margin:53.85pt 53.85pt 46.2pt 45.35pt;} div.Section2 {page:Section2;} /* List Definitions */ ol {margin-bottom:0in;} ul {margin-bottom:0in;} საქართველოს პრეზიდენტის ბრძანებულება №1 2002 წლის 4 იანვარი ქ. თბილისი საქართველოს ტრანსპორტისა და კომუნიკაციების სამინისტროს დებულებისა და სტრუქტურის შესახებ „აღმასრულებელი ხელისუფლების სტრუქტურისა და საქმიანობის წესის შესახებ“ საქართველოს 1997 წლის 15 აპრილის კანონის შესაბამისად: 1. დამტკიცდეს საქართველოს ტრანსპორტისა და კომუნიკაციების სამინისტროს თანდართული დებულება და სტრუქტურა. 2. ძალადაკარგულად ჩაითვალოს „საქართველოს ტრანსპორტისა და კომუნიკაციების სამინისტროს დებულების შესახებ“ საქართველოს პრეზიდენტის 2000 წლის 29 ივნისის №279 ბრძანებულება. 3. საქართველოს ტრანსპორტისა და კომუნიკაციების სამინისტრომ (მ. ადეიშვილი) 2002 წლის 1 იანვრამდე განახორციელოს ყველა საჭირო ღონისძიება საქართველოს ტრანსპორტისა და კომუნიკაციების სამინისტროს თანდართული დებულების სრული ამოქმედებისათვის. 4. ეს ბრძანებულება, გარდა ბრძანებულების მე-3 პუნქტისა, ძალაშია 2002 წლის 1 იანვრიდან. ე. შევარდნაძე ტრანსპორტისა და კომუნიკაციების სამინისტროს დებულება     მუხლი 1🔗. ზოგადი დებულებანი 1. საქართველოს ტრანსპორტისა და კომუნიკაციების სამინისტრო (შემდგომში – სამინისტრო) არის აღმასრულებელი ხელისუფლების სამთავრობო დაწესებულება, რომელიც შექმნილია ტრანსპორტისა და კომუნიკაციების სფეროში სახელმწიფო პოლიტიკისა და მმართველობის უზრუნველსაყოფად. 2. სამინისტრო თავის საქმიანობაში ხელმძღვანელობს საქართველოს კონსტიტუციით, „ტრანსპორტისა და კომუნიკაციების სფეროს სახელმწიფო მართვისა და რეგულირების წესის შესახებ“ და „კავშირგაბმულობისა და ფოსტის შესახებ“ საქართველოს კანონებით, სხვა სამართლებრივი აქტებითა და ამ დებულებით. 3. სამინისტროს დაფინანსების ძირითადი წყაროა სახელმწიფო ბიუჯეტი. სამინისტროს უფლება აქვს მიიღოს კანონმდებლობით ნებადართული სხვა არასაბიუჯეტო შემოსავლები და ანგარიშვალდებულია მათი მიზნობრივი გამოყენებისათვის. სამინისტროს აქვს საბიუჯეტო ანგარიში და სპეცანგარიში ხაზინაში. 4. სამინისტროს დებულებას ამტკიცებს საქართველოს პრეზიდენტი. სამინისტრო ანგარიშვალდებულია საქართველოს პრეზიდენტის წინაშე. 5. სამინისტროს აქვს ბეჭედი საქართველოს სახელმწიფო გერბის გამოსახულებითა და საკუთარი სახელწოდების აღნიშვნით, დასრულებული ბალანსი. 6. სამინისტროს იურიდიული მისამართია ქ.თბილისი, რუსთაველის გამზ. №12.     მუხლი 2🔗. სამინისტროს საქმიანობის სფერო და ამოცანები 1. სამინისტროს საქმიანობის სფერო მოიცავს საავტომობილო, სარკინიგზო, საზღვაო, საჰაერო ტრანსპორტის, კავშირგაბმულობისა და ფოსტის დარგებს. 2. თავის საქმიანობას სამინისტრო ახორციელებს სამინისტროს სტრუქტურული ქვედანაყოფების, მის სისტემაში შემავალ აფხაზეთისა და აჭარის ავტონომიური რესპუბლიკების სტრუქტურებისა და სამინისტროს გამგებლობაში მყოფი სახელმწიფო საქვეუწყებო დაწესებულებების მეშვეობით. 3. სამინისტროს ამოცანებია: ა) ტრანსპორტისა და კომუნიკაციების სფეროში შესაბამის სამინისტროებთან და უწყებებთან ერთად ერთიანი სახელმწიფო პოლიტიკის განხორციელება; ბ) ტრანსპორტისა და კომუნიკაციების სისტემების ეფექტიანი ფუნქციონირებისა და მათი განვითარებისათვის სრულყოფილი საკანონმდებლო ნორმატიული ბაზის შექმნა, დარგების განვითარების პროგრამების შემუშავება, მათი განხორციელება და მონიტორინგი; გ) სამინისტროს სისტემაში შემავალი დარგების რაციონალური განვითარების, მოსახლეობისა და ეროვნული ეკონომიკის ინტერესებიდან გამომდინარე ევროპა-კავკასია-აზიის სატრანზიტო დერეფნის „ტრასეკასა“ და საინფორმაციო დერეფნების მაქსიმალური