The Route Schedule foms an integral palt ofthis Ageement. Article 2 Cranl oF ttgllts l. Each Contracting party grants to the orher Contracting pany the rights specified in this Agreement to enable the designated airlines of the other ConEacting party to establish aDd operate intematiolal air services on the route specified in the Annex (hereinafter called ..the agrecd scrvicos'). 2. Subject to the provisions of fis Ageernent, the designated airlines ofeach Contncting Party shall enjoy, while operating an agreed service route, the following rights: a. to fly without landing across the territory of the other Contacting party along the air route(s) prescribed by the aeronautical authorities of the other Contracting pady; b. to make stops for non-traflic purposes at point(s) on the specified route in the territory of the other Contracting Pany, subject to the clearance of the aeronautical authorities of the other Contracthg pafiy; and c. to make stops at the point(s) o[ the specified route in the territory of the other Contlacting Party for thc purpose of taking on board ald/or discharging intemational faffic in passengers, baggage, cargo and mail, originating in or destined for the first Contracting Paiy. 3. On receipt of such designation, the other Contracting party shall, subject to the provisions of paragraphs 2 and 3 of this A,Iticle, grant 10 the ailine(s) so designated the appropriate operating authorization without urueasonable delay. 5. The designated airlire(s) of one Coirtracting party may commence, when it has acquired operating authorization, operation of the agreed services in accordance with the rerevant provisions ofthis AgreemeDt from the date prescribed in such authorization. Article 4 RevocatioD, Suspension ofAuthorization or Impositiotr of Conditiotr ︲ⅢⅢl ︲Ⅲ引ⅢⅢ引Ⅲ引ⅢⅢ引= ﹁日 l. Each Contracting Party shall have the right to revoke or suspend the operating authorization granted to the designated ailine(s) ofthe other Contracting party or to impose designated airline ofthe dghts specified ir Article 2 (Grant frights) ofthis Agleement, in any ofthe following cases: such conditions as it may deem necessary on the exercise by the said a. where it is nol satisfied that the substantial ownership and effective conbol of the said designated airtine arc yested in the other Contuacting party designating that airline or its natiomls; or b. where the said designated airtine fails to comply with the laws and regulations of the fust Conkacting party refe(ed to iII Anicle 5 ofthis Ageenent: or c. where the said designated airline otherwise fails to opErate conditions plescribed under this Agre€meot. in accordance with the 2. The laws and regulations of one Contracting Party relating to admission to, stay in or departue from its teritory of passeage$, crew, baggage, cargo or mail, such as laws and regulations relating to entry, cleaiaDce, irnmigration, passf,orts, customs and quarantile, shall be applicable to the passengels, crew, baggage, cargo or mail carried by the aircraft of the designated airline(s) of the othor Conhacting Pany while entedlg, staying in and departing ftom tho territory ofthe first Contracting Party. 3. Other relevant laws and rcgulatioDs relating to aircraft and provisions in respect of civil aviation ofone Contacting Party shall be applicable to the designated airline(s) ofthe other Contlacting Party while operating the agreed services in the territory ofthe firct Contracting Party. 4. PassEngc6, baggage, cargo and mail in direct traDsit and not leaving the area of the airport reserved for such purpose shall be subjcct to no mole than a simplified control. Article 6 Capacity Provisions l. There shall bc a fair and equal opporturity for the designated airtines of the Contracting Parties to opclate the ageed services on the specified route. 2. The agreed services supplied by the designated airlines of thc Contracting parties shall provide at a reasonable load factor capacity adequate to meet the aaffic requirements for the carriage of passengers, baggage, cargo and mail b€tween the teritories of tho Contracting Parties. 3. The designated airlines of both Cortracting parties shall deterDine independently the capacity, frequency and type of aircraft of the intematiooal air services. The aeronautical authorities of neither Contructing Party shall unilaterally limit the capacity, frequency and type of aircraft operated by the designated airline of the other Contracting parry, except as may be required for customs, technical, operational or environmsntal rcasons conditioDs coEistent u/ith Anicle l5 ofthe Chjcago Cotrvention. under unifom 4. It is the common understanding ofboth Contracting padies that code_share services are not counted agaiDlt the capacity entitlcmmt ofthe marketitrg carrier. 