I have the honour to acknowledge the receipt of Frr le er dated 23 August 2O1O
whrch reads as follows:
'ln order to more etfectively carry out the decisiorE regarding Georgia taken by the
member States of the North Atlantic Treaty OrgarEation (NATO) at the Bucharest
and the Strasbourg/Kehl Summtts and to enhate implementation of ongorng
programmes: in parlicular, the decision by NATO Foreign Ministers of 3 December
2008, welcomed by the NATO Heads of State ari Govemment at their Summit in
Strasbourg/Kehl, lo "maximize (NATO'S) advice, lsrstance. and support" for the
reform process in Georgia and to "reintorce ihe irormation and liaison offlce, in
Georgia;
ln order to further strengthen the relationship brteen NATO and Georgia, and
promote the effective functioning ol the NATo{aorgia Commission (NGC) and
programmes conducted within its frameworkl
Referring to the request from Georgia to estabtish a NATO Liaison Otfic€. hereafter
NLO, in Tbilisi, I have the honour with the aim of Gtablishing and setting up such
NLO rn Georgia and creating appropriate conditions lo enable it to function properly,
to propose the following arrangements
1. The NLO shall be accorded the futt privbges. immun(tes and facilities
equivalent to those granted to a diplomalic mission established in Georgia, in
accordance with lhe provrsrons of the Vienna Cor ention on Diplomalic Relations
done on 18 April 1961.

2. ln so far as it is not already accorded under FEragraph 1 of the p.esent letter,
the NLO'S moveable property which is imported h, expo(ed from or procured in
Georgia shall be exempted from all duties, taxes. tariffs, recompense, and other
payments.

ln addition and in so far as it rs not akeady accorded under paragraph 1 of the
present letler, in order to facililate the proper execution of NATO projects,
programmes and cooperation activilies, rncluding the NATO-Georgia Professionat
Development Programme, within the terntory of Georgia, any contracts required for
the execution or implementalion of aforementioned projects, programmes and
activities can be placed by slaff assigned by NATO

The Head of the NLO and other staff assigned by NATO to exercise therr
functions tn the lenitory ol Georgia, other than naiionats'or permanent residents
of
Georgra, together with the members of their famity torming part of their household
shall be accorded the full privileges, immunilies ind faciiities equivalent to those
granted to diplomatic agents accredited to Georgia, in accordance wrth the
provisions of the Vienna Convention on Diplomatic Relations, done
on 1g April 1961
5. The Head ot the NLO and other stafl assigned by NATO to exercrse their
functions in the territory of Georgia, except nalionals or permanent residents

Georgra, are exempt from taxes and can imporl goods for personal use and for the
use by the members forming part of their househald, without restrictions and import
taxes, in.so fa_r as lhese privileges and immunittes are not already accorded under
paragraph 4 of the present letter
6.1 Other otficials pedorming administrative and technrcat functions together with
the members of their famity forming part of their househotd, not nitionats or
permanent residents of Georgia, shall enjoy the privileges, immunitres
and facilities
equivalent to those granted lo members of the adminiatrative and technicat stalf of
diplomatic missions accrediled to Georgia, in accordance wrth the provisions of the
Vienna Convention on Diplomatic Retations, done on .tg April 1961.
6.2 NATO.experts emptoyed by, assigned to or aflached to NATO and temporarity
presenl in the territory of Georgia for the execution of the tasks
or functions of lhe
NLO, other^than localty hired personnet, sha enjoy during their presence in
the

7 Locally hired personnel performing administrative and technical functpns who

9, The Government of Georgia, through its delegated authonties, shalt facilitate

'10 Notwithstanding the priviteges and immunitiE appticable under other relevant
international instruments. the Head of the NLO, other staff assigned by NATO,
otficials and experts shall respect Georgia,s nabnat tegislation They ihal nol
engage in any form of professional or commercial aElvity in Georgia.
1'1. The Government of Georgia shall provide frte of rent the necessary oflice
space. This oflice space shall be made avaitabte b the NLO in a trmety manner
Operational costs, including utitities (etectricrty, heding, water) and office cteaning
shall be borne by NATO
12. The omce space of the NLO shall not be usedo any manner incompatible with
the lunctions of the Head ot the NLO, olher staff asstned by NATO and officiats.
13. The Government of Georgia shall take all lEcessary measures to ensure
adequale security and safety for the NLO and ils prt nises, together with its staff and
officials, and the members of their family forming prt of their househotd.

