Cenerrl
The procedures to be followed lbr Nattonal Competirive Bidding under Section
III of Schedule 2 ro this Ageement shall be subjecr ro the clarifications and procedures
set forth in the following paragraphs to ensure economy, emciency and rransparency and
broad consislency wirh the provistons of Section I of the 'Cutdelines for Pr@uremenr
under IBRD Loans and IDA Credils" (the Guidelines) published by the Bar*/Asso,ciarion
in Nlay 1004 and revised in October 2006

Eligibility
The eligibiliry of bidders shall be as defined under Section I of rhe Gurdelines;
accordingly, no bidder or potential bidder shall be declared ineligible fb. contracrs
tinanced by the BanlJAssociation for reasons other than rhose provided in Seciion I of
the Cuidelines Forergn bidders shall be eligble to parricrpate in bidding under the same
conditions as domesrrc bidded The requircment on the citizenshrp of peBonnel and
Iabor force in construction works, or any other similar requiremenq shall not be applied
as a discriminatory measure to limit participation of foreign bidders.

(a)
"Open competilive procedures" (i e. "public tendei' ralher than "lender")
shall be rhe defaut rule. A single envelope procedure shall be used for rhe submisston of
goods, works, or technical services (other than consuhants' services).
(b) Invitarions to bid shall be adve(ised in at leasr one widely circulated
narional daily newspaper allowtng a minimum of 30 days for the preparation and
submission ofbids. Advenisements published in loreign language newspap€rs shall be in
compliance \,ith such a 30-day-minimum in number of days for brds preparation and
submission
(c)
Bids shall not be invited on the basts ofpercenrage premjum or discount
over rhe eslimared cost. Cost esrimates shall not be disclosed to bidders.
(d)
Nonrefundable Fee for rhe bidding documenrs shall be allowed to be Daid
in Ceorgian Lari or in specified convenible tbretgn cunency equivalent. i.e USD,

(a)
Govenunenr-owned enlerprises in Ceorgia shall be eligible to participate
in bidding only if they can establish that they are legally and financially autonomous,
operate under commercial larv and are no,t a dependent agency ofthe Govemmenl
(b)
Goverunent-owned enterprises will be subject to the same bid and
performance security requiremenE as other bidders.

Perticipatiotr by Joirt Vetrtur€s
Participation shall be allowed from joint ventures on the condition that suchjoint
venlure partners will trejointly and severdlly liable under the Contract.

biddinB doruments, including prc-qualification documenLs, for lhe procurement ofgoods,
