Es besteht Einvemehmen dar0ber, dass das Abkommen auf Quellensteuern
fllr Lottcriegewinne keine Anwendung findet.
2. Zu Artikel 7
In Bezug auf Artikel 7 Absiitze I und 2 besteht Einvemehmen dartiber,
dass, son eit ein Untemehmen eines Vertragsstaates im andem Staat durch
eine dort gelegene Betiebstatte Gtlter oder Waren verkauft oder eine
andere Gesch6ftst.iitigke it ausUbl dic Gewinnc dieser Betriebst6fie nicht
aufgnmd des vom Untemehmen bezogenen Gesamtbetages ermittelt
werden, sondem nur auf demjenigen Teil der Gesamteink0nfte, der der
BetriebstAtte fflr ihre effektive Tdtigkeit bei diesen Verkdufen oder
Gesch[ftcn zugerechnet werden kann.
Hat ein Untemehmen bei VerHgen Uber die Uberwachung Liefemng oder
Montagc oder den Bau gewerblicher, kaufintinnischer oder
wissenschaftlicher Ausrtlstungen oder Anlagen oder dffentlicher
Einrichtungen eine Betriebst6tte, so werden die Gewinne dieser
Betriebstdtte nicht aufgrund der gesamten Summe des Vertrages ermittelt,
sondern nur aufgrund des Vertragsteils, der tats{chlich durch die
Betriebstatte im Staat, in dem diese lieg! erfllllt wird.

Have agreed at the signing at Bern on t}le 156 day of June, of the Agrcemcnt
between ttre two States for the avoidalce of double taxation with resPect to
taxes on incoEe afld ott capita.l upoa the following provisions which shall
form an integal part of t].e Agreement.

It is understood tlat the AgreeDeot shall not apply to taxes withheld at the
sourcc on prizcs in a lottery,

In rbspect of paragraphs 1 and 2 of Article 7, where an enterprise of a
Contracting State sells goods or merchandise or carries on busiless in the
othcr State through a Irrmaflent eatablishDent situated therein, the profits
of that Irrmanent establishEent shall not be determined on tlle basis of the
total aoount received by the enterprise, but shall be determined only on the
basis of that part of the total receipts which is attributable to the actual
activity of tfre permanent establishEent for such sales or business.
In the case of cortt acts for the survey, supply, installation or construction of
industrial, commercial or scientific equipment or prerDises, or of public
works, whea t}!e enterprise has a peroanent establish.raent, the profits of
such permarent establishment shall not be determined on the basis of the
total aEount of tlte conkact, but shall be determined oaly on the basis of
that part of the contract which is elfectively carried out by the permanent
establishEent in the State where the perEalent establisheent is situated.
The profits related to that part of the contract which is carried out by the
head oltrce of the enterprise shall be taxable only in the State of which the
enterprise is a resident.

Arl,2 Unter das Abkommen fallende Steuem
l. Dieses Abkommen gilt, ohne RUcksicht auf die Art der Erhebung, fllr
Steuern vom Einkommen und vom Vermdgen, die ftIr Rechnung eines
Vertragsstaats oder seiner politischen Unterabteilmgen oder lokalen
Korperschafrcn erhoben wirdenl
2. Als Steuem vom Einkommen und vom Verm0gen gelt€n alle steuern,
die vom Gesamteinkornmen, vom Gesamtvermogen oder von Teilen des
Einkommens oder des Vermdgens erhoben werden, eirschliesslich der
Steuem vom Gewinn aus der Verdusserung' beweglichen - oder - '
unbeweglichen Vermdgens, der Lohnsummensteuem sowie -der Steuem
Yom Vermdgenszuwachs.
3.Zu den bestehenden Steuem, fllr die das Abkommen gilg gehOrcn
irsbesondcrc:
a) in Georgien;
(i) die Gewinrsteueq
(ii)die Einkommenssteuer;
(iii) dieVermdgenssteuer;
(im Folgenden als "georgische Steuer" bezeichnct);
b) in der Schweiz:
die von Bund, Kantonen und Gemeinden erhobenen Steuem
(i)vom Einkommen (Gesamteinkommerl Erwerbseinkommerl
Vermogensertrag, Gesch[ftserfag, Kapitalgewinn und andere
Einkunfte); und
(ii)vom Vermogen (Gesamwerm0gen, beweglichcs und
unbewegliches Vermdgeq Geschdftsverrndgerq Kapital und
Reserven und andere Venndgensteile);
(im Folgenden als "schweizerische Steuer" bezeichnet).
4. Das Abkornmen gilt auch fur alle Steuem gleicher oder im Wesentlichen
uhnlicher Ar! die nach der Unterzeichmrng des Abkommens neben den
bestehenden Steuern oder an deren Stelle erhoben werden. Die zustlndigen
Behdrden der Vertragsstaaien teilen einander die in ihren Steuergesetzen
e ingeffienen wesentlichen linderungen mit
ArL3 AllgemeineBegriffsbestimmrurgen
l. Im Sinne dieses Abkommens, wenn der Zusammenhang nichts anderes
erfordert:
a) (i) bedeutet der Ausdruck "Georgien" das Gebiet irmerhalb der
Staatsgrenzen Georgiens einschliesslich des Festlandes, der_ _._
Binnengewdsser und Hoheitsgewdsser, des dadlber befindlichen
Lufoaums sowie der angenzenden Gebiete, der besonderen
' Wttschaftszone und des der Meereskllste vorgelagerten -- 'Festlandsockels, llber welche Georgien in Ubereinstimmung mit -dem Y0lkerrccht die Hoheitsreohtc ausubsn darf;
(ii)bedeutet der Ausdruck "Schweiz" die
Eidgenossenschaft;