3. The code-share anangement should be filed for approval by aeronautical authoritios ofthe Contracting PaIties. Article 8 Tsriffs l.The tarills to be applied by thc designated airlines ofa ContractiDg party for services covered by this Ageement shall be established at rcasonable levels, due regard being paid to all rclevart factors, includhg interests of users, cost of operation, of service, "hura"tJristics reasonable profit, tariffs of other airlines, and other commelcial considerations in the market-place. 2. The Contacting parties agee to give particular attention objectionable because they appcar ulreasonably to tariffs which may be discriminatory, unduly high or restrictive because of the abuse of a domimnt position, artificially low of air"O or irdirect subsidy or support, or .bredatolr',. l"o*" 6 3. Each Contracting Pany may require notifications or filing of tariffs proposed by the designated airline(s) of both Contracting Pafiies for carriage to or from its teritory. Such notification or filing may be requircd not more than thirty (30) days before the proposed date ofhtroduction. In special cases, this period may be reduced. 4. Each Contracting Party shall have the right to apprcve or disapprove tadffs for one-way or round-trip carriage betweeD the telritories of the two Conuacting parties which comnenccs in its own territory. The taliffs to be charged by the designated airline of one Contractin Party for cardage between the terdtory of the other Coltracting party and that of a third State on services covered by this Agreement shall be subject to the approval requirements of the other Contracting Party. Neiths! Contracting Pany shall take uailateral action to prevent the inauguration of proposed tariffs or the coltinuation of effective tariffs for one-way or rcurd{rip carriage between the territories ofthe two Cootlacting parties corunencing in thc territory of the other Contracting Party. 5. Approval of tadffs consequent upon the provisions of paragraph 4 above may be given expressly by either Conkacting Party to the airline(s) filing the tariffs. However, if the Conhacting Party concemed has not given in writing to the other Contracting party notice of disapproval of such tariffs of the aidirc(s) of the other Contracting party within thirty (30) days from the date of submission, the tariffs concemed shall be considered approved. IIr the event of the period of submission being reduced in accordance with paragraph 3, the Contracting Parties may agree that the period within which any disapproval shall be given be reduced accordingly. 6. Where eithe! Contracting Party believes that a tariff for carriage to its territory falls within the category described in paragraph 2 above, such Contracting party shall give notice of dissatisfaction to the othcr Contactilg party, as sootr as possible, and at least within thilty (30) days of the date of notification or filing of the tarilI, and may avail itself of the consultation procedures set out in paiagraph 7 below. 7. Each Contracting Party may rcquest consultation regarding any tarillof an airline of either Contracting Party for services covered by the ag:eement, including wherc the tariffconcemcd has beeD subject to a notice of disapproval or dissatisfaction. Such consultation shall be held not later tha[ sixty (60) days aftcr receipt of the rcquest. The Contracting pany shall coopemte in securing infomration necessary for reasoned resolution of the issues. If the Contracting Partie.s reach agreement, each Conhacting party shall use its that agreement into effect. Such teminatior shall not take place with less than thirty (30) days notice. Articl€ 9 Techtrical Services atrd Rate ofCharge l. Each Contracting Party shall provide regular airport(s), altemate airport(s) and air navigation facilities itr its territory and relevatrt services including communications, navigational, meteorological and other auxiliary facilities and services for the operation of agreed services by the designated airline(s) ofthe other Conhacting party. 