Public Registry suspended or refused registration: what to do under Georgian law
What to do when the Public Registry suspends, terminates or refuses an application, or registers another person's right: the deadlines, the administrative complaint, supplementing the file and the court route.
What to do
- Establish what was decided and when you officially received it; all deadlines run from that date. The decision may be a suspension, termination or refusal, or the registration of another person's right.
- Suspension: fix the problem first. The suspension period is 30 calendar days (Law of Georgia on Public Registry, Art. 21). It runs from official notification of the decision (or its publication) (Art. 21), and it cannot be extended (Art. 21). If the required document is submitted in time, proceedings resume (Art. 21); if it is not submitted in time, proceedings are terminated (Law of Georgia on Public Registry, Art. 22). Typical causes: a document or information needed for the decision was not attached (Art. 21), or there is an overlap with a registered object according to cadastral data (Art. 21).
- Check the decision: the registrar must specify ALL the required documents at once (Instruction on the Law on Public Registry, Art. 26); repeated suspensions to request new papers are not allowed. If the wrong document is submitted, the period keeps running, and the application is then left without consideration (Instruction, Art. 26). You may dispute the decision in parallel: a complaint does not stop it, and the suspension period keeps running (Law of Georgia on Public Registry, Art. 29).
- Appeal: a complaint against a registry decision must be filed within 30 calendar days from official notification. This is a special term, not the general one-month term under the General Administrative Code of Georgia (Law of Georgia on Public Registry, Art. 29). Refusal, suspension and termination are challenged by an administrative complaint (Art. 29). The complaint is reviewed by the Agency itself, through its superior official (General Administrative Code of Georgia, Art. 178), within one month (Art. 183). Exception: a decision to REGISTER another person's right is challenged directly in court (Law of Georgia on Public Registry, Art. 29).
- Court: without a complaint, a claim will not be accepted (Administrative Procedure Code of Georgia, Art. 2). The claim is filed within 1 month of the decision on the complaint or of the expiry of the period for issuing it (Art. 22). You may ask the court to order the Agency to register the right, that is, a claim for issuing an administrative act (Art. 23).
- Where to apply: National Agency of Public Registry or Public Service Hall (supplementing documents, complaint); administrative chamber of the district (city) court.
- Evidence: the decision with its date of notification (cabinet on napr.gov.ge), the submitted package, the missing documents, the cadastral drawing.
- Pitfalls: waiting for a reply to the complaint instead of supplementing the documents; submitting a 'similar' document instead of the one specified in the decision; going to court without an administrative complaint.
Be sure to check
- suspension: 30 calendar days from notification, no extension; fix in time or the application is terminated
- appeal: 30 calendar days; administrative complaint to the Agency (review within one month); then court within 1 month
- a complaint does not stop the suspension period, so collect documents in parallel
- the registrar must list all required documents at once; repeated suspensions are prohibited
- what to collect and where to apply