Vertragsstaat", je nach dcm Zusallllnenhang, Georgien oder die
Schweiz;
c) umfasst der Ausdruck "Person" natildiche Personeq Gesellschaften
und alle andercn Personenvereinigungen;
d) bedeutet der Ausdruck "Gesellschaft" judstische Personen oder
RechtstsEger, die fflr die Besteuerung wie jwistische Personen
behandelt werden;
e) bedeuten die AusdrOcke "Untemehmen eines Vertragsstaals" und
"Unternehmen des anderen Vertragsstaats", je nachdern, ein
Unternehmen, das von einer in einem Verhagsstaat ansUssigen Person
betrieben wir4 oder ein Untemehmen, das von einer im anderen
Vertragsstaat ansdssigen Person betiebcn wird;

(i) alle nattlrlichen Pcrsoneq die die Staatsangeh6rigkeit oder
StaatsbiFgerschaft eines Vertragsstaats b€sitzen;
(ii)alle juristischen Personeq Personengesellschaften und anderen
Personenvereinigungen, die nach dem in einem Vertragsstaat
geltenden Recht errichtet worden sind.
2. Bei der Anwendung des Abkommens durch einen Vertragsstaat hat,
wann der Zusammenhang nichts andercs erforderl jedo im Abkommen
nicht definierte Ausdruck die Bedeutung die ihm im Anwendungszeitraum
nach dem Recht dicses Staates Uber die Stcuern zukommt, ffir die das
diesem Staat
Abkommen gilt, wobei die Bedeutung nach dem
anzuryendenden Steuerrecht den Vorrang vor einer Bedeutung hat, die der
Ausdruck nach anderem Recht dieses Staates hal
in
Art 4 Ansassige Person
l.lrn Sinne dieses Abkommens bedeutet der Ausdruck "eine in einem
Vertragsstaat arsdssige Person" eine Persoq dic nach dem Rccht dicscs
StaatJ dort auf Grund ihres Wohnsitzes, ihres stlndigen Aufanthalts, des
Ortes ihrer Gcschf,fuleitung oder eines anderen Shnlichcn Merkmals
steuerpflichtig ist, und umfasst auch diesen Staat und seinc politischen
Unterabteilungen oder lokalen Kdrperschaften. Der Ausdruck umfasst
jedoch nicht eine Persoq die in diesem Staat nur mit Einkunften aus
Quellen in diesem Staat oder mit in diesem Staat gelcgenem Vermogen
steuerpflichtig isl
2. Ist nach Absatz 1 eine natilrliche Person in beiden Vertragsstaaten
ansessi& so gilt Folgendes:
a) Die Person gilt als nw in dem Staat ansessig, in dem sie 0ber eine
stendige wohnst{tte verfftgt; verfltgt sie in beiden Staaten uber eine
standige Wohnstatte, so gilt sie nur als in dem Staat ansdssig zu dem
sie die engcren persOnlichen und widschaftlichen Beziehungen hat
(Mittelpunkt der Lebensinteressen);
b) kurn nicht bestimmt werden, in welchem Staat die Person den
Mittelpunllt ihrer LebeNinteressen hat, oder verfftgt sie in keinem der
Staaten iiber eire st,indige Wohnstafte, so gilt sic nur als in dem Staat
ansdssig in dem sie ihren gewOhnlichen Aufenthalt hat;
c) hat die Person ibren gewtihnlichen Aufenthalt in beiden Staat€n oder
in keinem der Staaten, so gilt sie nur als in dem Staat ansdssig dessen
Staatsangehorigfi sie ist;
d) ist die Person Staatsangeh0riger beider Staaten oder keines der
StaaterL so regeln die zustdndigen Behbrden der Vertragsstaaten die
Frage in gegenseitigem Einvernehmen.
3. Ist nach Absatz 1 eine andere als eine natllrliche Person in beiden
Vertagsstaaten ansdssi& so gilt sie nur als in dem Staat ansdssi& in dem
sich der
ihrer tatsachlichen Gesch{ftsleitung befindet.

