text-decoration:line-through; color:red;} /* Page Definitions */ @page Section1 {size:8.5in 11.0in; margin:1.0in 1.0in 1.0in 1.0in;} div.Section1 {page:Section1;} /* List Definitions */ ol {margin-bottom:0in;} ul {margin-bottom:0in;} საქართველოს პრეზიდენტის ბრძანებულება №687  1997 წლის 25 ნოემბერი ქ. თბილისი საქართველოს ურბანიზაციისა და მშენებლობის სამინისტროს დებულების შესახებ „აღმასრულებელი ხელისუფლების სტრუქტურისა და საქმიანობის წესის შესახებ“ საქართველოს კანონის შესაბამისად: 1. დამტკიცდეს საქართველოს ურბანიზაციისა და მშენებლობის სამინისტროს თანდართული დებულება. 2. ძალადაკარგულად ჩაითვალოს „საქართველოს ურბანიზაციისა და მშენებლობის სამინისტროს დებულებისა და სტრუქტურის შესახებ“ საქართველოს პრეზიდენტის 1996 წლის 8 აპრილის №262 ბრძანებულება. ე. შევარდნაძე საქართველოს ურბანიზაციისა და მშენებლობის სამინისტროს დებულება I. ზოგადი დებულებანი  1. საქართველოს ურბანიზაციისა და მშენებლობის სამინისტრო (შემდგომში – სამინისტრო) არის საქართველოს აღმასრულებელი ხელისუფლების სამთავრობო დაწესებულება, რომელიც საქართველოს მოსახლეობისათვის სრულფასოვანი საარსებო პირობების შექმნის, დასახლებული პუნქტების მდგრადი და უსაფრთხო განვითარებისა და ქვეყნის ტერიტორიული რესურსების რაციონალური გამოყენების უზრუნველსაყოფად ასრულებს კანონიდან გამომდინარე ან საქართველოს პრეზიდენტის მიერ კანონის საფუძველზე დაკისრებულ ამოცანებს. 2. სამინისტრო მისდამი დაკისრებული ამოცანების განხორციელებისას წარმოადგენს სახელმწიფოს. 3. სამინისტრო თავის საქმიანობაში ხელმძღვანელობს საქართველოს კონსტიტუციით, საქართველოს საერთაშორისო ხელშეკრულებებითა და შეთანხმებებით, საქართველოს საკანონმდებლო და ქვეკანონური ნორმატიული აქტებითა და ამ დებულებით. 4. სამინისტროს აქვს დასრულებული ბალანსი, ხარჯთანუსხა და ბეჭედი სახელმწიფო გერბის გამოსახულებით. სამინისტროს დაფინანსების წყაროა სახელმწიფო ბიუჯეტი. 5. სამინისტრო ანგარიშვალდებულია საქართველოს პრეზიდენტის წინაშე, რომელიც წარმართავს, კოორდინაციას უწევს სამინისტროს საქმიანობას და ახორციელებს მასზე სამსახურებრივ ზედამხედველობას, კანონით დადგენილი წესით. 6. სამინისტროს იურიდიული მისამართია: თბილისი, 380060, ვაჟა-ფშაველას გამზირი 16. II. სამინისტროს საქმიანობის სფერო და ამოცანები 7. სამინისტრო ახორციელებს აღმასრულებელ ხელისუფლებას ურბანიზაციის პროცესის მართვის, დასახლებული პუნქტების მდგრადი და უსაფრთხო განვითარების, ქვეყნის ტერიტორიულ-სივრცითი ორგანიზაციის, საინჟინრო და სატრანსპორტო ინფრასტრუქტურის, ურბანული ტერიტორიების მიწათსარგებლობის, ქალაქთმშენებლობითი კადასტრის, ქალაქთმშენებლობისა და არქიტექტურის, კაპიტალური მშენებლობის, მშენინდუსტრიისა და საბინაო-კომუნალური მეურნეობის სფეროებში. 8. სამინისტროს ძირითადი ამოცანებია: საქართველოში ურბანიზაციის სტრატეგიის შემუშავება, დასახლებული პუნქტების მდგრადი და უსაფრთხო განვითარების უზრუნველყოფა, ქვეყნის ტერიტორიის ქალაქგეგმარებითი და საინჟინრო ორგანიზაცია. ამ მიზნით: ა) დადგენილი წესით საწარმოო ძალთა განლაგებისა და განსახლების სახელმწიფო და რეგიონალური პროგრამების, რაიონული დაგეგმარების სქემების შემუშავების ორგანიზაცია და მათი რეალიზაციის კოორდინაცია; ბ) საქართველოს ტერიტორიული რესურსების რაციონალურად გამოყენების მიზნით ურბანული ტერიტორიების ქალაქთმშენებლობის კადასტრის შემუშავება, სამშენებლო საქმიანობისათვის მიწის ნაკვეთების შერჩევის, ფუნქციური დანიშნულების განსაზღვრისა და შეცვლის, გადაწყვეტილებების მიღება-გამოყენების არქიტექტურულ-გეგმარებითი პარამეტრების შესახებ, მიწის ნაკვეთების გამოყოფის შესახებ გადაწყვეტილებაში მონაწილეობა მიწის მართვის სახელმწიფო დეპარტამენტთან ერთად; მონაწილეობის მიღება ქალაქებსა და სხვა დასახლებებში მიწის ნაკვეთების შეფასებასა და გადასახადის გეგმარებითი ღონისძიებებით რეგულირებაში; გ) საქართველოს ტერიტორიის ქალაქგეგმარებითი ორგანიზაციის, ქალაქებისა და სოფლების