BETWEEN THE GOVERNMENT OF GEORGIA
AND THE COVERNMENT OF THE STATE OFISRAEL
ON C00ERATHON IN THE FIGHT AGAINST cRIPIE AND
PUBLIC sECURITY ISSuES

Rccognizing their mutual intercst in coopcration in qdcr to protect their

Being aware. that crirne may endanger intemadonal peace. law and ortler, rule
of law, security. stability, tenirorial integriq, ol. their countries, irnpede
developmenr of economy, estsbrishment of inveitmenr environment, democistic
values and justice:
Emphasizing their cornmon inrerest to fight crime nnd ensure public securiry:

h) crimes facilitared by thc use ofcyber infrastnrctures;
i) othcr trans-border and intemational crinrcs;
j) crime and delinquency prevention;
k) exchange of criminal intelligence information regarding public securitv;
l) science and technology as applied ro public securiryl
m) emergency management;
n) critical infrastructure protection;
o) criminal analysis and forensics ([o the extenr which is under the comperence
of the implementing agcncies dcsignated in Article 3).
Article 2
Forms of cooperation
l. With the aim to prevcnt, detect and suppress crimes detailed in Anicle I of
[ris Agreement, rhe Parties shall cooperate in rhe lbllowing forms:
a) exchange of information;
b) coopcration in search for rvanted or rnissing persons, stolen items and
other objects related to crimc.
2. The Parties may also cooperatc in the following fonns:
a) cxchange ofrelevant expcrts and their training;
b) arrangement ofjoint seminars;
c) assistance in training ofprofessional staftl
d) exchangc ofresuks olscientific research;
e) cxchange of knor,r,ledge and exp€rience on research mcthods and means
used in the field of criminalities.

3. The cooperation purcua to this Agrccment shall be subject to the national
legisluion of the Parties and sha.ll take place according to the intemational
agrieements by which the Parties are bound.
4. Coopcration under this Agr€cment sball not include mutual legal assistance
in criminal maners and shall not derogarc from and/or affect ttre partics abiliD,
!o scck and provide mutual legal assistrncc under relevant agreemeqts
rcgulating mutual legal assistanc€ or Parties' cooperation through Intcrpol
channels and in accordance to Interpol's rules and regulations.
Article 3
Compctcnt Aulhoritics
l. For the implementation of this Agreernent, the cornpetenr authorities of the
Parties are:
For the Govemment ol'Georgia:
The Ministry of Internal Affairs of Gcorgia (hereinaftcr relerrcd to as: "MIA").
For the Govenrment of the Stare ol'lsrael:
Thc Ministry ol Public Securit;' (hercinafter ref'errcd to as: "IMPS").
2. The Parties shall exchange contact details of their conuct points in writing
for the implementation of this Agreement within sixty (60) days from the date
of entry into force of this Agreement.
3. Thc Parties shall inform each other in writing about any change in thc names,
competences or contact information of their competent au(hori!ies.
Article 4
Joint Working Groups
I. The Parties shall cstablish a Joint Working Group (hercinaller ret'crred tr: as
"JWG") which will, inter alia:

discuss future areas and phascs of cooperation;

agrec upon exclrange ofdelegations;
excrcise control over execution of the provisions ol'this Agreement as
well as over contr cts signed between the corresponding organizations, in the
framework of thc implementation of thi s Agreement.
2. 'lhe JWG may' establish sub-committecs on different aspccts ol cooperation
on a pemanent or temporary basis, as agrced by the Panies.
3. The JWG shall convene frorn rime to time, altemately in 'Ibilisi and in
Jerusalem, as shall bc agreed between the Parties.
Article 5
Cooperation req uests
l. The cooperation in the framervork of this Agreement shall be carricd out
upon a writen request of either Party.
2. The cooperation request shall contain:
a) name of the rcquesting, compctent authorityi
b) narne ofthe requested competent authority;
c) subject of the request:
d) reason of the request;
e) any other information which can contribule to the fulfillment of the request.
3. The requests and answers shall be in writing and in English.
4. In urgent cases, the Parties can communicate with each other verhallr,. Such
communication shall be confrrmed in writing within 5 working days-
Article 6
Transmission and use of personal rlata
l. "Personal data" in this Agrccment shall rnean anl data relaring to an
identified or identifiable narural person: an identifiable pemon is one who can
be identified, dircctly or indirectly, in particular by reference to an identificarion
number or to one or more factors specific to his physical, physiological, rnental,
economic, cultura.l or social identity.
2. The following provisions shall apply to the exchange of personal data
(hercinafter referred to as "data") and the handling of the transmitted dara:
a) penonal data shall be ransmitted undcr this agreement solely for puposes
which arc under competcnt authorities mentioned in paragraph I of arti;le
j;
b) the recipient Party may use the data solely for thc purposes mcntioned in the
cooperadon request and under the conditions dctermined by the datatransmining Party; such data may be used for othcr purposes only with the prior
written conscnt of the data-transmitring Parry and in compliance with the
legisluion of both Parties;
c) upon the requcst of the data-transmitting Party, the rccipient pany shall
providc information on ihe use of thc transmittcd data and the rcsults thus
achiwed;
d) the &ta-transmitting Party shall ensure that the transmitted dara are correct
and chcck that the transmission is neccssary and appropriate to the intended
pueose. In doing so, it is necessary to r€spect the national legislation of the
Parties which may rcstrict the data transmission. Should it be subsequently
asccdsincd that the ransmittcd data wcre incorrect or should not have be€n
transmitted, the recipient Party must be notified immediately. lt shall correct rhe
wrong data and destroy the data which should not have been transmitted;
e) the Parties shal I keep rccords on the ransmissions, receipt and destruction of
date The records shall in particular indicate the purpose of the transmission, the
scopc of thc data, the authoritics involvcd and the reasons for destruction;
f) NoMttutrnding articlc l0 to this agFc€ment, personal data that was
trsnsmitted under this Agrecment shalt not be transmined onward to third
bodies or States;
g) the Parties shall effectively protect the trsnsmined data against accidental or
unauthorized access, aceidental loss, accidental
unauthorized change,
against accidental or unauthorizcd transmission, or against accidental or
unauthorizcd disclosure.