2. Der Ausdruck "Betiebstltte" umfasst insbesondere:

e) eine Wertsultte; und

3. Eine Bauausfflhrung oder Montage ist nur darur eine Beriebstatte, wenn
deren Dauer sechs Monate uberschreitet.
4. Ungeachtet der vorstehenden Bestimmungen dieses Artikels gelten nicht
als B€triebstAtten:
a) Eirichtungeq die ausschliesslich zur L€erung Ausstellung oder
Auslieferung von Gtltem oder Waren des Untemchmens benutzt
werdcn;
b) Bestende von Gotem oder War€n des Untemehmers, dic
ausschliesslich zur Lagerung, Ausstellung oder Auslieferung
unterhalten werden;
c) Bestllnde von Gitem oder Waren des Unternehmens, die
ausschliesslich zu dem Zweck unterhalten werden, durch ein anderes
Untemehmen beafteitet oder vcrarbeitet zu wcrdenl
d) eine feste Geschxftseinrichtung, die ausschliesslich zu dem Zweck
unterhalten wirq fflr das Untemehmen Goter oder Warensinzukaufen
oder Informrtionen zu beschaffen;
e) eine feste Gesch6ftseinrichtung, die ausschliesslich zu dem Zweck
untErhalten wir4 fllr das Unternehmen Werbung zu beteiberL
Informationen zu erteilerL wissenschaftliche Forschung zu betseiben

f) eine Montage, die von cinem Unternehmen eines Verhagsstaats im
Zusammenhang mit der Lieferung von durch dieses Untemehmen

g) eine fese Gesch6fueinrichtung, die ausschliesslich zu dem Zweck
unterhalten wird, mehrere der unter den Buchstaben a) bis 0

6. Ein Unternehmen wird nicht schon deshalb so behandelt, als habe es
eine Betriebstatte in einem Vertragsstaat, weil es dort seine Tltigkeit durch
einen Makler, Kommissioniir oder einen anderen unabhiingigen Vertreter
Rahmen ihrer ordentlichen

Betriebstiitte oder auf anderc Weise) ihre Tatigkeit ausubt, wird keine der
beiden Gesellschaften zur BetriebstAtte der anderen.
Art. 6 EinkOnfte aus unbeweglichem Verm0gen
I. Einktlnfte, die eine in einem Vertragsstaat ansessige Person aus
unbeweglichem Verm6gen (einschliesslich der Einkilnfte aus land- und
fontwirrschaftlichen Betrieben) bezieht, das im anderen Vertragsstaat
liegt, kOnncn im anderen Staat besteuert werdcn.
2. Der Ausdruck "unbewegliches Vermdgen" hat die Bedeutung, die ihm
nach dem Recht des Vertragsstaats zukommg in dem das Vermogen liegt.
Der Ausdruck umfasst in jedem Fall die Zugehdr zum unbeweglichen
Verm0gerl das lebende und tote Inventar land- und forstwirtschaftlicher
Betriebe, die Rechte, fllr die die Vorschriften des Privatrechls Uber
Grundstucke gelte& Nutzungsr€chtc an Unbeweglichem Vermdgen sowie
Rechte auf veranderliche oder feste Vergtltungen ftlr die Ausbeutung oder
das Recht auf Ausbeutung von Mineralvorkommen, Quellen und anderen
Bodensch6tzen; Schiffe und Luftfahrzeuge gelten nicht als unbewegliches
Vermdgen.

2. Ubt ein Unternehmen eines VerEagsstaats seine Tatigkeit im anderen
Vertagsstaat durch eine dort gelegene Betiebstltte aus, so werden
vorbchaltlich des Absatzes 3 injedem Vertsagsstaat dieser Betriebstatte die
Gewinne zugerechnet, die sie hatte erzielen kdnnen, wenn sie eine gleiche
oder {hnliche Tatigkeit unter gleichen oder dhnlichen Bedingungen als
selbstlndiges Unternehmen ausgcilbt hatt€ und im Verkehr mit dem
Untemehmer! dessen Betriebstdtte sie is! vdllig unabhangig gewesen
were.
3. Bei dcr Ermittlung der Gewhne einer Betriebstltte werden die fflr diese
Betriebstdite entstandenen Aufuendr:ngen, einschlicsslich der
Geschtrftsfflbrungs- und allgemeinen verwaltungskosten, zum Abzug
zugelassen, gleichgitltig, ob sic in dem StaaL in dcm die BetriebstAtte liegt
oder andenrvo entstanden sind.
4. Soweit es in eiaem Vertragsstaat ublich ist, die einer Betriebst{tte
zuzurechnenden Gewinne drnch Aufteilung der Gesamtgewinne des
Untemehmens auf seine einzelnen Teile zu ermitteln, schliesst Absatz 2
nicht aus, dass dieser Vertragsstaat die zu besteuemden Gewinne nach der
ilblichcn Aufteilung ermittelu die gcwlhltE Gewinnaufteilung muss jedoch
derart sei! dass das Ergebnis mit den Grundsatzen dieses Artikels
ubercinstimmt.
5. Auf Grund des blossen Einkaufs von GUtem oder Waren fflr das
Untemehmen wird einer Betriebstltte kein Gewinn zugerechnet.