დაგეგმარებისა და განაშენიანების სამართლებრივი საფუძვლების შემუშავება და მათი დაცვის ზედამხედველობა; დ) რაიონული დაგეგმარების პროექტების, ქალაქებისა და სოფლების გენერალური გეგმების შემუშავების ორგანიზაცია და განხილვა, მათი რეალიზაციის კონტროლი; ე) ქვეყანაში ენერგეტიკული და საინფორმაციო სისტემების, რეგიონთაშორისი საინჟინრო კომუნიკაციებისა და სატრანსპორტო მაგისტრალების განვითარების გეგმარებითი მიმართულებების განსაზღვრა დაინტერესებულ სამინისტროებთან და უწყებებთან თანამშრომლობით; ვ) დასახლებული პუნქტების ჩამოყალიბებული განაშენიანების, არსებული შენობა-ნაგებობებისა და მათი კომპლექსების მოდერნიზაცია-რეკონსტრუქციის კონცეპტუალური საკითხების გადაწყვეტა ისტორიული მემკვიდრეობის დაცვის გათვალისწინებით, შესაბამისი გეგმების შემუშავება და განხილვა, მათი რეალიზაციის ზედამხედველობა; ზ) ურბანიზაციის პროცესის პრობლემატიკისა და ქალაქთმშენებლობის საფუძვლების მეცნიერული კვლევის ორგანიზაცია; თ) საგანგებო სიტუაციებისა და მისი შედეგების შერბილების, საშიში გეოლოგიური პროცესებისაგან გარემოს საინჟინრო დაცვისა და კაპიტალური მშენებლობისათვის საინჟინრო კვლევის დარგში ერთიანი ტექნიკური პოლიტიკის გატარება; ი) საქართველოს ქალაქების გეგმარებითი ორგანიზაციის მიზნით მიწისქვეშა სივრცის გამოყენების მიმართულებათა განსაზღვრა და მათი რეალიზაციისათვის დასახული ღონისძიებების განხორციელების ხელშეწყობა. 9. ქვეყნის სამშენებლო და კომუნალური მეურნეობის სფეროებში დარგობრივი და დარგთაშორისი ურთიერთობების ორგანიზაცია და ამ მიზნით: ა) სამშენებლო და კომუნალური მეურნეობის სფეროებში რეფორმის, პროგრესული საწარმოო სტრუქტურებისათვის ხელშეწყობის, წარმოების დეცენტრალიზაციის, კონკურენციის გაშლისა და დემონოპოლიზაციის პოლიტიკის გასატარებლად შესაბამისი რეკომენდაციებისა და ღონისძიებების შემუშავება; ბ) სამშენებლო კომპლექსისა და კომუნალური მეურნეობის ობიექტების პრივატიზაციის პროცესების წარმართვაში დადგენილი წესით მონაწილეობა; გ) კაპიტალური მშენებლობისა და კომუნალური მეურნეობის საჭიროებისათვის პროგრესული ტექნოლოგიების, შენობების ტექნიკური აღჭურვილობისა და საინჟინრო ნაგებობების რაციონალური ტიპების დანერგვის პროგრამების დამუშავებაში მონაწილეობის მიღება; დ) მშენინდუსტრიისა და საშენი მასალების წარმოების პერსპექტიული განვითარების სტრატეგიულ მიმართულებათა განსაზღვრა, შესაბამისი სახელმწიფო მიზნობრივი პროგრამების შემუშავება და მათი რეალიზაციის კოორდინაცია; ე) კაპიტალური მშენებლობისა და კომუნალური მეურნეობის ტექნიკური პოლიტიკის, სამშენებლო ნორმებისა და წესების, სტანდარტების, დებულებების, ინსტრუქციებისა და სხვა დარგობრივი ქვეკანონური აქტების შემუშავება; ვ) საინჟინრო კომუნიკაციებისა და სპეციალური დანიშნულების შენობა-ნაგებობების განვითარების რეგიონალური და ლოკალური პროგრამების შემუშავების ორგანიზაცია, მათი რეალიზაციის კოორდინაცია და კონტროლი; ზ) ტერიტორიების, კომუნიკაციებისა და შენობა-ნაგებობათა საინჟინრო დაცვა, სტიქიური მოვლენების შედეგების სალიკვიდაციო სამუშაოების კოორდინაცია; თ) ზღვისა და წყალსატევების ნაპირების აბრაზიული, მდინარეთა ხეობების ეროზიული პროცესებისაგან დაცვის მიზნით გეოდინამიკური პროცესების რეგულირება, ნაპირსამაგრი და აღდგენითი სამუშაოების ორგანიზაცია. 10. სამინისტროს საქმიანობის სფეროში ერთიანი სახელმწიფო, საფინანსო, საბიუჯეტო და ფასწარმოქმნის პოლიტიკის განხორციელება საბაზრო ეკონომიკური ურთიერთობების ჩამოყალიბებული თავისებურებების გათვალისწინებით და ამ მიზნით: ა) დარგის განვითარების ერთიანი სახელმწიფო პოლიტიკის განსაზღვრა, სოციალურ-ეკონომიკური პროგნოზირება მოკლე და გრძელვადიანი პერიოდისათვის; ბ) სახელმწიფო მშენებლობის დარგთაშორისი კონცეფციების შეჯერება და მის საფუძველზე განვითარების გენერალური სქემების შემუშავება დაინტერესებულ სამინისტროებთან და უწყებებთან თანამშრომლობით; გ) არქიტექტურული და საპროექტო-საძიებო საქმიანობის, აგრეთვე ბინათმშენებლობისა და საბინაო