"ნარკოტიკული საშუალებების, ფსიქოტროპული ნივთიერებების, პრეკურსორებისა და ნარკოლოგიური დახმარების შესახებ” საქართველოს კანონის 26-ე მუხლის მე-11 პუნქტისა და 29-ე მუხლის საფუძველზე, ვ ბ რ ძ ა ნ ე ბ:

1. დამტკიცდეს:
ა) ნარკოტიკული საშუალებების, ფსიქოტროპული ნივთიერებებისა და პრეკურსორების იმპორტისა და ექსპორტის წესი (დანართი №1);
ბ) განცხადება-დეკლარაციის ტიპური ბლანკის ფორმა ნარკოტიკული საშუალებების, ფსიქოტროპული ნივთიერებებისა და პრეკურსორების საიმპორტო ოპერაციის განხორციელებისათვის (დანართი №2);
გ) განცხადება-დეკლარაციის ტიპიური ბლანკის ფორმა ნარკოტიკული საშუალებების, ფსიქოტროპული ნივთიერებებისა და პრეკურსორების საექსპორტო ოპერაციის განხორციელებისათვის (დანართი №3);
დ) წინასწარი ნებართვის მოწმობის ფორმა ნარკოტიკული საშუალებების იმპორტზე (დანართი №4);
ე) წინასწარი ნებართვის მოწმობის ფორმა ფსიქოტროპული ნივთიერებების იმპორტზე (დანართი №5);
ვ) წინასწარი ნებართვის მოწმობის ფორმა „ნარკოტიკული საშუალებებისა და ფსიქოტროპული ნივთიერებების უკანონო ბრუნვის წინააღმდეგ ბრძოლის შესახებ” 1988 წლის კონვენციით გათვალისწინებული პრეკურსორების იმპორტზე (დანართი №6);
ზ) წინასწარი ნებართვის მოწმობის ფორმა ნარკოტიკული საშუალებების ექსპორტზე (დანართი №7);
თ) წინასწარი ნებართვის მოწმობის ფორმა ფსიქოტროპული ნივთიერებების ექსპორტზე (დანართი №8);
ი) წინასწარი ნებართვის მოწმობის ფორმა „ნარკოტიკული საშუალებებისა და ფსიქოტროპული ნივთიერებების უკანონო ბრუნვის წინააღმდეგ ბრძოლის შესახებ” 1988 წლის კონვენციით გათვალისწინებული პრეკურსორების ექსპორტზე (დანართი №9).

2. ამ ბრძანების ამოქმედებიდან ძალადარკულად ჩაითვალოს საქართველოს ჯანმრთელობისა და სოციალური დაცვის მინისტრის 2000 წლის 16 თებერვლის ბრძანება №19/ო „სპეციალურ კონტროლს დაქვემდებარებული ნარკოტიკული საშუალებების, ფსიქოტროპული ნივთიერებებისა და პრეკურსორების საქართველოს ტერიტორიაზე შემოტანის და საქართველოს ტერიტორიიდან გატანის წესის დამტკიცების შესახებ“ („საქართველოს საკანონმდებლო მაცნე“ №17, 2000 წლის 1 მარტი).
3. ბრძანება ძალაში შევიდეს გამოქვეყნებიდან 15 დღეში.