Verbundene Untemehmen
l. Wenn
a) ein Untemehmen eines Vertragsstaats unmittelbar oder mittelbar an
der Geschiiftsleitung, der Kontrolle oder dem Kapital' eines
Untemchmcns dcs andcrcn Vcrtragsstaats beteiligt ist, odcr
b) dieselben Personen unmittelbar oder mittelbar an der
Gesch{ftsleitung, der Kontrolle oder dem Kapital eines Unternebmens
eines Vertragsstaats und eines Unternehmens des anderen
Vertragsstaats beteiligt sind
und in diesen Fiillen die beiden Untemehmen in ihren kauAn6nnischen
oder furanziellen Beziehungen an vereinbarte oder auferlegte Bedingungen
gebunden sind, die von denen abweicherg die unabhilngige Unternehmen
miteinander vereinbaren w0rden, so dtlrfen die Gewinne, die eines der
Untemehmen ohne diese Bedingungen erzielt hafie, wegen dieser
Bedingungen aber nicht erzielt hat, den Gewirmen dieses Unternehmens
zugerechn€t und entsprechend besteuert werden.
2. Werden Gewinne, mit denen ein Untemehmen eines Vertragsstaats in
diesem Staat besteuert worden is! auch den Gewinnen eines Untemebmens
des anderen Vertragsstaats zuger€chnet und entsprechend besteuert und
handelt es sich -dabei um,Gewinne,-die -das Unternehmen _des anderen
Verhagsstaats erzielt h6tte, wenn die zwischen den beiden Untemehmen

3. Ein Vertragsstaat soll die Gewinne eines Untemehmens in den in Absatz
I g€nannten FAllen nicht mehr berichtigeq wenn die in seinem intemen
Recht vorgesehenen Fristen abgelaufen sin4 und keinesfalls, wenn seit
dem Ende des Jahres, in dem ein Untemehmen dieses Staates die Gewinne,
die Gegerstand einer solchen Berichtigung wdreq erzielt h6tte, mehr als
fflnf Jahre verflossen sind. Dieser Absatz ist in Fdllen von Betrug oder
vorsiitzlicher Unterlassung nicht arzuwenden.

Einvemebmen, wie die Begrenzungsbestimmungen der Abs{tze 2 und 3

die Gewinne, aus denen die Dividenden gezal t werden.
4. Der in diesem Artikel venvendete Ausdruck "Dividenden" bedeutet

6. Bezieht eine in einem Vertragsstaat anslssige Gesellschaft Gewinne
oder Einktlnfte aus dem anderen Vertragsstaaq so darf dieser and€re Staat
weder die von der Gesellschaft gezahlten Dividenden besteuerrl es sei
deIug dass diese Dividenden an eine im andercn Staat ansassige Person
gezahlt werden oder dass die Beteiligung, lilr die die Dividenden gezal t
werden, taMchlich zu einer im anderen Staat gelegenen Betriebstiitte oder
festen Eiffichtung gehdrt, noch Gewinne der Gesellschaft einer Steuer ftir
nicht ausgeschtlttete Gewinne unterwerfen, selbst wenn die gezahlten
Dividenden oder die nicht ausgeschUtteten Gewinne ganz oder teilweise
aus im anderen Staat erzielten Gewfurnen oder EinkUnften bestehen.
Art ll Zinsen
l Zinseq die aus einem Vertagsstaat stammen und deren
Nutzungsberechtigler eine im anderen Vertragsstaat ansAssige person ist,
kdrmen nur im anderen Staat besteuert werden.
2. Der
in diesem Artikel verwendete Ausdruck "Zinse ', bedeutet
Einktlnfte aus Fordenngen jeder Arg auch wenn die Forderungen durch
Pfandrcchte an Grundstilcken gesichert oder mit einer Beteiligung am
Gewirm des Schuldners ausgestattet sind, und insbesondere Eink[nfte aus
Offentlichen Anleihen und aus Obligationen, einschliesslich der damit
verbundenen Aufgelder und der Gewinne aus Losanleihen. ZuschlAge fflr
verspatcte Zal ung geltcn nicht als Zinscn im Sirure dieses Artikels.
3. Absatz
ist nicht anzuwenden, wenn der in einem Vcrtragsstaat
ansdssige Nutzungsberechtigte im anderen Verfagsstaat, aus dem die

