IMPLEMENTATION FRAMEWORK
2.1
lmplementation Plan. The tramework fbr implementation of the Prograrn will be

proposed Implementation Plan and as neccssary may requcst McA-Georg,ia to sublnit
clarifications or adjustmcnts. MCA-Gcorgia will submit an updated lmplementation Plan or
updated lmplcmentation Plan Document during any quarter in which significant changcs or
modifications are madc to a Project or to the Program. or when McA-Georgia determines that
the expected results, targcts and milcstones for the specified year are not likely to be achieved;
provided, hovever, that an updated Detailed Financial Plan will be subnritted each qwrter. In
such inslalces, MCA-Georyia will subnrit to MCC for approval a proposed revised
Implernentation Plan or updated Implemcntalion Plan Document (as applicable) on the same date
as the next Periodic Rcport is due. MCA-Georgia rvill ensure that the implementation of the
Program is condrrcted in accordance with the Implementation Plan-

accordance rvith the MCC Progrart Procuremenl Guidelincs. In addition, no later tlun six
lnonths after the Compact enters into force as provided in Article 7 of the Compact, MCAGeorgia will develop and implement a bid challenge systern ("BC.f') that provides suppliers.
contractors and consultanls that are interested parties the ability to seek review of procurement
actions and decisions. The organization, rules and procedures ofsuch BCS will be subjcct to
MCC approval. Upon MCC's approval of the BCS, MCA-Gcorgia will publish the BCS on the
MCA-Georgia website.
Fiscal Accountability Plan. Except as MCC agrees othenvise, MCA-Georgia will

respect to (a) budgeting; (b) accounting; (c) cash management; (d) financial lransactions lreceipts
and payments); (e) opening and managing Permitted Accounts; (t) personnel and pa1'roll: (g)
travcl and vehicle use; (h) asset and inventory control: (i) audits; and (i) rcporting. The Fiscal
Accountability Plan will be revised periodically. subject to rcvicrv and approval by MCC.

2.6 Notice to Providers: lncorporalion.

MCA-Georgia u'ill notili all Providers (and all other entities or individuals
receiving MCC Funding in conneclion with the Program) of the rcquirements of Section 2.7 of
the Compact and will include, or onstue the inclusion of, the requirernents of Seclion 2.7 ofthe
Compact in all agreements rvith a Provider if MCC is not a party to such agJeements.

MCA-Georgia will include, or ensure the inclusion of the requirements of:
(i)
Sections 2.1(c) and 2.7(c) ot'this Agreement and Section 3.7 ofthe
Compact and paragraphs (b)(i) and (ii), (c), and 1d) ofSection 3.8 ofthe Compact in all
agreements financed with MCCI Furding betrveen the Government or any entit-v of lhe
dowm..nt, on the one hand, and a Covered Provider that is not a non-profit organization
domiciled in the United States, on the otlrer hand;
(ii)
Section 3.7 ofthe Compact and paragraphs (bXi) and (ii) and (d) of
Section 3.8 of the Compact in all agreements financed with MCC Funding betwcctr the
Govemment or any entiry ofthe Govenunent. on the one hand, and a Provider that does not meet
the definition of a Covered Provider, on the other hard; and
(iii)
Section 3.7 ofthe Compact and paragraphs (b)(i) and (ii). (c). and (d) of

procurements for the Compact. A procurement director who has the requisitc skills and
experience to manage the procurement processeS planned for this Compact (lhe "Procutement
Direclof') has heen hired by MCA-Georgia In addition, procuremenl statl alrd procurement
support consultants will be engaged during the irnplemcntation ofthe Coqrpact to carry out the
required activities as describcd in a Procurement Operations Manual. including but not limited to
advertising, evaluations, contract administration, and contract closuc.

Agre€ment. This includes the registration oflhe narnes and the logo as a trademark, if
appropriate, the monitoring of unauthorized use by third parties, nnd, in case ofdetection of
unauthorized use. the entbrcement of such rights. MCA-Georgia will infbrm MCC as soon as

2.I2 Govemment Contribution.

(a)
In accordance u,ith Section 2.6(a) ofthe Compact, the (iovernment rvill make an
appropriate contribution. relative to its state budget and taking into account prevailing economic
conditions. toward meeting the objectives of the Compact. Such contribution will be in addition
to the Government's spending allocated toward such objectives in its budget tbr its fiscal year
2012. The Covemment's anticipated contributions ftrr liscal years 2013 tkough 2017 are sel
forth in Schedule 3 to this Agreement. Such contributions remain subject to any legal
requirements in Georgia for the budgeting and appropriation ofsuch contributions. including
approval ofthe Govemment's annual budget by Georgia's legislature. The Government's
contribution may include in-kind and financial contributions (including obligations olthe
Govemment on any debt incurred toward mceting the Objcctives).
(b) Unless otherwise agreed by the Parties, contributions denominated in the local

the exchange rate on the date the contribution payment is made or using an average rate over the
