ARTICLE 2 Applicrbility of the Chicrgo CoDveDtion Nothing in this Agreement damages thc rights and obligations ofthe Con&acting parties undcr the Chicago Convcntion. ARTICLf, 3 Grrtrt of Rights 1 Contracting Party grants to the other Contracting party the rights hereinafter specifi€d in this Agreement for the puryose of operatir4 scheduled intemational air services on the routes specified in the Annex to this Agreiment. Such sorvices and routes are hercinafrer called ,.the ageed services,, and .the specified routes', respectively. 2 While operating an agreed service on a specified route the airlines designated by each Contracting Party shallenjoy the following rights: a. to fly across the t€rrilory ofthe Statc ofthc othc. ARTICLE 7 Tarilfs l.The tadffs on any agreed senice shall bc cstablished by the designaled airlines at reasonable levels, d-ue regard being paid to all relevant factors, including cost of op€mtion, reasonable profit and chamcieristics of scrvice. The Aeronautical Authorities oi rhe Corfracting Partics shall considcr unacc€ptable tariffs that are unreasonably discriminatory, unauly high or rcstrictivc bccausc ofthc sbuse of. dominant position, or artificially low because of direct or indircct subsidy or support. 2.The Acronautical Authoritics of cach Co racting Party may re4uirc notification and filing of tarills for carriagc on passengcr air seniccs operatcd by a designated airline pursuant to this Agreemen{ cxctuding cargo tariffs, or tariffs to be charged by the designated airliae of the other Contracting Party for carriage betwecn the points in the territory of the State oflhc first Contacting Party and a third state. 3.Without limiting thc application of gencral competition and consumer legislation in force ofthe State oflach Contacting Party, intervention by the Acronautical Authorities ofthe Conrracting Party shall be limited to: a. b. c. th. pr€vention ofurtasonably low or discriminatory tariffs; thc protection of coNumers Aom i8iiffs ihat atc unreasonably hiSh or unreasonabiy rcsrictive due cithcr to the abusc of a dominant position ot lo conccried practices amoog airlin€s; or the protection of airlines from tariffs that arc srtificially low becausc of dir€ct or indircct govcmmcnlal subsidy or support. 4. If the Aeronautical Authorities ofeith€r Contracting Party believe that any such tariff is inconsistent with the considerations s€t out in palagraph I ofthis Anicle, they shall send appropriate notice to the designated airline ir question and, on receipt ofthal notice, such d;signated airline shall immediatcly suspcnd application of the rariff. Thc other Contrrcting Parl) nrat enjoy the rights specificd in Anicle 5 ofthis Agrcement- "::::: LEach Contmcting Party shallon a basis of rcciprocity exempt the designated airline ofthe other Contracting Party to the fullest cxtent under its national legislation fiom customs duties and charges, with tha exception ofcharges corresponding to the service performed, on aircraft of the designated airline of one Contracting Pary operating the agteed services, and fuel, lubricating oils, consumable technical supplies, spare parts including engines, regular aircraft equipmen! aircmff storcs (including foo4 liquor and toba.ro), the necessary documents (printed ticket stock, air waybills, any printed material which bears the insignia ofthe company printed thereon and usual publicity material distributed \\'ithout charE,e hy the designated airline) and other items intended for use or used solely nr connection wrth the operation or scrvicillS ol arrorala ol tlrc designatoo alrlnlc ol lll. other Contmcting Pafiy operating the ageed services. 2.The exemption granted by this Article shall apply to the items referred to in paragraph I of this Arricle: a. introduced into the territory ofthe State of one ContBcting Patty by or on behalf ofthe designated airline ofthe other Contracting Party; b. rctained on board aircmft of the dcsignated sirline of one Confrcting Party upon arriving in or leaving thc tcrritory ofthe State ofthe other Contracting Party; c. takcn otl board aircraft of the desiSnated airline of one Contracting Party in rhe territory ofthe Slate ofthe other Contracting Party and inlended for use in operating the agrecd scrvices; whether or not such itcms arc used ot coNumcd wholly within the territory ofthe State of thc Confacting Party grarting the cxemption provided such items are not alienated and/or sold in the territory ofthe State ofthe said Contracting Party. 3.The regular airbome equipmen! as well as the materials and suppli€s normally retained on board the aircmfi ofthe dcsignated airline ofeither Contracting Party may be unloadrd in the territory of lhe State of the othcr Contracting Party only with thc approval of thc customs authoritics of that State. ln such casc, they may be placed under lhe supervision of thc said authorities up to such time &s they arg rc-cxported or othcrwise disposed of in accordance with customs lcgislation ofthe State ofthis Contracting Pany. ARTICLE 9 Direct TrrDsit l. Passengers, baggage, cargo and mail in direct transit tfuough the terrilory of the State ofeithcr Contracting Party and not leaving the area ofthe airport rcserved for such purpose shall be subject to no more than a simplified control except where securiry provisions referred to in Article l0 ofthis Agreement require otherwise. 