5. Bestehen zwischen dem Schuldner und dem Nutzungsberechtigen oder
zwischen jedem von ihnen und eincrn Dritten besondsr€ Beziehungen und
0bersteigen deshalb die Zinsen, gemessen an der zugrundeliegenden
Fordenmg, den Betrag, den Schuldner und Nutzungsberechtigter ohnc
diese Beziehungen vereinbart hatten, so wird dieser Artikel nur auf den
letztcren Betrag angewcndet. In diesem Fall karm der ubersteigende BeEag
nach dem Recht eines jeden Vertragsstaats und unt€r BerUcksichti$mg dcr
anderen Bestimmungen dieses Abkommens best€uErt werden.
Art 12 Lizenzgebilhren
l. Lizenzgebuhren, die aus einem Vertragsstaat stammen und deren
Nutzungsberechtigter eine im andcren vertragsstaat ansassige Person ist
konnen nur in diesem anderen Staat b€steuert wsrden.
2. Der in diesern Artikel verwendetc Ausdruck "Lizenzgebtlhren" bcdeutet
Vergutungen jeder tut, die fflr die Benutzung oder fflr das Recht auf
Benutzung von Llrheberrechten an literarischen, ktnstlerischen oder
wissenschaftlichen Werken, einschliesslich kinematographischer Filrne,
von Patenten, MarkerL Mustem oder Modellen, Planen, geheimen Formeln
oder Verfahrcn oder fllr die Mitteilurg gewerblicher, kaufmannischer oder
wissenschaft licher Erfahrungen gezahlt werden.
3. Absatz
I ist nicht anzuwenden, wenn der in einem Vertragsstaat
ans[ssig€ NuEungsberechtigte im anderen Vutragsstaat, aus dem die
Lizenzgebllhren stammen, eine gewerbliche Tatigkeit durch eine dort
gelegene Betriebst[tte oder eine selbsgndige Arbeit dwch eine dort
gelegene feste Eiffichtung austlbt und die Rechte oder Vermdgenswerte,
frr die die Lizcnzgebilken gezatrlt werden, tatsdchlich zu dieser

Art 14 Selbstfmdige Arbeit
l. Einktlnfte, die eine in einem verbagsstaat ansassige PErson aus einem

2. Der Ausdruck "freier Benrf' umfasst insbesondere die selbstlndig
ausge0bte wissenschaftliche, literarische, kilnstlerische, erzieherische oder

l. Vorbehaltlich der Artikel 16, 18 und 19 kdnnen Gehdltcr, Ldhne und

aus unselbstAndiger Arbeit bezieht, nur in diesem Staat besteu€rt werd€n,
es sei denr! die Arbeit wird im anderen Vertragsstaat ausge0bt. Wird die
&beit dort ausgeubt, so kdnnen die dafltr bezogen€n vergutungen im
anderen Staat b€stsu€rt werden.

2. Ungeachtet des Absatzes konnen Vergutungen, die eine in einem
Vertragsstaat ansassigc Person fflr eine im andercn Vertragsstaat ausgeilbte
unselbstdndige Abeit bezieh! nur im erstgenannte-n Staat besteuert
werderq wenn
a) der Empfdnger sich im anderen Staat insgesamt nicht langer als 1E3
Tage wdhrend des betreffenden Kalenderjahres auft t, und
b) die Vergiitungen von einem A$eitgeber oder fllr einen fubeitgeber
gezahft werderq der nicht im anderen Staat ansdssig ist, und
c) die Vergutungen nicht von einer Betriebstltte oder einer festen
Eiffichtung getragen werden, die der Arbeitgeber im andercn Staat
hat.
3. Ungeachtet der vorstehenden Bestimmungen dieses Artikels konnen
Vergutungen ffk unselbstandige Arbeit, die an Bord eines Seeschiffes oder
Luftfahrzeugcs ausgeubt wir4 das im intemationalen Verkehr betieben
wird, in dem Vertragsstaat besteuert werden, in dem sich der Ort der
tats6chl ichen Geschdftsleihmg des Unternehmens befindet.
ArL 16 Aufsichtsrats- und Verwaltungsratsvergutungen
Aufsichtsrats- oder verwaltungsratsvergutungen und ahnliche Zahlungen,
die eine in einem Vertragsstaat ansdssige Person in ihrer Eigerschaft als
Mitglied des Aufsichts- oder Verwaltungsrats einer Gesellschaft beziehl
die im anderen Vertragsstaat ansassig ist, _k6 t9n im anderen Staat
besteuert werden.

