CONCERNING AIR SERVICES
The Govemment of Georgia and the Govemment of the State of Qatar (thCrcinafter referred to as
"lhe Contracting
i
Parties")
Bei,.g Parties lo the Convention on Intemational Civil Aviation opened for lignature at Chicago on
the seventh day ofDecember, 1944;
Desiring to conclude an Ageement according to the provrsions of the said Convention for the
purpose ofoperating air services between their state territories;
Have agreed as follows:
ARTICLE I
Definitions
For the purpose oflhis Agre€ment, unless the context otherwise requires:
(a) tle term "the Convention" means the Convention on Intemational Ci*.]it eviaton, opened for
signature at Chrcago on 7 December 1944 and includes: (i) any amendinent thereto whlch has
eDtered into force under Article 94 (a) thereof and has been ratified by bbth Contracting Panies;
and (ii) any annex or any amendmen( thereto adopted under Article 90 of that Conventton,
insofar as such amendment or annex is at any given time effective for both Contracting Paflies;
(b) the term "aeronautical authorities" means, in the case of Georgia, the #nistry f Economy ard
Suslainable Development of Georgia and,/or United Transport Adminilrration and in the case
ofthe State ofQatar, the Chairman ofthe Civil Aviation Authority or, i{ both cases, any person
rr body who may be authorized to perform any functions at present eigrcisable by the abovemenlioned authorilies or similar functions;

(c) the term "designated airline" means an airline which has been desigiated and aulhorized in
accordance with Article 4 ofthis Agreement;

(d) lhe term "terrilory" rn relation to a State has the meaning assigned tb it in tuticle 2 of the
Convention;

(e) the telms "air service", "intsmational air servic€", "airlin€" and "stop fpr non-lraffic purposes"
have tle meanings respectively assigned to them in Anicle 96 ofthe Colvcntion;
(0 ,he term "agteement" means this agreement, its Annex, and any amCldments to it or to thjs
airlines by the competent aulhonties or

aircraft over a given period and rcute or scction ofroute.
ARTICLE 2
Applicabilitv of lhe Convention

The provisions of this Agreement shall be subject to the provisions of th+ Convention insofar as
those provisions arc applicable to intemational air services.
ARTICLE 3
Granl of Rishts
L Each Contracting Party granls to the other Contractirg Party the follo',Ving rights in respect of
its intemational air services:
(a) the right to fly across its state territory without landing;
(b) the right to make stops in its state territory for non-traflic purposes.
2. Each Contracting Party grants to the other Contracting Party the rights hereinafter specified rn
lhis Ageement for the purpose of operating scheduled intemational ail services on the routes
specified in the appropriate Section of the Schedule arxxexed to this Afeement. Such services
and routes are hereinafter called "the ageed services" and the "specififd routes" respectively.
While operating an agreed service on a specified route the airlinbs designated by each
contracting party shall enjoy in addition to the rights specified in paragraph (1) ofrhis turicle
lhe right lo make slops in the state territory ofthe othtr Contracting Parl!/ at the poinls specified
for that route i[ the Schedule annexed to this Agreement for the purposd of taking on board and
discharging passengers and cargo, including mail in combination or sepdrately.
Nothing in paragraph (2) of this Article shall be deerned to confer on tlle designated airlines of
one Contracting Pany the right to take on board, in the state territory df the other Contracting
Party, passengers and cargo, rncluding mail, carried for hire or reward lnd destined for anothei
point in lhe state tenitory ofthe other Conh-acting Pany.
If
because of armed conflict, political distu6ances or developments, or unconquerable
circumstances, a designated airline ofone Contracting pariy is unable to opemte a service on lts
normal routing, the olher contracting Party shall use its best efrorts to facilitate the continued
operation ofsuch service rhrough appropnate temporary rearrang€mentsiofroutes.
ARTICLE 4
Desislation and Authorization of Airlines
l. Each Contracting Party shall have the right to designate in writing io the olher Contracting
Party one or more airlines for the purpose of operating lhe ageed dervices on the specilied
routes and to withdraw or altcr such desrgnations.

