AIR SERVICES AGREEMENT BETWEEN THE GOVERNMENT OF GEORGIA AND THE GOVERNMENT OF THE STATE OF KUWAIT AIR SERVICES AGREEMENT BETWEEN THE GOVERNMENT OF GEORGIA AND THE GOVERNMENT OF THE STATE OF KUWAIT The Government of Georgia and the Government of the State of Kuwait, hereinafter called the Contracting parties, Desiring to foster the development of Air Services between Georgia and the State of Kuwait, and to promote in the greatest possible measure international co-operation in this field. Desiring to apply to these services the principles and provisions of the Convention on lnternational Civil Aviation and of the lnternational Air Services Transit Agreement opened for signature at Chicago on the seventh day of Decembet 1944, Have agreed as follows: Article 1 Definitions ,) (The Convention)r means the Convention on lnternational Civil Aviation opened for signature at Chicago on lhe seventh day of December 1944, and includes any annex adopted under Article 90 of that Convention and any amendment of the Annexes or Convention under Article 90 and 94 thereof so far as these Annexes and amendments have been adopted by both Contracting Parties. b) <Agreementu means this Agreement, the Annex attached thereto, and any modillcations to the Agreement or to the Annexi c) (Aeronautical Authorities> means in the case of Georgia, the Ministry ol Economy and Sustainable Development and/or the Civil Aviation Agency, in the case of the State of Kuwait, the Directorate General of Civil Aviation or in both cases any other person or agency authorized to perform the functions exercised by lhe said authorities; d) (Designated Alrline)) means any airline that one Contracting Party has designated in writing lo the other Contracting Party in accordance with Article 3 of this Agreement as being an arrline v/hich is to operate the agreed air services on the routes specified in accordance with Article 2 of this Agreement; e) (Territory), (Air ServiceD, <lnternational Air Service> And (Stop For Non Traffic Purpose> shall for the purpose of this Agreement' have the meaning laid down in Arlicles 2 and 96 of lhe Conventionl 0 (Capacity> means;a. in relalion lo an aircraft, the payload of that aircraft available on a roule or a seclion of a route. b. in relation to a specified air servlce, the capacily of the aircraft used on such service multiplied by the frequency operaled by such aircralt over a given period on a route or a section of a route. g) <Tarifb means the prices to be paid for the carriage of passengers, baggage and freight and the conditions under which those prices apply, including prices and conditions for agency and other auxiliary services, but excluding remuneration or conditions for the carriage of mail. h) (Schedule, means lhe route schedule annexed to this Agreemenl. The Schedule forms an inlegral part of lhis Agreemenl and all references to lhe Agreement shall include reference to the Schedute except where otherwise provlded. i) (User Charge) means a charge made to airlines for the provrsion of airport, air navigahon or aviation security property, or facilities Article 2 Grantino of Riqhts and privileoes Each Contracting Party grants to the other Conhacling party the rights specified in this Agreement to enable its designated airline(st to e;tabtrsh-and operate international air services on the routes specifled in the appropriate section of lhe Schedule thereto (hereinafter called (Agreed Serviies, and <Specified RoutesD respectively). Subject to the provisrons of this Agreement, the designated airline of each Contracling Party shall enjoy, while operating an agreed service on a specified route, the following privileges: a) to fly without landing across the territory of the other Contracting party, b) to make stops in the said territory for non-traffic purpose, and c) to make stops in the said territory at the point or points specified for that route in the Schedule for the purpose of discharging and of taking on international traffic in passengers, mail and cargo. Nothing in paragraph 1 of this tuticle shall be deemed to confer on a designated airline of one Contracting Party the privilege of taking up, in the territory of the other Contracting Party, passengers, cargo and mail carried for remuneration or hire and destined tor anolher point in the lerritory of thal other Contracting party, excepl as may from time to time be jointly determined by the aeronautical authorilies of the contracting parties lf because of armed conflict, political disturbances or developmenls, or special and unusual circumstances, a designated airline of one Conkacting party is unable lo operate a service on its normal routing, the other Contracling party shall use its best etforts to facihtate the continued operation of such services through appropriate temporary rearrangements of routes. 4 Article 3 Desiqnation and Authorisation Each Contracling Party shell have the right to designate in writing to the other Contracting Party an auline or airlines for the purpose of operating the agreed services on the specified routes and to withdraw the designation of any airline or to substitute another airline for one previously designaled Such designation shall be effected by virtue of written notification between the aeronautical authorities of both Contracting Parties, confirmed by lhe exchange of diplomatic notes The airline or airlines designated by either Contracting Party may be required to satisfy the olher Contracting Party that it is quahfied to Iulfill the conditions prescribed by the laws and regulations normally and reasonably applied by thrs Contracting Party to the operation of intemaiional air services in conformig with the provisions of the Convention. On receipt of such designation the aeronautical authorities of the other Contracting Party shall granl the appropriate authorizations and permissions with minimum procedural delay, provided that: a) the airline is established in lhe territory of Contracting Parties and has a valid Operating License in accordance with its national legislation, and b) the Contracting Parties exercise and maintain effeclive regulatory conlrol of the airline and are responsible for issuing rts Air Operator's Certificate. When an airline has been so designated and authorized in accordance with this Article, it may at any time begin to operate the agreed services, in accordance with the provisions of the present Agreement Article 4 Revocation. The laws and regulations of a Contracting party relating to the admission to, stay in, or departure from its tenitory of aircraft engaged in internalional arr navigation, or to the operation and navigation of such aircrafl whrl€ within ils territory, shall be applied to the aircraft of both Contracting parlies without distrnction as to nationality, and shall be complied with by such aircrafl upon entering or departing from or while within the territory of that Contracting party. cargo and mail in transit across the territory of a -baggage. Baggage, cargo and mail shall be exempted from costumes dulies, Passengers, inspection fees and other national duties and charges if in direct transit. Article 9 Establishment of Tariffs The tariffs in respect of international air services operated toifrom/through the teritories of the two Contracting parties shall be eslablished by the desilnated airlines at reasonable levels, due regard being paid to all ielevant fictors, including cost of operation and reasonable profit. The Tariffs eslablished under paragraph 1 shall not be required to be filed by the designated airlines of one Contracting party with the aeronautical authorities of the other.. Contracting party, Not withstanding the foregoing, each Contracting . Article 12 Technical and Commerclal Representation 1.