2. BaEEage and cargo in direct fansit shall bc exempted from customs duties and other taxes. ARTICLE IO Aviaaior Security l.In accordance with their rights and obligations under intemational l.w, the Contracting Pafties rcaffirm lheir obligation to cach other to protect thc security of civil aviation against acts of unla\Ifrrl interferenc!. Each Contracting Party shall also Sive due consideration to any request from the oth€r Contracting Party fot reasoDable special security measures to meet a particular threat. s.When an incident or threat of an incident of unlawful seizure of civil aircrafl or other unla$4il acts against the safety of such aircraft, their passengers and crew, airpons or air navigation facilities occurs, the Confacting Parties shall assist each other by facilitating communications and other appropriat€ measures intended to teminate as rapidly as possible commensurate with minimum risk to life such incident or threat thereof. 6.When a Contracting Party has reasonable grcunds to believe that the other Contracting Party has departed from the provisions of this Article, the first Contracting Party may request consultation. Such co.sultation shall sta( within fifieen (15) days of rcceipl ofa rcquest. Failure to reach satisfactory agreement within fifteen (15) days from the $an of consultation shall constitute grounds for revoking, suspending or imposing conditions on the authorizations of the airline or airlines designated by the other Contracting Pany. ARTICLE I I Recogtrition of Cerailica(es and Licelces l. Certificates of airworthiness, certificates of competency and licences issued or rcndercd valid in accordance with the lcgislation in force ofthe State ofone Contracting Party, and unexpired shall be recognized as valid by the other Contsacting Party, for the purpose of operating the agreed serviccs, provided that the rcquirchents under which such c€atificates or licences were issued or rendered valid are equal to or above the minimum standards established under the Chicago Convention. 2. Each Contracting Party reserves the right, however to refuse to recognize, for the purpose offlights above the territory of its State, certificates of competency and licences granted to the nationals of its State or rendered valid for them by the third State. ARTICLE 12 Stfety l.Each Contracting Party may rcquest consultations with the other Contracting Party at any time conceming safety standards in any arca relating to aircrcw, aircraft or tieir operation adopted by the other Contracting Party. Such coDsultations shall take place within thirty (30) days ofrcceipt ofrhat requcst. 2.1f, following such consultations, one Contracting Pafy finds that the other Contracting Party does not effectiyely maintain and administer safety standards in any such arca that arc at least equal to the minimum standards cstablished at lhat time pursuant to the Chicago Convention, the frst Contracting Palty shall notiry the other Contracting pany of those findings and the steps considercd nccessary to conform with those minimum standards, and other Contracting Party shall takc appropriate corrective action. Failurc by the other Contracting Party to take appropriate action within fiffeen (15) days or such longer period as may bc agrecd shall be grounds fo. the application of Anicle 5 of this 3.As provided for in Afiicle 16 ofthe Chicago Convention the Contracting paflies agreed that any aircraft operated by the designated airline or airlines ofone Contracting pa.ty on services to or flom the teritory of the State of the other Cont'acting party may, while within the territory ofrhe State ofthe other Cont acting Party, be the subjecl of a search by the outhorized repr€s€ntativcs ofthe Aeronautical Authorities ofthe other Co racting Party, on board and arcund aircrafl to chcck both the validity of the ai.craft documents and those of its crew attd the apparent conditions ofthe aircraft and its equipment (in this Article called "ramp inspection"), provided this does not lead to unreasonable delay in the transportation. 4.lfany such ramp inspoction or scries of ramp inspcctions givcs risc to: a. serious concems that an aircraft or the operation of an aircraft does not comply with the minimum slandards established at that time pursuant to thc Chicago Convention, or b. serious concems that there is a lack ofcffcctive mai tenance and administration of safety standards establishcd at that timc pursuaot to the Chicago Convention, thc Contracting Party carryilg out the iNpection shall, for the purposes of Anicle 33 of the Chicago Colvention, be free to conclude that the requirements under which the certificate or licences in respact of that aircraft or in rcspect of the crew of that aiacrafl had been issued or rendcred valid, or that the r€quirements under which that aircraft is ' operated, are not equal to or above lhe minimum slandards established pursuant to the Chicago Convention. 5.ln the event that access for the purpose of undertaking a ranp inspection in accordance with paragraph 3 of this Anicle is denicd by the reprcsentarive ofthe designared airline ofone Contracting Pafy, the other Contracting Party may draw the c-onclusion refered to in paragraph 4 ofthis tuticle. 