დანართი №1
ნარკოტიკული საშუალებების, ფსიქოტროპული ნივთიერებებისა და
პრეკურსორების იმპორტისა და ექსპორტის წესი
1. ეს წესი ვრცელდება შესაბამისი ლიცენზიის მქონე, ნარკოტიკული საშუალებების, ფსიქოტროპული ნივთიერებებისა და პრეკურსორების (შემდგომში – სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებები) იმპორტით და ექსპორტით დასაქმებულ იურიდიულ პირზე, განურჩევლად უწყებრივი დაქვემდებარებისა და სამართლებრივ-ორგანიზაციული ფორმისა.
2. სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების იმპორტი და ექსპორტი ხორციელდება მხოლოდ შესაბამის საქმიანობაზე სათანადო ლიცენზიის მქონე იურიდიული პირების მიერ, „ნარკოტიკული საშუალებების, ფსიქოტროპული ნივთიერებების, პრეკურსორებისა და ნარკოლოგიური დახმარების შესახებ“ საქართველოს კანონის (შემდგომში – კანონი) შესაბამისად.
3. ნარკოტიკული საშუალებებისა და ფსიქოტროპული ნივთიერებების იმპორტი ნებადართულია სამედიცინო, ფარმაცევტული, სასწავლო, სამეცნიერო-კვლევითი, საექსპერტო-დიაგნოსტიკური, ანალიზურ-ლაბორატორიული და ვეტერინარული საჭიროების მიზნით, შრომის, ჯანმრთელობისა და სოციალური დაცვის სამინისტროს მიერ გაცემული ლიცენზიის საფუძველზე და გაეროს ნარკოტიკებზე კონტროლის საერთაშორისო კომიტეტის მიერ დამტკიცებული სახელმწიფო კვოტების ფარგლებში.
4. კანონის II სიაში მითითებული ნარკოტიკული საშუალებების იმპორტისა და მიღების უფლება აქვს სასწავლო, სამეცნიერო-კვლევით და საექსპერტო-დიაგნოსტიკურ დაწესებულებებს სასწავლო, სამეცნიერო-კვლევითი და საექსპერტო-დიაგნოსტიკური საქმიანობის განხორციელების მიზნით. აღნიშნული ნარკოტიკული საშუალებების შემოსატანად კვოტის განსაზღვრა არ არის სავალდებულო.
5. ნარკოტიკული საშუალებების იმპორტი ხორციელდება საქართველოს შრომის, ჯანმრთელობისა და სოციალური დაცვის სამინისტროს დაკვეთით.
6. ფარმაცევტული საქმიანობით დაკავებული ნებისმიერი იმპორტიორი და ექსპორტიორი ორგანიზაცია ყოველი საიმპორტო (საექსპორტო) ოპერაციის დაწყებამდე ვალდებულია საქართველოს კანონმდებლობით დადგენილი ფორმით წარუდგინოს შრომის, ჯანმრთელობისა და სოციალური დაცვის სამინისტროს ნარკოტიკების ლეგალური ბრუნვის კონტროლის ბიუროს (შემდგომში – ბიურო) საიმპორტო (საექსპორტო) სამკურნალო საშუალებების ჩამონათვალი მათი სავაჭრო და გენერიკული დასახელების, წამლის ფორმის, დოზის ერთეულისა და რაოდენობის ჩვენებით. თუ ჩამონათვალი შეიცავს კომბინირებულ პრეპარატს ან სხვა უცნობი დასახელების მედიკამენტს, მაშინ ბიუროს უფლება აქვს დამატებით მოითხოვოს ამ სამკურნალო საშუალებების სარეგისტრაციო მოწმობა.

7. აღნიშნული ჩამონათვალი ბიუროში მოწმდება საიმპორტო (საექსპორტო) დოკუმენტაციაში კონტროლირებადი ნივთიერების არსებობის დადგენის მიზნით.

8. იმ შემთხვევაში, როდესაც ჩამონათვალი არ შეიცავს სპეციალურ კონტროლს დაქვემდებარებულ ნივთიერებებს დოკუმენტის ყველა პირს, რომელშიც მითითებულია საიმპორტო ან საექსპორტო სამკურნალო საშუალებების ჩამონათვალი, ესმება შტამპი, შესაბამისად, „წინასწარ ნებართვას იმპორტზე არ საჭიროებს” ან “წინასწარ ნებართვას ექსპორტზე არ საჭიროებს” და მოწმდება ბიუროს პასუხისმგებელი პირის ხელმოწერით.