On receipt of such designation the other Contracting Party shall, suujcct ro the provisions of
paragraphs (3) and (4) of this AJticle, wilhout delay grant to the airlihe or airlines designated
the appropriate operaling authonzalrons
The aeronautical authorities of one Contracting Party may require an firline designated by the
other Contracting Parly lo satisfy them that it is qualified to fulfill the conditions prescribed in
accordance with the legislation in force olthe State of this Contractlng Pa(y_applied to the
operatlon of intemational air services by such authorities in conformib/ with the provisions of
the Convention.
4. Each Contracting Party shall have the right to refuse to grant the lperating authorizations
refered to in paragraph (2) of this Aiticle, or lo impose such confitions as it may deem
necessary on the exercise by a designaled airline of the right spccified in Anicle 3(2) of this
Agreement, in any case where the said Contracting Party is not Catisfied that substantial
ownership and effective control of that airline are vested in the Contrhcting Party designating
the airline or in nationals ofit's state
5 When an airline has been so designated and authorizcd, it may at any time begin to operate thc
services, provided that the flight schedules has been approved in accordance with the provisions
of Article 6 and thc tariff established in accordance with the provisibns of Article 9 of this
Agreement.
ARTTCLE 5
Revocation or Suspension of Ooeratins Authorizatiols
l
I Each Contracting party shall have the nght to revoke an operating auttloriz2lion or to suspend
the exercise ofthe rights specified in Anicle 3 (2) ofthis Ageement by]aD airline designated by
the other Contracting Party, or to imposc such conditions as it may deem necessary on the
exercise of these rights:
a) in any case where it is not satisfied that substantial ownershipland effective control of
that airline are vested in the Conlracting Pany designating the hirtine or in nationals of
such Contracting Party; or
b) in the case of failure by thal airline to comply with the lejislation in force of thc
Contracting Party v,/hich has granted these rights; or
c) if the airline otherwise fails to operate in accordance with rile

Armex of the Agreement. No Contracting Pany defines unilaterally the traffic capacity,
frequency or regulation, or the type (t)?es) of the aircraft for $e air cNrriers designated by the
other Palty, which are operated by the airlines designated by the othed Conh-acting Party, with
the exceptlon, when therc exists Iimitation in accordance with the techiical, oPerating, customs,
environmental requirements or otheE, established by the legislatioi. The operation of air
service, in any case, shall be carried out in accordance wili the homogeneous provisions
determined by the Article 15 ofthe
Convention

The airlines designated by the Contracting Par1y, submit to the Aeroniutical Authorities of the
other Contracting Party the flight schedules for apProval not later tlta-n 30 days prior to lhe
presumable date of their operating. This requirement shall also apply ito later arnendments ln
ipecific case, the mentioned period may be reduced on the basis of lhd agreement between the
Aeronautical Authorities
4. The schedules established for each season (April-October, November:March) shall remain tn
force for the further corresponding seasons, untrl new schedules have been establlshed ln
rccordance with the provisions ofthis Adrcle.
5. The flight schedule, whereas possible, should take in(o account the strvices' supplied on the
agreed air service equally, during the weekdays, with envisaging the redsonable requirement. [t

ARTICLE 8
Code Shear
In operating or holding out the authorized sewices on the agreed routes, ahy airline designated by
one Contracting Party may enter into co-operative markeling arrangemcnts like code sharing with
l) an airline or airlines designaled by lhis Contracting Party
2) an airline or airlines designated by the other Contracting Party
3) an airline or airlines ofa third country
provided that all airlines in such arrangements:
a) hold the appropriate aulhority on the routes and segments concemed
b) meet the requirements normally and reasonab
c) must in rcspect of any ticket sold by it, mak

ARTICLE 9
TariIIs
r) The tariffs on any agrecd service shall be establishcd al reasonable level!, due regard being patd
to all relevant facto6, including cost of operation, reasonable profii and characteristics of
sewrce. The aeronautical authorities ofthe contractirg parties shall consider unacceptable tariffs
that are uNeasonably discrimtnatory, unduly high or restictive becJuse of the abusc of a
dominant position, or artificially low becausc of direct or indircct sudsidy or suppon, or are
predatory

tariffs for carriage on passenger air sewices operated by a designatedlairline pursuant to this
Agreement, excluding cargo tariffs, or tariffs to be charged by the dcsidnated airline or airhnes
ofthe other Contracting Party for carriage between the fiIst Contracting Farty and a third state.

Each Party reserves the right to suspend or vary the operating auth5 zation of ar airline or
airlines ofthe other Party immediately i. the event lhe first Party concfudes, whether as a result
of a ramp hspeclion, a denial of access for ramp inspection, consultation or otherwise, that
,rnmediatc action is essential to the safety ofan airline operation.

Any action by one Party in accordance with paragraphs 2 or 6 above sirall be discontinued once
the basis for the taking ofthat action ceases to exit.

The appropriate authorities of a Contracting Party shall have lhe right without unreasohable
delays, to search aircrafl of the other Conkacting Pafiy on landing orldeparture and to inspecl
rhe cenificate and olher documents prescribed by the Convention.
