ARTICLE 2 - GMNT OF RIGHTS
1. Each Contracting party grants to lhe other Coniracling party the rights spectfied

Contracting Party the privilege of taking on, in the Tenilory of thq other Contracting party,
passengers, baggage and Cargo c€rried for remuneration or hire and destined for
another
point within the Territory of that other Contracting Party.
5. lf because of armed conflict, political dhturbances or developments or special and unusual
circumslances a Designated Airline of one Contracting party ts unable to operate a service
on rls normal routing, the other Contracting Party shall use its best efforts to facilitate the
continued opeEtion of such service through appropriate lemporary rearrangemenl of
routes as is mutually decided by the Contracting Parties.
6. The Designaled Airlines shall have tile right to use all airways, airports and other facilities
provided by the Contlading Parlies on a non-discriminatory basis.

ARNCLE 6 . CUSTOTUS DUTIES AND OTHER CHARGES
l. Each Contracting Party exempts the Designated Airlines o[ the other Contracting party from
import reslnctions, custom duties, direct or indirect taxes, inspection fees and all other
national and/or local dulies and charges on aircraft as well as their regular equipmenl fuel,
lubricants, consumable technic€l supplies, spare parts includrng engines, aircraft stores
including but not limited to such items as food, beverages, liquor, tobacco and other
producls for sale to or use by passenger:; during flight and other items intended for or used
solely in cpnnection with lhe operation or servicing of aircraft used by such Desqnated
Airline operating the Agreed Services, as well as prinled ticket stock, airway bi s, staff
uniforms, computers and ticket printers used by the Designated Airline for reservations and
ticketing, any printed material which bears the insgnia ol the Designated Airline printed
thereon and usual publicity and promolional materials distributed free ot charge by such
Designated Airline.

Tenitory of the Contracting Party granting the exemption, provided such items are not
alienated in the Tenitory of the said Contracting Party
3. The regular airbome equipment, as well as lhe materials, supplies and stores nomally
retained on board the aircrafr used by lhe Designaled Airline of eilher Contracting Party may
be unloaded in the Territory of lhe other Contracting Party only wrth the approval of the
customs authorities of that other Contracting Party. ln such case, such equipment and items
shall enjoy the exemptions provided for by paragraph (1) of this Article provided ihat they
may be required to be placed undel the supervision of the said authorities up to such time
as they are re-exported or otherwise disposed of in accordance with cusloms regulations.
4. The exemptions provided for by this Artjcle shall also be available in situations where the
Designated Airlines of either Contracling Party have entered into anangements with another
airline(s), for the loan or transler in the Territory of the other Contracting Party, of the regular
equipment and the other items refened to in paragraph (1) of this Article, provided that that
other airline enjoys the same exemption(s) flom that other Conkacling Party.
1. The laws, regulations and procedures of one Contracting party relating to the admissiofl to,
sojourn in, or departure from its Territory of aircraft engaged in inlernational air navigation, or
lo the operation and navigation of such aircraft while withtn its Terntory. shall be

behalf of such passengers, baggage, crew and Cargo upon entry into and departure from
and while within the Territory of the flrst Contracting party.
3. Neither Contracting Party may grant any preference to its own or any other airline(s) over
the Designated Airline(s) of ihe other Contracting party in the applic€tion of the taws and
regulations proviled for in this Articte
4. Passengers, baggage and Cargo in direct transit across the Tenitory of either Contracting

ARTICLE IO - SAFEW
1 Each. Conkacting Party may request consultalions at any time concerning safety
standards in any area relating to aircrew, aircraft or their operation adopted by the othei
Contracting Party. Such consultations shall take place within 30 days of ihat requesr.
2. [, following such consultations, one Conkacting party finds that the other Conkacling
Partydoes not effectively maintain and admrnister safe, standards in any such area
that
are at least equal to the minimum slandards established at that time pursuant to the
Convention, the first Contracting Party sha notfy the other Contracting parly of those
findings and the steps considered necessary to conform wrth those minimum ilandards,
and that other Contracting Party shall lake appropriate corrective action_ Failure by the
other Contracting Party to take appropriate action within .tS days or such longer period as
may be agreed, shall be grounds for the application of Article 4(.1) of lhrs Agreement
3. lt is agreed that any aircraft operated by an airline of one Contracting party on services to
or from the Teritory of the other Contracting party may, white within the Territory of the
other Contracting Party, be made the subject of an examinalion by the authorized
representatives of the other Contracting Party, on board and around the aircraft to check
both the validity ot the aircrafl documents and those of its crew and the apparent condition
of the akcraft and its equipment (rn this Anicle called "ramp inspection"), provrded lhis
doos not lead to unreasonabls delay.
4. l, any such ramp inspeclion or series of ramp inspections gives rise lo:
a) Serious concems that an aircrafr or lhe operatjon of an aircraft does not comply with the
minimum standards established at that time pursuant to lhe Convention; or
b) Serious concems that there is a lack of effective maintenanc€ and administratjon of
safety standards established at that lime pursuant to the Convention;
lhe Contracting Party carrying out the inspection shall, tor the purposes of Articte 33 of the
Convention, be free to conclude that the requirements under whlch the c€rtificate or licenses
in respecl of that aircraft or in respect of the crew of that alrcraft had been issued or
rendered valid or that the requirements under which that aircraft is operated are not equal to
or above lhe minrmum slandards established pursuant to the Convention
5, ln the event lhat access for the purpose of undertaking a ramp lnspection of an aircEft
operated by an airline of one Conlracting Party in accordance with paragraph (3) of this
Arlicle is denied by a representalive of lhat airline, the other Contracting Party shall be ftee
lo inler that serious concems of the type referred to in paragraph (4) of this Article arise and
draw lhe conclusions refened to in that paragraph.
6. Each Contrdcting Party reserves the right to suspend or vary the operating authorization of
an airline or aidines of the olher Contracting Party immediately in the event the firsl
Confading Party concludes. whether as a result of a ramp inspeclion, a series of ramp
inspections, a denial of access for ramp inspecibn, @nsultation or othenvise, that
immediat€ action is essentialto the safety ofan airline operation
7. Any action by one Conhacting Party in accordance with paragraphs (2) or (6) of this Artcle
shallbe discontinued once the basis fortaking lhat action ceases to exist.