NATO and the competent authorities of GeorrF shall agree on any additional
security arrangements for the oFfice space of the NLO.
15
The NLO may fly the NATO flag and use the NATO embtem. NATO and the
competent authorities of Georgia will consult each dter about such placement.
16 Any dispute between Georgia and NATO rel59 to the NLO, its programmes
and cooperation activities, including the NATO-Georgia Professionat Development
Programme. shall be settled by diplomatic means.
'17. Georgia and NATO may, by wntten noti,icdion, propose amendments or
modifications to the present agreement and requel consideration ol such proposed
amendments or modiflc€tions. These amendments rld modifications shall enler inlo
force in the same manner as this agreement.
18. The agreement may be terminated by either lra(y by giving written notilication
of termination through diplomatic channels. The termination shall take etfect three
months after the date of receipt of the notitlcatio by the Party concerned. The
agreement shall lhen cease to be in force except fur the setflement of outstanding
claims lhat arose before the day on which the termirEtion look effecl.
19. The present agreement does not and is not in&nded to change or amend. nor
shall it be construed as to change or amend, the provisions of the Exchange of
Letlers between NATO and Georgia regardrng 0|e appointment ot a NATO/PfP
Liaison Officer to Georgia dated 31 January and 2 February 2005.

( Afin d'appliquer plus concretement les docisiorE concernant la G6orgie adoptees
par les Etats membres de l'Organisation du Trait6 de lA antique Nord (OTAN) aux
sommets de Bucarest et de Strasbourg-Kehl et O renforcer ta mise en @uvre des
programmes en cours I en particulier la deci-n des ministres des Affaires
6trangdres de I'OTAN du 3 decembre 2008, accldlie Iavorablement par les chefs
d'Etal et de gouvernement de l'OTAN a leur somml de Strasbourg-Keht, d'optimiser
les avis, laide et le soutien que I'OTAN foumtt au Focessus de rolorme en Georgie
et de renforcer le bureau d'intormation et de liaisoadans ce pays;
Afin de consolider plus avant les relalions entre I'OTAN et la Georgie et de facititer te
bon fonctionnement de la Commission OTAN-Geqgie (COG) et la mise en @uvre
des programmes men€s dans ce cadre .
Me r6f6rant a la demande de la Georgie relative a lolablissement d'un bureau de
liaison de I'OTAN (denomm6 ci-aprds le Bu.eau de liaison) a Tbilissi, et dans la
perspective de I'6labliss€ment et de la mise sur ded d'un lel bureau en G6orgie,
ainsi que de la mise en place des conditions proFiEs e son bon fonctionnement. j'ai
l'honneur de proposer les dispositions qui suivent:

Le Bureau de larson se vort accorder lous les privileges, immunites ei facilites
qui sont octroyes a une mission diplomatique 6tab& en Georgie, conlormement aux
dispositions de la Convention de Vienne sur les rdations drplomatiques, conclue le
18 avril 1961 .

Dans la mesure oi ils ne le sonl pas d6ja en vertu du paragraphe 1 de la
pr6senle lettre, les biens mobiliers du Bureau de liaison importos ou acquis sur le
tenitoire de la G6orgie, ou exportes depuis celuki. sont exoneres de tous droits,
taxes, compensations et paiements divers
3. En outre, et dans Ia mesure oir ils ne sonl pas deja habilites a le faire en vertu
du paragraphe 1 de la presente lettre, les membres du personnel atfectes par
I'OTAN peuvent, en vue de taciliter la bonne execution, sur Je terriloire de la
G6orgie, des projets, programmes et activites de coopdration de IOTAN, y compns
le Programme de perfeclionnement professionnel OTAN-Georgie, conclure tout
contrat necessaire a l'execution ou e la mise en ceuvre desdits projeis, programmes
et aclrvit6s
4. Le chef du Bureau de liaison el les autres membres du personnel affectes par
l'OTAN en vue d'exercer leurs fonclions sur le territoire de la Georgie, pourvu qu,ils
ne sorent pas des ressortissants de la Georgie ou n'y aient pas leur residence
permanente, ainsi que les membres de leur famille [aisant parlie de leur menage, se
voienl accorder tous les priviliges, immunit6s et facili16s octroyes aux agents
diplomaliques accr6dil6s auprds de la G6orgie, conform6menl aux dispos(ions de la
Convention de Vienne sur les relations diplomatiques, conclue le '18 avril 1961