2. The designated airline(s) of each Contracting party shall be charged for the use of airports and air navigation facilities ofthe other Conhacting party at fair and rcasonable Iatcs prescribed by the apprcpriate authodties ofthe other Contracting party. Such rate shall [ot be higher than those applicable to any airtine of other States for the services and the use of similar airports and air navigational facilities in the territory oftho other Contracting party. Anicle 10 ProvisioD of Statistical Data The aercnautical authorities of either Contacting party shall fumish to the aero[autical authorities of the other Contracting party, at their request, statistical data as may be reasonably required for the purpose ofrcviewing the capacity provided by the agreed services operated by the designated airline(s) of the first Contactirg party on the specified route. Such data shall include all idormation required to detemine the amount of haffic carried by the said designated airline on the agreed sewices. Article l2 Customs Dulles aDd Taxatiotr 1. When an aircruft operated on the agreed services by the designated airline of one Contracting Pany arrives in the territory ofthe other Contracting party, the said aircraft and its regular equipment, spare pads (including engines), fuels, oil (including hydraulic fluids, lubdcants) and aircraft stores (including foo4 beverages and tobacco) on board such aircraft shall be exempt on the basis ofreciprocity fiom all customs duties, taxes, inspection fees and other similar fees and charges, provided such equipment and items remain ou board the aircraft up to such time as they are re-exported. 2. The following equipmetrt and items shall also be exempt on the basis ofreciprocity ﹁ロロロロローーロロロロ⁚日11 all customs duties, taxes, inspection fees and other similar fees and charges, with the cxception of charges conesponding to the services provided: a. regular equipment, spare pads (including engines), fuels, oil (including hydraulic fluids, lubdcants) and aircraft stores (including food, beverages and tobacco) canied into the territory of the other Contractitrg Party alrd intelded for use on aircraft operated on the agreed services by thg designated airline(s), even when such equipment and items are to be used on part of the joumey perfomed over the territory ofthe other Contracting Party; b. sparc palts (itrcluding engines) inhoduced into the territory of the other Contracting Party for the maintenance or repair of aircraft operated on thc ageed services by the designated airline(s). 3. The equipment and items rcferred to in paragraphs I and 2 ofthis Article may bc unloaded in the teEitory of the other Contracting party with the approval of the Customs authorities tho other Contracting Party. Such equipment and items shall be kept under the supervision or control of the Customs authorities of the other Contracting palty up to such time as they are le-exported, or otherwise disposed of in accordance with the customs regulations ofthe other Conhacting Pafty. 4. The exemption prcvided for in paragraphs I and 2 ofthis Article shall also be available where a designated airline of one Contracting party has contEcted with other airline(s), which similarly enjoy(s) such exemptions in the.territory of the other Conhactirg party, for the loao or tra$fer in the territory ofthe other Contracting party ofthe equipment and items specified in pangraphs I and 2 ofthis Article. 5. Printed ticket stock, air waybills and publicity materials introduced by the designat airline(s) of one Cortmcting Party into the territory of the other Contracting party, shall exempt on the basis of reciprocity ftom all customs duties, taxes, inspection feqs ard similar fees aod charges. 6. Office supplies, vehicles for office use, vehicles for special use at airport, bus{}?e vehicl (excluding cars) for carriage of crew members and their baggage, as well as comp reservation system and communication equipment including their spare parts of representation of the designated airline(s) of either Contracting party shall, when introd into the said teritory ofthe other Co[tracting party, be exempt from customs duties and duties on importation oD the basis of reciprocity provided these supplies are intended for airline's own use and do not exceed reasonable limit. 7, Baggage, cargo and mail in direct transit shall be exempt from all customs duties, taxe inspection fees and other similar fees and charges on the basis of reciprocity with exception ofthe charges corresponding to the services provided. 8. The rcvenues and profit realized by the designated airline(s) of each Contracting p within the terdtory ofthe other Cootlacting party in connection with operation ofthe services shall be exempt Aom all taxes. 9. The ploperty of the designated airline(s) of each Contracting party within the tenitory the other Cotrhacting Party shall exempt from all taxes on the basis ofreciplocity. 