ARTICLE ,I2 - AVIATION SECURITY
Consislent with their rights and obligations under intemalonal law, the Contracting parties
reaffirm that their obligatron to each other lo protecl the security of civil aviation against
acts

Withoul limiting the generality of their righls and obligations under international law, the
Contracting Parties shall in parlicular act in conformity with lhe provisions of the Convenlion
on Otfences and Certain Other Acts Committed on Board Atrcraft, signed at Tokyo on 14
September 1963, the Convenlion for the Suppression of UnlaMul Seiz-ure of Aircrait, signed
at the Hague on 16 December 1970, the Convention for the Suppression of Unla\,vfulActs
against the Safety of Civil Aviation, signed at Montreal on 23 September, 1971 and the
Pmlocol for the Suppression of Unlawtut Acts of Violence at Airports Serving tnternationat
CivilAviatjon Supplementary to lhe Convenlion for the Suppression of UnlaMulActs against
the Safety of Civil Aviation done at Montreal on 23 September 1971, signed at Montreat on
24 February'1988.the Convention on the Marking of Ptastrc Explosives for the purpose of
Detection, done at Montreal on 1 March 1991 and any other agreement governing civil
aviation security binding upon both Contracting Partes
The Contracting Parlies shall provide upon request all necessary assistance to each olher lo
plevent acts of unlaMul seizure of civil aircraft and olher unlawtul acts against the safety of
such aircraft, their passengeG and crew, airports and air navigation facrlitres and any other
relevant threal to the security of civil aviation.
The Contrading Parties shall, in their mutual relations, act in conformity with the avialion
security provisions estiablished by the lntemational Civil Aviation Organization and
designated as ann€xes lo lhe Convention to the extent that such security provisions are
applic€ble to the Contracting Parties.
ln addition, the Contracling Parlies shall require that operators of aircraft of their registry or
opeEtors of aircraft who have their principal place of brjsiness or permanent residence in
their Tenitory and the operators of airports in their Tenilory act rn conformity with such
aviation security provisions as are applicable to the Conlracting Parties.
Each Contracting Party agrees that its operators of aircraft may be required to observe lhe
aviation security provisions refened to in paragraph 4 above applied by the other
Contracting Party for entry into, departure from, or while within the Tenitory of that other
Contracting Party.
Each Contracting Party shall ensure that measures are effectively applied \aithin its Terfitory
to protect the aircraft and to security screen thek passengers, crew and carry-on items and
to carry out app.opriate security checks on baggage, Cargo and arrcrafl stores prior to
boarding or loading. Each Contracling Party also agrees to give posi[ve consideration to
any request from the other Contrac'ting Party for reasonable special security measu€s to
meet a pa(icular threat.

ARTICLE 14 - TRANSFER OF FUNDS
1 Each Contracling Party grants to the Des€nated Airlines of the other Conkacthg pady the
right to transfer freely the ercess of receipts over expenditure eamed by such airlines rn its

services as well as commercial interest earned on such rsvenues (including interest earned

2. lf a Contracting Party imposes restrictions on the transfer of excess of receipls over
expenditure by the Designaled Airlines ofthe other Conlracting Party, the la(er shall have a
right to impose reciprocal reslrictions on the Designated Airlines of the first Contracling
Party.
3. ln the event that there exisls, a special agreemenl between the Contracling Parties for the
avoidance ol double laxation, or in the case where there is a special agreement ruling the
transfer of funds between the two Contracting Panies, such agreement shall prevail
