Shoutd the first two arbitrators fail to agree upon the lhird, unless the Govemment and ADB agree otheMise, the lhird arbitrator shall be chosen by the president of the lntemationat Court of Justice. A majority vote of the arbitrators shall be suflicient to r€ach decision which shall be final and binding. The third arbitrator shall be emF,owered to setfle all questions of procedure tn any case where there is disagreement with respecl lhereto The Govemment and AOB shall cover expenses related to arbitrators' appointed by them and therr representation expenses with regard to the arbitrage process.