ამოქმედება და მათი მაღალი კონკურენტუნარიანობის უზრუნველყოფა; დ) მოქმედი კანონმდებლობის ფარგლებში ეკონომიკური რეფორმების განხორციელება, შესაბამის უწყებებთან ერთად ინსტიტუციური მშენებლობის, კომერციალიზაციის, რესტრუქტურიზაციისა და პრივატიზაციის განხორციელებისათვის ხელშეწყობა. კონკურენტული გარემოს ჩამოყალიბება. საბიუჯეტო შემოსავლების ზრდა; ე) სატრანსპორტო და საკომუნიკაციო სისტემაში საგარეო ეკონომიკური და სამეცნიერო – ტექნიკური ურთიერთობების განვითარება; მსოფლიო სატრანსპორტო და საკომუნიკაციო ინფრასტრუქტურებში ინტეგრირება; ქვეყნის საკომუნიკაციო სისტემის პერსონალიზაციის დაჩქარება, ინვესტიციების, საერთაშორისო დახმარებებისა და კრედიტების მოზიდვა; ვ) ტრანსპორტის, კავშირგაბმულობისა და ფოსტის სფეროში მოწინავე ტექნოლოგიების დანერგვა; ზ) კანონმდებლობით დადგენილი წესით საერთაშორისო ორგანიზაციებსა და საზღვარგარეთის ქვეყნებში ტრანსპორტის, კავშირგაბმულობისა და ფოსტის სფეროში სახელმწიფოებრივი ინტერესების წარდგენა და დაცვა; თ) ტრანსპორტის სფეროში სატრანსპორტო სისტემითა და საშუალებებით მომსახურების მოქნილი და კონკურენტუნარიანი სატარიფო პოლიტიკის განხორციელება; ი) ეროვნული საფოსტო საგადასახადო ნიშნების (მარკების, მარკირებული კონვერტებისა და მარკირებული ღია ბარათების) კანონმდებლობით დადგენილი წესით გამოცემის, გავრცელების, ბრუნვიდან ამოღებისა და ლიკვიდაციის ორგანიზაცია; კ) ტრანსპორტისა და კომუნიკაციების სფეროში თანამედროვე, მაღალი დონის უსაფრთხოების მოთხოვნილებების მაქსიმალური დაცვა; ლ) საქართველოს ეროვნული ეკონომიკის და მოსახლეობის სატრანსპორტო, კავშირგაბმულობისა და ფოსტის მომსახურების მოთხოვნილების მაქსიმალური დაკმაყოფილება.     მუხლი 3🔗. სამინისტროს ფუნქციები 1. სამინისტროს ფუნქციებია: ა) ტრანსპორტის, მათ შორის სპეციალური სახეობების ტრანსპორტის, და კომუნიკაციების სფეროში სახელმწიფო პოლიტიკის ძირითადი მიმართულებების შემუშავება და კანონმდებლობით დადგენილი წესით დამტკიცების შემდეგ მათი განხორციელების კოორდინაცია; ბ) საქართველოს კანონმდებლობით დადგენილი წესით სატრანსპორტო და საკომუნიკაციო სისტემების მართვა, სხვა სამინისტროებთან, სახელმწიფო დეპარტამენტებთან, უწყებებთან, ორგანიზაციებთან და დაინტერესებული ქვეყნების შესაბამის ორგანოებთან ერთად „ევროპა-კავკასია-აზიის“ სატრანსპორტო და საკომუნიკაციო დერეფნის ფუნქციონირებასთან დაკავშირებულ სამუშაოთა კოორდინაცია და მიღებულ გადაწყვეტილებათა შესრულების ზედამხედველობა თავისი უფლებამოსილების ფარგლებში; გ) სატრანსპორტო, კავშირგაბმულობისა და ფოსტის სისტემების განვითარების ინდიკატიური გეგმებისა და სახელმწიფო პროგრამების შემუშავება, სოციალურ-ეკონომიკური მაჩვენებლების პროგნოზირება მოკლე და გრძელვადიანი პერიოდებისათვის; დ) მარკეტინგული კვლევის წარმოება, შიდა და გარე სატრანსპორტო და საკომუნიკაციო ბაზრის შესწავლა და პროგნოზირება, ალტერნატიული მიმართულებების შემუშავება და მათი ეკონომიკური დასაბუთება; ე) სისტემაში ქვეყნის ეკონომიკური პოლიტიკის შესაბამისი საინვესტიციო პოლიტიკის განხორციელება, საინვესტიციო პროგრამების, ბიზნესგეგმების შემუშავებისათვის ხელშეწყობა, ურთიერთობების დამყარება მსოფლიოს საფინანსო-საინვესტიციო ორგანიზაციებთან; სატრანსპორტო და საკომუნიკაციო სამეცნიერო-კვლევითი საქმიანობის კოორდინაცია, პროგრესულ ტექნოლოგიათა გამოყენება; ვ) ქვეყნის საშინაო და საგარეო პოლიტიკის ძირითად მიმართულებათა საფუძველზე სტანდარტიზაციის პროგრამის შემუშავება და სერტიფიკაციის სისტემის ჩამოყალიბებაში მონაწილეობა, მოქმედი კანონმდებლობის შესაბამისად; ზ) საერთაშორისო ორგანიზაციებში საქართველოს წარდგენა და მისი ინტერესების