ფონდის აღდგენა-განახლების სამართლებრივი საფუძვლების შემუშავება; დ) სახელმწიფოს ახალი საბინაო პოლიტიკის შესაბამისი პროგრამების შემუშავება, ბინათმშენებლობისა და საბინაო ფონდის აღდგენა-განახლების სტიმულირების ღონისძიებების დასახვა და რეალიზაციის კოორდინირება; ე) დარგის განვითარების პრიორიტეტულ მიმართულებათა განსაზღვრა, კომპლექსური მიზნობრივი პროგრამების შედგენა და მათი განხორციელების კოორდინაცია, პრაქტიკაში დასანერგად სათანადო რეკომენდაციების შემუშავება; ვ) დარგისათვის ბიუჯეტით გათვალისწინებულ კაპიტალურ დაბანდებებზე მენაშენის – დამკვეთის ფუნქციის შესრულება; სანარდო ვაჭრობის (ტენდერი) ორგანიზაცია, მოწყობა და მისი პირობების შესრულების კონტროლი თავისი კომპეტენციის ფარგლებში; ზ) არქიტექტურული და სამშენებლო საქმიანობის სერტიფიცირება და ლიცენზირება, სამშენებლო მასალების სტანდარტიზაცია და სერტიფიცირება „საქსტანდარტის“ მიერ დელეგირებული უფლებების ფარგლებში, დარგში სამშენებლო რისკების დაზღვევის კოორდინირება; თ) პროექტირების, მშენებლობისა და საშენ მასალათა წარმოებაში დავალიანებების დაფარვის საკითხების მოსაწესრიგებლად შესაბამისი ღონისძიებების შემუშავება და სახსრების მოზიდვა დარგის აღორძინების მიზნით; ი) საქართველოს ტერიტორიაზე სახელმწიფო არქიტექტურულ-სამშენებლო ზედამხედველობის განხორციელება მთავარი არქმშენინსპექციის და მის სისტემაში შემავალი ადგილობრივი ხელისუფლების შესაბამისი სამსახურების მიერ მათდამი დელეგირებული უფლებამოსილების ფარგლებში; კ) ქალაქებისა და დასახლებული პუნქტების, ურბანული ტერიტორიების რაციონალურად გამოყენებისათვის, კანონმდებლობით განსაზღვრული წესით მშენებლობისათვის მიწების შერჩევის, ფუნქციონალური დანიშნულების განსაზღვრისა და შეცვლის, არქიტექტურულ- გეგმარებითი პარამეტრების შესახებ გადაწყვეტილების მიღება, მიწის ნაკვეთების გამოყოფაზე გადაწყვეტილებაში მონაწილეობა მიწის მართვის სახელმწიფო დეპარტამენტთან ერთად, მშენებლობის ნებართვის გაცემა, უძრავი ქონების ტექნიკური ინვენტარიზაცია საბინაო-კომუნალურ სფეროში; ლ) მმართველობის ადგილობრივ ორგანოთა სტრუქტურებში შემავალი სამინისტროს პროფილის სამსახურების საქმიანობის მეთოდური ხელმძღვანელობა, კოორდინაცია და კონტროლი; მ) დარგში მომუშავე კადრების გადამზადებისა და კვალიფიკაციის ამაღლების ორგანიზაცია, კადრების განათლების კოორდინაცია; ნ) დარგობრივი საინფორმაციო ბანკის, საინფორმაციო სისტემების შექმნა და განვითარება; ო) დარგში საგარეო-ეკონომიკური სტრატეგიული მიმართულებების განსაზღვრა; ამ სფეროში საკოორდინაციო-მეთოდოლოგიური ფუნქციების შესრულება და უცხოური ინვესტიციებისა და კრედიტების მოზიდვის ხელშემწყობი ღონისძიებების შემუშავება-რეალიზაცია; პ) დარგობრივი სამეცნიერო-ტექნიკური პროგრამების, წინასაპროექტო და კაპიტალური მშენებლობის საპროექტო-სახარჯთაღრიცხვო და სხვა საინვესტიციო დოკუმენტაციის სავალდებულო სახელმწიფო ექსპერტიზა დადგენილი წესის ფარგლებში; ჟ) დარგის სამართლებრივი მომსახურების ორგანიზაცია. III. სამინისტროს ხელმძღვანელობის ორგანიზაცია და უფლებამოსილებანი  11. სამინისტრო ეფუძნება ერთმმართველობის პრინციპს. 12. მინისტრს საქართველოს პარლამენტის თანხმობით თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფლებს საქართველოს პრეზიდენტი. 13. მინისტრი პასუხისმგებელია საქართველოს პრეზიდენტის წინაშე სამინისტროს მთელი საქმიანობისათვის. 14. მინისტრი, როგორც სამინისტროს ხელმძღვანელი: ა) მეთაურობს სამინისტროს და აწესრიგებს სამინისტროს გამგებლობის სფეროს მიკუთვნებულ საკითხებს; ბ) პასუხისმგებელია საქართველოს კონსტიტუციის, სხვა საკანონმდებლო აქტების, საქართველოს პრეზიდენტის ბრძანებულებებისა და განკარგულებების შესრულებისათვის იმ სფეროში, რომელიც სამინისტროს მმართველობას განეკუთვნება; გ) იღებს გადაწყვეტილებებს სამინისტროს გამგებლობის სფეროს მიკუთვნებულ საკითხებზე, თუ მათზე გადაწყვეტილების მიღება კანონით ან საქართველოს პრეზიდენტის აქტით არ ევალებათ სახელმწიფო საქვეუწყებო