On Making Additions to the Code of Administrative Offences of Georgia

The Parliament of Georgia enacts:

I. The following additions shall be made to the Code of Administrative Offences of Georgia (Bulletins of the Supreme Council of the Georgian SSR, 1984, supplement to No 12, Art. 421):

1. The Code shall be supplemented with Articles 157¹, 157² and 157³, reading as follows:

"Article 157¹. Unlawful reproduction of copies of a work, phonogram or videogram

Unlawful reproduction of copies of a work, phonogram or videogram for the purpose of sale, rental or use, –

shall entail a fine of five hundred to one thousand GEL, with confiscation of the reproduced copies.

The same act committed by a person who, within one year, had been subjected to an administrative penalty for such an act, –

shall entail a fine of one thousand to three thousand GEL, with confiscation of the reproduced copies.

Note: The confiscated reproduced copies shall be subject to destruction, except in cases where they are transferred to the holder of the copyright or related right at his/her own request.

Article 157². Falsification of information indicated on copies of a work, phonogram or videogram🔗

Falsification of information indicated on copies of a work, phonogram or videogram, indication of false information about the manufacturer or the place of manufacture, which misleads the user, –

shall entail a fine of five hundred to one thousand GEL, with confiscation of the copies of the work, phonogram or videogram.

The same act committed by a person who, within one year, had been subjected to an administrative penalty for such an act, –

shall entail a fine of one thousand to three thousand GEL, with confiscation of the copies of the work, phonogram or videogram.

Note: The confiscated copies shall be subject to destruction, except in cases where they are transferred to the holder of the copyright or related right at his/her own request.

Article 157³. Alteration or destruction of the protection mark affixed by the copyright holder on copies of a work, phonogram or videogram🔗

Alteration or destruction of the protection mark affixed by the copyright holder on copies of a work, phonogram or videogram –

shall entail a fine of one thousand to three thousand GEL.

The same act committed by a person who within one year had been subjected to an administrative penalty for such an act –

shall entail a fine of three thousand to five thousand GEL, with confiscation of the copies of the work, phonogram or videogram.

Note: The confiscated copies shall be subject to destruction, except where they are transferred to the holder of the copyright or related right on the basis of his/her own request.".

2. In Article 208 of the Code, after the word "156th" the numbers "1571, 1572, 1573" shall be added.

3. Article 239 shall be supplemented with paragraph 33 of the following content:

"The protocol on the administrative offences provided for by Articles 157¹, 157², 157³ of this Code shall be drawn up by the bodies of the Ministry of Internal Affairs".

4. In paragraph 2 of Article 252 of the Code, after the word "156th" the numbers "1571, 1572, 1573" shall be added.

II. This Law shall enter into force on the 15th day after publication.