9. თუ ჩამონათვალი შეიცავს სპეციალურ კონტროლს დაქვემდებარებულ ნივთიერებას, მაშინ წინასწარი ნებართვის მოწმობის მისაღებად ბიუროს საიმპორტო (საექსპორტო) სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების ჩამონათვალი წარედგინება ცალკე. ჩამონათვალს უნდა ახლდეს შემდეგი დოკუმენტაცია:
ა) შესაბამისი განცხადებადეკლარაცია, რომელიც ივსება №2 ან/და №3 დანართებით გათვალისწინებული ფორმის შესაბამისად;
ბ) იმპორტიორ და ექსპორტიორ ორგანიზაციებს შორის დადებული ხელშეკრულების ასლი. ხელშეკრულებას თან უნდა ახლდეს ინვოისი საიმპორტო (საექსპორტო) ნივთიერების ან პრეპარატის შესახებ;
გ) ფარმაცევტული საწარმოს მიერ გაცემული საბუთი, სადაც მოცემული იქნება საექსპორტო პრეპარატში ნარკოტიკული საშუალების, ფსიქოტროპული ნივთიერების ან/და პრეკურსორის შემცველობის (სუფთა მოქმედი ნივთიერების) გადასაანგარიშებელი კოეფიციენტი (მხოლოდ ადგილობრივი წარმოების პროდუქციის ექსპორტის განხორციელებისას).

10. საექსპორტო ოპერაციების განხორციელების დროს, გარდა წინამდებარე დებულების მე-9 პუნქტში მითითებული დოკუმენტაციისა, ბიუროს წარედგინება იმპორტიორი ქვეყნის უფლებამოსილი ორგანოს მიერ გაცემული წინასწარი საიმპორტო ნებართვა (დედანი) კონკრეტული საექსპორტო სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების რაობისა და რაოდენობის მითითებით.

11. წინასწარი ნებართვის მოწმობა გაიცემა მხოლოდ ერთჯერადად შემოსატან (გასატან) რაოდენობაზე.

12. ხელშეკრულების ძირითადი პირობების შეცვლისას წინასწარი ნებართვის მოწმობა ფორმდება ხელახლა.

13. წარმოდგენილი დოკუმენტაციის სისწორეზე პასუხისმგებლობა ეკისრება წინასწარი ნებართვის მოწმობის მაძიებელ იმპორტიორ (ექსპორტიორ) ორგანიზაციას.

14. იმ შემთხვევაში, თუ საქართველოს საბაჟო საზღვარზე შემოტანილი სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების ფაქტობრივი რაოდენობა აღემატება ბიუროს მიერ გაცემულ საიმპორტო ნებართვის მოწმობაში მითითებულ რაოდენობას, საბაჟო ორგანო აცნობებს შრომის, ჯანმრთელობისა და სოციალური დაცვის სამინისტროს (შემდგომში – სამინისტრო) ფაქტობრივად შემოტანილი სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების რაოდენობის შესახებ და მოქმედებს საქართველოს კანონმდებლობით დადგენილი წესის შესაბამისად.

15. იმ შემთხვევაში, თუ საქართველოს საბაჟო საზღვარზე შემოტანილ სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების ფაქტობრივი რაოდენობა ნაკლებია ბიუროს მიერ გაცემულ საიმპორტო ნებართვის მოწმობაში მითითებულ რაოდენობაზე, საბაჟო ორგანო აცნობებს სამინისტროს შემოტანილი რაოდენობის შესახებ და ატარებს საქონელს, ხოლო სამინისტროს შესაბამისი მაკონტროლებელი ორგანო შეისწავლის მიზეზებს და მოქმედებს საქართველოს კანონმდებლობით დადგენილი წესის შესაბამისად.

16. იმ შემთხვევაში, თუ ექსპორტის განხორციელებისას საბაჟო ორგანოს მიერ აღმოჩენილ იქნა სხვაობა სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების ფაქტობრივ რაოდენობასა და წინასწარ ნებართვის მოწმობაში მითითებულ რაოდენობას შორის მეტობის ან ნაკლებობის მხარეს, საბაჟო ორგანო აცნობებს ბიუროს საექსპორტო საქონლის ფაქტობრივი რაოდენობის შესახებ, აკავებს საქონელს, რის შემდგომ სამინისტროს შესაბამისი სამსახური და საბაჟო ორგანოები თავიანთი კომპეტენციის ფარგლებში სწავლობენ მიზეზებს და მოქმედებენ საქართველოს კანონმდებლობით დადგენილი წესის შესაბამისად.

17. სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების იმპორტის და ექსპორტის დროს გაიცემა შემდეგი სახის წინასწარი ნებართვის მოწმობები:
ა) წინასწარი ნებართვის მოწმობა ნარკოტიკული საშუალებების იმპორტზე (ყვითელი ბლანკი);
ბ) წინასწარი ნებართვის მოწმობა ნარკოტიკული საშუალებების ექსპორტზე (ყვითელი ბლანკი);
გ) წინასწარი ნებართვის მოწმობა ფსიქოტროპული ნივთიერებების იმპორტზე (მწვანე ბლანკი);
დ) წინასწარი ნებართვის მოწმობა ფსიქოტროპული ნივთიერებების ექსპორტზე (მწვანე ბლანკი) – (დანართი №8);
ე) წინასწარი ნებართვის მოწმობა „ნარკოტიკული საშუალებებისა და ფსიქოტროპული ნივთიერებების უკანონო ბრუნვის წინააღმდეგ ბრძოლის შესახებ” 1988 წლის კონვენციით გათვალისწინებული პრეკურსორების იმპორტზე (ვარდისფერი ბლანკი);
ვ) წინასწარი ნებართვის მოწმობა „ნარკოტიკული საშუალებებისა და ფსიქოტროპული ნივთიერებების უკანონო ბრუნვის წინააღმდეგ ბრძოლის შესახებ” 1988 წლის კონვენციით გათვალისწინებული პრეკურსორების ექსპორტზე (ვარდისფერი ბლანკი).

18. წინასწარი ნებართვის მოწმობის დაკარგვის შემთხვევაში გაიცემა დუბლიკატი, რომელსაც ისეთივე იურიდიული ძალა აქვს, როგორც დედანს.

19. სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების საიმპორტო ოპერაციის დაწყებამდე, საიმპორტო ჩამონათვალის ყველა პირს ესმევა შტამპი „საჭიროებს წინასწარ ნებართვის მოწმობას იმპორტზე” და მოწმდება ბიუროს პასუხისმგებელი პირის ხელმოწერით. წინასწარი ნებართვის მოწმობა გაიცემა 6 ეგზემპლარად (ექვსივე ეგზემპლარი წარმოადგენს დედანს); აქედან ერთი რჩება ბიუროში, ერთი – იმპორტიორ ორგანიზაციაში და ინახება 5 წლის განმავლობაში, ხოლო დანარჩენი ეგზემპლარები ეგზავნება შემდეგ ორგანიზაციებს:
ა) ექსპორტიორი ქვეყნის მთავრობას ან კომპეტენტურ ორგანოს;
ბ) შრომის, ჯანმრთელობისა და სოციალური დაცვის სამინისტროს წამლის სააგენტოს;
გ) საქართველოს ფინანსთა სამინისტროს საბაჟო დეპარტამენტის შესაბამის სამსახურს 2 ეგზემპლარი.

20. საიმპორტო ოპერაციის განხორციელებისთანავე საბაჟო ორგანოს მიერ ივსება წინასწარი ნებართვის მოწმობის მეორე გვერდზე გამოყოფილი სპეციალური გრაფა ფაქტობრივად იმპორტირებული საქონლის ძირითადი მახასიათებლების (სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების რაობა, რაოდენობა და სხვა), სატვირთო-საბაჟო დეკლარაციის ნომრისა და საბაჟო გაფორმების თარიღის მითითებით. ამ დოკუმენტის ერთი ეგზემპლარი რჩება საბაჟოზე, ხოლო მეორე ეგზემპლარი იმპორტიორი ორგანიზაციის მეშვეობით 5 დღის განმავლობაში უბრუნდება ბიუროს.

21. სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების იმპორტის შემდეგ ბიურო ექსპორტიორი ქვეყნის კომპეტენტურ ორგანოს საერთაშორისო ნორმებით გათვალისწინებული წესით აწვდის ინფორმაციას ფაქტობრივად იმპორტირებული ნივთიერებების რაოდენობის შესახებ.

22. სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების ექსპორტის შემდეგ ბიურო იმპორტიორი ქვეყნის კომპეტენტური ორგანოდან საერთაშორისო ნორმებით გათვალისწინებული წესით მოითხოვს ინფორმაციას ექსპორტირებული ნივთიერებების რაოდენობის დანიშნულების ადგილამდე მიტანის შესახებ.

23. ექსპორტის შემთხვევაში ბიუროს მიერ საექსპორტო ჩამონათვალის ყველა ეგზემპლარს ესმება შტამპი „საჭიროებს წინასწარ ნებართვას ექსპორტზე” და მოწმდება ბიუროს პასუხისმგებელი პირის ხელმოწერით. წინასწარი ნებართვის მოწმობა გაიცემა 6 ეგზემპლარად (ექვსივე ეგზემპლარი წარმოადგენს დედანს); აქედან, ერთი რჩება ბიუროში, ერთი – ექსპორტიორ ორგანიზაციაში და ინახება 5 წლის განმავლობაში, ხოლი დანარჩენი ეგზემპლარები ეგზავნებათ შემდეგ ორგანიზაციებს:
ა) შრომის, ჯანმრთელობისა და სოციალური დაცვის სამინისტროს წამლის სააგენტოს;
ბ) საქართველოს ფინანსთა სამინისტროს საბაჟო დეპარტამენტის შესაბამის სამსახურს – 2 ეგზემპლარი;
გ) იმპორტიორი ქვეყნის მთავრობას ან კომპეტენტურ ეროვნულ ორგანოს.

24. საექსპორტო ოპერაციის განხორციელებისთანავე საბაჟო ორგანოს მიერ ივსება წინასწარი ნებართვის მოწმობის მეორე გვერდზე გამოყოფილი სპეციალური გრაფა ფაქტობრივად ექსპორტირებული საქონლის ძირითადი მახასიათებლების (სპეცკონტროლირებადი საშუალებების რაობა, რაოდენობა და სხვა), სატვირთო-საბაჟო დეკლარაციის ნომრისა და საბაჟო გაფორმების თარიღის მითითებით. დოკუმენტის ერთი ეგზემპლარი რჩება შესაბამის საბაჟო ორგანოში, ხოლო მეორე ეგზემპლარი ექსპორტიორი ორგანიზაციის მიერ 5 დღის განმავლობაში უბრუნდება ბიუროს.

25. ამ წესის ფარგლებში ნებადართულია იმ სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების ექსპორტი, რომელთაც გაუვიდათ საქართველოში რეგისტრაციის ვადა.
26. საქართველოში სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების იმპორტი (ექსპორტი) ნებადართულია მხოლოდ იმ საბაჟო პუნქტებიდან, რომელთა ნუსხა განსაზღვრულია საქართველოს ფინანსთა სამინისტროს საბაჟო დეპარტამენტის მიერ.
27. აკრძალულია ნარკოტიკული საშუალებების და ფსიქოტროპული ნივთიერებების:
ა) იმპორტი (ექსპორტი) საფოსტო ყუთის ან ბანკის მისამართით;
ბ) იმპორტი საბაჟო საწყობის მისამართით;
გ) ექსპორტი საბაჟო საწყობის მისამართით, გარდა იმ შემთხვევებისა, როდესაც იმპორტიორი ქვეყნის კომპეტენტური ორგანოს მიერ გაცემულ ნებართვაში მითითებული იქნება კონკრეტული საბაჟო საწყობი;
გ) ტრანზიტი;
დ) რეექსპორტი, გარდა იმ შემთხვევებისა, როდესაც საერთაშორისო ორგანიზაციები ახორციელებენ პროგრამით გათვალისწინებულ საქმიანობას.
28. სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების წინასწარი ნებართვის მოწმობის გარეშე შემოტანის მცდელობისას საქართველოს ფინანსთა სამინისტროს საბაჟო დეპარტამენტი უზრუნველყოფს საქონლის უკან დაბრუნებას მომწოდებლის ხარჯით, რის შესახებაც ერთი კვირის ვადაში აცნობებს სამინისტროს.

