color:teal;} span.msoDel {mso-style-name:""; text-decoration:line-through; color:red;} /* Page Definitions */ @page Section1 {size:8.5in 11.0in; margin:.75in 63.0pt 1.0in 1.0in;} div.Section1 {page:Section1;} /* List Definitions */ ol {margin-bottom:0in;} ul {margin-bottom:0in;} საქართველოს პრეზიდენტის ბრძანებულება №670 1997 წლის 17 ნოემბერი ქ. თბილისი საქართველოს სოფლის მეურნეობისა და სურსათის სამინისტროს დებულების შესახებ 1. დამტკიცდეს საქართველოს სოფლის მეურნეობისა და სურსათის სამინისტროს თანდართული დებულება. 2. ძალადაკარგულად ჩაითვალოს „საქართველოს სოფლის მეურნეობისა და სურსათის სამინისტროს დებულების დამტკიცების შესახებ“ საქართველოს პრეზიდენტის 1996 წლის 8 აპრილის №260 ბრძანებულება. ე. შევარდნაძე საქართველოს სოფლის მეურნეობისა და სურსათის სამინისტროს დებულება I. ზოგადი დებულებანი 1. საქართველოს სოფლის მეურნეობისა და სურსათის სამინისტრო (შემდგომში – სამინისტრო) შექმნილია და თავის საქმიანობას ახორციელებს „აღმასრულებელი ხელისუფლების სტრუქტურისა და საქმიანობის წესის შესახებ“ საქართველოს კანონის საფუძველზე. სამინისტროს იურიდიული მისამართია ქ. თბილისი 380023, მ. კოსტავას ქ. №41. 2. სამინისტრო არის სახელმწიფო სამთავრობო დაწესებულება, რომელიც ახორციელებს აღმასრულებელ ხელისუფლებას კანონიდან ან საქართველოს პრეზიდენტის მიერ კანონის საფუძველზე მიღებული დავალებებიდან გამომდინარე სოფლის მეურნეობისა და სურსათის სექტორში (შემდგომში – სექტორი) სახელმწიფო მმართველობის უზრუნველსაყოფად. 3. სამინისტრო მისთვის დაკისრებული მოვალეობების შესრულებისათვის ანგარიშვალდებულია საქართველოს პრეზიდენტის წინაშე. 4. საქართველოს კანონებისა და საქართველოს პრეზიდენტის აქტების შესაბამისად სამინისტროს მიერ თავისი კომპეტენციის ფარგლებში მიღებული ნორმატიული აქტები სავალდებულოა შესასრულებლად იურიდიული და ფიზიკური პირებისათვის საქართველოს მთელ ტერიტორიაზე. 5. სამინისტროს აქვს დებულება, დამოუკიდებელი ბალანსი, ანგარიშსწორების ანგარიში ბანკში, სპეცანგარიში ხაზინაში, ხარჯთა ნუსხა და ბეჭედი საქართველოს გერბის გამოსახულებით. სამინისტროს დაფინანსების წყაროა სახელმწიფო ბიუჯეტი. სამინისტროს უფლება აქვს მიიღოს დახმარებები, შემოწირულობანი, სხვა არასაბიუჯეტო შემოსავლები და ანგარიშვალდებულია მათი მიზნობრივი გამოყენებისათვის. 6. სამინისტრო ეფუძნება ერთმმართველობის პრინციპს. სამინისტროს თანამდებობის პირს უფლება არა აქვს იმავდროულად ეკავოს სხვა თანამდებობა საჯარო სამსახურში. 7. სამინისტროს კომპეტენცია დადგენილია კანონით ან კანონის საფუძველზე. სამინისტროს უფლება არა აქვს გადასცეს სხვა სახელმწიფო ან არასახელმწიფო დაწესებულებას უფლებები და მოვალეობები, რომლებიც მის კომპეტენციას განეკუთვნება, თუ საქართველოს კანონმდებლობით სხვა არ არის დადგენილი. 8. სამინისტრო გამოსცემს აქტებს თავისი კომპეტენციის ფარგლებში, საქართველოს კონსტიტუციის, სხვა კანონების, საქართველოს პრეზიდენტის აქტებისა და საქართველოს პარლამენტის დადგენილებების საფუძველზე და მათ შესასრულებლად. 9. სამინისტროს გამგებლობაში შეიძლება იყოს სახელმწიფო ბიუჯეტიდან დაფინანსებული სახელმწიფო საქვეუწყებო დაწესებულებები, რომელთა ძირითად ამოცანას არ შეადგენს აღმასრულებელი ხელისუფლების განხორციელება. 10. სახელმწიფო საქვეუწყებო დაწესებულება იქმნება, გარდაიქმნება და საქმიანობას წყვეტს საქართველოს პრეზიდენტის ბრძანებულებით ან საქართველოს პრეზიდენტის მიერ განსაზღვრული წესის საფუძველზე სამინისტროს მიერ. 11. იმ სახელმწიფო საქვეუწყებო დაწესებულების დებულებას, რომელიც შექმნილია საქართველოს სოფლის მეურნეობისა და სურსათის სამინისტროს ბრძანებით, ამტკიცებს საქართველოს სოფლის მეურნეობისა და სურსათის მინისტრი. 