დაცვა, შესაბამის უწყებებთან ერთად ამ ორგანიზაციების საქმიანობაში მონაწილეობა, სატრანსპორტო და საკომუნიკაციო სისტემაში საერთაშორისო ხელშეკრულებათა განხორციელების კოორდინაცია; თ) საერთაშორისო გამოცდილების შესწავლა და ანალიზი, საერთაშორისო მოლაპარაკების, შეთანხმებების კონცეპტუალური და ორგანიზაციული მომზადება; ი) საერთაშორისო სატრანსპორტო გადაზიდვებთან დაკავშირებულ, ასევე საკომუნიკაციო სფეროში სამთავრობათაშორისო ხელშეკრულებებთან და კონვენციებთან მიერთებისა და შესრულების უზრუნველყოფა; კ) შესაბამისი საკანონმდებლო ბაზის სრულყოფის, ტრანსპორტის, კავშირგაბმულობისა და ფოსტის საშუალებებით მომსახურების უზრუნველყოფის მიზნით საკანონმდებლო და კანონქვემდებარე ნორმატიული აქტების პროექტების შემუშავება და მათი შესრულების კონტროლი თავისი კომპეტენციის ფარგლებში; ლ) საგანგებო სიტუაციებში სამაშველო სამუშაოების განხორციელებისათვის ტრანსპორტის, კავშირგაბმულობისა და ფოსტის საშუალებების შეუფერხებელი მუშაობის უზრუნველსაყოფად კონკრეტულ ღონისძიებათა შემუშავება და განხორციელება, ტრანსპორტის სფეროში სატრანსპორტო შემთხვევების ექსპერტიზის ორგანიზაცია კანონით მინიჭებული კომპეტენციის ფარგლებში; მ) დადგენილი წესით სისტემაში გარემოს დაცვისა და სოციალური სფეროს მდგომარეობის ანალიზი, პროცესების პროგნოზირება, დაინტერესებულ უწყებებთან ერთად შესაბამის ღონისძიებათა შემუშავება და მათი შესრულების ორგანიზაცია; ნ) წინადადებების შემუშავება ტრანსპორტის, კავშირგაბმულობისა და ფოსტის საშუალებებისათვის სახელწოდებათა მინიჭებისა და სხვა ატრიბუტიკის შერჩევის შესახებ; ო) სატრანსპორტო-საკომუნიკაციო სისტემაში უსაფრთხოების პოლიტიკის შემუშავება, წარმართვა და მისი განხორციელების კონტროლი; მომსახურებისა და მოძრაობის უსაფრთხოების გაძლიერების მიზნით კანონმდებლობით დადგენილი წესით შესაბამისი ღონისძიებების შემუშავება და განხორციელება; პ) ქვეყანაში კავშირგაბმულობისა და ფოსტის სახელმწიფო საკუთრებაში არსებული ქსელების მუშაობის კოორდინაცია, კავშირგაბმულობის ნაგებობათა ქსელებისა და სისტემების სახელმწიფო ექსპერტიზის ორგანიზაცია, კავშირგაბმულობის ქსელების და საშუალებების ტექნიკური და ეკოლოგიური ნორმების შესაბამისი დაპროექტების, მშენებლობის, ექსპლუატაციისა და მომსახურების უზრუნველმყოფი ნორმატიული აქტების შემუშავება და გამოცემა კანონმდებლობით დადგენილი წესით; ჟ) ტრანსპორტის სფეროში სატრანსპორტო სისტემითა და საშუალებებით მომსახურების ტარიფების დამტკიცება; რ) სპეციალური კავშირებით მართვის ორგანიზაცია; ს) კომპეტენციის ფარგლებში სატრანსპორტო და საკომუნიკაციო დარგების მეტროლოგიური უზრუნველყოფის ორგანიზაცია; საერთაშორისო წესებისა და მოთხოვნების შესაბამისად რადიოსიხშირული სპექტრის დანაწილებისა და გეოსტაციონარულ ორბიტაზე საქართველოს პოზიციის გამოყენების, რადიოელექტრონულ საშუალებათა ელექტრომაგნიტური შეთავსებადობის ტექნიკური პოლიტიკის შემუშავება და მათი საერთაშორისო – სამართლებრივი დაცვის ღონისძიებათა კოორდინაცია; ტ) საგანგებო და საომარი მოქმედებების დროს, მიუხედავად საკუთრების ფორმისა, კავშირგაბმულობის, ფოსტისა და სატრანსპორტო საშუალებათა პრიორიტეტული გამოყენება (მართვა ან მათი ფუნქციონირების შეჩერება) სათანადო ანაზღაურებით, კანონმდებლობით დადგენილი წესით; უ) სისტემაში სამობილიზაციო ღონისძიებათა შემუშავება და განხორციელება; ფ) სისტემაში სახელმწიფო შეკვეთების შესრულების უზრუნველყოფისათვის ხელშეწყობა; ღ) ტრანსპორტის, კავშირგაბმულობისა და ფოსტის რეგიონალური განვითარების პოლიტიკისა და რეგიონთაშორისი ურთიერთობების საკითხების გადაწყვეტა; ყ) ნუმერაციის ერთიანი სისტემის პოლიტიკის შემუშავება, კავშირგაბმულობის