degree of ffre as rhey each exercise with their own classified information,
knowledge and expertise of n similar nature.
2. Classified information and docurnents transmined in thc framework of
cooperation under this Agreement ma}, he provided to third srares and
intemational organizations only with a wrinen consenl of rhe transmitting party.
3. The rccipient Party shall grant the level of proteclion ro the clnssified
information received from dte sender Pany in accordance u,ith rhc tnhle of
equivalcnce constituting the annex to this Agreemenr. This nnncr shall
constitute an inregral part of this Agreemenr.
Article 8
Refusrt to fulfill requests
l. The rcquested Party may rorally or partly refuse a requcst, should it believe
that granting a requesr is likcly to infringe the sovercignty. sccurity, public
order and national inrerests of its counry, or if it is conrrary [o the national
legislation of irs srare.
2. If the fulfillment of request is torally or panly rcjected, the rcquesred parry
shall communicate in a timely manner and in writing the reasons of retusal to
the requcsting Pany.
Article 9
Expenses
Each Pary sha.ll cover arr of its own expenses rerated to the imprcmentation
or'
this Agreement, unless the Parties mutually agree otherwise on a ca-se
by case
basis.
Article l0
Rcletion to other internatiooal treaties
The provisions of this Agreemenr do not affect the parties' obligations assumed
under other intcmational treaties and righs confened on rhem.
Article I I
Settlement of disputes
l..ln the event of any dispute arising bctween the parties. rvherher such dispute
relates to rhe inrerpretation or applicuion of the Agreement:
a) The Parties shall, in rhe t'lrsr instance, make every reasonablc eflbn to reach
au amicable settlement through the points of contact mentioned in Article 3;
b) In the e*cnt of failure to reach such a settlemenr, the dispute shall he sertled
by direct consulurions betrveen the Director General of the IMpS and the MIA
trr, in the lasr resort, by negotiations through diplomatic channcls.
2. During the dispure sefilemenr, borh parties shall continue ro rillfill all their
commitments under this Agreement.
Article t 2
Amcndmenls and supplcmcnts
This Agreement may be amended and supplententecl by a mul.ual consent of the
Parties. such Amendments and supplements shall be an integral part of this
Agreement and shall enter into f-orce in accordance wirh the Iraiagraph r of the
Anicle I 4 of this Agreemenr.
Articlc l3
Langurrge of communication
All communications generated by either Party shall be in writing and in
English.
Article l4
[-inol provisions
l. Agreement shall enter into force on the thinieth (30) day from the date of
the receipt of the last written notification through thc diplomatic channels b1,
which thc Parries notiS each other that their intemal legal procedures f'or the
entry into force of the Agreement have been complied with.
2. This Agreement shall rernain in force until eirher Pan;- norifics thc olher
in writing, through diplomaric channels, of its intent ro rcrminarc it. lt shalt
cease to be in force 90 (ninety) days from the date ofsuch noritication.
3. Should such norification be issucd, the Parties shall enrer consultarions.
in order to fully evaluate the consequences of the terminatiorr of the Agrecment
and take such actions as necessar), to alleviate problerns thar rnay.result front
termination.
4. Cooperation activiries already initiated rhe tiamervork ol' rhis
Agrecment (lmplementing Anangements, contracts and other instrumenrs) plior
to termination. shall continue until their completion.