12. სამინისტრო და მის გამგებლობაში მყოფი სახელმწიფო საქვეუწყებო დაწესებულება უფლებამოსილია გასწიოს სახელმწიფო წარმომადგენლობა იმ მოვალეობათა შესრულებისას, რომლებიც მას ეკისრება საქართველოს კანონმდებლობით. 13. სამინისტროს წარმომადგენელი არის მინისტრი ან მის მიერ უფლებამოსილი პირი. 14. სამინისტრო იყოფა სტრუქტურულ ქვედანაყოფებად, სამინისტროს შესახებ დებულების შესაბამისად. 15. თავისი მმართველობის სფეროში პოლიტიკის შემუშავების, სტრატეგიულ საკითხებზე გადაწყვეტილებების მიღებისა და სახელმწიფო უწყებებთან კოორდინირებული ქმედების მიზნით მინისტრი ქმნის სათათბირო კოლეგიალურ ორგანოს – საბჭოს, რომლის შემადგენლობაში გარდა სამინისტროს სისტემის თანამდებობის პირებისა შეიძლება შევიდნენ დაინტერესებულ სამინისტროთა და უწყებათა ხელმძღვანელები. 16. სამინისტროს სტრუქტურულ ქვედანაყოფებს არ გააჩნიათ აღმასრულებელი ხელისუფლების უფლებამოსილებანი იმ პირების მიმართ, რომლებიც არ არიან საჯარო მოსამსახურეები სამინისტროში. 17. სამინისტროს სტრუქტურული ქვედანაყოფების კომპეტენცია განისაზღვრება დებულებით, რომელსაც ამტკიცებს მინისტრი. 18. სამინისტროს სისტემაში არსებული იმ დეპარტამენტის, ინსპექციის, მთავარი სამმართველოს, სამმართველოს, სამსახურის, სხვა სტრუქტურული ერთეულის კომპეტენცია, რომელიც ახორციელებს მმართველობის ფუნქციებს, სახელმწიფო ზედამხედველობას და კანონით განსაზღვრულ შემთხვევაში – სახელმწიფოებრივ იძულებას, განისაზღვრება კანონით და სამინისტროს მიერ დამტკიცებული დებულებით. II. სამინისტროს საქმიანობის მიზანი, სფერო, ფუნქციები და ამოცანები 19. სამინისტროს მიზანი, სფერო, ფუნქციები და ამოცანებია: ა) აგრარულ-სამრეწველო და სასურსათო კომპლექსის ტრანსფორმაციის პროცესში წარმოების დონის ამაღლებისა და მოსახლეობის ცხოვრების პირობების გაუმჯობესების ხელშეწყობა ბუნებრივი რესურსების მაქსიმალურად დაზოგვის პირობებისა და აგრარული პოლიტიკის კონცეფციით განსაზღვრული ორიენტირების გათვალისწინებით; ბ) ეროვნულ ტრადიციებზე და საერთაშორისო გამოცდილებაზე დაყრდნობით აგრარული რეფორმის განხორციელება სასოფლო-სამეურნეო პროდუქციის კერძო მწარმოებელთა ფართო ფენის ჩამოყალიბების, სოფლის, როგორც სოციალურ-ეკონომიკური ერთეულის, განვითარების პრობლემების კომპლექსური გადაწყვეტისათვის ხელშეწყობა, მეცნიერების, სოფლის მეურნეობისა და მრეწველობის კოოპერაციისა და ინტეგრაციის ორგანიზაცია; გ) შიდა ბაზრის სურსათით გაჯერებისათვის, სამამულო პროდუქციის მწარმოებელთა კონკურენტუნარიანობისათვის ხელის შეწყობა, საექსპორტო პოტენციალის სრულად გამოყენება, საგარეო ბაზარზე მყარი პოზიციების მოპოვება; დ) მწარმოებელთა და მომხმარებელთა ინტერესების შეხამებისათვის ხელშეწყობა, ეკოლოგიურად სუფთა სასოფლო-სამეურნეო პროდუქტების წარმოებისა და მოსახლეობის სასურსათო უსაფრთხოების უზრუნველყოფის ორგანიზაცია; ე) სოფლის მეურნეობისა და სურსათის წარმოება-რეალიზაციაში საერთაშორისო გამოცდილების დანერგვა, საერთაშორისო დახმარების კოორდინირება, მათი ეფექტიანი გამოყენება; ვ) სექტორის, როგორც სისტემის, სახელმწიფოებრივი მართვის უზრუნველყოფა; ზ) სექტორში სტრატეგიისა და პოლიტიკის შემუშავება, დაგეგმვა-პროგნოზირება, საქართველოს პრეზიდენტისათვის წინადადებებისა და პროექტების წარდგენა, მიღებულ გადაწყვეტილებათა შესრულების უზრუნველყოფა; თ) სექტორის ფუნქციონირების და რეფორმების სამართლებრივი ბაზის ჩამოყალიბებისათვის კანონპროექტებისა და სხვა ნორმატიული აქტების პროექტების