ქსელების ერთიანი სიგნალიზაციისა და სინქრონიზაციის ტექნოლოგიური უზრუნველყოფის პრინციპების შემუშავება და დადგენა; შ) კანონმდებლობით დადგენილი წესით უფლებამოსილებათა დელეგირების საფუძველზე სისტემაში სახელმწიფოს წილობრივი მონაწილეობით შექმნილი საწარმოების მართვის უზრუნველყოფა; ჩ) საერთო სარგებლობის საავტომობილო გზების ქსელის განვითარების საკითხებში საქართველოს საავტომობილო გზების დეპარტამენტთან ერთად ერთიანი პოლიტიკის წარმართვა; ც) კანონმდებლობით დადგენილი წესით საქართველოს კომუნიკაციების ეროვნულ კომისიასთან თანამშრომლობა.     მუხლი 4🔗. სამინისტროს უფლება-მოვალეობანი 1. სამინისტროს მიერ მიღებული ნორმატიული აქტები კანონმდებლობით დადგენილი წესით სავალდებულოა ყველა იურიდიული და ფიზიკური პირისათვის, მიუხედავად მათი ორგანიზაციულ-სამართლებრივი ფორმებისა. 2. სამინისტრო უფლებამოსილია: ა) თავისი კომპეტენციის ფარგლებში მონაწილეობა მიიღოს ქვეყნის ეკონომიკური და სამეცნიერო-ტექნიკური განვითარების პროგრამებისა და სახელმწიფო ბიუჯეტის პროექტების შემუშავებასა და განხილვაში; ბ) განახორციელოს სისტემის განვითარების სახელმწიფო პროგრამების შესრულების სათანადო კონტროლი; გ) სამინისტროსათვის დაკისრებული ფუნქციების განსახორციელებლად კანონით განსაზღვრულ უფლებამოსილებათა ფარგლებში მოითხოვოს ინფორმაცია როგორც სახელმწიფო, ისე კერძო სტრუქტურებისგან; დ) მოქმედი კანონმდებლობის შესაბამისად დაამყაროს ურთიერთობები საერთაშორისო ორგანიზაციებთან, აგრეთვე, იურიდიულ და ფიზიკურ პირებთან, დადოს მათთან ხელშეკრულებები, მოახდინოს ხელშეკრულებათა ექსპერტიზა; ე) კომპეტენციის ფარგლებში მოამზადოს დასკვნები და შენიშვნები საკანონმდებლო და კანონქვემდებარე ნორმატიული აქტების პროექტების შესახებ; ვ) ხელი შეუწყოს სისტემაში დადგენილი წესით საწარმოების შექმნასა და განვითარებას; ზ) განსაკუთრებული მნიშვნელობის პროექტების განხორციელებისათვის წარუდგინოს საქართველოს პრეზიდენტს დასაბუთებული წინადადებები საბიუჯეტო დაფინანსების საჭიროების შესახებ კანონმდებლობით დადგენილი წესით; თ) უზრუნველყოს ეროვნული საფოსტო ნიშნების, საფოსტო კონვერტების, მარკებისა და ღია ბარათების დამტკიცება, მათი ღირებულებისა და ტირაჟის განსაზღვრა, გამოშვება, გავრცელებისა, ბრუნვიდან ამოღებისა და ლიკვიდაციის ორგანიზაცია კანონმდებლობით დადგენილი წესით; ი) კანონმდებლობით დადგენილი წესით მართვის უფლებამოსილებათა დელეგირების საფუძველზე მიიღოს გადაწყვეტილება სახელმწიფოს წილობრივი მონაწილეობით შექმნილი საწარმოების წმინდა მოგების განაწილების შესახებ და დადგენილი წესით შეათანხმოს იგი შესაბამის სახელმწიფო ორგანოებთან, აგრეთვე ფინანსთა სამინისტროსთან ერთად გადაწყვიტოს ტრანსპორტისა და კომუნიკაციების დარგების ფუნქციონირებისათვის აუცილებელი საწარმოების ფინანსური დახმარების გაწევის საკითხი სახელმწიფოს მონაწილეობით შექმნილი საწარმოებიდან მიღებული წმინდა მოგების ხარჯზე, საქართველოს კანონმდებლობით დადგენილი წესით; კ) განახორციელოს საქართველოს კანონმდებლობით განსაზღვრული სხვა უფლებამოსილებანი. 3. სამინისტრო ვალდებულია: ა) ითანამშრომლოს აფხაზეთისა და აჭარის ავტონომიური რესპუბლიკების წარმომადგენლობითი, აღმასრულებელი ხელისუფლებისა და ადგილობრივი თვითმმართველობისა და მმართველობის ორგანოებთან; ბ) დადგენილ ვადებში უზრუნველყოს შესაბამის სახელმწიფო უწყებებში საანგარიშგებო, საპროგნოზო და სტატისტიკური ინფორმაციის წარდგენა; გ) უზრუნველყოს ქვეყნის უმაღლეს წარმომადგენლობით ორგანოსა და აღმასრულებელი ხელისუფლების შესაბამისი სტრუქტურების ინფორმირება სატრანსპორტო და საკომუნიკაციო სისტემაში მიმდინარე საქმიანობის შესახებ.     