დაწესებულებებს ან თანამდებობის პირებს; დ) თვალყურს ადევნებს სამინისტროს სტრუქტურული ქვედანაყოფებისა და სამინისტროს მმართველობის სფეროში არსებული სახელმწიფო დაწესებულებების მიერ თავიანთი მოვალეობების შესრულებას და ახორციელებს სამინისტროს საჯარო მოსამსახურეების გადაწყვეტილებებისა და საქმიანობის სამსახურებრივ ზედამხედველობას კანონით დადგენილი წესით; ე) მინისტრს ჰყავს 4 მოადგილე, მათ შორის ერთი პირველი; ვ) საქართველოს პრეზიდენტს წარუდგენს პირველი მოადგილისა და მოადგილეების კანდიდატურებს და განსაზღვრავს მათ უფლებამოსილებებს; ზ) კანონით დადგენილი წესით თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფლებს მინისტრის მრჩევლებს, სამინისტროს სტრუქტურული ქვედანაყოფების უფროსებს, სამინისტროს ტერიტორიული ორგანოების უფროსებს და მათ მოადგილეებს საჯარო ხელისუფლების შესაბამის ადგილობრივ ორგანოსთან შეთანხმებით, ითანხმებს მმართველობის ადგილობრივ ორგანოთა სტრუქტურაში არსებული სამინისტროს პროფილის სამსახურების ხელმძღვანელთა კანდიდატურებს, თუ საქართველოს კონსტიტუციით და კანონებით სხვა რამ არ არის დადგენილი, სამინისტროს საშტატო განრიგით გათვალისწინებულ სხვა საჯარო მოსამსახურეებს; თ) კანონით დადგენილი წესით თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფლებს სამინისტროს გამგებლობაში მყოფ საქვეუწყებო დაწესებულებათა ხელმძღვანელებს; ი) შეაქვს წინადადება საქართველოს პრეზიდენტთან სამინისტროს წლიური ბიუჯეტის შემოსავლისა და გასავლის საკითხებისა და, აუცილებლობის შემთხვევაში დამატებითი ბიუჯეტის პროექტის თაობაზე; იღებს გადაწყვეტილებებს საბიუჯეტო სახსრების მიზნობრივი გამოყენების შესახებ და პასუხს აგებს ბიუჯეტის ზუსტად და მიზანშეწონილად შესრულებისათვის; კ) სახელმწიფო ბიუჯეტის შესაბამისად ამტკიცებს სამინისტროს მმართველობის სფეროში არსებული სახელმწიფო დაწესებულებების ხარჯთანუსხას, ახორციელებს მათი შესრულების კონტროლს და, აუცილებლობის შემთხვევაში, იძლევა მითითებებს საბიუჯეტო სახსრების გამოყენების შესახებ; ლ) ადგენს სამინისტროს მმართველობის სფეროში არსებული სახელმწიფო დაწესებულებების სტრუქტურას, საქმის წარმოების წესს, გარდა იმ შემთხვევებისა, როცა ისინი დადგენილია მინისტრის ბრძანების ზემდგომი სამართლებრივი აქტებით; მ) ამტკიცებს სტრუქტურული ქვედანაყოფების დებულებებს; ნ) ამტკიცებს სამინისტროს მმართველობის სფეროში არსებული სახელმწიფო საქვეუწყებო დაწესებულებების დებულებებს; ო) წყვეტს სამართლებრივ დავებს სამინისტროს სტრუქტურულ ქვედანაყოფებს შორის, აგრეთვე სამინისტროს სახელმწიფო საქვეუწყებო დაწესებულებებს შორის; პ) დადგენილი წესით შეაქვს წინადადებები შესაბამის ორგანოებში გადაწყვეტილებების მისაღებად იმ საკითხების შესახებ, რომლებიც სამინისტროს გამგებლობის სფეროს განეკუთვნება; ჟ) ანგარიშს აბარებს საქართველოს პრეზიდენტს სამინისტროს საქმიანობის შესახებ; რ) ასრულებს მისთვის საქართველოს კანონებით, საქართველოს პრეზიდენტის ბრძანებულებებითა და განკარგულებებით დაკისრებულ სხვა ამოცანებს; ს) პასუხს აგებს სახელმწიფო ქონების დაცვისა და გამოყენებისათვის და ორგანიზაციას უწევს ამ საქმიანობას კანონმდებლობით დადგენილი წესით; ტ) კანონის საფუძველზე და მის შესასრულებლად გამოსცემს ბრძანებებს და პასუხისმგებელია მის მიერ ხელმოწერილი ბრძანებების კანონიერებასა და მიზანშეწონილობაზე; უ) ზედამხედველობს სამინისტროს სტრუქტურული ქვედანაყოფების, აგრეთვე სამინისტროს სახელმწიფო საქვეუწყებო დაწესებულებების საქმიანობის კანონიერებასა და მიზანშეწონილობას; ფ) ძალადაკარგულად ცნობს პირველი მოადგილის, მოადგილეების, სამინისტროს სტრუქტურული ქვედანაყოფებისა და სამინისტროს სხვა თანამდებობის პირების, აფხაზეთისა და აჭარის ავტონომიური რესპუბლიკების, თბილისისა და ადმინისტრაციული ერთეულების (ქალაქების) შესაბამისი დაწესებულებების ხელმძღვანელების აქტებსა და მოქმედებებს, რომლებიც არ შეესაბამება საქართველოს კონსტიტუციას, სხვა კანონებს, საქართველოს პრეზიდენტის ბრძანებულებებსა და განკარგულებებს, აგრეთვე მინისტრის ბრძანებებს; ქ) უფლებამოსილია კანონით დადგენილი წესით ძალადაკარგულად ცნოს მითითებული თანამდებობის პირების და სამინისტროს სახელმწიფო საქვეუწყებო დაწესებულებების ხელმძღვანელთა აქტები და მოქმედებები მათი მიზანშეუწონლობის მოტივით; ღ) უფლება აქვს სამინისტროს თანამდებობის პირების მოქმედებაზე სამსახურებრივი ზედამხედველობა დააკისროს პირველ მოადგილეს. 