მომზადება ან მათ მომზადებაში მონაწილეობის მიღება; ი) სექტორში საწარმოთა რესტრუქტურიზაცია-რეორგანიზაციისა და პრივატიზების მიზანმიმართულ და ორგანიზებულ წარმართვაში მონაწილეობა; კ) სექტორში მმართველობის სხვადასხვა რგოლში საბაზრო ეკონომიკის ადეკვატური ქმედობაუნარიანობის ჩამოყალიბება; ლ) საშინაო და საგარეო ბაზრების მდგომარეობისა და ტენდენციების შესახებ ინფორმაციის მოპოვება და ანალიზი, სისტემატიზაცია, პროგნოზირება და გავრცელება. კონსულტირება და დახმარება წარმოებისა და სოციალური მოწყობის ორგანიზაციასა და მართვაში, სექტორში ინტეგრაციული პროცესების განვითარებაში; მ) საბაზრო ინფრასტრუქტურის (საბითუმო ბაზრები, ბირჟები, საშუამავლო ფირმები, საკრედიტო კავშირები და ამხანაგობები, სადაზღვევო და საპენსიო ინსტიტუტები) ფორმირებისათვის ხელშეწყობა; ნ) სამელიორაციო, სანაშენე, საჯიშე, სანერგე, სელექციის, მეთესლეობის, ჯიშთა გამოცდისა და დაცვის, მცენარეთა დაცვის, ვეტერინარული, აგრონომიულ-საინჟინრო-ტექნიკური და სხვა სახის მომსახურების სტიმულირება და განვითარება; ო) სოფლის მეურნეობისა და კვების პროდუქტების წარმოებისა და რეალიზაციის რეგულირებისათვის ხელშეწყობა, კვების პროდუქტების სასაქონლო წარმოების სახელმწიფო ლიცენზირება, აგრეთვე ხარისხის კონტროლის ორგანიზაცია და სერტიფიცირება თავისი კომპეტენციის ფარგლებში; პ) მცენარეთა დაცვის საშუალებების, სასუქების, ვეტსაშუალებათა, სასოფლო-სამეურნეო კულტურებში ბიოენერგოაქტივობის გამოცდის ორგანიზაცია, რეგისტრაცია. მათი გამოყენებისათვის ნებართვის გაცემა, გამოყენების კონტროლი საქართველოს ჯანმრთელობის დაცვის სამინისტროსა და საქართველოს გარემოსა და ბუნებრივი რესურსების დაცვის სამინისტროსთან შეთანხმებით. საკარანტინო ობიექტების შემოღწევისაგან ქვეყნის ტერიტორიის დაცვა, თესლისა და სარგავი მასალის ხარისხის კონტროლის ორგანიზაცია, სახელმწიფო ზედამხედველობა თვითმავალი მანქანებისა და სხვა ტექნიკის ტექნიკურ მდგომარეობაზე (გარდა ავტომანქანებისა); ჟ) სოფლის, როგორც ერთიანი სოციალურ-ეკონომიკური ერთეულის, კომპლექსური განვითარების უზრუნველყოფის ღონისძიებათა შემუშავებასა და განხორციელებაში მონაწილეობა სხვა ცენტრალურ უწყებებთან, ავტონომიური რესპუბლიკების, სამხარეო, რაიონულ (საქალაქო) ორგანოებთან თანამშრომლობით; რ) დელეგირებული უფლებამოსილების ფარგლებში სექტორში სახელმწიფო ქონების მართვის ფუნქციების შესრულება; ს) ავტონომიური რესპუბლიკებისა და სხვა ადმინისტრაციულ-ტერიტორიული ერთეულების სოფლის მეურნეობისა და სურსათის მმართველობითი რგოლების ორგანიზაციულ-მეთოდური ხელმძღვანელობა, დახმარება და კონსულტირება; ტ) სექტორში დასაქმებული მეურნე სუბიექტების სამეცნიერო-საკონსულტაციო მომსახურების, პროფესიული ცოდნის დაუფლებისა და კვალიფიკაციის ამაღლების ორგანიზაცია; უ) აგროსამრეწველო და სასურსათო სექტორში არასახელმწიფო სტრუქტურების (კავშირები, ასოციაციები და სხვა საზოგადოებრივი გაერთიანებები) საქმიანობისათვის ხელშეწყობა, საზოგადოებრიობასთან სისტემური ურთიერთობა; ფ) საფინანსო-ეკონომიკური პოლიტიკის შემუშავებაში მონაწილეობის მიღება და მისი განხორციელების მეშვეობით, სათანადო რესურსების ფორმირების გზით სასურსათო ბაზარზე ზემოქმედება ბაზრის გაჯერებისა და სტაბილურობის უზრუნველყოფისათვის; ქ) სახელმწიფო საჭიროებისა და რეზერვებისათვის რესურსების ფორმირება და მათი გამოყენებისათვის ზედამხედველობა; ღ) სექტორში საერთაშორისო ურთიერთობების წარმართვა; საერთაშორისო კოოპერაციის განვითარებაში მონაწილეობა; ყ) თავისი კომპეტენციის ფარგლებში ხელისუფლების ორგანოების, ფიზიკური და იურიდიული პირებისაგან ინფორმაციის