მუხლი 5🔗. სამინისტროს სტრუქტურული ქვედანაყოფები 1. სამინისტროს სტრუქტურული ქვედანაყოფებია: ა) კავშირგაბმულობის, ფოსტისა და საინფორმაციო ტექნოლოგიების დეპარტამენტი; ბ) საქართველოს პარლამენტთან ურთიერთობის, საკანონმდებლო საქმიანობისა და სამართლებრივი უზრუნველყოფის (შემოკლებით – იურიდიული) დეპარტამენტი; გ) ეკონომიკური პოლიტიკის, რეფორმებისა და დარგთაშორისი კოორდინაციის დეპარტამენტი; დ) საერთაშორისო ურთიერთობების დეპარტამენტი; ე) სამინისტროს აპარატი; ვ) საზოგადოებასთან ურთიერთობის დეპარტამენტი; ზ) უსაფრთხოებისა და სამსახურებრივი ზედამხედველობის ინსპექცია; თ) ბუხჰალტერია. 2. კავშირგაბმულობის, ფოსტისა და საინფორმაციო ტექნოლოგიების დეპარტამენტის ძირითადი ამოცანები და ფუნქციებია: ა) კავშირგაბმულობისა და ფოსტის ქსელებითა და საშუალებებით სახელმწიფო ორგანოების, ფიზიკური და იურიდიული პირების საერთაშორისო სტანდარტების შესაბამისი მომსახურებისათვის ხელშეწყობა; ბ) კავშირგაბმულობისა და ფოსტის ქსელების ერთიანი სიგნალიზაციისა და სინქრონიზაციის ტექნოლოგიური უზრუნველყოფის პრინციპების შემუშავება; გ) საინფორმაციო და საკომუნიკაციო ტექნოლოგიებისა და ინტერნეტის ქსელების განვითარების სტრატეგიის განხორციელება დადგენილი წესით; ეროვნული საკომუნიკაციო-ტექნოლოგიური ინფრასტრუქტურის განვითარების გეგმის შემუშავება; დ) საინფორმაციო და საკომუნკიაციო ტექნოლოგიების ტექნოლოგიური უზრუნველყოფის მოკლევადიანი და გრძელვადიანი პროგრამებისა და პროექტების შემუშავება, მათი დანერგვისათვის ხელშეწყობა და სამამულო საქმიანობის ინტეგრირება მსოფლიო ტელესაკომუნიკაციო სივრცეში; საინფორმაციო მართვის ახალი პრინციპების დამკვიდრება; ე) სხვა ქვეყნების კავშირგაბმულობისა და ფოსტის ადმინისტრაციებსა და საწარმოებს შორის ურთიერთობის დამყარებისათვის, კავშირგაბმულობისა და ფოსტის პროდუქციის ტრანზიტისა და ექსპორტ-იმპორტისათვის ხელშეწყობა; ვ) კავშირგაბმულობისა და ფოსტის სფეროში ნორმატიული აქტების პროექტების შემუშავება, კავშირგაბმულობისა და ფოსტის ტექნიკური და ეკონომიკური მდგომარეობის მონიტორიგნი; ზ) საქართველოში კავშირგაბმულობისა და ფოსტის ქსელების განვითარების, სრულყოფისა და ფუნქციონირების კოორდინაცია. კავშირგაბმულობისა და ფოსტის ობიექტებისა და ქსელების მშენებლობის, რეკონსტრუქციის პროექტებისა და მათი საინვესტიციო გეგმების ექპერტიზა; თ) სპეციალური კავშირებით მართვის ორგანიზაცია; ი) დარგის პრივატიზაციის განხორციელების გეგმის პროექტის შემუშავება, საპრივატიზებო ობიექტების ნუსხის შედგენა; კ) დარგის საწარმოების ბალანსზე რიცხული ქონების ეფექტიანი გამოყენების შესახებ კანონმდებლობის შესაბამისად წინადადებების შემუშავება; ლ) კავშირგაბმულობის ქსელებისა და სისტემის ფუნქციონირების ინფორმაციული უზრუნველყოფა; მ) ნუმერაციის ერთიანი სისტემის პოლიტიკის შემუშავება; ნ) კავშირგაბმულობისა და ფოსტის ქსელებისა და სისტემების ფუნქციონირების ინფორმაციული უსაფრთხოების ღონისძიებათა განხორციელებაში მონაწილეობა. 3. საქართველოს პარლამენტთან ურთიერთობის, საკანონმდებლო საქმიანობისა და სამართლებრივი უზრუნველყოფის დეპარტამენტის ძირითადი ამოცანები და ფუნქციებია: ა) სამინისტროს საკანონმდებლო საქმიანობის წარმართვა, სამართლებრივი აქტების პროექტების შემუშავება და ექსპერტიზა. სისტემაში მოქმედი შესაბამისი სამართლებრივი აქტების მოთხოვნათა შესრულების კონტროლის განხორციელებაში მონაწილეობა; ბ) სისტემაში ინსტიტუციური რეფორმების სამართლებრივი უზრუნველყოფა; გ) საერთაშორისო სატრანსპორტო და საკომუნიკაციო საკანონმდებლო სივრცეში ინტეგრირების უზრუნველყოფა. ტრანსპორტისა და კომუნიკაციების სფეროში საერთაშორისო ურთიერთობების საკითხების მოწესრიგებაში მონაწილეობა. სამართლებრივი აქტების საერთაშორისო ორგანიზაციების მიერ დადგენილ სტანდარტებთან ჰარმონიზაციისათვის ხელშეწყობა და მისი განხორციელების მონიტორინგი; დ) საქართველოს პარლამენტთან და საქართველოს პრეზიდენტის საპარლამენტო მდივნის სამსახურთან ურთიერთობის კოორდინაცია. 