15. მინისტრის უფლებამოსილება წყდება კანონით დადგენილი წესით. 16. მინისტრის პირველ მოადგილეს და მოადგილეებს მისივე წარდგინებით თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფლებს საქართველოს პრეზიდენტი. 17. მინისტრის ერთ-ერთი მოადგილე მინისტრის დავალებით ახორციელებს საპარლამენტო მდივნის ფუნქციას. 18. მინისტრის პირველი მოადგილე: ა) ხელმძღვანელობს იმ სტრუქტურული ქვედანაყოფების მუშაობას, რომლებიც მინისტრის ბრძანებით მის დაქვემდებარებაშია გადაცემული; ბ) ხელმძღვანელობს სამინისტროს საქმიანობას და კოორდინაციას უწევს სამსახურების ურთიერთობებს მინისტრის არყოფნისას; გ) ახორციელებს მინისტრის ბრძანებით მინიჭებულ სხვა უფლებამოსილებებს. 19. მინისტრის მოადგილეები ხელმძღვანელობენ მინისტრის ბრძანებით მათდამი დაქვემდებარებულ სამსახურებს და ახორციელებენ სხვა უფლებამოსილებებს. 20. მინისტრის პირველი მოადგილისა და მოადგილეების უფლებამოსილება წყდება კანონით დადგენილი წესით.  IV. სამინისტროს სისტემა და სტრუქტურა  21. სამინისტროს ცენტრალური აპარატი, აფხაზეთისა და აჭარის ავტონომიური რესპუბლიკების ურბანიზაციისა და მშენებლობის სამინისტროები, მხარეებში ურბანიზაციისა და მშენებლობის დეპარტამენტები, ქ.თბილისისა და ადმინისტრაციული ერთეულების (ქალაქების) შესაბამისი სამსახურები, ასევე სამინისტროს დაქვემდებარებული ორგანიზაციები და დაწესებულებები ქმნიან ურბანიზაციისა და მშენებლობის, კომუნალური მეურნეობის, სამშენებლო ინდუსტრიისა და საშენ მასალათა წარმოების ერთიან სახელმწიფო სისტემას. 22. დეპარტამენტი, სამმართველო, განყოფილება წარმოადგენს სამინისტროს სტრუქტურულ ქვედანაყოფს, რომელსაც, როგორც წესი, არ გააჩნია აღმასრულებელი ხელისუფლების უფლებამოსილება იმ პირების მიმართ, რომლებიც არ არიან საჯარო მოსამსახურეები სამინისტროში. 23. სტრუქტურული ქვედანაყოფის ამოცანები, ხელმძღვანელობა, მის შემადგენლობაში შემავალი ერთეულები და მათი ძირითადი ამოცანები, თანამდებობების ნუსხა, სტრუქტურული ქვედანაყოფისა და მისი შემადგენელი სამსახურის ხელმძღვანელის შეცვლის წესი, ასევე სტრუქტურული ქვედანაყოფისათვის საკუთარი ბლანკის ფლობისა და გამოყენების წესი განისაზღვრება მათი დებულებით, რომელსაც ამტკიცებს მინისტრი. 24. სტრუქტურულ ქვედანაყოფს ხელმძღვანელობს უფროსი, რომელსაც თანამდებობაზე ნიშნავს და თანამდებობიდან ათავისუფლებს მინისტრი. სტრუქტურული ქვედანაყოფის უფროსი უშუალოდ ექვემდებარება მინისტრის პირველ მოადგილეს ან მოადგილეს და უზრუნველყოფს სტრუქტურულ ქვედანაყოფისათვის დაკისრებული ამოცანების ზუსტ და დროულ შესრულებას. 25. სამინისტროს სტრუქტურული ქვედანაყოფებია: ა) ტერიტორიულ-სივრცითი დაგეგმვის, ქალაქთმშენებლობის და არქიტექტურის დეპარტამენტი; ბ) მშენებლობის, სამშენებლო ინდუსტრიისა და საშენ მასალათა წარმოების დეპარტამენტი; გ) საბინაო-კომუნალური მეურნეობის დეპარტამენტი; დ) ეკონომიკისა და რეფორმების დეპარტამენტი; ე) მეცნიერების კოორდინაციის მთავარი სამმართველო; ვ) მთავარი არქიტექტურულ-სამშენებლო ინსპექცია; ზ) საქმეთა მმართველობა; თ) მხარეებში ურბანიზაციისა და მშენებლობის დეპარტამენტები. 26. ტერიტორიულ-სივრცითი დაგეგმვის, ქალაქთმშენებლობისა და არქიტექტურის დეპარტამენტის ძირითადი ფუნქციებია: ა) ქვეყნის დასახლებული პუნქტების მდგრადი და უსაფრთხო განვითარებისათვის, ურბანიზაციის სტრატეგიის შემუშავება და მართვის მექანიზმების განსაზღვრა; ბ) საწარმოო ძალთა განთავსებისა და განსახლების სქემების, რაიონული დაგეგმარების პროექტების, ქალაქებისა და დასახლებების, ურბანული ტერიტორიების გენერალური გეგმების შემუშავების ორგანიზაცია და მათი რეალიზაციის კოორდინაცია; გ) არქიტექტურული და საპროექტო საქმიანობის ორგანიზაცია და კოორდინაცია; დ) აფხაზეთისა და აჭარის ავტონომიური რესპუბლიკების ურბანიზაციისა და მშენებლობის სამინისტროების, მხარეების ურბანიზაციისა და მშენებლობის დეპარტამენტების, ქ.