CHAFIER I - GENERAL PROVISIONS
Article 1- Obiect and PurPose
This Convention is concemed with Programe services embodied 'i hansmissions The

Article 4 - Fr€€dom ofr€cePtion ard rekan3mission
The Pdties shall ensure freedom of exPrcssion d inJornation in accordance with
Articl€lo of the Convention ,or the l'rotection of Human RiShts and Fundament l
Frertoms and lhey shal SuaraDtee freedom of re.ePtion md shall not restrict the
retransmission on their territories of Programme services whtch conPly with the terms of
this Convention.
Arti.le 5 - Duties of the tlansmitting Pdtie6 l
Each tsansmitting Paty shal ensure that all Protramne services transmitt€d by
broadcasters within its iuisdiction conply with the terms of this Convention
For the pulPoses of this Convention, a broadcaster within the junsdichon of a Party is:

a boradcaster who is deemed to be established in that Patty a€cording to
ParagaPh 3,
-
a broadcaster lo whom ParatraPh 4 aPPUes.
For th€ purpo6e of this Convmtion, a broadcaster shal b€ deemed to b€ established in a
Party, hcreinafter ref€rred to as "kansntitting Party" in the followinScases:

the broadcaster has its head of6ce in that Paty and the decisrons on Programme
s.hedu.l€6 are taken in that Parly;
b
if a broadcaster has its head office in one Party but decisions on Programme schedul€r
are tal(en in another Party, it shall be deened to be establjshed in the Paity where a
signi6crnt paft of the worlforce involved in the pursuit of the t€levision broadcasting
a.rivity operates; iJ a sitnificant pfft of lhe workforce involved in the Pursuit of the
television broadcastint achvity operates in each of thos€ Partses, the broadcaiter shall
be deemed to be established in the Party where it has its head office, if a signficant Part
oi LLrc workforce hvolved in the pursuitof the television broadcastint activity oPerate3
in neither of those Parti€s, the broadcaster shall be deemed to be established in the
Pnrty where it first began broadcastint in accordaffe with the system of law of tltat
Party, provided that it nraintains a stable and ef(ective lin-k with the €conomy of that
P.rtY;

This Convmtion shall mter into force on the first day of the month folowing th€ exPnation
of a period of tluee months after the date on which seven States, of which at Ieast five
memb€r States ol the Council of EuoPe, have express€d their cons€nt to be bound by the
Convention in accordance wilh the Fovisions of the Preceding ParagraPh.