6 1 Les autres agents assumant des fonctrons adminrstratives et techniques, ainsi
que les membres de leur famille faisant partie de teur m6nage, pourvu qu'ils ne
soient pas des ressortissants de la Georgie ou n'y aient pas leur restdence
permanente, beneficienl des privitCges, rmmunit6s et facilit6s accordes aux
membres du personnel adminislralif et technique des missions diplomatiques
accrddrt6es auprds de la G6orgie, conformoment aux disposilions de la Convention
de Vienne sur les relations diptomatiques, conclue le 't8 avril 1961.
6.2 A l'exception des agents recrutes sur place, les experts de I,OTAN emptoyds
par l'OTAN, ou atfectds ou atlach6s a cette-ci qui sonl temporairement presents sur
le lerriloire de la G6orgie pour accomplir des Eches ou des ronctions relevant du
Bureau de liaison b6n6ficient pendant leur prdsence sur ce territoire des privrleges,
immunites el lacilit6s mentionnes au paragraphe 6 'l
7. Les agenls recrutes sur place par le Bureau de liaison pour assumer des
fonctions administralives el techniques qui sonl des ressortissants de ta Georgie ou
y ont leur residence permanente sont soumis aux lois

'10. Nonobstant les privileges et immunites qui leusont accordes en vertu d,autres
instruments internationaux applicables, le chef & Bureau de liaison, les autres
membres du personnel affectes par I'OTAN et les agents et experts sont tenus de
rcspecter les lois g6orgiennes. lls ne p€rrent exercer aucune activito
professionnelle ou commerciale en Georgie.
11. Le Gouvernement georgien met a dispolon a titre gratuit les tocaux
necessaires e usage de bureaux Ces locaux Serqt mis a la disposition du Bureau
de liaison dans les d€lais requis. Les frais dc foncttonnement, y compris les
commodit6s telles que l'eleclricite, le chauffage et leau, ainsi que le nettoyage des
locaux sont a la charge de I'OTAN.

Les locaux du Bureau de liaison ne pew€rl 6tre utilis6s d'aucune manidre
incompatible avec les fonctions de son chef, des autres membres du personnel
affecles par l'OTAN ou des agents.
13. Le Gouvernement g6orgien prend loutes les llEsures necessaires pour assurer
la securit€ el la s0rete du Bureau de liaison, de -s locaux, des membres de son
peEonnel et de ses agents, ainsi que des membres de leur famille faisant partie de
leur menage.
14 L'OTAN et les autorites georgiennes comp€t€rles conviennent des 6ventuelles
dispositions de securile suppl6meniaires a prendr pour les locaux du Bureau de
liaison.
15 Le Bureau de liaison peut arborer le drapeau et utiliser l'embleme de I'OTAN
L'OTAN et les autorites goorgiennes competentes se consultent au sujet de leur
placement.
16 Toul diffdrend entre la G6orgie el I'OTAN au cJiel du Bureau de liaison ou des
programmes et activites de cooperaton men6s pa lur, y compns le Programme de
perfectionnement professionnel OTAN-G6orgie, est r6gle par les voies
diplomatiques.
'17. La Georgie et I'OTAN peuvent. moyennanl notification 6crite, proposer des
amendemenls ou modifications au present acqd et demander a ce que ces
propositions soient examinees Ces amendements et modificalions enlrenl en
vigueur de la mCme maniere que I'accord proprement dit.
18. Chaque Padie peul mettre fin au pr6sent accord moyennant notification ecrite
transmise par la voie diplomalique a I'autre Partie La denooc,ation prend effet trois
mois apres rdception de cette noiification. L'accord cesse ators d'etre en vigueur
sauf en ce qui concerne le reglement des demandes d'indemnite pendantes nees
avant la date de prise d'eftel de la denonciation
19 Le prdsent accord n'a ni pour objet ni pour effet d'amender ou de modilier les
disposilions de l'6change de lettres entre t'OTAN et ta G€orgie concornanl la
nominalion d'un agent de liarson OTAN/PPP en Georgie, en date des 3.t janvier et 2
fevrier 2005, et il ne peut etre interprete comme y portant amendemenl ou
modrfication