თბილისისა და ადმინისტრაციული ერთეულების (ქალაქების) შესაბამისი სამსახურების საქმიანობის მეთოდური ხელმძღვანელობა და კოორდინაცია; ე) სახელმწიფოს ახალი საბინაო პოლიტიკის შესაბამისი პროგრამების შემუშავება, ბინათმშენებლობისა და საბინაო ფონდის აღდგენა-განახლების პროცესის სტიმულირების ღონისძიებათა დასახვა და რეალიზაციის კოორდინირება; ვ) ქვეყნის ტერიტორიული რესურსების რაციონალურად გამოყენების მიზნით გარემოსდაცვითი პროგრამებისა და ქალაქთმშენებლური კადასტრის შემუშავების ორგანიზაცია და მათი რეალიზაციის კოორდინაცია; ზ) საგანგებო სიტუაციების შეფასება, გარემოს საინჟინრო დაცვისა და საინჟინრო კვლევის ორგანიზაცია. 27. მშენებლობის, სამშენებლო ინდუსტრიისა და საშენმასალათა წარმოების დეპარტამენტის ძირითადი ფუნქციები: ა) დეპარტამენტი თავისი კომპეტენციის ფარგლებში შეიმუშავებს პროგრამებისა და საქმიანობის გეგმებს სამშენებლო კომპლექსის განვითარების ერთიანი სახელმწიფო პოლიტიკის გასატარებლად. დეპარტამენტი მონაწილეობს: ბ) სამშენებლო კომპლექსის საწარმოებისათვის სახელმწიფო ნორმატიული ბაზის, კანონებისა და ქვეკანონური აქტების, სტანდარტების, დებულებების, ინსტრუქციების შემუშავებაში, სამშენებლო კომპლექსის ობიექტების პრივატიზაციის დარგობრივი პროგრამების შემუშავებაში, მმართველობის ადგილობრივ ორგანოთა სტრუქტურებში შემავალი დეპარტამენტის პროფილის სამსახურებისათვის ხელშემწყობი პირობების შექმნაში; გ) დეპარტამენტი კოორდინაციას უწევს და არეგულირებს სამშენებლო კომპლექსის საქმიანობას თავისი კომპეტენციის ფარგლებში, კურირებს სამინისტროს მიერ დაფუძნებულ საწარმოებს დეპარტამენტის პროფილის მიხედვით. 28. საბინაო-კომუნალური მეურნეობის დეპარტამენტის ძირითადი ფუნქციებია: ა) ქვეყნის კომუნალური მეურნეობის დარგის განვითარების პრიორიტეტულ მიმართულებათა განსაზღვრა, გრძელვადიანი პროგნოზირების და შემუშავებული ინდიკატური გეგმების საფუძველზე მათი რეალიზაციის ვადების განსაზღვრა; ბ) კომუნალური მეურნეობის შემდგომი განვითარებისათვის საკანონმდებლო და ნორმატიული აქტების შემუშავების ორგანიზაცია; გ) სახელმწიფო ქონების გამოყენების ეფექტიანობის უზრუნველყოფა, დარგის მეცნიერულ-ტექნოლოგიური პროგრამების შემუშავება და მათი ექსპერტიზა; დ) საქართველოს ტერიტორიაზე განლაგებული სამინისტროების, უწყებებისა და სხვა სახელმწიფო, არასახელმწიფო და ფიზიკურ პირთა კომუნალური მეურნეობის სამსახურების კოორდინაცია და მეთოდური ხელმძღვანელობა; ე) საზღვარგარეთის ქვეყნებთან მეცნიერულ-ტექნოლოგიური თანამშრომლობის პრიორიტეტულ მიმართულებათა განსაზღვრა და მათი განხორციელება; ვ) უძრავი ქონების ტექნიკური ინვენტარიზაცია საბინაო-კომუნალურ სფეროში. 29. ეკონომიკის და რეფორმების დეპარტამენტის ძირითადი ფუნქციებია: ა) დარგის განვითარებისათვის: შიდასახელმწიფოებრივ და საგარეო ერთიანი პოლიტიკის, მოკლე და გრძელვადიანი პერიოდის, კომპლექსური მიზნობრივი პროგრამების და ინდიკატურ გეგმების, საკანონმდებლო ბაზის, საფინანსო და საბიუჯეტო პოლიტიკის – პროგნოზირება, სტრატეგიულ მიმართულებათა განსაზღვრა, რეკომენდაციების შემუშავება და განხორციელების კოორდინაცია; ბ) დარგისათვის ბიუჯეტით გათვალისწინებული კაპიტალური დაბანდებების მენარდეთა შორის ტენდერების მოწყობის, კონტრაქტების დადების, სახარჯთაღრიცხვო და სახელშეკრულებო ფასების განსაზღვრის, ნორმებისა და მეთოდიკის შექმნისა და სრულყოფის, საწარმოებისა და სპეციალისტების ლიცენზირების და სერტიფიკაციის კოორდინაცია და კონტროლი; გ) პრივატიზების, ანტიმონოპოლური საქმიანობის, კონკურენციის ხელშემწყობი, უცხოური ინვესტიციებისა და კრედიტების მოზიდვის ღონისძიებების დარგობრივი პროგრამების შემუშავება და მათ რეალიზაციაში მონაწილეობა. 