ArL 17 Kttnstler und SPortler
1. Ungeachtet der Artiket 14 und
li kiinnen Einkunfte, die eine in einem
Vertra-gsstaat ansdssigc Person als Ktlnstler, wie Bilhnen-, Film-,
Rundflink- und Femsehktlrstler sowie Musiker, oder als Sportler aus ilrer
im andercn Vertragsstaat personlich ausgeilbten T6tigkeit bezieh! im
anderen Staat besteuert werden.
2. Fliessen Einktinfte aus einer von einem Kiinstler oder Sportler in dieser
Eigenschaft personlich ausgeilbten Tdtigkeit nicht dem Kllnstler oder
Sp-ortler selblt, sondem einer drderon Penon zu, so kdnnen diese
Einkttnfte ungeachtet der Artikel 7, 14 und 15 in dem Vertragsstaat
besteuert werdeq in dem der Kiinstter oder Sportler seine Tetigkeit ausubt'
Dieser Absatz ist nicht anzuwendeq wenn dargetan wird dass weder der
Kunstler oder Sportler noch mit ihm verbundene Personen unmittelbar an
den Gewinnen dieser anderen Person beteiligt sind.
Art lE Ruhcg€halter
Vorbehaltlich des Artikels 19 Absatz 2 konnen Ruhegeh5lter und dhnliche
\/erg0tungen, die einer in einem Vertragsstaat ansiissigen Person ftir
frilhere urselbstnndige Arbeit gezrhlt werden, nur in diesem Staat
besteusrt werden.
Art 19 dffentlicher Dienst
l. a)
Geh6[ter, Ldhne und Hhnliche Vergutungeq arrigenommen
Ruhegehlilter, die von einem Vertragsstaat oder einer seiner

K6rperschaften erbracht werderq sind die Artikel 15, 16, 17 und 18
anzuwenden.
Art.20 Studentcn
Zahhmgen, die ein Student oder Lehrling der sich in 6inem Vertragsstaat
ausschliesslich zum Studium oder zur Ausbildung aufiidlt und der im
anderen Vertragsstaat ansessig ist oder dort unmittelbar vor der Einreise in
den erstgenannten Staat ansassig war, ffir seinen Unterhalt, sein Studium
oder scinc Ausbildung erhiill dtHen im erstgenannten Staat nicht bcsteuert
werdeq sofem diese Zahlungen aus Quellen ausserhalb dieses Staates
stanunen.
ArL 2l Andere Einkllnfte
l. Eink0nfte einer in einem VerEagsstaat ans{ssigen Person, die in den
vorstehenden Artikeln nicht behandelt wurden, kdnnen ohne Rucksicht auf
ihre Herkunft nur in diesem Staat besteuert werden.
2. Absalz
I ist auf andere Einkunfte als solche aus unbeweglichem
Venndgen im Sinne des Artikels 6 AbsaE 2 nicht anzuwenden, wenn der
in einem Vertragsstaat ansassige Empfltnger im anderen Vertragsstaat eine

l. Unbewegliches Vermdgen im Sinne des Artikels 6, das einer in einem

ArL 23 Vermeidung der Doppelbesteuenrng
l. Im Falle Georgiens wird die Doppelbesteuenrng wie folgt vermieden:
a) Bezieht eine in Georgien ansAssige Person Einktlnfte oder hat sie
Vermdgen und ktinnen diese Einkilnfte oder dieses Vermdgen nach
diesern Abkommen in der Schweiz besteuert werderl so rechnet
Georgien:
(i) auf die vom Einkommen dieser Person zu erhebende Steuer den
Beaag aq der der in der Schweiz gezah.lten Steuer entspricht;
aufdie vom Vermtigen dieser Person zu erhebende Steuer den
Betrag an, der der in der Schweiz gezahlten Verm6genssteuer
entspricht.
(ii)
Der anzurechnende Betrag darfjedoch in beiden Fallen den Teil der
vor der Arechnung ermittelten Steuer vom Einkommen oder vom
Vermdgen nicht Ubersteige4 der auf die Eink0nfte,-.die in der

diesem Abkommcn in Georgien besteuert werde& so nirnmt die

Festsetzung der Steuer flir das iibrige Einkommen oder das iibrige

b) Bezieht eine in der Schweiz ansassige Person Dividenden, die nach

Schweiz dieser anslssigen Person auf Antrag eine Entlastung. Die
Entlastung besteht:
(i) in der Anrcchnung der nach dem Artikel 10 in Georgien erhobenen
Steu€r auf die vom Einkommen dieser ansrssigen Person
geschulderc schweizerische Steuer; der anzurechnende Betrag darf
jedoch den

ArL24 Gleichbehandlung

Artikels I auch fllr Personen, die in keinern Vertragsstaat ansessig sind.
2. Die Besteuerung einer Betriebstdtte, die ein Untemehmen eines
Vertragsst ats im anderen Vertragsstaat hat, darf im anderen Staat nicht
ungfnstiger sein als die Besteuerung von Unternehmen des anderen
Staates, die die gleiche Tdtigk€it ausuben. Diese Bestimmung ist nicht so
auszulege4 als verpflichte sie einen Vertragsstaat, den im anderen
und die