4. ეკონომიკური პოლიტიკის, რეფორმებისა და დარგთაშორისი კოორდინაციის დეპარტამენტის ძირითადი ამოცანები და ფუნქციებია: ა) ეკონომიკური ანალიზი, პროგნოზირება, რეკომენდაციების შემუშავება, სისტემის განვითარების ინდიკატიური გეგმებისა და სახელმწიფო მიზნობრივი პროგრამების შემუშავებაში მონაწილეობა; ბ) სისტემის საფინანსო პოლიტიკის კოორდინაცია საბაზრო ურთიერთობათა თავისებურებების გათვალისწინებით, საბიუჯეტო შემოსავლების რეზერვების ძიება და მათი ამოქმედების მიზნით სათანადო რეკომენდაციების მომზადება; გ) სატრანსპორტო სფეროში სატარიფო პოლიტიკის წარმართვა; დ) სისტემაში კომერციალიზაციისა და პრივატიზაციის განხორციელებისათვის ხელშეწყობა; ე) დარგობრივი რეფორმებისა და ინსტიტუციური მოწყობის ძირითად მიმართულებათა განსაზღვრა და მათი კოორდინირება; ვ) დარგების, აგრეთვე შესაბამისი ინფრასტრუქტურის განვითარების პროგრამების შემუშავების ორგანიზება და მათი განხორციელების მონიტორინგი; ზ) სამეცნიერო-ტექნიკური განვითარების პრიორიტეტულ მიმართულებათა ფორმირება, ტრანსპორტის სფეროში სტანდარტიზების პრობლემატიკის მართვა; თ) საინვესტიციო პოლიტიკის კოორდინირება და საინვესტიციო და ტექნიკური პროექტების მონიტორინგი; ი) მარკეტინგული კვლევა და წინადადებათა შემუშავება კონკურენტუნარიანობის ამაღლების მიზნით; კ) სამინისტროს სისტემაში შემავალი სახელმწიფო ქონების ბაზაზე დაფუძნებული სამეწარმეო სუბიექტების მიზნობრივი ორიენტირების ფორმირება, დაგეგმვა, ანალიზი და მონიტორინგი; ლ) საკანონმდებლო-ნორმატიული დოკუმენტების შემუშავებაში მონაწილეობა; მ) დარგების ფუნქციონირება და ტექნიკურ-ეკონომიკური განვითარების შესახებ საინფორმაციო ბაზის ფორმირება და ანალიზი. 5. საერთაშორისო ურთიერთობების დეპარტამენტის ძირითადი ამოცანები და ფუნქციებია: ა) აწარმოოს თანამშრომლობა საერთაშორისო ორგანიზაციებთან და ქვეყნებთან; ბ) ხელი შეუწყოს ინვესტიციების, გრანტების მოზიდვას, სატრანსპორტო და სატელეკომუნიკაციო სექტორის საერთაშორისო ორგანიზაციებში ინტეგრირებას; გ) კომპეტენციის ფარგლებში კოორდინაცია გაუწიოს საერთაშორისო კონტრაქტებსა და პროექტებს, დააწესოს მათი განხორციელების მონიტორინგი; დ) დაგეგმოს და მოამზადოს საერთაშორისო ხასიათის ღონისძიებები, შეისწავლოს საერთაშორისო გამოცდილება და შეიმუშაოს მათი დანერგვის რეკომენდაციები; ე) უზრუნველყოს რეგიონალური პროექტების კოორდინაცია (ტრასეკა, პეტრა, ტაე და სხვ.). 6. სამინისტროს აპარატის ძირითადი ამოცანები და ფუნქციებია სამინისტროსთვის ადმინისტრაციული (კადრები, კანცელარია, შიდა სამეურნეო საკითხების მოწესრიგება) დახმარების უზრუნველყოფა მისი შეუფერხებელი მუშაობისათვის აუცილებელი ყოველგვარი მომსახურების განსახორციელებლად. 7. საზოგადოებასთან ურთიერთობის დეპარტამენტის ძირითადი ამოცანები და ფუნქციებია თანაშემწეობრივ-რეფერენტული, საინფორმაციო, საზოგადოებასთან ურთიერთობების უზრუნველყოფა, პრესასთან და მასობრივ ინფორმაციის საშუალებებთან მუშაობის წარმართვა. 