioyalty and reliability. u,ho is not involved in the custod),or handling ofSIDs, to act as conrroller: 5.1.l. to moniror on a continuous basis the inrplementation of these minimum r.equiremenls; 5.1 .2. to drarv immediate attention to any, shortcomings in the implemenrationt 5.1.3. to provide the executive head and the concerned oflicials rvith advice on improventents to the procedures for the issuance of SlDs; and 5.1.4. to submit a quality-control report to management on the above. The controller should, if possible, be familiar rvith all the operations to be monitorcd. 5.2. The controller should report directly to the execurive head ofthe issuing authority, 5.3. All officials ofthe issuing authoritl., including the executive head- should be placed under a duty to provide the controllel with all documentation or information that rhe controller considerc relevant to the performance of his or her tasks. 5.4. The issuing authority should make appropriate arrangements to eusure thar oft'icials can speak freely to the controller u,ithour tear of victimizarion. 5.5. The terms of rcfcrence of the controller should require rltat particular artention be given ro the following tasks: 5.5. I . verifying that the rcsources. premises. equipmenl and stalf arc sulficient for the eliic ient performance ofthe firnctions ofthe issuing authorirl,; 5.5.2. ensuring that the arrangements lbr the safe custody ofthe blank and cornpleted SlDs are adequate: 5.5.3. ensuling that adequate rules, arrangements or procedures are in place in accordance u,ith sections 2.6. 3.2,4 and 5.,1 above. 5.5.4. ensuringthat those rules and procedures. as ucllas arrangements. are rvell knoun and understood by thc officials concerned; 5.5.5. detailed monitoring on a rantlonr basis ofeach acrion carried our. including the related annotations and other records, in processing pafticular cases, fiom the receipt ofthc application lor a SID to the end ofthe procedure lor its issuancel 5.5.6. verification ofthe efficacl.ofthe security measures used for the custody of blank SIDs. implemgnts and materials; 5.5.7. verification, ifnecessary rvith the aid of a trusred expert. ofthe security and veracitl,ofthe information stored electronicallt and that lhe requirement for 24 hours a day. seren dar,s a u'eek acccss is nrainiained: 5.5.8. investigating anv reliable report ola possible u.rongful issuance ofa SID or ola possible falsification or t'rar,rdulent obtenrion ofa SlD. in ordcr to identiti any inrernal malpractice or weakness in slstems that could have resulted in or assisted the rvrongful issuance or thlsitication or fiaud; 5.5.9. investigating complaints alleging inadequate access to the details in the database given rhe requirenrenls ofparagraphs l, 3 and 5 olArticle 4 ofthe Convention. or inaccuracies in those details: 5.5.10. ensuring that reporls identilying improvements to the issuance procedures and areas ol weakness have been acted upon in a timely' and effective manner by the executive head of the issuing authority: 5.5.I l. maintaining records ofquality-control checks that have been carried out: 5.5. I 2. ensuring that management reviews of qualitv-control checks have been performed and that records ofsuch revieu,s are maintained. 5.6. The executive head ofthe issLring authority should ensure a periodic evaluation ofthe rcliability of the issuance s)-stem and procedures, and oftheir conforntit), lvith the requirements ofthis Convention. Such evaluation should take into account the follorving: 5.6. I . find ings of anJ- aud its of rhe issuance system and procedures: 5.6.2. repons and findings of investigations and ofothcr indications relevant to the elfectiveness of corrective action taken as a result of reported r.veaknesses or breaches of sccurity; 5.6.3. records ofSlDs issued, lost. voided or spoiled; 5.6.4. recolds relating to the fUnctioning ofquality control; 5.6.5. records of problems rrith rcspect to the reliability or securitv ofthe electronic database, including inquiries made to the database; 5.6.6. effects olchanges to the issuance s)'stem and procedures resulting tiom technological improvements or innoyatioris in the SID issuance procedures; 5.6.7. conc lusions ofmanagement re\ie\\s: 5.6.8. audit of procedures to ensure l.haI they are applied in a manner consistel, t \a.ith respect fbr fundamental principles and rights at uork embodied in relevant ILO insrruments. 5.7.