მიღება, გადამუშავება და ანალიზი. III. სამინისტროს უფლებამოსილებანი 20. სამინისტროს უფლება აქვს: ა) მონაწილეობა მიიღოს ქვეყნის ეკონომიკური და სოციალური პოლიტიკის, კანონპროექტების, ქვეკანონური აქტების, სახელმწიფო პროგრამებისა და სახელმწიფო ბიუჯეტის შემუშავებაში; ბ) მოითხოვოს და მიიღოს ხელისუფლების ორგანოების, იურიდიული და ფიზიკური პირებისაგან თავისი საქმიანობისათვის აუცილებელი კანონმდებლობით ნებადართული ინფორმაცია; გ) განახორციელოს სექტორის განვითარების პროგრამებისა და პროექტების შესრულების კონტროლი, დადგენილი წესით მიიღოს ანგარიშგება მონაწილეებისაგან; დ) თავისი კომპეტენციის ფარგლებში, კანონით დადგენილი წესით შეიმუშაოს და მიიღოს ნორმატიული და ინდივიდუალური ხასიათის სამართლებრივი აქტები, ინსტრუქციები, მეურნე სუბიექტების სტანდარტები და მოითხოვოს მათი შესრულება; კანონმდებლობით განსაზღვრული წესით უზრუნველყოს არამართლზომიერი ქმედების აღკვეთა, მიაღწიოს ზიანისა და ზარალის ანაზღაურებას; ე) წარუდგინოს საქართველოს პრეზიდენტს წინადადებები სექტორში პოლიტიკის კორექტირების, გადაწყვეტილებებში ცვლილებათა შეტანის ან მათი გაუქმების შესახებ; ვ) მოამზადოს დასკვნები და შენიშვნები კანონპროექტზე, საქართველოს პრეზიდენტის აქტების პროექტებსა და სხვა დოკუმენტებზე; ზ) სახელმწიფო ორგანოების, საზოგადოებრივი ორგანიზაციების, იურიდიული და ფიზიკური პირების მიერ სამინისტროს კომპეტენციის საკითხებში ჩარევის შემთხვევაში მოითხოვოს მისი შეწყვეტა; შევიდეს შესაბამისი წინადადებით საქართველოს პრეზიდენტთან; თ) არსებული წესის მიხედვით დაამყაროს ურთიერთობა სხვა ქვეყნების შესაბამის სახელმწიფო ორგანოებთან და საერთაშორისო ორგანიზაციებთან, აგრეთვე იურიდიულ და ფიზიკურ პირებთან, თავისი კომპეტენციის ფარგლებში ან ასეთი უფლებამოსილების არსებული წესით მიღების შემთხვევაში დადოს მათთან ხელშეკრულებები სახელმწიფოს სახელით; ი) საზოგადოებრივი ორგანიზაციების წარმომადგენელთა, მეცნიერებისა და სპეციალისტების მონაწილეობით შექმნას საკონსულტაციო და პრობლემური კომისიები, საბჭოები; კ) მოაწყოს აუქციონები, კონკურსები, ტენდერები სექტორში სახელმწიფო და საერთაშორისო პროგრამებში მონაწილეთა და სახელმწიფო შეკვეთების (საჭიროების შემთხვევაში) შემსრულებელთა გამოსავლენად, დადგენილი წესით გააფორმოს მათთან ხელშეკრულებები; ლ) განახორციელოს „მეწარმეთა შესახებ“ საქართველოს კანონით დადგენილი უფლებამოსილებანი სამინისტროს მიერ დაფუძნებული სახაზინო საწარმოების, შეზღუდული პასუხისმგებლობის საზოგადოებათა და იმ სახელმწიფო ქონების მიმართ, რომელთა მართვის უფლება დელეგირებულია სამინისტროსათვის; მ) უშუალოდ წარმართოს სამინისტროს გამგებლობაში არსებული დეპარტამენტების, სამსახურებისა და ორგანიზაციების საქმიანობა, არსებული წესით მოახდინოს მათი რეორგანიზაცია, ლიკვიდაცია, შექმნას ახალი სტრუქტურები; ნ) წარმართოს საკადრო პოლიტიკა, შექმნას კადრების მომზადების, გადამზადების, კვალიფიკაციის ამაღლების სისტემა; ო) განიხილოს მოქალაქეთა განცხადებები სამინისტროს კომპეტენციას მიკუთვნებულ საკითხებზე და მიიღოს შესაბამისი გადაწყვეტილებანი; პ) განახორციელოს საქართველოს კანონმდებლობით, საქართველოს პრეზიდენტის აქტებითა და ამ დებულებით განსაზღვრული სხვა უფლებამოსილებანი. 