29. საქართველოში სტიქიური უბედურების ან სხვა საგანგებო სიტუაციების დროს ნარკოტიკული საშუალებისა და ფსიქოტროპული ნივთიერების იმპორტიორი ან ექსპორტიორი იურიდიული პირები არ საჭიროებენ წინასწარი ნებართვის მოწმობას. ამ დროს იმპორტირებული სამკურნალო დანიშნულების ნარკოტიკული საშუალებებისა და ფსიქოტროპული ნივთიერებების ლეგალურ ბრუნვაზე ვრცელდება საქართველოს კანონმდებლობით გათვალისწინებული კონტროლის რეჟიმი.

30. თუ საზღვარგარეთ წარმოებული სამკურნალო საშუალება წამლის ფორმის სახით არ ექვემდებარება საერთაშორისო კონტროლს, წინასწარი ნებართვის მოწმობა იმპორტზე გაიცემა იმ შემთხვევაშიც, თუ მწარმოებელი (ექსპორტიორი) ქვეყანა საქართველოს მხარისაგან მოითხოვს აღნიშნულ დოკუმენტს.
ამავე უფლებით სარგებლობა შეუძლია საქართველოს მხარესაც იმ შემთხვევაში, თუ საქმე ეხება ჩვენს ქვეყანაში წარმოებულ ნარკოტიკული საშუალების, ფსიქოტროპული ნივთიერების ან/და პრეკურსორის შემცველი პრეპარატის ექსპორტს ან კანონმდებლობით გათვალისწინებულ სხვა შემთხვევებს.

31. წინასწარი ნებართვის მოწმობის გაცემაზე გადაწყვეტილება მიიღება განცხადება-დეკლარაციის შემოტანიდან 14 დღის განმავლობაში.

32. წინასწარი ნებართვის მოწმობის გაცემაზე უარის თქმის მოტივების შესახებ 10 დღის ვადაში წერილობით ეცნობება განმცხადებელს.

33. საქართველოში მცხოვრები ავადმყოფის ინდივიდუალური საჭიროებისათვის დაურეგისტრირებელი ნარკოტიკული საშუალებებისა და ფსიქოტროპული ნივთიერებების იმპორტი ხორციელდება „წამლისა და ფარმაცევტული საქმიანობის შესახებ“ საქართველოს კანონის საფუძველზე, ამ წესის სრული დაცვით.
34. სარეგისტრაციოდ იმპორტირებული სპეციალურ კონტროლს დაქვემდებარებული ნივთიერებების ნიმუშები ექვემდებარებიან საბაჟო გაფორმებას და იმპორტიორ ორგანიზაციაში შემოსავალში აყვანას. ამ ნიმუშების რეგისტრაციაზე უფლებამოსილ ორგანოსათვის გადაცემა ხორციელდება მიღება-ჩაბარების აქტის საფუძველზე.

35. აკრძალულია წინასწარი ნებართვის მოწმობის მესამე პირისათვის გადაცემა.

36. ეს წესი ვრცელდება „ნარკოტიკული საშუალებების, ფსიქოტროპული ნივთიერებების, პრეკურსორებისა და ნარკოლოგიური დახმარების შესახებ” საქართველოს კანონით გათვალისწინებულ ნარკოტიკულ საშუალებებზე, ფსიქოტროპულ ნივთიერებებზე და კლინიკო-ლაბორატორიული, ფარმაცევტული და სამედიცინო დანიშნულების პრეკურსორებზე.