10. Wages, salaries and other similar remuneration received by lhe employees of representation of the designated airline(s) of either Contracting party, who arc nationals the Iirst Contsacting Party, shall be exempt from all taxes on the basis of reciprocity by other Conkacting Party. Article 13 Conversiotr and Remittatrce of Revetrue l. The designated airline(s) ofsuch Contracting party shall have, on the reciprocal basis, th right to remit its revenue received in the territory of the other Contracting party to th territory ofthe first Contacting party. 2. The conversion and remittance of such revenue shall be effected in convgrtible currenc ofremittance. 3. Each Contracting party shall facilitate the conversioD and rcmittances of the revenr received in its territory by the designated airline(s) of the other Colhacting pady, and assi promptly the said airline(s) in attcnding to the relevant fomalities. at the effective rate of exchange prevailing on the date l0 Article 14 Aviatioo Security 1. Each Contracting Party may rcquest consultations at any time colceming the safet standards maintained by the other contacting party in areas relating to aeronautical facilities flight crew, aircraft and the operation of aircraft. Such consultations shall take place withi thirty (30) days ofthe receipt ofthat request. 2. ll following such consultations, one Contracting party finds that the othcr Contracti Pady does not effectively maintain and administer safety standards in the areas referred to i paragaph 1 that meet the Standards established at that time puNuant to the Convention, th other Contracting Party shall be infomed of such findings and of the steps consi necessary to conform with the Standards. Each Contacting Party.eserves the right to suspend or vary the operating authorizatio of an atline or airlines of the othe! Contracting Party immediately in the event the Conhacting Party corcludes, whether as a result of access for ramp inspection, a series o ramp inspections, a denial of access for lamp iNpection, consultatio[ or otherwise, imtrlediate action is esseltial to the safety of the airline operation. 7. Any action by one Contracting Party in accoldance with paragraphs 2 or 6 above shall discontinued once the basis for the taking ofthat actiol ceases to exist. Article 16 Recogtrition of Certilicates aDd Licetrses 1. Each Conhacting Pa(y shall recognize the valid certificate of air worthiness, certifi of competency and licenses issued or validated by the other Contracting pany for operation of the agreed services on the specified route, provided that the standards of s certificates and licenses comply with or above the minimum standards established from to time in accordance with the Convention on Intemational Civil Aviation. 2. Each Contracting Party rescrves the right, however, to rcfuse to recognize, for purpose of flights over its own teritory, certificates of admission and licences granted to i own nationals by the other Contmcting Party. Article 17 CoDsultation l. If the aeronautical authorities of the Conbacting parties fail to rcach a settlement of said dispute, the Contacting Palties shall settle such dispute through diplomatic channels. Article 19 Ametrdment strd Modilication l. If either of the Contracting Parties considers it desirable to amend any provision of thi Agreement or its Annex, it may at any time request consultation with the other Contractin Party, and such consultatioq which may be through discussion or by correspondence, begin within a period of niDety (90) dals from the date of receipt ofthe request by the Contracting Party, unless both Conkacting parties agree to an extensio[ ofthis period. 2. The consultation referred to in paragraph t of this Article may also be held betweel aeronautical authorities of the Conhacting parties, 3. Any amendmetrt to this Agrecment shall come into force when it has been confmed by exchange of notes through diplomatic channels. 4. If the AmendmeDt relates only to the provisiols of the annexed Schedules, it may agreed upon between the aeronautical authorities of both Contracting parties and become effective ftom the date of agreement between both aeronautical authorities. Article 20 Terminatioo Either Contracting Party may at any time give notice to the other Contracting party throu diplomatic channels of its decision to terminate this Agreement. Where aircraft is leased from airlines ofthird coutraies, only the lessee airlines wi be entitled to exercise tralfic on the services performed; and c. The leased aircraft ftom third countries should only be allowed on a temporary basi with duration no more than two years, and the designated airlines concemed s submit liability, insurance and other rclevant documents to rclevant authorities of Contracting Parties as required whilc filing the applications.
