Article 141⁷. Temporary rule for commissioning of construction carried out in violation of permit conditions within the administrative boundaries of Batumi Municipality🔗
1. The construction public supervision body is entitled to commission a completed building/structure within the administrative boundaries of Batumi Municipality, including an independently functioning completed object of a complex of buildings/structures (hereinafter – object), for which a construction permit was issued and the construction of which was carried out in violation of the agreed architectural project (including by change of development regulation parameters, violation of functional zoning) or on an incompatible land plot. This paragraph also applies to an object for which a construction permit has not been issued, but the construction of which was carried out within the area of an approved development regulation plan/detailed development plan, as well as to an individual residential house located on a land plot in private ownership (except for an object of commercial purpose and an object built in the area determined by the Batumi Municipality Sakrebulo after the entry into force of this article), the characteristics of which do not exceed the characteristics of a Class II building/structure and the construction of which was carried out without a construction permit or a construction notice.
2. Commissioning applies to an object for which a construction permit has been issued within the administrative boundaries of Batumi Municipality and the construction of which, as of 26 September 2022, is completed, as well as to an object for which a construction permit has not been issued, but which is located within the area of an approved development regulation plan/detailed development plan and the construction of which, as of 26 September 2022, is completed. Commissioning also applies to an individual residential house located on a land plot in private ownership (except for an object of commercial purpose and an object built in the area determined by the Batumi Municipality Sakrebulo after the entry into force of this article), the characteristics of which do not exceed the characteristics of a Class II building/structure, for which a construction permit has not been issued and the construction of which, as of 26 September 2022, is completed.
3. For the purposes of this article, a completed object is an object the construction works of the main structural system and exterior of which, except for facing and improvement works, are completed.
4. An interested person, for the purpose of commissioning the object, shall apply to the construction public supervision body within 2 years from the entry into force of this article.
5. An interested person, for the purpose of commissioning the object, shall submit an application to the construction public supervision body. The following documentation shall be attached to this application:
a) a topographic plan reflecting the current state of the object;
b) an extract from the public registry and the corresponding survey drawing of the land plot, on which the operational facility is shown;
c) the architectural design of the facility and a survey drawing reflecting the current condition of the facility;
d) photographs of the facility;
e) an expert opinion issued by an accredited inspection body confirming the stability and seismic resistance of the load-bearing structures of the facility;
f) where necessary − an expert opinion issued by an accredited inspection body on the design;
g) in the case of the internal layout of the facility or of finishing and improvement works having been carried out in violation − the consent of the relevant persons;
h) in the case of the absence of the mandatory number of parking spaces provided for by the agreed architectural design (where such an obligation exists under the agreed architectural design), and, in the absence of the said design − in the case of the absence of the number of parking spaces provided for by the legislation of Georgia for this facility − the consent of the relevant persons;
i) test reports of the technological equipment installed in the facility (lift, escalator and others);
j) in the case of a commercial facility whose characteristics exceed the characteristics of a Class II building/structure − a conclusion on compliance with the fire safety requirements in force at the time of issuance of the relevant construction permit.
6. For the purposes of subparagraphs „g“ and „h“ of paragraph 5 of this Article, the need for the consent of the relevant persons and the circle of such persons shall be determined by the construction public supervision body.
7. An interested person shall be entitled, in agreement with the Municipality of the City of Batumi, to carry out the finishing and improvement works provided for by subparagraph „g“ of paragraph 5 of this Article within 2 years from the entry into force of this Article, which does not require an additional construction permit. The works to be carried out as determined by this paragraph shall comply with the principles of the agreed architectural design, and, in the absence of a construction permit, with the principles of another agreed architectural design existing within the area of the approved development regulation plan/detailed development plan (where such a design exists).
8. In the process of commissioning the facility (except for an individual residential house), the principle of reasonable accommodation shall be taken into account in order to ensure the promotion of equality of persons with disabilities with other persons and the elimination of discrimination.
9. After the submission to the construction public supervision body of the documentation defined by paragraph 5 of this Article, it confirms the construction carried out in violation, taking into account the construction works performed. It shall be obliged, in accordance with the requirements of this Article, to adopt a decision on the commissioning of the facility or on refusal to commission the facility. The construction public supervision body shall adopt the decision provided for by this paragraph within 6 months from the submission to it of the relevant application. Failure to adopt the said decision within this period does not restrict the right of a person to re-submit to the construction public supervision body an application for the purpose of commissioning the facility.
10. Commissioning of a facility in accordance with this Article does not mean:
a) the lawfulness of works carried out in violation of the boundary zone;
b) exemption from payment of the amount established for increasing the land plot development intensity coefficient (K-2).
11. Before the commissioning of a facility, in order to ensure its safety or proceeding from private and public interests, the construction public supervision body shall be entitled to require an interested person to submit additional documentation or to fulfil the relevant conditions directly related to the commissioning of this facility. Failure to submit the documentation required in accordance with this paragraph or failure to fulfil the relevant conditions may become grounds for refusal to commission the facility.