3. Sofem nicht Artikel 9, tutikel l1 Absatz 5 oder Artikel 12 Absatz 4
anzuwenden ist sind Zinseq Lizenzgebithren und andere Entgelte, die ein
Untemehmen eines Vertragsstaats an eine im anderen Vertragsstaat
ansdssige Person zahlt, bei der Ermittlung der steuerpflichtigen Gewinne
dieses Untemehmens unter den gleichen Bedingungen wie Zahlungen an
eine im erstgenannten Staat ansdssige Person zum Abzug zuzulassen.
Dementsprechend sind Schulden, die ein Untemehmen eines Vertragsstaats
gegentlber einer im anderen Vertragsstaat ansalssigen Person hat, bei der
Ermittlung des steuerpflichtigen Vsrrndgens dieses Unternehmens untsr
den gleichen Bedingungen wie Schulden gegeniiber einer im erctgenannten
Staat ansessigen Person zum Abzug zuzulassen.
4. Untemehmen eines Vertragsstaats, deren Kapital ganz oder teilweise
unmittelbar oder mittelbar einer im anderen Vertragsstaat ansdssigen
Person oder mehreren solchen Personen gehdrt oder ihrer Kontrolle
unte iegt, dlirfen im erstgenannten Staat keiner Besteuerung oder damit
zusammcnhdngenden Verpflichtung unterworfen werden, die anders oder
belastender ist als die Besteuenmg und die damit zusammenhdngenden
Verpflichhmgen, denen andere dhnliche Unternehmen des erstgenannten
- . Staates unterworfen sind oder unterworfen werden kdnnen. .
5. Dieser Artikel gilt ugeachtet des Artikels 2 fiir Steuem jeder Art und
Bezeichnung.
Art.25 Verstdndigungsverfahren
l. Ist eine Person der Auffassung, dass Massnahmen eines Vertagsstaats
- - oder beider Vertragsstaaten fflr sie zu einer Besteuerung fllhren oder fflhren

werden, die diesem Abkommen nicht ensprichl so kann sie urb€schadet
der nach dem imerstaatlichen- -[echt dieser Staaten vorgesehenen
Rechtsmittel ifuen Fall der zustllndigen Behorde des vertragsstaats, in dem
sie ansdssig ist, oder, sofem ihr Fall von Artikel 24 Absatz I erfasst wir4
der zustf,ndigen Behdrde des Vertmgsstaats unterbreiten, dessen
Staatsangehoriger sie ist. Der Fall muss innertralb von drci Jahrcn nach der
ersten Mitteilung der Massnahme unterbreitet werden, die zu einer dem
Abkommen nicht entsprechenden Besteuerung fflhrt.
2. Iliilt die zustiindige Behdrde die Einwendung fiir begrtlndet und ist sie
setbst nicht in der Lage, eine beAiedigende Ldsung herbeizufllhreq so
wird sie sich bemllhen, d€n Fall durch Venundigung mit der zustAndigen
Behorde des anderen VerFagsstaats so zu regeln, dass eine dem
Abkommen nicht entsprechende Besteuenmg vermieden wird.
3. Die zustEndigen Behdrden der vertragsstaaten werden sich bemllhen,
Schwierigkeiten od er Zweife[ die bei der Auslegung oder Anwendung des
Abkommens entstehcn, in gegenseitigem Einvernehmen zu beseitigen. Sie
kdnnen auch gemeirsam dadber beraten, wie eine Doppelbesteuerung in
Fallen vermieden werden kann, die im Abkommen nicht behandelt sind'

Die zustdndigen Behdrden der Vsrtragsstaaten kdnnen zur
Herbeifllhrung einer Einigung im Sinne der vorstehenden Atratze
unmittelbar miteinander verkehren. Erscheint ein milndlicher
Mcinungsaustausch frir dic Ilerbciltihrung der Einigung zwcckmdssig, so
kann ein solcher Meinmgsaustausch in einer Kommission durchgeffihrt
werden, die aus Vertretem der z.:st{ndigen Behdrden der Vertragsstaaten
besteht.