30. მეცნიერების კოორდინაციის მთავარი სამმართველოს ძირითადი ფუნქციებია: ა) ურბანიზაციის, მნშენებლობის, კომუნალურ დარგში სამეცნიერო სამუშაოებისა და ახალი ტექნოლოგიების დანერგვის ორგანიზების კოორდინირება; ბ) სამშენებლო დარგში ნაციონალური ტექნიკური ნორმების, სტანდარტიზაციის და სერთიფიცირების სისტემის ჩამოყალიბება დაინტერესებულ სამინისტროებთან და უწყებებთან თანამშრომლობით; გ) სამშენებლო კომპლექსის სამეცნიერო-კვლევითი ორგანიზაციების მოღვაწეობის ძირითადი მიმართულებების განსაზღვრა, მათი მუშაობის სრულყოფისათვის წინადადებების შემუშავება და მოღვაწეობის შედეგების განხილვა-დანერგვა დაინტერესებულ სამინისტროებთან და უწყებებთან თანამშრომლობით; 31. მთავარი არქმშენინსპექციის ძირითადი ფუნქციებია: ა) არქიტექტურულ-სამშენებლო საქმიანობაში დარღვევების გამოვლენა და განხილვა კანონის და შესაბამისი ქვეკანონური აქტების საფუძველზე; ბ) არქიტექტურულ-სამშენებლო საქმიანობაში დარღვევების შესახებ საკითხების განხილვა და გადაწყვეტილების გამოტანა მათი ხასიათისა და სახეობის ფაქტობრივი ან მოსალოდნელი შედეგების გათვალისწინებით; გ) საწარმოო და არასაწარმოო დანიშნულების ობიექტების მშენებლობის გაფართოება-რეკონსტრუქციის, საშენი მასალების, ნაკეთობების, კონსტრუქციებისა და სამშენებლო პროდუქციის ხარისხის შემოწმება მშენებლობაში მონაწილეთა უწყებრივი დაქვემდებარებისა და საკუთრების ფორმის მიუხედავად; დ) არქმშენინსპექციის უფლებამოსილება მთლიანად ვრცელდება ერთობლივ საწარმოებსა და საზღვარგარეთის ფირმებზე, რომლებიც ახორციელებენ ობიექტის მშენებლობას და აწარმოებენ საშენ მასალებს, ნაკეთობებს, კონსტრუქციებს საქართველოს ტერიტორიაზე, თუ საერთაშორისო შეთანხმებით სხვა პირობები არაა გათვალისწინებული; ე) სახელმწიფო არქიტექტურულ-სამშენებლო ზედამხედველობის შესახებ ნორმატიული აქტების შემუშავებაში მონაწილეობა. 32. საქმეთა მმართველობის ძირითადი ფუნქციები ა) მშენებლობის სისტემაში საკადრო საკითხთა სტრატეგიის შემუშავება და ამ პროცესის მართვის მექანიზმის სრულყოფა; ბ) დარგის ხელმძღვანელი კადრების მომზადების, გადამზადების, კვალიფიკაციის ამაღლების ორგანიზაცია; გ) სახელმწიფო მოხელის გამოცდისა და ატესტაციის ორგანიზაცია; დ) მოქმედი წესის შესაბამისად საიდუმლო საქმის უზრუნველყოფა, სამობილიზაციო საქმიანობა; ე) სამინისტროს კოლეგიის სხდომების მომზადება, გაფორმება, განხილულ საკითხთა შესრულების კონტროლი; ვ) შემოსული კორესპონდენციების მიღება, აღრიცხვა-გაფორმება და მათი შესრულების კონტროლი; ზ) საგარეო ურთიერთობათა, პრესსამსახურისა და სამეურნეო სამსახურის კოორდინაცია. 33. სამინისტროს სისტემაში არსებული იმ დეპარტამენტის, ინსპექციის, მთავარი სამმართველოს, სამმართველოს, სხვა სტრუქტურული ერთეულის კომპეტენცია, რომელიც ახორციელებს მმართველობით ფუნქციებს, სახელმწიფო ზედამხედველობას და კანონით განსაზღვრულ შემთხვევებში – სახელმწიფოებრივ იძულებას, განისაზღვრება სამინისტროს დებულებით. V. სამინისტროს უფლებები და ვალდებულებები 34. სამინისტრო უფლებამოსილია: ა) თავისი კომპეტენციის ფარგლებში მისცეს მითითებანი საქართველოს სხვა სამინისტროებსა და უწყებებს, როგორც საქართველოს ტერიტორიის გეგმარებითი ორგანიზაციის, მშენებლობაში და კომუნალურ სფეროში ერთიანი სახელმწიფო პოლიტიკის გამტარებელმა, და მოითხოვოს მათგან სათანადო ინფორმაცია. დაუწესოს კონტროლი: ბ) დარგში შემავალ საწარმოებსა და ორგანიზაციებს საკანონმდებლო და სხვა ნორმატიული აქტების შესრულებას; გ) სახელმწიფო შეკვეთების შესრულებას; დ) არქიტექტურულ-სამშენებლო საქმიანობის შედეგად შექმნილი პროდუქციისა და საშენი მასალების ხარისხს; ე) განსახლების, საწარმოო ძალთა განთავსების, დასახლებული პუნქტების ტერიტორიული განვითარებისა და ქალაქთმშენებლობის პროცესში ბუნებათსარგებლობის პროგრამების შექმნასა და რეალიზაციას. დადგენილი წესით: ვ) დააფუძნოს საწარმოები, დაამტკიცოს მათი წესდებები და წარადგინოს სარეგისტრაციოდ; ზ) საჭიროების შემთხვევაში მოახდინოს მის დაქვემდებარებაში მყოფი