8. უსაფრთხოებისა და სამსახურებრივი ზედამხედველობის ინსპექციის ძირითადი ამოცანები და ფუნქციებია: ა) ტრანსპორტისა და კომუნიკაციების სფეროში მოქმედი სამართლებრივი აქტების მოთხოვნათა შესრულების მონიტორინგი; ბ) ტრანსპორტისა და კომუნიკაციების სფეროში უსაფრთხოების საერთო პოლიტიკის შემუშავებაში მონაწილეობა, მასთან დაკავშირებული ნორმატიული ბაზისა და დასავლურ სტანდარტებთან ჰარმონიზაციის უზრუნველყოფისათვის ხელშეწყობა და მისი განხორციელების მონიტორინგი; გ) საერთაშორისო სამართლებრივ აქტთა მოთხოვნათა შესაბამისად სფეროში უსაფრთხოებაზე პასუხისმგებელი სუბიექტების მიერ შემუშავებული უსაფრთხოების ღონისძიებათა გეგმის შესრულების ზედამხედველობა და სათანადო რეკომენდაციების მომზადება; დ) საჯარო მოხელეების საქმიანობისადმი საშემსრულებლო დისციპლინის დაცვის მიზნით სამსახურებრივი ზედამხედველობის განხორციელებაში მონაწილეობა და სათანადო რეკომენდაციების მომზადება; ე) კანონმდებლობით დადგენილ სფეროში მოქმედი მაკონტროლებელი ორგანოების მიერ გამოვლენილი დარღვევების შესახებ საკითხების მომზადება და სათანადო წინადადებების შემუშავება. 9. ბუხჰალტერიის ძირითადი ამოცანები და ფუნქციებია: ა) უზრუნველყოს სამინისტროს მიერ განხორციელებული ყველა სამეურნეო ოპერაციის საბუხჰალტრო ანგარიშების სისრულე და კონტროლი, ოპერატიული ინფორმაციის და ბუხჰალტრული ანგარიშების დროული შედგენა და წარდგენა; ბ) ბუხჰალტრულ აღრიცხვასთან დაკავშირებული მეთოდური მითითებების შემუშავება დარგის თავისებურებებიდან გამომდინარე მოქმედი კანონმდებლობის შესაბამისად. 10. სამინისტროს სტრუქტურული ქვედანაყოფების კომპეტენცია, სტრუქტურა და საშტატო ნუსხა განისაზღვრება მათი დებულებებით, რომლებსაც ამტკიცებს მინისტრი.     მუხლი 6🔗. სამინისტროს ხელმძღვანელობა 1. სამინისტროს ხელმძღვანელობს მინისტრი, რომელსაც საქართველოს პარლამენტის თანხმობით თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფლებს საქართველოს პრეზიდენტი. 2. მინისტრს ჰყავს ხუთი მოადგილე, მათ შორის ერთი პირველი. 3. მინისტრის ერთ-ერთი მოადგილე მინისტრის დავალებით ახორციელებს საპარლამენტო მდივნის ფუნქციას. 4. მინისტრის საქმიანობა ეფუძნება ერთმმართველობის პრინციპს. 5. მინისტრი: ა) მეთაურობს სამინისტროს და აწესრიგებს სამინისტროს მმართველობის სფეროსათვის მიკუთვნებულ საკითხებს; ბ) დამოუკიდებლად იღებს გადაწყვეტილებებს მის კომპეტენციას მიკუთვნებულ საკითხებზე, წარმოადგენს სამინისტროს სხვა ორგანოებთან და ორგანიზაციებთან ურთიერთობაში როგორც ქვეყნის შიგნით, ისე მის ფარგლებს გარეთ; გ) უზრუნველყოფს სამინისტროს წინაშე დასმული ამოცანების შესრულებას; დ) დაკისრებული ფუნქციების განსახორციელებლად გამოსცემს ბრძანებებს; ე) ერთიანი სახელმწიფო პოლიტიკის განხორციელების მიზნით კოორდინაციას უწევს სამინისტროს სტრუქტურული ერთეულისა და ქვედანაყოფების საქმიანობას და ამტკიცებს მათ დებულებებს; ვ) მოქმედი კანონმდებლობის შესაბამისად თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფლებს სამინისტროს სტრუქტურული ქვედანაყოფების ხელმძღვანელებს, აგრეთვე „ტრანსპორტისა და კომუნიკაციების სფეროს სახელმწიფო მართვისა და რეგულირების წესის შესახებ“ საქართველოს კანონის შესაბამისად თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფლებს საჯარო სამართლის იურიდიული პირების – სატრანსპორტო ადმინისტრაციების თავმჯდომარეებს; ზ) ამტკიცებს და საჭიროების შემთხვევაში შეაქვს სათანადო ცვლილებები აპარატის საშტატო ნუსხაში დაწესებული რიცხოვნობისა და შრომის ანაზღაურების წლიური ფონდის ფარგლებში; თ) თავისი მმართველობის სფეროში ქმნის კომისიებს, საბჭოებს სათათბირო უფლებითა და განსაზღვრავს მათი საქმიანობის წესს; ი) საქართველოს პრეზიდენტთან შეაქვს სამინისტროს წლიური ბიუჯეტის შემოსავლისა და გასავლის საკითხებისა და აუცილებლობის შემთხვევაში – დამატებითი ბიუჯეტის პროექტის შესახებ წინადადებები; იღებს გადაწყვეტილებებს საბიუჯეტო სახსრების მიზნობრივი გამოყენების შესახებ და პასუხს აგებს ბიუჯეტის ზუსტად და მიზანშეწონილად შესრულებისათვის; კ) კანონით დადგენილი წესით ახორციელებს სამსახურებრივ ზედამხედველობას სამინისტროს საჯარო მოსამსახურეების გადაწყვეტილებებსა და საქმიანობის შესახებ; ლ) სამსახურებრივი ზედამხედველობის განხორციელებისას გამოსცემს ინდივიდუალურ სამართლებრივ აქტებს; მ) დადგენილი წესით წარადგენს ტრანსპორტისა და კომუნიკაციების სფეროს განსაკუთრებით გამორჩეულ მუშაკებს საპატიო წოდებებსა და ჯილდოებზე; ნ) უზრუნველყოფს მოქალაქეთა მიღებას. 