2. Die Bestimmungen dieses Artikels dtlrfen auf keinen Fall dahin
ausgelegt werderl dass sie einem der Vertrsgsstaaten dje V-erpflichtung
aufirlegin, Verwaltungsmassnahmen durchzuftlhren,-die von den
Vorschriften oder der Verwalhrngspraxis dieses oder des anderen
Vertragsstaats abweicheq oder die seiner Souveranitlt' Sicherteit oder
dem Ordre public widersprechen, oder Angaben zu vermitteln, die nicht
aufgnmd seiner eigenen oder aufgnmd der Gesetzgcbung des ersuchenden
Staates beschaft werden kdnnen.
Art 27 Mitglieder diplomatischer Misiionen und konsilarischer -vertsetungen
Dieses Abkommen beriihrt nicht die steuerlichen Vorrechte, die den
Mitgliedem diplomatischer Missionen und konsularischer Vertretungen
nach den allgemeinen Regeln des Vdlken€chts oder auf Gnrnd besonderer
Vereinbarungen zuslehen.
Arr 2t Inkrafttreten
l. Jeder Vertragsstaat notifiziert dem andern Verhagsstaat auf dem
diplomatischen Weg, dass die innerstaatlichen gesetzlichen Erfordernissc
fflr das Inkrafttreten dieses Abkommens erfullt sind. Das Abkommen tritt
in Kraft, wenn die letzte dieser beiden Notifikationen ihrem Adressat€n
zugegangen ist.
2. Die Bestimmungen des Abkommens finden Anwendung:
a) hinsichtlich der an der Quelle erhobenen Steuer auf Betr6ge, die am
oder nach dem l. Januar des auf das Inkrafttreten des Abkommens
folgenden Jalres gezahlt oder gutgeschrieben werden;
b) hinsichtlich der llbrigen Steuem auf Steuerjahrc, die am oder nach
dem l. Januar des auf das hkrafttreten des Abkommens folgenden

ArL 29 - Kondigung
-Dieses -dbkommen -bleibt - in - Ika&-solange -es-nicht-von -ernem
Verhagsstaat gektlndigt wird. Jeder Vertragsstaat karm das Abkommen auf
diplomatischem Weg unter Einhahmg einer Frist von mindestens sechs
Monaten zum Ende eines Kalenderjalres kiindigen. In diesem Fall findet

Geschehen zu Bern am 15. Juni 2010 im Doppel in georgischer, deuscher
und englischcr Sprache, wobci jeder Wortlaut gleicherweise verbindlich
ist. Bai unterschiedlicher Auslegung soll der englische Wortlaut
massgebend sein.

1. For the purposes of this Agreement, thc tcam "resident of a Contracting State'

2. Wtlerc by reason of thc provisions of paragraph 1 ar individual is a !€sidcnt of

simila, naturc, and also includes that State and any political subdivision or local
authority thcrEof. This term, howevcr, does not includc arly pcrson who is liablc to

7. The fact that a company which is a rcsident of a Contracting State controls or is
coakollcd by a coloparly which i8 a reoident of the othar Contracting State, or
which ca-rrics on busincss in that other Statc (whcther through a permarrcnt
establishment or otherwise), shall not of itself constitute either company a
perEanent estsblishment oI the othcr.
Articlc 6
Income froe iEmovable piopcrty
1, Income derivcd by E resident of a Contracting State frota io.moeable property

State may be taxed in that other State.
2. Thc tcrtn 'im&ovable propcrtjf shall havc t}rc Ecaniltg which it has undcr tltc

shall in any casc include prop€rty accessory to iamovable property, livestock and
equipnent used in agriculture and foreetry, rights to which the provisions of
general law respecting landed property apply, usufruct of immovable ploperty and
righas to variablc or fixed paj.roents as consideration for the working of, or thc right
to work, Drineral deposits, soutres and other natural resources; ships and aircta.ft

3. The provisions of parag?ph 1 shall apply to incoae derived ftoa the dircct use,
letting, or use in any other form of itueovable propeity.
4. The provisions of paEgraphs I and 3 shall also apply to the incoae froE

2. If the place of ellective managelnent of a shipping enterprise is aboard a ship,
then it shall be deeEed to be situated itr the Contracting Stetc in q,hich thc hoEe
ha.bou! of thc ship is situatcd, or, if thcre is no such hoac ha.rboui, in thc
Contacting State of which the opcrator of the ship is a residcnt.
3. Thc provisions of pa-ragraph I shall also apply to profits from thc participation
in a pool, a joint bufiess or an irltemational operating agency.

Article 28
Entry into force
1. Each Conkactint State shall notify to the other, th!'ough diploaatic channels,
thc complction of the procedures required by its law for the bringing into force of
this AgrreEelrt. The Agreement shall enter into forcc on the date on which tlle later
of thosc notifications has been lecaivcd.
2. lhe provisions of the Agreeoent sha.ll have effect:
a) in rcspcct of tax E'ithhcld at source on arlounts paid or credited on or slter the
first day of Jatruary of the year next following the yea.r of the entiy into force of
thc Agrceoent;
b) in rcspect of other taxes for taxetion years beginning on or efter the lirst
day of January of t}le yesr next following the year of tlte entry into force
of the AgreeEent.