საწარმოების შერწყმა, გაერთიანება და ლიკვიდაცია; თ) განახორციელოს საგამომცემლო საქმიანობა; ი) დანიშნოს საწარმოს ან ორგანიზაციის ხელმძღვანელი, გაათავისუფლოს იგი თანამდებობიდან; კ) სახელმწიფო ანტიმონოპოლურ სამსახურთან ერთად მოამზადოს წინადადებები დარგში შემავალი მონოპოლისტი საწარმოების მიმართ სათანადო ღონისძიებების თაობაზე. ლ) საკუთარი უფლებამოსილების ფარგლებში აწარმოოს მოლაპარაკება და დადოს ხელშეკრულებები როგორც საქართველოს, ასევე საზღვარგარეთის იურიდიულ და ფიზიკურ პირებთან; მ) შექმნას დარგთაშორისი საკოორდინაციო საბჭო, უწყებათაშორისი კომისია, სამეცნიერო-ტექნიკური, არქიტექტურულ-ქალაქგეგმარებითი, ექსპერტთა და სხვა საბჭოები, დროებითი შემოქმედებითი კოლექტივები. VI. მინისტრის სათათბირო ორგანოები 35. მინისტრს შეუძლია თავისი მმართველობის სფეროში შექმნას კომისიები და საბჭოები (შემდგომში – კომისია) სათათბირო უფლებებით და განსაზღვროს მათი მოვალეობანი და საქმიანობის წესი. 36. კომისიას შეიძლება მიეცეს გადაწყვეტილების გამოტანის უფლება, თუ ეს უშუალოდ კანონიდან გამომდინარეობს. 37. კომისია იქმნება მინისტრის ბრძანებით, რომლითაც განისაზღვრება კომისიის ამოცანები, თავმჯდომარე (საჭიროების შემთხვევაში – თავმჯდომარის მოადგილე) და წევრები, ამოცანის შესრულების ვადა და მომსახურე სტრუქტურული ქვედანაყოფი. 38. კომისიის წევრად შეიძლება დანიშნულ იქნეს სხვა სამთავრობო დაწესებულების მოსამსახურე ამ დაწესებულების ხელმძღვანელის წარდგინებით. კომისიის მუშაობაში შეიძლება თავიანთი თანხმობით ჩაბმული იქნენ პირები, რომლებიც არ იმყოფებიან სახელმწიფო სამსახურში. 39. თუ კომისიის თავმჯდომარე არ არის მოხელე, რომელიც შედის სამინისტროს ხელმძღვანელობაში ან არ არის სამინისტროს სტრუქტურული ქვედანაყოფის ხელმძღვანელი, მინისტრი სამინისტროს ხელმძღვანელობიდან ან სამინისტროს სტრუქტურული ქვედანაყოფების ხელმძღვანელობიდან ნიშნავს კომისიის მუშაობისათვის პასუხისმგებელ პირს. 40. კომისიის საქმიანობას და კომისიის სხდომაზე საოქმო წარმოებას უზრუნველყოფს კომისიის მომსახურე სამინისტროს სტრუქტურული ქვედანაყოფი ან საერთო განყოფილება. 41. კომისია უფლებამოსილია მის წინაშე მდგომი ამოცანების შესრულების მიზნით გამოითხოვოს აუცილებელი დოკუმენტები. 42. კომისიის თავმჯდომარე ანგარიშვალდებულია მინისტრის წინაშე, თუ კომისიის შექმნისას სხვა რამ არ იქნა გათვალისწინებული. 43. კომისიის მუშაობისას დამატებითი სამსახურებრივი მოვალეობის შესრულება შეიძლება ანაზღაურდეს. VII. სამინისტროს სიმბოლიკა 44. სამინისტროს გააჩნია ბეჭედი, რომლის ცენტრშიც გამოსახულია სახელმწიფო გერბი. რგოლის ზედა მხარეს განთავსებულია წარწერა „საქართველოს ურბანიზაციისა და მშენებლობის სამინისტრო“. 45. სამინისტრო გამოიყენებს სახელმწიფო დროშას მოქმედი კანონმდებლობის შესაბამისად. 46. სახელმწიფო გერბის გამოსახულება გამოიყენება სამინისტროს ბლანკებზე და სამინისტროს შესასვლელის აბრაზე. 47. სამინისტროს შეიძლება ჰქონდეს ემბლემა, რომელიც რეგისტრირდება მოქმედი კანონმდებლობის შესაბამისად. 48. სამინისტროს ემბლემა შეიძლება გამოყენებულ იქნეს სავიზიტო ბარათებზე, სხვა ბეჭდურ გამოცემებსა და სამინისტროს სუვენირებზე. VIII. სამსახურებრივი ზედამხედველობა 49. მინისტრი კანონით დადგენილი წესით ზედამხედველობს სამინისტროს სტრუქტურულ ქვედანაყოფებს, აგრეთვე სამინისტროს საქვეუწყებო დაწესებულებათა საქმიანობის კანონიერებასა და მიზანშეწონილობას. 50. მინისტრი სამსახურებრივი ზედამხედველობის განხორციელებისას გამოსცემს ინდივიდუალურ სამართლებრივ აქტებს. 51. მინისტრს უფლება აქვს სამინისტროს თანამდებობის პირების მოქმედებაზე სამსახურებრივი ზედამხედველობა დააკისროს პირველ მოადგილეს. IX. დასკვნითი დებულებები 52. სამინისტროს დებულებას ამტკიცებს საქართველოს პრეზიდენტი ბრძანებულებით სამინისტროს დებულებაში ცვლილებებისა და დამატებების შეტანა ხორციელდება საქართველოს პრეზიდენტის ბრძანებულებით. 53. სამინისტროს რეორგანიზაცია ან ლიკვიდაცია ხდება კანონმდებლობით დადგენილი წესით.