21. სამინისტრო ვალდებულია: ა) პერიოდულად მოახსენოს საქართველოს პრეზიდენტს სამინისტროსათვის მინიჭებულ უფლებამოსილებათა გამოყენებისა და განხორციელების შესახებ; ბ) უზრუნველყოს დაკისრებული ამოცანებისა და ფუნქციების შესრულება; გ) დროულად და ხარისხიანად შეასრულოს საქართველოს პრეზიდენტის დავალებები და მითითებები; დ) დადგენილ ვადებში და მოთხოვნების შესაბამისად წარადგინოს პროექტები და წინადადებები კანონპროექტების, ინდიკატური გეგმის, სახელმწიფო ბიუჯეტის, სახელმწიფო პროგრამებისა და სხვათა შესამუშავებლად; ე) მჭიდროდ ითანამშრომლოს საკანონმდებლო, აღმასრულებელ და სასამართლო ხელისუფლების ცენტრალურ, ავტონომიური რესპუბლიკებისა და სხვა ადმინისტრაციულ-ტერიტორიულ ერთეულებთან, სამხარეო, რაიონულ (საქალაქო) ორგანოებთან; ვ) არ დაუშვას სხვა ორგანოების კომპეტენციაში ჩარევა; ზ) ითანამშრომლოს საზოგადოებრივ ორგანიზაციებთან, უშუალოდ და მასობრივი ინფორმაციის საშუალებებით უზრუნველყოს სისტემატური ურთიერთობა საზოგადოებრიობასთან; თ) კომპეტენტური ორგანოების გაფრთხილებისთანავე შეაჩეროს საკუთარი გადაწყვეტილებებისა და აქტების მოქმედება, ხოლო მათი არამართლზომიერების დადგენის შემთხვევაში გააუქმოს ან შეცვალოს ისინი; ი) დადგენილ ვადებში და ფორმით წარუდგინოს ანგარიშები შესაბამის სახელმწიფო ორგანოებს; კ) პასუხი აგოს მიღებულ გადაწყვეტილებებზე, მათ შორის ამ გადაწყვეტილებებით მიყენებულ ზიანზე ან ზარალზე კანონმდებლობით დადგენილი წესით; ლ) გამოვიდეს სასამართლოში მხარედ და სარჩელის აღძვრისას განთავისუფლდეს სახელმწიფო ბაჟის გადასახადისაგან; მ) შეასრულოს კანონმდებლობით და ამ დებულებით განსაზღვრული სხვა მოვალეობანი. IV. სამინისტროს საქმიანობის ორგანიზაცია და სტრუქტურა 22. სამინისტრო შედგება თანამდებობის პირების, სტრუქტურული ქვედანაყოფების, მის გამგებლობაში მყოფი დეპარტამენტების, მთავარი სამმართველოების, სამმართველოების, ინსპექციების, სამსახურების, რაიონების (ქალაქების) ორგანიზაციების, საწარმოების და სოფლის მეურნეობისა და სურსათის რაიონული (საქალაქო) სამმართველოებისაგან; სამინისტრო ახორციელებს ავტონომიური რესპუბლიკების, შესაბამისი უწყებებისა და სხვა ადმინისტრაციულ-ტერიტორიული ერთეულების შესაბამისი სტრუქტურული ქვედანაყოფების ორგანიზაციულ-მეთოდურ ხელმძღვანელობას. მათი საქმიანობის ძირითადი ამოცანები და კომპეტენცია განისაზღვრება დებულებებით, რომლებსაც ამტკიცებს მინისტრი. 23. სამინისტროს ხელმძღვანელობს მინისტრი, რომელსაც ამ თანამდებობაზე ნიშნავს საქართველოს პრეზიდენტი პარლამენტის თანხმობით. მინისტრს თანამდებობიდან ათავისუფლებს საქართველოს პრეზიდენტი. 24. მინისტრი, როგორც სამინისტროს ხელმძღვანელი: ა) ხელმძღვანელობს სამინისტროს და აწესრიგებს სამინისტროს გამგებლობის სფეროსათვის მიკუთვნებულ საკითხებს; ბ) პასუხისმგებელია საქართველოს კონსტიტუციის, კანონების, საქართველოს პრეზიდენტის ბრძანებულებებისა და განკარგულებების, პარლამენტის დადგენილებების შესრულებაზე აგროსამრეწველო და სასურსათო სექტორში; გ) იღებს გადაწყვეტილებებს სამინისტროს გამგებლობის სფეროს მიკუთვნებულ საკითხებზე, თუ მათზე გადაწყვეტილებების მიღება კანონით ან საქართველოს პრეზიდენტის აქტით არ ევალება სახელმწიფო საქვეუწყებო დაწესებულებებს ან თანამდებობის პირებს; დ) თვალყურს ადევნებს სამინისტროს სტრუქტურული ქვედანაყოფებისა და სამინისტროს გამგებლობის სფეროში არსებული სახელმწიფო დაწესებულებების მიერ თავიანთი მოვალეობის შესრულებას და ახორციელებს სამსახურებრივ ზედამხედველობას სამინისტროს საჯარო მომსახურების გადაწყვეტილებებსა და საქმიანობაზე კანონით დადგენილი წესით; ე) თავისი კომპეტენციის ფარგლებში თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფლებს მინისტრის მრჩევლებს, სამინისტროს სტრუქტურული ქვედანაყოფების უფროსებს, სამინისტროს ტერიტორიული ორგანოების უფროსებს საჯარო ხელისუფლების შესაბამის ადგილობრივ ორგანოსთან შეთანხმებით, სამინისტროს საშტატო განრიგით გათვალისწინებულ სხვა საჯარო