6. მინისტრის მოადგილეებს მინისტრის წარდგინებით თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფლებს საქართველოს პრეზიდენტი.     მუხლი 7🔗. მინისტრის სათათბირო ორგანოები 1. მინისტრის სათაბირო ორგანოა სამინისტროს საბჭო. მის შემადგენლობაში შედიან: მინისტრის პირველი მოადგილე და მოადგილეები, სამინისტროს სტრუქტურული ქვედანაყოფების ხელმძღვანელები, აგრეთვე მინისტრის მიერ დანიშნული სხვა თანამდებობის პირები და სპეციალისტები. სამინისტროს საბჭოს წევრების რაოდენობასა და პერსონალურ შემადგენლობას ამტკიცებს მინისტრი. 2. მინისტრს შეუძლია თავისი მმართველობის სფეროში შექმნას კომისიები სათათბირო უფლებებით და განსაზღვროს მათი საქმიანობის წესი. 3. კომისიას შეიძლება მიეცეს გადაწყვეტილების გამოტანის უფლება, თუ ეს უშუალოდ კანონიდან გამომდინარეობს. 4. კომისია იქმნება მინისტრის ბრძანებით, რომლითაც განისაზღვრება კომისიის ამოცანები, თავმჯდომარე (საბჭოების შემთხვევაში – თავმჯდომარის მოადგილე) და წევრები, ამოცანის შესრულების ვადა, დაფინანსების წყარო და მომსახურე სტრუქტურული ერთეული და ქვედანაყოფი. 5. კომისიის წევრად შეიძლება დანიშნულ იქნეს სხვა სამთავრობო დაწესებულების მოსამსახურე ამ დაწესებულების ხელმძღვანელის თანხმობით. კომისიის მუშაობაში შეიძლება ჩართულ იქნენ პირები, რომლებიც არ არიან სახელმწიფო მოხელეები. 6. თუ კომისიის თავმჯდომარე არ არის მოხელე, რომელიც შედის სამინისტროს ხელმძღვანელობაში, ან არ არის სტრუქტურული ქვედანაყოფის ხელმძღვანელი, მინისტრის სამინისტროს ხელმძღვანელებიდან ან სამინისტროს სტრუქტურული ქვედანაყოფების ხელმძღვანელობიდან ნიშნავს კომისიის მუშაობისათვის პასუხისმგებელ პირს. 7. კომისია უფლებამოსილია მის წინაშე მდგომი ამოცანების შესრულების მიზნით გამოითხოვოს აუცილებელი დოკუმენტები. 8. კომისიის თავმჯდომარე ანგარიშვალდებულია მინისტრის წინაშე, თუ კომისიის შექმნისას სხვა რამ არ იყო გათვალისწინებული.     მუხლი 8🔗. მინისტრის მრჩევლები 1. თავისი კომპეტენციის ფარგლებში მინისტრი თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფლებს მინისტრის მრჩევლებს. მრჩევლები თანამდებობაზე ინიშნებიან მინისტრის უფლებამოსილების ვადით. 2. მრჩევლების მოვალეობანი განისაზღვრება თანამდებობრივი ინსტრუქციით, რომელსაც ამტკიცებს მინისტრი.     მუხლი 9🔗. სამინისტროს სიმბოლიკა 1. სამინისტროს აქვს მრგვალი ბეჭედი, სახელმწიფო გერბითა და წარწერით: „საქართველოს ტრანსპორტისა და კომუნიკაციების სამინისტრო“. 2. სამინისტრო გამოიყენებს სახელმწიფო დროშას მოქმედი კანონმდებლობის შესაბამისად. 3. სახელმწიფო გერბის გამოსახულება გამოიყენება სამინისტროს ბლანკსა და სამინისტროს შესასვლელის აბრაზე. 4. სამინისტროს შეიძლება ჰქონდეს ემბლემა, რომელიც რეგისტრირდება მოქმედი კანონმდებლობის შესაბამისად. 5. სამინისტროს ემბლემა შეიძლება გამოყენებულ იქნეს სავიზიტო ბარათზე, სხვა ბეჭდურ გამოცემებსა და სამინისტროს სუვენირებზე.     მუხლი 10🔗. დებულებაში ცვლილებებისა და დამატებების შეტანის წესი 1. დებულებაში ცვლილებებისა და დამატებების შეტანა ხდება საქართველოს პრეზიდენტის ბრძანებულებით. 2. სამინისტროს ლიკვიდაცია და რეორგანიზაცია ხდება კანონმდებლობით დადგენილი წესით. ტრანსპორტისა დაკომუნიკაციების სამინისტროს სტრუქტურა