6.Each Contracting Party rcscrves the right to suspcnd or vary the operating authorization of the designated airline or airlines ofthc othcr Conmcting PaIty immediately in the event the first Confacting Party concludcs, whcthcr ds a rcsult ofa ramp inspcction, a scries of mmp inspection, a denial of ac..ss for .amp inspection, conslltalion or othcrwise, thal immediate action is essentiallo th. safety ofan airlinc operation. 7.Any Ection by one Contracting Party in rclation to the desigmted airlinc of lhe oihcr Contmcting PaIty in ac.ordance with paragraph 2 or 6 of this Anicle shall be discontinucd once thc basis for thc taking ofthat ection ccascs to exist. 8.With rcferenc.€ to paragraph 2 ofthis Article, if it is determined that one Contracring Party remains in non-compliance with the ICAO standards when the agreed time period has laps€d, the other Contracting Party shall advise the Secretary General ofthe ICAO The latter should also be advised ofmeasurcs taken by the first Contracring Party to comply with the ICAO standards. ARTICLE I3 Provisiou of Slatistics The Aeronautical Authorities of one Contracting Party shall supply to the Aeronautical Authorities of the other Contracting Party at lheir request such periodic or other statements of statistics as may be rcasonably required for the purpose of reviewing th€ capacity provided on the agreed services by the designated airlines of the Contracting Party rcferrcd to fust in this Articlc. Such statements shall include all information requir€d to detcrmine the iunount of tramc carried by those airlines on the ageed services and the origins and destinations of such kaffic. ARTICLE T4 Trarsfer of ExrniDgs Each Contmcting Party shall grant to the designated airlirFs ofthe other Contracting Party the right of fic. transfer of the excess of reccipts ovcr expcnditue, eamed in th€ territory of its State in connection with thc carriage of passengers, baggage, cargo by the designated airlines of this other Contracting Party. Such transfer shall be made in a frEely convertible curency in accordance with the legislation in force of the States of the Contracting Parties. ARTICLE 15 Airlitre Represetrl.tioD rDd Sales l.The designated airline or airlines ofone Contmcting Palty shall bc cntitled, in accordance with the legislation in force ofthe Slate ofthe other Contracting Party rclating to entry, residencc and cmployment to maintain within the tenitory of the State of that other Contracting Party those of their own managerial, technical, operational and other staff $al are requircd for (he provision ofair services. 2.The designatcd airlines ofeither Contracting Party shall have the right to establish on-line olfice in the territory of the State of the other Contracting Party. 3.The designated airlincs ofone Contracting Party shall havc the right to sale air services in the tcnitory ofthe Statc ofthe other Contracting Party, either dircctly or through age s appointcd by them in local curroncy. ARTICLE 16 Utar Chrrgqt Neither Contracting Party shall imposc or pcrmit to bc imposed on lhe desiSnated airlines ofthe other Contracting Party uscr charges higher than those imposed on its own airlines operaling similar intemalional air scrviccs. ARTTCLE 17 Cotrsltltrtiotrs Either Contracting Pafy may at any timc requ€st consultations with the other Conlraciing Party on the compliance r ith, intcrpretation, application or amendmeot of this Agreement. Such consultations, which may be held betweco the Aeronautical Authorities, shall begin within a p€riod of sixty (60) days from the date the other Cont acting Party rcceives a *Titlen reques! unless otherwise ageed by the Contracting Panies. ARTICLE 20 TerbinrtioD rDd Entry into Force shall be concluded for an indefinite p€riod and enter into force on the date of the rcc€ipt through diplomatic chafftcls of the latest written notification by the Contracting Parties of rhe completion of Ihcir intemal legal procedures neccssary for cntry into forcc ofthis AgIc ment. I . This Agrecment 2.Either Contracting Party may at any timc givc notic€ in writing to the othcr Contracting Party of its decision to terminate this Agrecmcnt. Such notic€ shall b€ simultaneously commuoicatcd to the ICAO. In such cas€ this Agrrement shall be terminated in twelve (12) months after the date of the rcccipt of the notic€ by lhe othet Contracting Party, unless the notic€ is withdrawn bcforc the cxpiry of this period. Frcqucncies The designat.d airlines of either Cont acting party may operate air services on the specified routes up to maximum frequcncies, which shall be agreed upon between the Aeronautical Authorities of the Contracting parties. 2. Intermcdiate points and/or points beyond Any intermediate point and/or point b€yond may be scrvcd by the desigoated airline of each Contracting Party in any combination and in any order (whi;h may include servicing intermediate points as bcyond points and bcyond points as intermediate points). 3. Code-sharing In operating or holding out air scrvic€s oo the spccified routes, ary designated airline of one Contracting Parq may enter into co-opcrative mar.keting arrangiments such as blocked-space or code-sharing arangcments with the designated airline or airlines of either Cont acting Pany. Any frequency of air sewices operated under code-sharing agrcement shall be counted only as the frequency ofthe operaling carrier.