მოსამსახურეებს; ვ) კანონით დადგენილი წესით თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფლებს სახელმწიფო საქვეუწყებო დაწესებულებათა ხელმძღვანელებს; ზ) საქართველოს პრეზიდენტთან შეაქვს წინადადებები მინისტრის პირველი მოადგილის, მინისტრის მოადგილეების კანდიდატურების, კანონით განსაზღვრული წესით სისტემის სხვა თანამდებობის პირთა თაობაზე; სამინისტროს წლიური ბიუჯეტის შემოსავლისა და გასავლის საკითხებზე და აუცილებლობის შემთხვევაში დამატებითი ბიუჯეტის პროექტზე; იღებს გადაწყვეტილებებს საბიუჯეტო სახსრების მიზნობრივი გამოყენების შესახებ და პასუხს აგებს ბიუჯეტის მიზნობრივი შესრულებისათვის; თ) სახელმწიფო ბიუჯეტის შესაბამისად ამტკიცებს სამინისტროს მმართველობის სფეროში არსებული სახელმწიფო დაწესებულებების ხარჯთა ნუსხას, ახორციელებს მათთვის საჭირო ფულადი და სხვა სახსრების გაცემის უზრუნველყოფას, მათი შესრულების კონტროლს და აუცილებლობის შემთხვევაში იძლევა მითითებებს საბიუჯეტო და არასაბიუჯეტო სახსრების გამოყენების შესახებ; ი) ფინანსთა სამინისტროსთან შეთანხმებით ამტკიცებს არასაბიუჯეტო სახსრების ხარჯთა ნუსხას, ხარჯვის წესს და პასუხს აგებს მისი შესრულებისათვის; კ) ადგენს სამინისტროს მმართველობის სფეროში არსებული სახელმწიფო დაწესებულებების სტრუქტურას, საქმისწარმოების წესს, გარდა იმ შემთხვევებისა, როცა ისინი დადგენილია ზემდგომი სამართლებრივი აქტებით; ლ) დადგენილი წესით შეაქვს წინადადებები ზემდგომ ორგანოებში გადაწყვეტილების მისაღებად იმ საკითხებზე, რომლებიც სამინისტროს გამგებლობის სფეროს განეკუთვნება; მ) ანგარიშს აბარებს საქართველოს პრეზიდენტს სამინისტროს საქმიანობის შესახებ; ნ) ასრულებს მისთვის საქართველოს კანონებით, საქართველოს პრეზიდენტის ბრძანებულებებითა და განკარგულებებით დაკისრებულ სხვა ამოცანებს; ო) ათანხმებს გადაწყვეტილებას შესაბამის სამინისტროსთან ან სამთავრობო დაწესებულებასთან სამინისტროს გამგებლობის სფეროსათვის მიკუთვნებულ ისეთ საკითხებზე, რომლებიც ეხება აგრეთვე სხვა სამინისტროს ან სამთავრობო დაწესებულების გამგებლობის სფეროს. თანხმობის მიუღებლობის შემთხვევაში საკითხი განიხილება მთავრობის სხდომაზე და გადაწყვეტილებას იღებს საქართველოს პრეზიდენტი; პ) პასუხს აგებს სახელმწიფო ქონების დაცვასა და გამოყენებაზე და ორგანიზაციას უწევს ამ საქმიანობას კანონმდებლობით დადგენილი წესით; ჟ) სამინისტროს სტრუქტურული ქვედანაყოფები საქართველოს პარლამენტს ან საქართველოს პრეზიდენტს მიმართავენ მინისტრის მეშვეობით; რ) წარმოადგენს სამინისტროს სხვა ორგანოებთან და ორგანიზაციებთან ურთიერთობაში; ს) წარმართავს სამინისტროსა და მის გამგებლობაში მყოფი დეპარტამენტების, სამსახურებისა და ორგანიზაციების საქმიანობას; ტ) უშუალოდ, აგრეთვე მოადგილეების, სამსახურებისა და ორგანიზაციების ხელმძღვანელების მეშვეობით წყვეტს სამინისტროს ამოცანებით, ფუნქციებითა და უფლებამოსილებებით განსაზღვრულ საკითხებს; უ) განსაზღვრავს მოადგილეებისა და სხვა თანამდებობის პირების ფუნქციებსა და მათ პასუხისმგებლობას; ფ) ამტკიცებს სტრუქტურული ქვედანაყოფებისა და ორგანიზაციების დებულებებს, სამინისტროს მიერ დაფუძნებული სახაზინო საწარმოების, შეზღუდული პასუხისმგებლობის საზოგადოებების წესდებებს, ამ დებულების I თავის მე-9 პუნქტით გათვალისწინებულ საქვეუწყებო დაწესებულებათა დებულებებს, ითანხმებს ავტონომიური რესპუბლიკების აღმასრულებელი ხელისუფლების შესაბამისი უწყებების დებულებებს; ქ) ამტკიცებს სამინისტროს ტერიტორიული ორგანოების დებულებებს; ღ) ითანხმებს ავტონომიური რესპუბლიკების სოფლის მეურნეობისა და სურსათის სამინისტროს ხელმძღვანელთა კანდიდატურებს; მმართველობის