MEMORANDUM OF UNDERSTANDING BETWEEN THE MINISTRY OF DEFENCE OF GEORGIA AND THE MINISTRY OF DEFENCE OF THE KINGDOM OF DENMARK ON DEFENCE CO-OPERATION MEMORANDUM OF UNDERSTANDING BETWEEN THE MINISTRY OF DEFENCE OF GEORGIA AiID THE MINISTRY OF DEFENCE OF THE KINGDOM OF DENMAR.K ON DEFENCE CO.OPEMTION The Ministry of Defence of Georgia and the Ministry of Defence of the Kingdom of Denmark - hereinafter referred to as the "Participants", In recognition of the principles of friendly relations, sovereign equality and peaceful settlements of disputes as stated in United Nations Charter and in the Final Act of the Organisation on Security and Co-operation in Europe, Acting in a spirit of Partnership for Peace and co-operation, Aiming to strengthen the understanding between the two countries and to contribute towards peace, stability, security and mutually beneficial co-operation on the whole European continentr recognising the importance of stable and democratic sovereign states to the interests of confidence, stability and security in Europe as a whole, Being convinced that their co-operation in the defence field will contribute to further strengthening of the good relations already established between Georgia and the Klngdom of Denmark, Have reached the following understanding: SECTION 1 PURPOSE 1. The purpose of this Memorandum is to provide a framework for co-operation in the defence field between the Participants in accordance with international law, their national legislation and with any treaties that the Participants have entered into. 2. Co-operation in the defence field between the Participants will be effected with the intention of strengthening peace and stability. ! SECTION 2 AREAS OF CO-OPERATION 1. The Participants will develop bilateral defence contacts in all or any of the follov{ing principal areas: . Security and mllltary policy; integration of the armed forces into a free and democratic society; . . . NATO integration; personnel issues, including leadership concepts and civic education; other areas mutually agreed by the Participants. 2. The Co-operation may take the form of visits, consultations, meetings, exchange of views and seminars. The Participants may agree on other forms of co-operation activities, SECTION 3 ANNUAL CO-OPERATION PLAN 1. On the basis of this Memorandum of Understanding the Participants will compile an annual cooperation plan, speciFying the areas of co-operation which has been jointly approved, when and where they will be carried out, and other matters. Both Participants can make concrete proposals, which will be exchanged through the appropriate channels. 2. Each annual co-operation plan will be prepared and mutually approved by the authorized representatives of the participants no later than the end of November in the preceding year, SECTION 7 SETTLEI,IENT OF DISPUTES 1. Disputes relating to the interpretation or application of this l4emorandum of Understanding will be resolved within the framework of the NATO/pfp SOFA and will not be referred to any national or intemational tribunal or third party for set ement. sEcrIoN a AMEI{DMENT The present Memorandum of Understanding can be amended and supplemented, with the mutual consent of the Participants, which will be concluded as separate protocols and will enter into effect in the same way as the present l4emorandum of Understanding. These Protocols will be integrated parts of this Memorandum of Understanding. SECTION 9 FINAL PROVISIONS 1. This Memorandum of Understanding is not intended to conflict with national or international law, 2. This Memorandum of Understanding will enter into etfect on the date of receipt of the last written notification of completion of internal procedures required for its entry into effect by each Particlpant. 3. This l4emorandum of Understanding is concluded for an indefinite period of time unless it is terminated by mutual consent or by either participant glving g0 days, written notice to the other through the appropriate channels. 4. The agreement among the States parties to the North Auantic Treaty and Other States participating in the partnership for peace regarding the Status of their Forces done in Brussels on 19 June 1995 and Additional protocols (pfplNATO SOFA) to this Agreement shall apply to the personnel of the armed forces of the participants during their stay on the territory of the other participant,s State pursuant to provision of this 14emorandum. 5. Until further notice by the I'linistry of Defence of the Kingdom of Denmark this Memorandum of Understandlng shall not be applicable to Greenland and the Faroe Islands.