სამხარეო, რაიონული (საქალაქო) ორგანოების წარდგინებით ნიშნავს და ათავისუფლებს შესაბამისი სტრუქტურული ქვედანაყოფების ხელმძღვანელებს; ახორციელებს კანონმდებლობით, საქართველოს პრეზიდენტის აქტებით და ამ დებულებით მინიჭებულ სხვა უფლებამოსილებას. ყ) ქმნის სხვადასხვა სამთავრობო და სახელმწიფო საქვეუწყებო დაწესებულებათა წარმომადგენლების კომისიას, რომლის შემადგენლობას ამტკიცებს და ნიშნავს საქართველოს პრეზიდენტი ან მისი დავალებით საქართველოს სახელმწიფო მინისტრი. V. მინისტრის სამართლებრივი აქტები 25. საქართველოს კონსტიტუციის 31-ე მუხლის თანახმად მინისტრი კანონის საფუძველზე და მის შესასრულებლად გამოსცემს ბრძანებებს. 26. მინისტრი, რომელიც ხელს აწერს ბრძანებას, პასუხისმგებელია ბრძანების კანონიერებისა და მიზანშეწონილობისათვის. 27. მინისტრის ბრძანება უფლებააღმჭურველი ან ამკრძალავი აქტია. მასში მითითებული უნდა იყოს ის საკანონმდებლო ნორმა, რომლის საფუძველზე და შესასრულებლად გამოიცემა ბრძანება. 28. მინისტრის ნორმატიული აქტის პროექტი გადაეცემა იუსტიციის სამინისტროს, რომელიც ორ კვირაში იძლევა დასკვნას მისი საქართველოს საკანონმდებლო აქტებთან და საქართველოს პრეზიდენტის ბრძანებულებასთან შესაბამისობის შესახებ. ნორმატიული აქტი მინისტრის ხელმოწერიდან ათ დღეში გადაეცემა იუსტიციის სამინისტროს სახელმწიფო რეესტრში გასატარებლად. 29. მინისტრის ბრძანებას უნდა ჰქონდეს სათაური, მითითებული უნდა იყოს მიღების თარიღი და ადგილი, ძალაში შესვლის თარიღი და მოქმედების ვადა (თუ განსაზღვრული ვადითაა მიღებული), თანამდებობის პირის ხელმოწერა, სარეგისტრაციო ნომერი, ხოლო თუ აქტი სახელმწიფო რეესტრში შეტანას მოითხოვს –აგრეთვე სახელმწიფო რეესტრის კოდი. 30. მინისტრის სამართლებრივი აქტი, თუ ის ნორმატიულია, ძალაში შედის ოფიციალურ ბეჭდვით ორგანოში მისი გამოქვეყნებისთანავე, თუ იმავე სამართლებრივი აქტით სხვა ვადა არ არის დადგენილი, ინდივიდუალური სამართლებრივი აქტი ძალაში შედის მისი ხელმოწერის დღეს და დაუყოვნებლივ ეცნობება დაინტერესებულ პირებს. VI. მინისტრის უფლებამოსილების შეწყვეტა 31. მინისტრის უფლებამოსილების შეწყვეტის საკითხი რეგულირდება საქართველოს კონსტიტუციით „აღმასრულებელი ხელისუფლების სტრუქტურისა და საქმიანობის წესის შესახებ“ საქართველოს კანონის მე-18 მუხლის მოთხოვნათა მიხედვით. VII. მინისტრის პირველი მოადგილე და მოადგილეები, სტრუქტურული ქვედანაყოფის ხელმძღვანელები 32. მინისტრს ჰყავს პირველი მოადგილე და ორი მოადგილე, რომელთა უფლებამოსილებანი განისაზღვრება მინისტრის ბრძანებით. 33. მთავრობის შემადგენლობის მიერ უფლებამოსილებათა მოხსნა ან სხვა საფუძველზე მინისტრის სამსახურებრივ უფლებამოსილებათა შეწყვეტა მინისტრის პირველი მოადგილისა და მოადგილეების უფლებამოსილებათა შეწყვეტის საფუძველია. 34. მინისტრის პირველ მოადგილეს და მოადგილეებს უფლება არა აქვთ შედიოდნენ სამეწარმეო საზოგადოებების ხელმძღვანელ, საკონტროლო ან სარევიზიო ორგანოებში, ეწეოდნენ სამეწარმეო საქმიანობას. 35. მინისტრის პირველი მოადგილე ხელმძღვანელობს იმ სტრუქტურული ქვედანაყოფების მუშაობას, რომლებიც მინისტრის ბრძანებით მის დაქვემდებარებაშია გადაცემული. 36. მინისტრის პირველი მოადგილე ხელმძღვანელობს სამინისტროს საქმიანობას და კოორდინაციას უწევს სამსახურების ურთიერთობებს მინისტრის არყოფნისას. 37. მინისტრის პირველ მოადგილეს და მოადგილეებს მინისტრის წარდგინებით თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფლებს საქართველოს პრეზიდენტი. 38. მინისტრის ერთ-ერთი მოადგილე მინისტრის დავალებით ახორციელებს საპარლამენტო მდივნის ფუნქციას. 39. სამინისტროს ძირითადი სტრუქტურული ერთეულებია: მინისტრის აპარატი, დეპარტამენტები, ინსპექციები, სამსახურები, მთავარი სამმართველოები, სამმართველოები, განყოფილებები, ჯგუფები (სექტორები). 40. სტრუქტურული ქვედანაყოფების ხელმძღვანელები წარმართავენ ამ ქვედანაყოფების საქმიანობას დებულებით განსაზღვრული მიმართულებებისა და უფლებამოსილების შესაბამისად. VIII. სამსახურებრივი ზედამხედველობა 41. მინისტრის კომპეტენცია სამსახურებრივი ზედამხედველობის სფეროში ხორციელდება „აღმასრულებელი ხელისუფლების სტრუქტურისა და საქმიანობის წესის შესახებ“ საქართველოს კანონის 45-ე მუხლის მოთხოვნათა საფუძველზე. IX. სამინისტროს ცენტრალური აპარატის სტრუქტურა 42. ცენტრალური აპარატი შეიცავს შემდეგ ქვედანაყოფებს: – მინისტრის აპარატი – იურიდიულ და პარლამენტთან ურთიერთობის სამმართველო – აგრარული რეფორმების დეპარტამენტი – საფინანსო-ეკონომიკური დეპარტამენტი – სოფლის მეურნეობის დეპარტამენტი – კვების მრეწველობის დეპარტამენტი – პურპროდუქტებისა და სურსათის დეპარტამენტი – საერთაშორისო ურთიერთობის დეპარტამენტი – მეცნიერული უზრუნველყოფისა და ბუნებათსარგებლობის დეპარტამენტი – ადმინისტრაციული დეპარტამენტი. X. სამინისტროს ტერიტორიული ორგანოები 43. სამინისტროს შესაბამის ადმინისტრაციულ-ტერიტორიულ ერთეულებში გააჩნია შემდეგი ორგანოები: – ავტონომიურ რესპუბლიკებში – სოფლის მეურნეობისა და სურსათის სამინისტროები – რაიონებში (ქალაქებში –რაიონული ზონებით) – სოფლის მეურნეობისა და სურსათის სამმართველოები – სამინისტროს შემადგენლობაში შემავალი სტრუქტურული ქვედანაყოფები და მის გამგებლობაში მყოფი სახელმწიფო საქვეუწყებო დაწესებულებებისა და ორგანიზაციების შესაბამისი ტერიტორიული ერთეულები. XI. სამინისტროს სისტემაში არსებულ სახელმწიფო საქვეუწყებო დაწესებულებათა ნუსხა – მელიორაციისა და წყალთა მეურნეობის დეპარტამენტი – ვეტერინარიის დეპარტამენტი – თევზის მეურნეობის დეპარტამენტი „საქთევზი“ – მევენახეობისა და მეღვინეობის სახელმწიფო რეგულირების დეპარტამენტი `სამტრესტი~ – მინერალური და მტკნარი წყლების სახელმწიფო რეგულირების დეპარტამენტი – მეცხოველეობის სანაშენე საქმის დეპარტამენტი – სოფლის მეურნეობის პროდუქტების ხარისხის სახელმწიფო ინსპექცია – პურისა და პურპროდუქტების ხარისხის სახელმწიფო ინსპექცია – თესლეულისა და სარგავი მასალის ხარისხის სახელმწიფო ინსპექცია – მელიორაციის ინსპექცია – „საქტექზედამხედველობის“ ინსპექციის მთავარი სამმართველო – კვების პროდუქტების წარმოების ლიცენზირების სამუშაოთა ორგანიზაციის სამსახური – თბილისის, ქუთაისის, რუსთავის, ფოთის კვების პროდუქტების ლიცენზირების სამსახურები – სელექციური მიღწევების გამოცდისა და დაცვის კომისია – მცენარეთა დაცვის სამსახური, მასში შემავალი: – ფიტოსანიტარიული სახელმწიფო ინსპექცია – მცენარეთა დაცვის რესპუბლიკური სადგური – აგროქიმიური და ნიადაგის ნაყოფიერების სამსახური, მასში შემავალი: – ნიადაგის ნაყოფიერების რესპუბლიკური ცენტრი – ნიადაგის ნაყოფიერების დასავლეთ საქართველოს ცენტრი – საქართველოს ტექნიკურ-ეკოლოგიური კვლევის სამეცნიერო ცენტრი – სოფლის მეურნეობის ბიოტექნოლოგიის სამეცნიერო-კვლევითი ცენტრი – ქვეყნის შიგნით ზამთრის საძოვრებისა და პირუტყვის გადასარეკი ტრასების რაზმი – აჭარის საძოვრების ადმინისტრაცია – სასოფლო-სამეურნეო მანქანათა საგამოცდო სადგური – აგრობიზნესის სახელმწიფო ინსტიტუტი – მატერიალურ-ტექნიკური მომარაგების მთავარი სამმართველო. XII. დასკვნითი დებულებანი 44. სამინისტროს დებულებას ამტკიცებს საქართველოს პრეზიდენტი. 45. სამინისტროს რეორგანიზაცია და ლიკვიდაცია ხორციელდება მოქმედი კანონმდებლობით.
